Ordinance Violations Report o o o o o o 0 CITY of ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING July 12, 1977 Minutes The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Don Jacobson on July 12, 1977 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: d'Arcy Bosell, Walter Bruns, James Elling, Ralph Kishel, Larry Retzlaff Commissioner Absent: John Johanson Minutes of June 28, 1977 Correction: page 2 - 2nd paragraph - change "June" to "July" Motion by Commissioner Retzlaff, seconded by Commissioner Bosell, to approve the Minutes of June 28 as amended. Motion carried unanimously. Leonard McLaughlin Variance Request Continued (Comm. #6-77-4) Chairman Jacobson talked to the City Attorney today and it was his (the Attorney's) opinion that Mr. McLaughlin did not need a variance from the City of Andover. All he needed was a better legal description so as to not describe lots 11 and 12 in his legal description. With a better legal he would just take it down to the court house and record it. He is starting out with 2 lots and ending up with 2 lots. He is not creating any new parcels. It was suggested that we just scratch this from the agenda. Mr. McLaughlin was contacted by phone today and was agreeable to it. Lawrence B. Carlson Sketch Plan (Comm. #7-77-1) Mr. Carlson presented a plat containing over 130 acres of land and the minimum lot size is 2% acres. The park land, 13+ acres, is high, usable ground. The Plat is in Section 4 at Verdin Street and 181st Avenue and is zoned R-1. The Planning and Zoning Commission and Mr. Carlson discussed and/or commented on the following: (1) lot size of lots 1 and 6 of block 5 and lots 4 and 6 of block 4; (2) lot 6 of block 3 has 292' on the county road; (3) all the corner lots must be 15' wider; (4) temporary cul-de-sacs on 177th Lane and 179th Avenue to the West; (5) whether lots 1 and 8 of block 4 were buildable with the pipeline easement going through; o o o o o o o Planning and Zoning Commission Meeting Minutes - July 12, 1977 Page 2 (6) a letter from the pipeline company giving approval for what Mr. Carlson is proposing; (7) extension of Arrowhead into Verdin Acres; (8) 177th Lane - Block 4 is too long;(9) a 10' dedicated walkway is needed to provide access to the park. Mr. Carlson will make or look into the changes discussed and prepare the preliminary plat. Briar Lane Estates Sketch Plan (Comm. #7-77-2) Clayton Orttel, Jr, Orttel, Sr., owner. Avenue and is zoned developer, presented the sketch plan for Clayton It is a 59 acre parcel in Section 13, off 157th R-1. Some of the items discussed by Mr. Orttel and the Planning and Zoning Commission were: (1) length of streets - the proposed Ilex Street is too long; (2) Lot 4 of Block 3 - no lot can be larger than twice the average lot size - suggested making it park land; (3) must have authority from the owner in writing to go ahead with the plat; (4) no park land is shown; (5) 159th Avenue should perhaps have a temporary cul-de-sac; (6) lots 1 and 2 of Block 4 are too small and also lots 3 and 5 of block 3; (7) lot 4 of block 3 has double frontage which is not allowed; (8) soil borings will be required; (9) the 20 contiguous acres also owned should be shown on the preliminary plat; (10) in order to develop the 20 acres to the north, there should be some logical extension for road purposes; (11) the plat is in the Coon Creek Watershed District, therefore the Watershed Board will have to review the plat and perhaps require ponding, etc. Mr. Orttel will go ahead with the preliminary platting after taking into account the items mentioned above. Rosella Sonsteby Sketch Plan (Comm. #7-77-5) Mrs. Sonsteby explained that the land she wants to plat is a little more than 20 acres, is south of Round Lake, in Section 29, has R-1 zoning, 7 lots, and they are large, pretty, wooded lots. When the Planning and Zoning Commission pointed out the minimum 330' frontage required on all lots and 2~ acres, Mrs. Sonsteby stated that she is making smaller lots because she feels that City sewer assessments will soon be there and also people don't want such big lots. Discussion: (1) proposed park land on Round Lake with no road access; (2) lot 1 doesn't meet any of the requirements; (3) she has the option of applying for a rezoning; (4) extension of 143rd Avenue; (5) temporary cul-de-sac; (6) Ordinance 8, Section 4.33 (C) 4. - which requires a special permit for grading and filing on shore land lots; (7) Ordinance 8, Section 4.33 (d) 2. - shore land plats must be approved by the State and DNR; (8) none of the lots meet the 330' frontage or the 2~-acre requirements. Mrs. Sonsteby