Publish on February 4, 1977 o o o o \. o o 0 (,ry of ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING February 8, 1977 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Don Jacobson on February 8, 1977 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Walter Bruns, James Elling, John Johanson, Ralph Kishel (arrived at 8:50 P.M.), Larry Retzlaff Robert McClure (appointed to a 3-year term on the Planning and Zoning Commission on January 10, 1977) was appointed to the City Council on January 3l, 1977. The City Council will choose someone to take Mr. McClure's place on the Planning and Zoning Commission. Also present: Rex Stockwell - City Engineer from T.K.D.A., and others Minutes of January 25, 1977 Corrections: page 2/James Refrigeration/2nd paragraph - Change "3- pump" to "2-pump" and "2 regular gas pumps" to "1 regular gas pump". Motion by Commissioner Bruns, seconded by Commissioner Retzlaff, to approve the meetings Minutes of January 25th as corrected. Motion carried unanimously. Barnes' Rolling Oaks 2nd Addition Preliminary Plat (Comm. #4-76-8) Engineer Stockwell gave the Commission a letter dated 2-7-77 ( copy attached) and reviewed it with them. The Commission also received information from the Coon Creek Watershed Board's Engineer (copy is attached) . Mr. Barnes' Engineer, Gene Hakanson, had previously prepared a storm drainage plan and submitted it to the Coon Creek Watershed Board. In reviewing the plat, the Watershed Board recommended a number of ponding areas. Mr. Barnes, Mr. Hakanson, and Rex Stockwell met today at the site to discuss the ponding. They agreed to eliminate the northern pond. By enlarging the other ponds and their easements, this would not decrease the lot size below the minimum requirement. Northern Natural Gas Company has an easement through the area and Mr. Hakanson will check with them about excavating or filling over their gas line. The County Ditch is in conformance with the recommendation. I o o o o o Planning and Zoning Commission Meeting Minutes - February 8, 1977 Page 2 The changed road right-of-way on Prairie Road will make the lots and the park along Prairie Road about 20' larger. Discussion of definition of easement - drainage and maintainance. They are redesigning the roadway of Palm Street for drainage purposes. Engineer Stockwell will contact the Coon Creek Watershed Board to see if the plat is still acceptable with the ponding revisions. Motian by Commissioner Retzlaff, seconded by Commissioner Bruns, to continue the public hearing on Barnes' Rolling Oaks 2nd Addition to February 22nd Regular Planning and Zoning meeting to give the developer more time to comply with the Engineering firm's letter and time to get the response back from Northern Natural Gas Company. Motion carried unanimously. Rosella Sonsteby Garage Moving Permit (Comm. #1-77-2) Mrs. Sonsteby withdrew her request. James Refrigeration Special Use Permit (Comm. #1-77-3) o Charles James and Stanley Biggin were present. The Planning Commission had received revised copies of their proposal. Mr. Biggin said they were pleased with the revision because it would make traffic problems fewer. Discussed the illuminated signs; screening - there is a line of trees there now; future development; reason for the width difference between the driveways; Attorney Hawkins' letter regarding one permit for the station and the underground storage tanks. Motion by Commissioner Bruns, seconded by Commissioner Elling, to close the public hearing. Motion carried unanimously. Motion by Commissioner Retzlaff, seconded by Commissioner Johanson, that the Planning and Zoning Commission recommends to the City Council approval of the James Refrigeration Special Use Permit for Parcel 5200 of Plat 65918 (the SE~ of Section 18 located at the junction of CSAH 7 & 58). Reasons for the recommendation of approval will be: 1) said Special Use Permit request complies with provisions of Ordinance 8 and that the Special Use Permit be granted on Sections 7.03 and 4.26; 2) refer Attorney Hawkins' letter of January 31, 1977; 3) there wasn't any negative citizen input; 4) the request is not detrimental to the health, welfare or well-being of the City. Amendment by Commissioner Retzlaff, seconded by Commissioner Johanson, that the original plans that were submitted to the Planning and Zoning Commission at the regular meeting have now been changed and have the Fire Marshall's approval of 2-2-77 on the revision. Amendment and motion carried unanimously. This will be on the City Council Agenda on March 1, 1977. o o o o o o o o Planning and zoning Commission Meeting Minutes - February 8, 1977 Page 3 Charge to Subcommittee for Ordinance Revision (Comm. #1-77-4) Chairman Jacobson had prepared a 2-page document regarding the guide to the Subcommittee that was distributed to the Commission. They reviewed and discussed: paragraph 1; paragraph 4 - adding Engineer; funding; not dissolving the Committee at the end of the time stated but leavlng it as a "standing committee"; where to meet and how much ahead of time the meeting has to be posted. The Commission changed the 1st paragraph by deletlng the word "amending" and adding the word "recommending" at.ter "otherwise". They changed paragraph 4 by adding in the 1st sentence after necessary legal "and engineering" and after Andover city Attorney "and engineering firm". Motion by Commissioner Bruns, seconded by Commissioner Retzlaff, that the Planning and Zoning