June 28, 1977
MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:35 P.M. by Chairman Don Jacobson on June 28, 1977
at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka,
Minnesota 55303.
Commissioners Present: d'Arcy Bosell, Walter Bruns, James Elling,
John Johanson, Ralph Kishel, Larry Retzlaff

Corrections: page 5 - Motion - 3rd line from bottom - change "as recommended"
to "per the recommendation"
page 6 - 2nd motion - 3rd line - change spelling of
"preliminaty" to "preliminary"
Motion by Commissioner Retzlaff, seconded by Commissioner Bosell, to
accept the Minutes of June 14, 1977 as amended. Motion carried unanimously.
Discussion on unsafe, dilapidated buildings (Comm. #6-77-5)
Chairman Jacobson advised that there is a provision in the State Building
Code which the City has adopted already, so we don't need anything else
so the matter will be dropped.
Buildability Ordinance Continued Public Hearing (Comm. #4-77-1)
The Commission had copies of two letters from City Attorney, William
G. Hawkins, and also a letter from Jim Thurston and Dave Clough, Andover
Building Officials. Attorney Hawkins' letter expressed his feelings on
having a problem enforcing the Ordinance, in his opinion.
Motion by Commissioner Bruns, seconded by Commissioner Kishel,
Section V of the proposed Buildability Ordinance be changed to
as per Section V of Bill Hawkins' letter dated June 24, 1977.

Motion
Discussed Building Officials' letter. The Commissioners felt that if
the Building Officials needed additional help, they could hire someone
to do the necessary soil borings or get information and help from the
City Engineer with soil maps, etc.
Amendment by Commissioner Bruns, seconded by Commissioner Kishel, to change
the previous motion to Section VI. Motion carried unanimously.

Motion by Commissioner Bruns, seconded by Commissioner Bosell, that the
Planning and Zoning Commission recommend to the Andover City Council
the adoption of AN ORDINANCE RELATIVE TO NOTIFICATION OF BUILDABILITY
OF LOTS OF RECORD IN ANY SUBDIVISION AND BUILDABILITY OF PARCELS OF
UNPLATTED LAND USED AS A SITE FOR CONSTRUCTION OF A DWELLING UNIT for
the reasons being: 1) that the proposed Ordinance provides protection
for purchasers of platted and unplatted land in the City of Andover.
2) that the Building Inspector is provided with "tools" to help in the
analysis of soil conditions for granting certifications. 3) that the
-- pIPposed Ordinance will help in the future development of Andover and
provides for the safe transfer of buildable lots and/or unplatted land.
4) a public hearing was held and no opposition to the Ordinance was
expressed. 5) the acceptable Attorney's opinion was received by the
Planning and Zoning Commission in December, 1976 and June, 1977.
Amendment by Commissioner Retzlaff, seconded by Commissioner Bosell,
to change #5 to read - the City Attorney has made comments and his
recommendations have been considered.

Amendment and Motion carried unanimously. This will be on the City
Council Agenda JHne 21, 1977.

McCombs - Knutson Associates, Inc. Interview
William H. (Skip) McCombs and Steve Harvey were present for interview
tonight because of a conflict and inability to attend last nights special
meeting. Mr. McCombs said the company is 11 years old and employees
75 people so are one of the larger firms. They provide land surveying,
engineering, some architecture, planning, and a fairly wide variety of
services. They represent 35 cities in Minnesota, Iowa, and Wisconsin.
Those near are Elk River, Dayton, and Rogers. Presently they are working
with Dayton to bring their Plan into compliance with the Metropolitan
Council. Mr. Harvey said that they had gone to Met Council and gotten
a copy of the Andover systems statement to review and he explained to
the Commission the work program that McCombs has proposed. They read
the Grow Township Community Development Plan and compared it to the systems
statement to come up with their proposal. Their first approach would be
to go to Met Council and iron out the systems statement. They explained
further the costs, tentative schedule, etc.

Chairman Jacobson asked, "How do you feel you can plan for the City
the issue of an airport will not be decided until January 1, 1978?
can you start earlier?" Mr. McCombs, "We would gather together all
data - topography, existing facilities, sewer, transportation, etc. in
order to have everything ready to go." Chairman Jacobson, "We have
various committees working on these items. Would you incorporate their
ideas into your plan, work with them, or delete them?" Mr. McCombs, "We
would use the information if possible. It would depend on the materials
they came up with - whether it was feasible or not and also, somebody
has to tie it all together."

