Commissioners Present: d'Arcy Bosell, Walter Bruns, James Elling, John Johanson Commissioner Absent: Ralph Kishel Also Present: Rex Stockwell - City Engineer, Jerry Windschitl _ Andover Mayor, and others Minutes Motion by Commissioner Bosell, seconded by Commissioner Elling, to approve the Minutes of August 23, 1977 as written. Vote on motion: yes - Chairman Retzlaff. Commissioner Bosell, Commissioner Johanson, Commissioner Elling; present - Commissioner Bruns. Motion carried. Norman Shequen Lot Split Application (Comm. #9-77-1) Mr. Shequen had been in previously requesting a variance to split his property. Now he is attempting to split his property under the new Ordinance #40, the Lot Split Ordinance. He owns Lot 3, Block 1, Pankonin Addition and wishes to divide it in half. The driveways are shown on lot 2 and lot 4. There are no driveways on lot 3. He still has the same interested buyer who would like to buy ~ of lot 3 and start a 32 x 80 machine shop and employ about 6 people. Commissioner Bruns expounded on his views of the lot split request~ it is the same request as the variance that was just denied; it is not in conformance with the land; it was the legislative intent of the ordinance to restrict lot splits to residential lots and my intent to restrict lot splits to residential lots and areas with sewer; it doesn't conform to the Comprehensive Plan - a ~ acre lot in that area. Mr. Shequen replied that you don't need the sewer in an industrial area as much as in a residential area. o o o u o Planning and Zoning Commission Meeting Minutes - September 13, 1977 Page 2 Discussion: the lot sizes in Hughs' Industrial Park; when Hughs' Industrial Park was platted; this would be a desirable business for GB zoned area; who owns the service road; Section 6.02 of Ordinance 8; 39,000 square feet or 20,000 square feet required for a septic system; discussed alternate sewage systems; may require premature expansion of city sewer past large parcels of land to service these ~-acre lots; previous action by the Planning and Zoning Commission and the City Council on Mr. Shequen's variance request to split the property. Motion by Commissioner Elling, seconded by Chairman Retzlaff, that the Planning and Zoning Commission recommends to the Andover City Council approval of the Norman Shequen lot split application for lot 3, block 1, Pankonin Addition for the following reasons: 1) It meets the existing Ordinance #40 as it now stands. 2) There was no public opposition to it. Vote on motion: y.es - Commissioner Elling, Chairman Retzlaff; no _ Commissioner Bruns, Commissioner Bosell; present - Commissioner Johanson. Motion fails. Commissioner :5(~w..._ r Johanson stated his concern over Ordinance #40 - Section C - intent _ whether this lot split would interferewith orderly planning. Commissioner Elling said that he felt we are expanding the City sewer system with this approval, but we must act according to the requirements of the existing ordinances. MOtion by Commissioner Elling, seconded by Chairman Retzlaff, that the Planning and Zoning Commission recommends to the Andover City Council approval of the Norman Shequen lot split application for lot 3, block 1, Pankonin Addition for the following reasons: 1) It meets the existing Ordinance #40 as it now stands. 2) There was no public opposition to it. Vote on motion: yes - Chairman Retzlaff, Commissioner Johanson, Commissioner Elling; no - Commissioner Bosell, Commissioner Bruns. MOtion carries. o Commissioner Bosell stated her reasons for voting "no" on the motion, "First, I feel that under Ordinance 40 it does say that it should be in conformance with public interest,~dI think it's contrary to public interest. I also think we are setting a precedent which would allow the use of land in the GB area where there was no sanitary sewer system and"a lot less than 2~ acres." 0.'1 (c...o.~"ec.1ed 1-"J.J'n) The Lot Split Application will be on the City Council agenda on October 4, 1977. o o o o o o o Planning and Zoning Commission Meeting Minutes - September 13, 1977 Page 3 Rum River Crossing Discussion (Comm. #9-77-2) Bob Isaacson, of Consulting Engineers Diversified, explained their position regarding the crossing. They have been hired by Anoka County Highway Department to do some of the initial work and preliminary studies. The County has shown their preferred sites for the crossing of the Rum River between Ramsey and Andover. These proposed locations are not firm. C.E.D. is preparing a project development report that summarizes the over all project - approximate costs, location, etc. They are to contact all or any agencies that would be affected by the bridge. If the City of Andover thinks that the bridge would be an asset or has an opinion, it should be expressed. They will prepare a preliminary report to the County. The County will submit the report to various agencies, Cities, etc., and get feedback and then prepare a final report. They are looking hopeful~y to start construction by next Spring, 1978. Commissioner Johanson mentioned that the access road is probably more important than the bridge itself. Mr. Isaacson stated that it would be a 4-lane bridge from a 2-lane street. There are county plans to develop various streets to allow the bridge. Joe Chutich, formerly a Anoka City Commission member, stated that the City of Anoka approved this plan a year ago. Commissioner Elling commented that it appears this crossing would relieve traffic problems for the City of Ramsey and the City of Anoka but would create problems in the City of Andover and Andover wouldn't benefit from the crossing. He also was concerned about where the access road would run. The Planning and Zoning Commission could see no reason for a crossing. Mayor Windschitl replied that it has been put in the area to have an access or extension of a Ramsey road. Andover has not been asked where they would