Commission accept the Chairman's Charge to the Subcommittee for Ordinance Review (copy attached) as amended. Motion carried unanimously, Lot Split Ordinance Discussion (Comm. #12-76-5) The Commission reviewed Commissioner Bruns' draft of a Lot Split Ordinance. They discussed: whether to allow splits into only 2 lots or if they should allow 3 or more; whether a lot split would cause problems with lots not being in conformance with the surrounding area; whether to notify the property owners within 350' of a lot split and to have a public hearing; talked about how many times a person can split their land; whether the rural area should be the same restrictions as the urban area. The Commission decided to study this further and all be prepared to approve a final draft at the next regular meeting. Subcommittee for Ordinance Revision walter Bruns will be the Commissioner who will take Robert McClure's place on the Subcommittee for O~dinance Revision. Planning Seminars presented by the Center for the Study of Local Government The Center is sponsoring 4 workshops on: 1 - land use planning 2 - zoning functions 3 - legal foundations of planning and zoning 4 - subdivision regulations. Four of the Commission members were certain they could go to at least one of the meetings. It was suggested that everyone go to a different meeting in order to garner all the materials and information possible. o o () o o o o Planning and Zoning Commission Meeting Minutes - February 8, 1977 Page 4 Motion by Commissioner Retzlaff, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommends that the City Council reimburse the Planning and zoning Commission members the seminar fee of $20 per person and mileage for attending the Center for the study of Local Government's Planning Seminars. WEBER Planning and Zoning Commission Andover, Minnesota Re: Barnes Rolling Oaks Second Addition Preliminary Plat Review Andover, Minnesota Commission No. 6223-77 Gentlemen: We have reviewed the revised preliminary plat dated January 31, 1977 and the storm drainage study for Barnes Rolling Oaks Second Addition. Attached to this letter is a copy of our most recent correspondence with the discussing required information in the preliminary stage. GEORGE J. SCHROEPFER CLIFFORD W. HAMBLIN EDWARD J. BOOTH City of Andover The following are our comments regarding the revised plat and storm drain- age study: 1. The Coon Creek Watershed Board has reviewed the preliminary plat. They approved the plat contingent upon (1) a 100' easement, 50' either side of the county ditch and (2) response from Northern Natural Gas Company for filling over gas easement. 2. The developer has written Northern Natural Gas Company and is awaiting a response about filling over the easement. 3. The revised plat includes the required 100' drainage easement along the county ditch. 4. The revised plat conforms with the required right of way alignment for Prairie Road. The legal description must be revised to include dedication of the west one half of Prairie Road. o o r\ V o o o o Andover City Council February 7, 1977 Page Two 5. The storm drainage study prepared for the plat recommends three storm drainage ponds to conform with the Coon Creek Watershed requirements. Several revisions are required for these ponds and will be discussed with the Commission. 6. Minor street profile revisions are required. designed to provide complete drainage to the site s. The streets must be recommended ponding 7. A drainage easement will be required for each ponding site. The easements are necessary for future maintenance by the City to assure proper drainage as designed. Normal maintenance such as mowing is generally completed by the owner of the property. We have discussed these requirements with the developer. We will review this letter with the Commission at the February 8, 1977 meeting. Since the Planning and Zoning Commission recommendation of approval on November 9, 1976, the City has received correspondence from the Coon Creek Watershed' Board requiring the following: I) 100 foot drainage easement, 50 feet on either side of the center- line of County Ditch No. 20. 2) Calculations and design for restricting the amount of run-off to that which would occur without any development based on a 100 year storm. We have also completed the final alignment of Prairie Road (MSAH #101) through this area. The final alignment varies considerably with that shown on the preliminary plat. The preliminary plat must be revised to conform with our final alignment. The Anoka County Highway Department has installed a new 36" CMP culvert under Andover Blvd. on County Ditch No. 20. The Coon Creek Watershed o o o o ;" \..J Andover City Council . December 6, 1976 Page Two ~ ..~, . . . .. Board will no longer allow an increase in runoff from the plat into the ditch. The developer, therefore, cannot be required to increase the size of this culvert if the culvert is found to be too small. We will know what size culvert is necessary after the Comprehensive Storm Drainage plan is completed for the area. At that time a replacement program for all inadequate culverts should be developed. As a resul~ of the new information required, revised street profiles and drainage structures will be necessary in conjunction with an engineering study of present and future surface water runoff. We recommend the pre- liminary plat be referred to the Planning and Zoning Commission for the above revisions so the final stages of the preliminary plat can be completed. PHONE: 884,5371 .