Commissioners Present: d'Arcy Bosell, Walter Bruns, James Elling, John Johanson, Ralph Kishel Commissioner Absent: Larry Retzlaff Also Present: Rex Stockwell, Engineer from T.K.D.A. Minutes Motion by Commissioner Bruns, seconded by Commissioner Johanson, to accept the Minutes of February 22, 1977 as submitted. Vote on motion: yes - Commissioner Bruns, Commissioner Johanson, Commissioner Kishel, Commissioner Elling, Chairman Jacobson; present - Commissioner Bosell. Motion carried. Barnes' Rolling Oaks 2nd Addition Preliminary Plat (Comm. #4-76-8) Engineer Stockwell read and discussed with the Commissioners his letter (copy attached) dated February 28, 1977. He also referred to a letter from Northern Natural Gas Company (copy attached). The ponding, shown on the plat, is the same size as before but reduced from 3 ponds to 2 with a little larger capacity. They discussed the Prairie Road right-of-way. The final plat's legal description will exclude the legal description for Prairie Road right-of-way. Winslow Holasek spoke to the Commission about the 50' easement for County Ditch #20 along the railroad track. Fay Barnes said he was willing to allow for 100' of easement instead of the 50' as shown. Discussed the buildability of some of the lots that seem low. Referred to previous reports on water table, filling of lots, etc. Motion by Commissioner Kishel, seconded by Commissioner Johanson, that the Andover Planning and Zoning Commission recommend to the City Council the approval of the Preliminary Plat of Barnes' Rolling Oaks 2nd Addition as revised on the plat submitted March 8, 1977 inasmuch as it conforms to the Engineering standards which have been reviewed by the City Engineer and it conforms to the existing City Ordinances o o o o o Planning and Zoning Commission Meeting Minutes - March 8, 1977 Page 2 of the City of Andover and the Preliminary Plat has been reviewed and approved by the Northern Natural Gas Company, the County Engineer of Anoka County, and the Coon Creek Watershed Board. Subject to two revisions being made: 1) the drainage easement,'instead of being 50' bordering on Burlington Northern property, it should be 100' so that in the event of the County Ditch #20 having to be realigned there would be adequate area to place spoil materials; 2) the provision that Prairie Road shall be deeded to the City of Andover in most likelihood prior to the approval of the final plat. Motion carried unanimously. United Power Association Variance and Special Use Permit (Comm. #3-77-1) o Chairman Jacobson advised those present that he is an employee of United Power Association and, therefore, would not vote on this matter but would like to Chair the meeting. As there were no objections, Chairman Jacobson opened the public hearing on the Special Use Permit to construct a transmission substation. The following people were present: J. Pat Cairns - right-of-way acquisition supervisor for United Power, Gene Weyling - Electrical Engineer in charge of Substation Design for United Power, Jim Egan - Environmental Specialist from United Power, Paul Ruud - Anoka County Highway Engineer, Mr. and Mrs. Calvin Jellison - the sellers of a portion of their property to United Power, Ron Roth - adjacent property owner, and Walter Vosica - adjacent property owner. Mr. Cairns explained United Power Association's proposal. They are planning to construct a transmission substation in Section 34, north of Bunker Lake Boulevard, where they already have a double circuit 230/69 kV transmission line. Also on this property is a double circuit 345 kV transmission line owned by Northern States Power. UPA is proposing constructing the substation between the 2 lines. This would take bulk electrical energy from NSP and be tied into the UPA system which includes the large generating plant in North Dakota. UPA would like to grade and fill the site this fall and then construction would start as early as possible in 1978. United Power has to get approval of the loan from REA. Also, if the Minnesota Environmental Quality Council decides to review, it takes quite a bit of time. This substation must be ready for operation for the fall of 1978. The site is 18 acres, including the 1~ acres they already own, and it is zoned GB (General Business). They will landscape the area and plant trees. The estimated cost of construction and land will be$3,000,000 and estimated property tax would be $120,000. o o o o o o Planning and Zoning Commission Meeting Minutes - March 8, 1977 Page 3 Mr. Ruud explained the County Highway Department's proposed future plans for upgrading roads in the area. He said they would build Hanson Boulevard between the United Power and the Northern States Power lines and perhaps other public utilities could be incorporated into this area. The existing house within the site, occupied by Mr. and Mrs. Calvin Jellison, is being purchased by UPA with an option for them to live there for 5 years. UPA will be buying part of the junkyard property so the Jellisons will move their business operations further West. / Questions were asked and discussion ensued on the following sections of Andover Ordinance 8: 8.18 - Radiation & Electrical Emmissions - UPA said that there is no radio activity. This wouldn't cause any interference with radio or TV reception. 