Comm. #6-77-6 Revised Zoning Ordinance Discussion o For publication on November 4, 1977 o o o 0 CITY 01 ANDOVER o o REGULAR PLANNING AND ZONING COMMISSION MEETING November 8, 1977 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on November 8, 1977 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: d'Arcy Bosell, Walter Bruns, James Elling, John Johanson, Ralph Kishel Also Present: Rex Stockwell, City Engineer, and others Minutes of October 25. 1977 Correction: page 1 - 5th line from bottom - change the word "deprecates" to "depreciates" Motion by Commissioner Elling, seconded by Commissioner Bosell, to approve the Minutes of October 25, 1977 as corrected. Motion carried o unanimous ly. Cunningham Addition Preliminary Plat Public Hearing Continued (Comm. #7-77-4) Chairman Retzlaff read letter from Israelson & Associates dated November 8, 1977 (copy attached). Jim Hane gave the Commission and Engineer Stockwell copies of the latest revision of this plat. It shows a new legal description and the area dividing the 2 blocks that was formerly l40th Circle, is now part of the area known as "future development". Discussed legal description shown on the plat and whether it is accurate; and continuing the public hearing until the engineer has had an opportunity to review this plat and its current configuration for engineering aspects. Mr. Hane expressed concern over a time conflict he is having. He was reminded that the Engineer and Commission received the plat tonight, therefore had no change to review. The easement requirement of the Coon Creek Watershed Board has still not been taken care of. Engineer Stockwell will check to see if the plat is proper with the two blocks not connected, whether the lots haye to be contiguous. Mr. Hane will get a letter from Israelson & Associates, Engineering firm for the Watershed Board, saying they will waive the 50' easement requirement for the ditch. Motion by Chairman Retzlaff, seconded by Commissioner Bosell, that the Cunningham preliminary plat public hearing be continued to the November 22nd meeting. Motion carried unanimously. o u () :) o u . , u o Planning and Zoning Commission Meeting Minutes - November 8, 1977 Page 2 Rosella Sonsteby House Moving Permit Request (Cornm. #11-77-1) Mrs. Sonsteby wishes to move a house from Anoka to her 35-acre parcel zoned R-l (Plat 65930, parcel 9000) on l4lst Avenue (or 41st Avenue in Anoka). She showed pictures of the house and the site where the house will be placed. She said that the house will be 75' back from the street and would be brought up to Andover Building Code. With the recent widening of 7th Avenue, where she currently lives, she feels there will be more traffic and noise and she will move into this house on the 35 acre parcel. The Commission received a letter from the Building Inspector (copy attached) which they reviewed and discussed. They questioned when the signed statement asked for by the Building Inspector should be submitted. Mrs. Sonsteby indicated she is willing to sign. Discussed Ordinance 8 - Section 4.11 Relocated Structures. Motion by Commissioner Elling, seconded by Commissioner Bruns, that the Planning and Zoning Commission recommend to the City Council approval of the house moving for Rosella Sonsteby under Section 4.11 of Ordinance 8 because: it is not depreciating the surrounding property, she has met ther~uirements of Ordinance 8 and there is no public opposition. Vote on motion: yes - Commissioner Elling, Commissioner Bruns, Chairman Retzlaff~ Commissioner Johanson, Commissioner Kishel; present - Commissioner Bosell. Motion carried. Mrs. Sonsteby will attempt to have the City Council act on this on their agenda of November 15, 1977. Oak Hollow Preliminary Plat and Variance Request (Comm. #7-77-2) Mrs. Clayton Orttel was present. Chairman Retzlaff read a memo he had sent to the Commission giving information about the last City Council meeting and why the preliminary plat and variance were referred back to the Commission by the Council. Variance Request: The Mayor had stated, at the City Council Meeting, that in the past developers have always gotten easements for possible future extensions of streets similar to that shown on the plat for l58th Avenue. The Chairman said he had reviewed the ordinances and was unable to find anything that seemed to call for the easements mentioned. (j o u o ~ Planning and Zoning Commission Meeting Minutes - November 8, 1977 Page 3 The Commission, Mrs. Orttel and Engineer Stockwell discussed: the statements made by Mr. & Mrs. Kenneth Ilstrup, the property owners and residents to the West of l58th who would be affected by an extension, who expressed concern that they didn't want to see l58th extended because it would go through their house; the extension would wreck the lot (Lot 6, Block 2) at the end of the cul-de-sac; the street (158th Avenue) is too long. The Commission reviewed their previous motion of recommendation on the variance and also Section 17.01 of Ordinance 10. Motion by Commissioner Bosell, seconded by Commissioner Johanson, that the Planning and Zoning Commission recommend to the City Council approval of the Clayton Orttel Variance regarding l58th Avenue - cul-de-sac length - under Section l7.0l of Ordinance 10 allowing them to vary from Section 9.03 G. Reasons for the approval: 1) there was no public opposition to it; 2) it is not detrimental to the area; and 3) the topography of the land is such that it would create a hardship to the owner by not granting it in that the plat would not be feasible as it stands. Discussed: the motion; it was suggested that the exact wording from ;...