~ January 24, 1977 Mr. Loren Hentges, Chairman Coon Creek Watershed Board 11873 Northeast Raddison Road Minneapolis, Minnesota 55434 Re: Project CC i7-1, Reviewal of Barnes Rolling Oaks, 2nd Addition Dear Mr. Hentges: The plat contains 40 lots of approximately 2-1/2 acres per lot, zoned single family rural. The plat was received on January 20,1977. Four items are noted: 2) 1) The rational formula was used to determine the additional runoff. This formula should not be used in areas this large, however, it is broken down into several sub-areas. The detention basins shown are more than adequate to contain the additional runoff calculated. The drainage plain which has been submitted will adequately handle the additional runoff. Two of the detention basins are located partially within the Northern Natural Gas pipel ine easement. Mr. Hakanson has w"itten a letter to the Gas Company re- garding their proposal and as yet, has not received their comments. o ~) The plat shows a 50' easement for the County ditch. Mr. Hakanson was informed that the policy for easements is 50' on either side of the ditch. They will change tile easement to conform to the Watershed Board's policy. 4) Most of these basins will be located on sand with absorb~ion rates ranging fr~m 0.6 mins./inch to 4.6 mins./inch, which indicates that 2' of water in the basins will seep into the g~ound within a couple of hours. In conclusion, the plat fulfills the Watershed Board requirements for drainage atten- uation with two provisions: 1) the detention basins located on pipeline are approved by Northern Natural Gas Co. 2)' ease~2nts are granted to the Watershed Board as required on Ditch No. 20. CC 77-1) Dear Mr. Barnes: The Coon Creek Watershed Board has reviewed the plans for Barnes Rolling Oaks, 2nd Addition and has approved the plat with the 2 restrictions listed on the attached letter. In addition, we are requesting that your engineer send us the calculations, size and grade of the culvert that is needed under the service road where it crosses County Ditch #20. We are recommending that this culvert handle at least a 10 year flood. Enclosed are permit forms to be filled out for any proposed work in or next to County Ditch #20. Also enclosed is an easement form to be followed by the surveyor for the easements along County Ditch #20. If you have any questions, please call me. Coon Creek Watershed Board Secretary, Mrs. Braastad City of Andover u o CJ o I'~ "-J SUBCOMMITTEE FOR ORDINANCE REVIEW CHARGE The Andover Planning and Zoning Commission hereby charges the Subcommittee for Ordinance Review with the following responsibilities in connection with reviewing, rewriting and otherwise recommending changing the ordinances of the City of Andover. The Subcommittee shall begin its efforts at revision with Ordinances No.8, 10, l7 and any other ordinance which, in the Committee's determination, should be included in the complete revision of aforementioned ordinances. The Subcommittee Chairman, or his designee, will, at every regular Planning and Zoning Commission meeting, update the full Commission as to its progress. Drafts of all proposed ordinance changes, when approved by the Subcommittee, shall be brought to the full Commission for a full and complete review. -, I' , , J \,~, The Subcommittee's work is advisory only and subject to the review of the full Planning and Zoning Commission, with final approval or denial of any changes the prerogative of the Andover City Council. The Subcommittee will be guided by applicable Minnesota statutes and is hereby authorized to seek necessary legal and engineering advice advice from the Andover City Attorney and engineering firm in the redrafting of said ordinances. The Subcommittee, if it shall find it necessary to expend monies for assistance, shall forward a written request for said money to the full Commission and that request shall outline the scope of work and cost. If consultants are needed, a proposal from the consulting firm shall also be included. If the Commission deems the request appropriate, the Commission shall request funding fram the Andover Ci ty Counci 1. The Subcommittee may contact any and all persons they see fit in the performance of their duty and shall have the assistance of the Clerk of the Planning and Zoning Commission to assist them in gathering data and other such activities. The Subcommittee is authorized to hold meetings at time and places as they see fit, but all such meetings shall be noted with the Clerk, posted as public meetings and open to the general public at all times in accordance with State statutes. :_) C) o () ~ u - \ ( . , '--/ o () Subcommittee for Ordinance Review Charge, continued Page two The Subcommittee shall report back to the Andover Planning and Zoning Commission with their recommendations on changes to Ordinances No.8, 10, l7 and others the Subcommittee has seen fit to have reviewed by no later than May 1, 1977. Following resolution of the above-mentioned ordinances, the Subcommittee shall review all other ordinances of the City and report back to the full Commission no later than September 1, 1977 with their recommendations. Following the completion of these responsibilities, the Subcommittee shall be dissolved. This charge may be amended, if needed, by action of a majority vote of the full Commission at any regular Planning and Zoning Commission meeting.