8.19 (a) - Noise - Mr. Egan explained that it would come out to approximately 52 decibels on the A sca)e. 8.04 - Landscaping - the substation will be fenced and have J[~a~~ y in the area. The rest of the property will be seeded and 4 to 5 foot trees planted to screen. 8.03 - Screening - Mr. Roth was concerned about how this would affect residential development of his property to the East. It was explained that the outer area would be properly planted with evergreen trees. 8.01 - Exterior storage - there won't be anything stored at the substation. Storage facilities for UPA are at Elk River and Grand Rapids. 8.21 - fire hazard - no fire problem. 9tl ~~ 3/~ ~ The Minnesota Environmental Quality Council has the authority to approve all !F.si\iJ/~e~ similar to this and all transmission lines that are 230 ~~nd above. UPA has applied for an exemption to this approval from that because this site is of local significance only. It was suggested that it would be a good idea to make Andover approval subject to the EQC's making this an exempt site. They were asked if they were going to upgrade or convert the existing lines, and replied that the 69 kV line will be realigned. Motion by Commissioner Bruns, seconded by Commissioner Kishel, to close the public hearing. Motion carried unanimously. Commissioner Elling advised those present that he works for Northern States Power Company and will abstain from voting on the issue. o o o o o o Planning and Zoning Commission Meeting Minutes - March 8, 1977 Page 4 Motion by Commissioner Kishel, seconded by Commissioner Johanson, that the Andover Planning and Zoning Commission recommend to the City Council that the Special Use Permit requested by United Power Association on the East 600' of the SE~ of the NE~ of Section 34, Township 32, Range 24 be granted inasmuch as it conforms with Ordinance 8 - Sections 8.01,8.03,8.04,8.18, and 8.19 (a); and in addition, inasmuch as its just a local significant impact, it will be subject to the requirements of the Environmental Quality Council. In addition, the site has met with the approval of the County Highway Engineer and would lend to the Northerly extension of Hanson Boulevard for future construction. Vote on Motion: yes Commissioner Bosell, Commissioner Elling. Commissioner Johanson, Commissioner Bruns, Commissioner Kishel; present - Chairman Jacobson, Motion carried. o Mr. Cairns explained that United Power is requesting a variance to construct a microwave tower, which would be in the SW corner of the property, and also the substation will have a structure that is over the height limitation of Andover Ordinance. The tower's function is to give communication control to the operation and switching of loads into the entire UPA system. The guy wires will be within the site and the tower would be about 150' North of the centerline of Bunker Lake Boulevard. The tower is about 30" on each of its 3 sides at the base and 150' high. Discussed:the tower falling (when a tower falls it usally falls within 60% of it's radius); Ordinance 8 - Section 4.16; the tower will be west of the existing house; it will be about 160' to the closest conductor. Motion by Commissioner Bruns, seconded by Commissioner Johanson, that the Planning and Zoning Commission recommend to the Andover City Council approval of the Variance Request for United Power Association microwave tower on the East 600' of the SE~ of the NE~ of Section 34, Township 32, Range 24, in that the Variance Request complies with 4.16 and too, there has been no public opposition to such heighth variance; that it conforms with 8.21 of Ordinance 8 (fire safety and protection features). Discussion on heighth of tower and substation and limitations or restrictions. Motion withdrawn. o Motion by Commissioner Bruns, seconded by Commissioner Johanson, that the Andover Planning and Zoning Commission recommend to the Andover City Council approval of the Variance request for United Power Association for variance for heighth limitation not to exceed 130' structure in the substation and 160' microwave tower on land described as follows: the East 600' of the SE~ of the