-", 17.01 should be cited in the motion. '--/ Amendment by Chairman Retzlaff under reasons to add: adjacent property owners would be adversely affected if l58th Avenue would be extended because it directly empties into the property of Kenneth Ilstrup of 15803 Crosstown Boulevard NW, Anoka, Minnesota and that Mr. Ilstrup was present and did concur with not having it extend onto his property. No second - amendment dies. Discussion: parliamentary procedures and language of motion and amendment. Vote on motion: carried unanimously. This will be on the City Council Agenda on November 15, 1977. CJ Preliminary Plat: Chairman Retzlaff said that the Council returned the plat to the Commission for further discussion with the City Engineer and because the Commission had forwarded the plat with 3 contingencies: 1) street profile review with the City Engineer, 2) Review of soil boring information by the Engineer, and 3) indicate on the plat where fill material is needed. Engineer Stockwell said that the street profile item has been reviewed and meets with his approval. Soil boring information and fill material item - the two lots that required fill because of future septic systems have been taken care of. They have indicated on the plat the finished ground elevation - what height they would have to fill to in order to maintain a separation between the lowest part of the drainage system and the highest ground water elevation per the soil boring information. Engineer Stockwell said he would recommend approval. / \ \.J -, u , " u o ." , \..J Planning and Zoning Commission Meeting Minutes - November 8, 1977 Page 4 Also, the Council has asked that the Commission review the lot frontage requirements in the ordinances in regard to lots 3 and 4 of Block 2 and Lot 1 of Block 3. Each of these lots has a questionable frontage. The Commission discussed: lot frontages; previous comments that houses for Lot 3 and Lot 4 of Block 2 would front on Ilex and Lot 1, Block 3 would front on l59th Avenue; Ordinance 8 - Section 3.02 AAA & WW and Section 6.02 - minimum requirements and Ordinance 10 Section9.06 c _ corner lots must be 15' wider than interior lots. Engineer Stockwell reviewed with the Commission the definitions of lot front, lot width, lot side, corner lot and also the minimum requirement for this zoning of 330' of frontage. Chairman Retzlaff said that with similar corner lots:in the Hawk Ridge preliminary plat, which the Planning and Zoning Commission recommended approval on in August, those lots were noted in the motion as "exceptions". The City Attorney has told Chairman Retzlaff that with these type of things, the Planning and Zoning Commission can either ask for variances or exceptions on the preliminary plat. The Commission reviewed the Hawk Ridge motion of recommendation and also the original motion of recommendation dated 10-11-77 for the Oak Hollow preliminary plat. ~ Motion by Commissioner Bruns, seconded by Commissioner Bosell, that the Planning and Zoning Commission recommend to the Andover City Council that they approve the Oak Hollow Preliminary Plat in that: 1) Being in compliance with existing ordinances with the following exceptions: a. Lot 3 and Lot 4 of Block 2 and Lot 1 of Block 3 are exceptions to the lot frontage in ordinance 8 - Section 6.02. b. Exceptions under Ordinance 8, Section 3.02 paragraphs AAA and WW on Lot 3 and Lot 4 of Block 2 and Lot 1 of Block 3. On these lots, house frontages would have to be on the longest street frontage. Lot 3 and Lot 4 of Block 2 would face Ilex Street and Lot 1 of Block 3 the home would have to face l59th Avenue. The developer has met with the Planning and Zoning Commission and has agreed to the proposed location of the house sites. 2) The contingencies, on the recommendation made 10-11-77 by the Planning and Zoning Commission, have been met. 3) The Park and Recreation Commission has reviewed and approved the park. 4) The Preliminary Plat meets the engineering standards of the City of Andover as recommended by,T.K.D.A. following the review of the final preliminary plat drawing of October 24, 1977. 5) No public opposition was received for this preliminary plat. 6) It is compatible with the surrounding area. The Commission discussed Ordinance 8 Section 6.02 again regarding lot frontage - the lots are still the same size as the last time the Commission made a recommendation. Discussed exceptions - Ordinance 10 Section 17 _ 17.01 hardship; Mrs. Orttel stated that it would adversely affect the topography of this property and would cause a hardship if this is not (~ allowed, they would lose trees. ~-J 1\ U ( '\ U o /\ :\.._) Planning and Zoning Commission Meeting Minutes - November 8, 1977 Page 5 Amendment by Commissioner Bruns, seconded by Commissioner Bosell, to amend the motion to read: the reasons for the exceptions of Lot 3 and Lot 4 of Block 2 and Lot 1 of Block 3 - they have said it is a hardship as defined