will have to change the subdivision in order to meet the Ordinance requirements. o o o o o Planning and Zoning Commission Meeting Minutes - July 12, 1977 Page 3 New View Sketch Plan (Comm. #7-77-3) Ray Allatore and Charles Hartfiel, developers of the property, were present to discuss their proposal with the Commission. It is a 8.7 acre parcel to be divided into 21 lots in Section 29 and there is R-4 zoning in the area. Discussion: (1) lot 1, block 1 has only 80' frontage; (2) the developers proposed dedicating lots 3 and 4 of block 1 as park land; (3) extension of Quay Street would not match the existing Quay Street in the Quickstrarn Addition; (4) the piece of land between this plat and Quickstrom's Addition; (5) the plat was originally submitted in February, 1973, and then withdrawn; (6) Ordinance 8, Section 4.03 (g) non-conforming use on open land for 3 years; (7) corner lot has to be larger; (8) Ordinance 10, Section 9.06 A 1. and 2.;-(9) with R-4 zoning, only every 3rd lot can be built on until sewer carnes. The Planning and Zoning Commission would like the Attorney's opinion on Ordinance 8, Section 4.03 G. The Chairman will take care of it and the developers will be notified. c=> Cunningham Addition Sketch Plan (Comm. #7-77-4) The developer was not present and had not submitted the sketch plan materials. This will be on the next meeting's agenda. Lot Split Ordinance (Comm. #12-76-5) This item was approved by the Commission and then sent to the City Council. At the last meeting, the City Council sent it back to the Planning and Zoning Commission for further work. Chairman Jacobson read City Council Minutes and told what the City Council wants. They want the Planning and Zoning Commission to look into the following: change park dedication fees; philosophy of the ordinance - they would like to encourage development in the Urban area and not in the Rural area; look at having a division greater than 2 instead maybe 3 or 4; the need for engineering services that would be required. Discussed park fees - all agreed to change to $100 park fee per lot. Discussed how many lots to have. The intent was that if more than 2 lots were desired, they could get a variance for more. The Commission will leave it as is. o Discussed engineering services states,"Such other information intent of the lot split" - #5 would take care of that,which as may be required to fully represent the o o o o o Planning and Zoning Commission Meeting Minutes - July 12, 1977 Page 4 On page 2 - Section III B. Commissioner Bruns mentioned that the language didn't seem to be right. After discussion, the Commission changed the sentence to read "Upon receipt of an application for a lot split, the Clerk shall notify by mail all property owners within 350 feet of the property the date of the review of such lot split." In Section I the Commission changed the sentence to read itA lot split is any division of a lot, parcel or tract of land into not more than two (2) parcels." Motion by Commissioner Bosell, seconded by Commissioner Elling, that these 3 changes be incorporated into the lot split ordinance and sent back to the City Council for consideration: (1) definition (Section I) to add a period after the word "~arcels" and to delete the rest of the sentence. (2) Section III - B - change to read: Upon receipt of an application for a lot split, the Clerk shall notify by mail all property owners within 350 feet of the property the date of the review of such lot split. (3) Section V - B - to change the charge for park dedication to $100 for each lot created. o Amendment by Commissioner Retzlaff, seconded by Commissioner Bruns, that the Planning and Zoning Commission has considered the recommendations of the City Council and after further consideration, the Planning and Zoning Commission recommends that the Andover City Council adopt the revised lot split ordinance. Motion and amendment carried unanimously. Ordinance Violations Report Discussed what could be done regarding Ordinance Violations previously reported. Chairman Jacobson will ask the City Council what might be done at the next (July 19, 1977) City Council meeting. Meadow Creek Baptist Church has a private school (K - 10) with 300 to 500 children enrolled. They recently had their ground breaking ceremony for new construction for the school. Chairman Jacobson will call Rev. Valentine about the special use permit and then will proceed to the City Counc i 1. Revised Zoning Ordinance Discussion (Comm. #6-77-6) The Planning and Zoning Commission set Monday, July 18th at 7:30 P.M. for a special meeting to review the new zoning ordinance proposed.