Commissioner Elling - Have you had any experience with M.A.C.? Mr.
McCombs - no. Commissioner Kishel asked if they had experience in reviewing
ordinances and zoning. Mr. McCombs replied that from a technical standpoint
they have. They just did Rockford's Ordinances. We have established
a good reputation - particularly in high-environment communities.
Commissioner Bruns - with the political problems in Dayton, how do you
make the decision for Planning? Mr. McCombs - We have been their Engineers
since January and the City Council has to make the decision. Our role
is to support the philosophy you develop. We can tell you our experience
and what we think but our role is as advisor and counsel. Commissioner
Bosell - Have you gone before Met Council? Mr. McCombs _ We have a lot
of projects before the Council and a lot of projects before the E.Q.C.
Commissioner Bosell - You said you have an attorney in your firm now.
What kind of experience does he have before Met Council? Mr. McCombs _
We would not use him as a representative. In dealing with the Comprehensive
Plan you should use your City Attorney unless there is some hang up.
Commissioner Bosell - The projected costs ($14,500 to $18,000) you show,
do they include legal? Mr. McCombs - Our proposal covers all anticipated
costs - not just McCombs. The fiscal would partly be covered by your
fiscal consultant; the legal would be some one else. Commissioner
Retzlaff - Do you currently work for any projects the Met Council is
undertaking? Mr. McCombs - No, just the Metropolitan Waste Commission.
Commissioner Retzlaff - Are you currently retained by or work for any
firm, individual, or neighboring community of Andover? Mr. McCombs
No, only those previously mentioned. I think you should pick someone
you have confidence in. We have a good track record and you can check
with any of our clients and the 35 communities we have represented.
Mr. McCombs was advised that the Commission will send a letter within
the next 10 days telling the decision of the Commission.
Planning Consultant Selection (Comm. #4-77-5)
Commissioner Retzlaff stated that the City Council referral of 4-23-77
stated the Commission should seek an individual or planning firm who
would represent Andover in matters relating to the Community Development
Plan. Then, on 4-26-77, in the Planning and Zoning Minutes, we are seeking
an individual or individuals to represent the City before Met Council.
We are possibly looking for two different individuals. Planners are
coming in with plans for revising the Comprehensive Plan, etc. Are we
looking for one or two individualsZ
Discussion: should define what is wanted; should get a planner to update
the Comprehensive Plan and review the Ordinances; not one of the candidates
fits all the bills; the City has an adequate engineering firm. Commissioner
Retzlaff said, "I have a problem with two law firms representing the City.
Discussion on whether an attorney was needed to represent the City for
the systems statement; the ad for the position; the hourly rates were
all similar but the time projected was different.

Chairman Jacobson suggested culling it down to 2 firms and sit down
with them and make them aware that Andover has a sewer plan, committees
working on some of these items, and then get a very accurate, detailed
report or estimate from the firms as to cost, time, etc. We could
recommend to the City Council the hiring of Bernard Steffan on the
systems statement then on January l, 1978, we could have the other firm
ready to go on the Community Development Plan.
Discussed where the money would come from to pay Mr. Steffan. The Met
Council will give $1,000 for planning but not for legal fees. The
Commission feels that the City needs a representative to the Met. Council
and a planning consultant. After discussion of the various firms interviewed,
it was suggested that the Chairman write to the firms and give them
some more information so they can come back with better estimates.
Discussed how much to require of them before they get the contract with
the City.

Motion by Commissioner Retzlaff, seconded by Commissioner Elling, to
recommend that the Chairman draft a letter outlining what our goals
and objectives are to 3 firms: Amenity One, Inc., Midwest Planning and
T.K.D.A.; and in the letter giving the generalities of what we want and
asking them to bring forward some presentation for further review.
Discussion on getting the final systems statement, then have the planning
consultant take over; and also, sending a letter to those not chosen.
Motion carried unanimously.
Motion by Commissioner Bruns, seconded by Commissioner Retzlaff, that
the Planning and Zoning Commission recommend to the City Council that
if the City Council feels a conflict exists in the final systems statement
from Met Council and the City Council wishes to pursue the matter of
reconciling the City's position with the Metropolitan Council's position,
the Planning and Zoning Commission would recommend the hiring of Mr. Bernard
Steffan at the rate of $40 per hour at a cost not to exceed $4,000 to
assist the City in reconciling the two positions.
Discussion: what the City Council wanted from the Planning and Zoning
Commission and now going one step further and hiring Bernard Steffan;
sending a letter to Mr. Steffan advising him of the Planning and Zoning
recommendation. Commissioner Retzlaff restated his position that he feels
they have a choice of one - it was a foregone conclusion - and would
have liked to have seen more people than one to choose from.

Vote on motion: yes - Chairman Jacobson, Commissioner Elling, Commissioner
Johanson, Commissioner Bosell, Commissioner Bruns, Commissioner Kishel;
no - Commissioner Retzlaff. Motion carried.

Leonard McLaughlin Variance Request (Comm. #6-77-4)
Mr. McLaughlin explained his reasons for asking for the variance.
He owns Lot 11 and 12 of Auditor's Sub 102, section 33, between Crooked
Lake Boulevard and Gladiola Street and wishes to split the property
into two parcels - one fronting on Gladiola and one on Crooked Lake
Boulevard. He has a buyer for the parcel on Gladiola Street and intends
to build on the other himself. The lots would be 120 x 473.48 each.
He wishes to split the property as per the legal descriptions included
with the variance request.
The Commission felt that by splitting the property as shown, 4 lots
would be created. After lengthy discussion on the matter, it will be
on the next Planning and Zoning Commission and a letter will be written
to the City Attorney asking for correct procedure to follow _ whether
Mr. McLaughlin will have to combine the lot II and 12 and then ask for
the variance or what the Commission should do.
Revised Zoning Ordinance Discussion (Comm. #6-77-6)
The Commission selected Thursday, July 7, at 7:30 P.M. as the date for
a Special Meeting to discuss the proposed ordinance.
Adjournment
Motion by Commissioner Retzlaff, seconded by Commissioner Bruns, to
adjourn. Motion carried unanimously.

Constance Free Church Variance Request Continued (Comrn. #3-77-7)
No one was present to represent the church. Chairman Jacobson had
talked to the representative informing them of the meeting.
Motion by Commissioner Elling, seconded by Commissioner Retzlaff, that
the Planning and Zoning Commission recommend to the City Council that the
Constance Free Church Variance Request be denied due to lack of interest.
Because (1) that we have had them on the agenda 3 or 4 consecutive
times and they have not shown up and (2) the Commission Chairman has
called them, asking them, and informing them of our actions and that
they still have not shown up.
Motion carried unanimously.
This will be on the City Council Agenda July 19, 1977.