under section 17.01 of Ordinance 10. Amendment and motion carried unanimously. This will be on the City Council Agenda for November 15, 1977. Meadow Creek Baptist Christian School Amended Special Use Permit Public Hearing (Comm. #11-77-2) Chairman Retzlaff opened the public hearing. Grady Kinghorn, treasurer of the school board, came forward to explain their request. They received a special use permit on August 16, 1977 by the Andover City Council for a school for grades K-lO. The amended permit, now requested, is to extend the school to include grades 11 and 12. This should have been asked for in the original special use permit request but it was overlooked. The enrollment this year is 188 and the increase to grades 11 and 12 would not affect the previous estimated enrollment figure given of about 200 students. They would have to build additional facilities r, if they wished to increase their enrollment very much. ~ ~ '~/ Motion by Commissioner Elling, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommend to the Andover City Council approval of the amended Special Use Permit for Meadow Creek Baptist Church Christian School under Ordinance 8 Section 5.03 Subparagraphs A and B and that provisions of that section have been met and the school would not be increasing it's enrollment. It is amending City Council Resolution #RlOO-7. Amendment by Commissioner Bosell, seconded by Commissioner Bruns, to add that there will be no increased traffic impact on the area; that it will not adversely affect the value of the surrounding property; that it's in conformance with the Comprehensive Plan; that it will not adversely affect either the health, safety, morals or general welfare of the community; and there was no public opposition. Vote on amendment: yes - Commissioner Kishel, Commissioner Johanson, Chairman Retzlaff, Commissioner Bruns, Commissioner Bosell; no - Commissioner Elling. Amendment carried. Motion carried unanimously. Chairman Retzlaff closed the public hearing. This will be.on the City Council Agenda on December 6, 1977. r, \.J (J . " u c) o :.J Planning and Zoning Commission Meeting Minutes - November 8, 1977 Page 6 Municipal State Aid Street System (Comm. #11-77-3) Rex Stockwell, City Engineer, explained that every year the City has to update the State Aid Street System for the State. One small part of that updating is making an analysis of the City streets. He showed the Commission the report he has of each street in the City showing the width of travelled portion, surface, width of right-of-way, condition, length, etc. The total eligible miles for MSAS is 84.13 miles. 1/5th of the total is the amount Andover can designate on the MSAS, which would be 16.84 miles. Andover has 15.82 miles already designated; thus there are 1.5 miles that has to be put on the map for the State this year. He said that usually the information is submitted, the State looks at it the following year and the City would get the funds in 1979. If it is sent to the State by December 1st, they will review it by January 1, 1978. u The Road Committee reviewed this last week and recommended that the designated roadway for this year be the future extension of Hanson Boulevard from Bunker to County Road #18 at Nightingale Street. The money could be used to purchase easements and perhaps the County would complete the roadway sooner. The Engineer explained how the MSAS system works, how the funds are allocated, past designation of roadways, how the funds are received and how they can be spent. Motion by Commissioner Elling, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommend to the Andover City Council applying the additional State Aid mileage to the projected Hanson Boulevard between Bunker Lake Road and terminating at County Road 18. Vote on motion: yes - Commissioner Kishel, Commissioner Johanson, Chairman Retzlaff, Commissioner Elling; present - Commissioner Bruns, Commissioner Bosell. Motion carried. Will be on the City Council Agenda on November 15, 1977. Planning Consultant Discussion (Comm. #4-77-5) Chairman Retzlaff advised that this was taken care of at'. the last Special Planning and Zoning Commission Meeting on October 27, 1977. Revised Zoning Ordinance Discussion (Comm. #6-77-6) CJ Chairman Retzlaff mentioned that when the D.N.R. changes the designation of the Rum River, the City of Andover will have to change the zoning ordinance in that area to comply. The D.N.R. will be holding public hearings in January or February of 1978; therefore, the Commission should consider that in the revision being made. Andover, Minnesota Attn: Ms. Delores Hanson Re: Cunningham Addition (Our File CC 77-1) Dear Ms. Hanson: As the engineers for the Coon Creek Watershed District, we will recommend approval of the proposed drainage plan for Cunningham Addition based on its location in regards to the Andover Storm Sewer Plan. We have advised the Watershed Board that the preliminary storm sewer plan for Andover meets Watershed Board regulations concerning runoff. o At this time, no approval of the plat has been made by the Watershed Board. Final action will likely take place on November 28, 1977 at the Watershed Board meeting where a hearing on the petition of Mr. Cunningham to be included in the ditch system, will be held.