like a crossing. We have looked at the possibility of having a crossing at sometime but never had the opportunity to give our opinion on where we want it. It was just put where the City of Ramsey would like a crossing. Discussed briefly the impact of all the added traffic. It should go over to County Road 9 or to Hanson Boulevard as shown on the Anoka County Thoroughfare Plan of July, 1974. Perhaps it should cross at l59th to give a straight road across the City. It would then be away from residential development. Engineer Stockwell said he was asked to review as it relates to Andover's street and thoroughfare plan. At this time the heaviest traffic will be in the Urban Plnnning area. The disadvantage would be more traffic from Ramsey. It will tie into Round Lake Boulevard which has the worst traffic in the City. County Road 20 seems to be the best place for a major road to cross the City. o o o o o Planning and Zoning Commission Meeting Minutes - September 13, 1977 Page 4 Mayor Windschitl thought we should have a joint meeting with Ramsey to decide the matter instead of only Ramsey's decisions. Funding is for the bridge and all the approach work would be paid by Andover. The problems seem to outweigh the advantages. Since 7th Avenue is now improved, the traffic would go across the bridge and then down 7th. The Commission thought Mr. Stockwell should look into the following: 1) Municipal State Aid Funding; 2) traffic studies; 3) how does this bridge tie into our thoroughfare plan; 4) possibility of County Road 20 being the major road extending across the bridge; 5) whether the City of Ramsey set out a definite location. Mayor Windschitl pointed out the fact that C.E.D. should have the answers to the above questions as they are the engineering firm for the City of Ramsey. The decision was made to continue the discussion to the next Planning and Zoning Commission Meeting on September 27th and ask Bob Isaacson, or someone from Consulting Engineers Diversified, to come back with more information. Also to invite Ed Fields - County Commissioner, Paul Ruud - Highway Engineer, and Arnold Cox - Ramsey Mayor to the meeting on the 27th for their input. o Discussion on Possibility of Rezoning Joe Chutich requested time on the agenda to get the Commission's thoughts on rezoning some property (2.7 acres) he owns in Section 32 at the NW corner of County Road 9 and Bunker Lake Boulevard. He would remove the old house and would like the property rezoned to commereial (NB) in order to put in a hardware store and perhaps a garden/nursery shop. He told the Commission of the development across the street in Anoka - 10 acres of commercial use, 5 acres multiple and the rest of the 91 acres is residential. This (Bunker and County Road 9) is one of the busiest intersections in the area. He would put in a service road and a fence or something adjacent to the residential area. The Commission, after hearing his proposal, tended to have a favorable opinion. Lot Split Ordinance Amendment Public Hearing (Comm. #8-77-6) Chairman Retzlaff opened the public hearing. The City Council adopted the Lot Split Ordinance on August 16, 1977 and now are requesting that the Planning and Zoning Commission look into the possibility of amending the ordinance. The Ordinance, as written, allows division of residential and businness or commercial property over the entire City. o o . ) '-- r'j \.. o o Planning and Zoning Commission Meeting Minutes - September 13, 1977 Page 5 The Commission discussed: variances; suggested only allowing lot splits in certain zoning designations; the directive from the City Council to rezone or impose a moratorium; how to word the amendment to clearly state the intent; the memo from Patricia K. Lindquist dated 9-10-77. Motion by Commissioner Bruns, seconded by Commissioner Elling, to close the public hearing. Motion carried unanimously. Motion by Commissioner Bruns, seconded by Commissioner Johanson that the Planning and Zoning Commission recommend to the Andover City Council an amendment to Ordinance #40. An amendment of the title to read: An Ordinance Regulating the Splitting of Residential Lots, Parcels, or Tracts of land within the City of Andover. Also amend Section I _ Definition - to read: A residential lot split . . . in size. To amend Section I-A. - to read No residential lot, . . . . To make a new section C which shall state: No lot in an unsewered area shall be split where the resultant lot is less than 2~ acres. o Motion carried unanimously. This will be on the City Council Agenda on October 4, 1977. Rural R-2 and R-3 Zoning Discussion (Comm. #9-77-3) The City Council has requested action on the R2 and R3 zoning in the rural area of the City in order to comply with Ordinance requirements and orderly development. Chairman Retzlaff explained the reasons for this request. The Attorney, in a letter, suggested the Planning and Zoning Commission review the matter and either initiate rezoning those areas or placing a moratorium on that land. The Commission agreed the moratorium was the most logical and discussed which zoning areas should be included in the moratorium. Some members felt R2, R3 and R4 in the unsewered area and others thought the moratorium sho ul d be on Rl zoning also. A final decision was made to hold a public hearing for a moratorium ordinance on September 27 and not specify which zoning areas at this time and then make the recommendation to the City Council based on input at that meeting. Chairman Retzlaff will work up a rough draft on a moratorium ordinance that could be adopted. Revised Zoning Ordinance Discussion (Comm. #6-77-6) The Commission will hold a special meeting for going through the new zoning ordinance on September 20th at 7:30 P.M. o Adiournment Motion by Commissioner Johanson, seconded by Commissioner Elling, to adjourn. Motion carried unanimously. Meeting adjourned at 11:20 P.M.