NE~ of Section 34, Township 32, Range 24., The reasons being: 1) it conforms with Section 4.16 of the zoning ordinance and 2) it conforms with 8.21 of the zoning ordinance and 3) there has been no public opposition. o o o o Planning and Zoning Commission Meeting ,~ Minutes - March 8, 1977 \--1 Page 5 Vote on Motion: yes - Commissioner Bosell, Commissioner Bruns, Commissioner Johanson, Commissioner Kishel; present - Commissioner Elling, Chairman Jacobson. Motion carried. This will be on the City Council Agenda on April 5, 1977. Variance Request on Lot 25, Block 2 Meadowood Plat (Comm. #3-77-2) The footings for a new home were put in 7' short of the minimum requirement. The City Council has asked that the Planning and Zoning Commission expedite this so that the builders can go ahead with construction. It was an honest mistake and 7' isn't going to make that much difference. Motion by Commissioner Elling, seconded by Commissioner Bosell, that the Andover Planning and Zoning Commission recommend approval of the variance for Lot 25, Block 2, Meadowood Addition for exemption of Ordinance 8, Section 6.02. It is a variance to the setback which is 33' instead of the 40' that is required. Discussion on whether to include in the recommendation that it was an error on the part of the building official of the city. ..--" ! ) '--./ Amendment by Commissioner Bosell, seconded by Commissioner Elling, that the variance is because the violation was not detected early enough to stop construction. Amendment and motion carried unanimously. This will be on the City Council Agenda for March 15, 1977. Metropolitan Council Significant Rules (Comm. #3-77-3) The Commission discussed the Met Council public hearing on March 16, 1977 and suggestion was made that a statement or letter be sent stating Andover's position and/or feelings. They discussed briefly the materials sent recently from Met Council and trying to set up some better lines of communication to negotiate with them. The Planning and Zoning Commission will meet with the City Council at a special meeting on March 10th to review and discuss the recently issued Metropolitan Systems Statement. () Motion by Commissioner Elling, seconded by Commissioner Bruns, that Chairman Jacobson be authorized to write a letter stating the City of Andover Planning and Zoning Commission's concern and positions regarding the matters alleged to be of metropolitan significance in the Metropolitan Council's statement dated 2-2-77 and furthermore, that the Mayor or the City Council respond or designate whether they would like to have an authorized representative at the meeting on Wednesday, March 16, 1977. Amendment by Commissioner Bruns, seconded by Commissioner Elling, to have the Mayor or City Council respond accordingly. Amendment and motion carried unanimously. o o " lJ o o o o Planning and Zoning Commission Meeting Minutes - March 8, 1977 Page 6 Progress Report from Subcommittee for Ordinance Revision Commissioner Elling reported on their meeting of March 5th. They would like to incorporate all the definitions of the ordinances into a new Ordinance #1 so that the same definitions could be used in all the ordinances. They would like City Council opinions and Commission opinions on Ordinances #6, 24, 25, and 26 at this time. Adjournment Motion by Commissioner Elling, seconded by Commissioner Johanson, to adjourn. Motion carried unanimously. WEBER Planning and Zoning Commission Andover, Minnesota Re: Barnes Rolling Oaks Second Addition Preliminary Plat Review Andover, Minnesota Commission No. 6223-77 Commission Members: o We have reviewed the preliminary plat for Barnes' Rol- ling Oaks Second Addition dated February 22, 1977. The revised plat includes those revisions required as a result of discussions at the February 8, 1977 Commission meeting. CLIFFORD W. HAMBLIN EDWARD J. BOOTH The items contained in a letter to the Commission from TKDA dated February 7, 1977 have been completed on the revised plat. Attached to this letter is a copy of the letter received from Northern Natural Gas Company regarding exca- vation and filling over gas company easements. There has been some confusion over the easement requirements for County Ditch No. 20 along the Burlington Northern right of way. The Coon Creek Watershed Engineer explained that a 100' easement, 50' either side of the ditch, is required over the entire length of the ditch within the plat. He indicated only 50' of easement would be required on this plat along the Bruling- ton Northern right of way where the ditch falls along the property line or within the BNR right of way. The preliminary plat with the recent revisions conforms to the requirements of existing City ordinances.
