Comm. #6-77-6 Revised Zoning Ordinance Discussion o For publication on October 7, 1977 o o o 0 C''J'Y of ANDOVER o o REGULAR PLANNING AND ZONING COMMISSION MEETING October 11, 1977 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on October 11, 1977 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: d'Arcy Bosell, James Elling, John Johanson, Ralph Kishel Commissioner Absent: Walter Bruns Minutes of September 27, 1977 o Corrections: page 1 - 3rd line from bottom - add 'after "systems" "and would require 2' of fill material to become buildable." 2nd line from bottom - after 2~' add "of fill material". page 2 - 4th paragraph - 2nd line - change ''minimum'' to ''maximum''. page ~ - 5th paragraph - 4th line - correct spelling of "with". last paragraph - last line - change "unservices" to "unserviced". page 6 - 4th paragraph - 8th line - after the word "cover" add "material". Motion by Commissioner Bosell, seconded by Commissioner Elling to approve the minutes of September 27, 1977 as amended. Motion carried unanimously. Oak Hollow Preliminary Plat Continued (Comm. #7-77-2) The Commission received revised plats showing additional park land dedicated, the radius on the end of l58th Avenue corrected, and the soil boring test holes. The Commission and Mr. Orttel discussed the soil borings and the fact that test hole #3 and test hole #4 were bored in depressions. More borings will be made near these two holes. o Motion by Commissioner Elling, seconded by Commissioner Johanson, that the Planning and Zoning Commission recommend to the City Council approval of the Oak Hollow preliminary plat dated September 14, 1977 and submitted to the Planning and Zoning Commission on October 11, 1977 with the following contingencies: 1) street profile review with the City Engineer; 2) review of soil boring information by the Engineer; 3) indicate on the plat where fill material is needed. Motion carried unanimously. o o o o o Planning and Zoning Commission Meeting Minutes - October 14, 1977 Page 2 Motion by Commissioner Elling, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommend to the City Council approval of the Clayton Orttel Variance regarding l58th Avenue - cul-de-sac length - under Section 17.01 of Ordinance 10 allowing them to vary from Section 9.01 G. Reasons for the approval: there was no public opposition to it and it is not detrimental to the area. Motion carried unanimously. This will be on the City Council Agenda for November 1, 1977. Cunningham Addition Preliminary Plat Public Hearing (Cornm. #7-77-4) Chairman Retzlaff opened the public hearing. The Commission had received a letter from the City Engineer dated October 6, 1977 (copy attached) regarding his review of the plat. They also received revised copies of the plat from James Hane, developer of the property. o Chairman Retzlaff read the letter from the Coon Creek Watershed Board's engineering firm, Harold Israelson & Associates, Inc. Mr. Hane said that when the 2nd phase of the property is developed, he would be putting in a holding pond, therefore, wouldn't be using the ditch at all. He will go to the Coon Creek Watershed Board and try to talk them into leaving the easement as is instead of the 50' they are now requesting. He would face legal action, he said, before giving them 50' of his property. His abstract currently shows an existing ditch easement. Some of the items in the Engineer's letter - sewer lines, gas & phone lines - will be shown on the plat as soon as Mr. Hane's surveyor can get to them. Because of the City street and storm sewer construction being done in this area, they were not able to provide them before. Mr. Hane was asked if l40th Circle would be constructed and he replied that if he has to give a 50' easement on the ditch, he would have to revamp all the lots, therefore couldn't give an answer at this time. The Commission questioned whether the property shown on the plat as "future development" should be an outlot or an exception on the plat. The legal description shown on the plat is for all of the property. It must be corrected to indicate only the land being platted at this time. Motion by Commissioner Kishel, seconded by Commissioner Elling, to continue the public hearing until the next meeting in order to give the developer more time to comply with the City Engineer's letter. Motion carried unanimously. This will be on the Planning and Zoning Commission Agenda for October 25, 1977. () o o o o o o ~, u Planning and Zoning Commission Meeting Minutes - October 11, 1977 Page 3 Lot Split Ordinance Discussion (Comm. #10-77-1) Chairman Retzlaff asked that this be deleted from the agenda because it was taken care of at the last City Council meeting. Planning Consultant - Comprehensive Plan Discussion (Comm. #4-77-5) Chairman Retzlaff explained that, after an initial interview, 3 firms were chosen for further consideration for the position of planning consultant - Amenity One, Clarence Smith; Midwest Planning, Tom Loucks; and T.K.D.A., Wes Hendrickson. Tom Loucks is no longer with the firm of Midwest Planning. However, he will be included in the final consideration under the firm name of Tom Loucks and Associates. In discussing the intent of the Planning and Zoning Commission for the role and responsibilities of the planning consultant, it was unanimously agreed that considering the high figures submitted for the job of completely redoing the Comprehensive Development Plan, the Planning and Zoning Commission will do the job. The Commission would do all the research and revision work and the firm hired would be an adviser, consultant or reviewer rather than the leader. Chairman Retzlaff will write to the firms asking them to submit (1) proposed hourly rate for services as a consultant/planner; (2) cost for review after Planning and Zoning Commission has revised the Plan; and (3) approximate cost for printing and assembly. There will be a Special Meeting on Thursday, October 27th for again interviewing Planning Consultants. Revised Zoning Ordinance Discussion (Comm. #6-77-6) The Commission will meet on Tuesday, October 18, 1977 at 7:30 P.M. to review the revised zoning ordinance which is proposed. BOOTH We have reviewed the preliminary plat for Oak Hollow Addition located in Section 13 north of 157th Avenue N. W. The property is in an R -1 Zoning District requiring a minimum lot size of 2l acres. The following are our .comments regarding the proposed subdivision as prepared on August 26, 1977. General Comments 1. 157th Avenue N. W. is a designated Municipal State Aid Roadway which requires a right of way width of 120 feet. The developer has included dedication of 60 feet width of right of way north of the centerline of l57th Avenue as required for a State Ai d Roadway. 2. The proposed subdivision is within the Coon Creek Watershed District. A copy of the plat must be submitted to the Board for their review to obtain approval of the plan. 3. Temporary cul-de -sacs will be constructed at each end of l59th Avenue N. W. partly on temporary easements as indicated on the plat. At such time as 159th Avenue N. Width and type of surfacing of 157th Avenue N. W. 2. Existing utilitie s including telephone and electr ic. 3. Drainage easement along ditch, 50' wide, at southeast corner of plat. 4. Drainage and utility easements, 10' each side of: a) Lot line between Lot 2 and Lot 3, Block 1 b) Lot line between Lot 3, Block I and Park c) Lot line between Lot 2 and Lot 3, Block 2 d) Lot line between Lot 5 and Lot 6, Block 2 5. Drainage and utility easement over west 50 feet of Lot 1, Block 2. 6. Future house on Lot 3, Block 2 must front on Hex Street per Lot frontage width requirement. 7. Existing and proposed street profiles including typical street section for rural area, culverts (18" CMP) with flared ends, and other drainage structures and ditch work. 8. Soil borings and percolation tests. Location to be obtained from City Engineer. All borings must show mottling, if any. 9. Minimum basement floor elevation have been indicated. Revisions may be necessary once soil information is obtained. This letter will be reviewed with the Commission Members at the September 27, 1977, meeting. Very truly yours, \..
