Comm. #12-76-5 Lot Split Ordinance Discussion o Publish on January 7, 1977 o o o o o o 0 CITY of ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING January 11, 1977 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Acting Chairman Larry Retzlaff on January 11, 1977, at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Walter Bruns, James Elling, John Johanson (arrived at 7:40), and Ralph Kishel Commissioners Absent: Don Jacobson and Robert McClure Also Present: Andover Councilman Ken Orttel and others Minutes Motion by Commissioner Kishe1, seconded by Commissioner Retzlaff, to approve the Minutes of December 14, 1976. Vote on motion: yes- Commissioner Retzlaff, Commissioner Kishel; present - Commissioner Elling, Commissioner Bruns. Motion carried. Barnes' Rolling Oaks 2nd Addition Preliminary Plat (Comm. #4-76-8) Faye Barnes, owner, was present and gave copies of his plat to the new Planning and Zoning Commission members. The Commission received a letter (copy attached) from T.K.D.A. dated December 6, 1976 which explained the Coon Creek Watershed Board's recommendations on the plat. The Plat was referred back to the Commission by the City Council on their meeting of December 7, 1976. Mr. Barnes has had his Engineer prepare the information requested by the Coon Creek Watershed Board and the plat will have to be resubmitted and reviewed by them before the Planning Commission can take any further action. Motion by Commissioner Kishe1, seconded by Commissioner Bruns, to continue discussion on the Barnes' Plat until February 8, the first meeting in February. Motion carried unanimously. Great Oak Estates Sketch Plan (Comm. #1-77-1) LeRoy Winner, surveyor, and Richard Hoggatt, one of the owners, were present to discuss the proposed plat. The property is located on Eidelweiss Street, North of Bunker Lake Road, and between Crooked Lake School and Coon Creek. There are 2 existing houses and 5 proposed new lots in the plat. City sewer has been installed and the street is class 5. o o o o o Planning and Zoning Commission Meeting Minutes - January 11, 1977 Page 2 The Commission, Mr. Hoggatt, and Mr. Winner discussed: the zoning of the land; whether the smaller lots of Block 1 would allow houses compatible with the 2 existing houses on Block 2; money instead of land for park purposes; Eidelweiss Street - who owns it, paperwork required if the City doesn't own it; if paving, curb & gutter, storm sewer, etc., are to be installed or a temporary or permanent cul-de-sac is necessary; Ordinance lO - Sections 9.03 and lO.08 in particular; the size of lot 1, block 1. The Commission advised Mr. Hoggatt and Mr. Winner to check with an Attorney and the Engineer regarding Eidelweiss Street - ownership and improvements, or upgrading, necessary before proceeding with the preliminary plat. Rosella Sonsteby Garage Moving Permit (Comm. #1-77-2) o Mrs. Sonsteby showed the Commission a picture of the 40 x 50 garage she would like to have moved from the Ghostley property, one mile to the North, to her property at 4100 - 7th Avenue. Ernst Movers will do the moving of the structure and would move it across a field and then only ~ mile on 7th Avenue. The Commission attempted to determine exactly where the garage would be located. It was decided that they would like to see the building and more information regarding location before a decision is made. Motion by Commissioner Kishel, seconded by Commissioner Bruns, that the garage moving permit be continued until the next meeting (January 25, 1977). Motion carried unanimously. Zoning of Ramsey Annexation Discussion (Comm. #12-76-4) Commissioner Retzlaff explained that the City Council, at their December 7, 1976 meeting, has referred this to the Commission for discussion. When the land was annexed, it was designated R-1 Zoning. Now a number of 1-acre lots have been built on, resulting in non-conforming use. The Commission discussed the fact that the Moratorium Ordinance states "no rezoning" until July 1, 1977; and that Ordinance /f8, the zoning Ordinance, will be reviewed and revised soon. o Motion by Commissioner Bruns, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommends to the City Council that the property secured through annexation from the City of Ramsey be retained as R-1 Zoning for the following reasons: 1) we will soon be reviewing all the land uses and have a study made for future land use planning and, at that time, can look at the zoning of this property; 2) no improvements (such as sewer, water, etc.) in the area that would necessitate changing the zoning; 3) the Moratorium Ordinance (#36) currently in effect. Motion carried unanimously. o o o o (\ U o o Planning and Zoning Commission Meeting Minutes - January 11, 1977 Page 3 Lot Split Ordinance Discussion (Comm. #12-76-5) Commissioner Retzlaff explained the reason for the Ordinance Request being placed on the Agenda. With all the sewer, storm sewer, and street improvements recently and the high cost of assessments, a number of property owners are interested in splitting or dividing their property. Rather than go through the platting procedure, which could be a financial hardship, it has been suggested that a new Ordinance be adopted regarding lot splitting. It was mentioned that there should be a limit on the number of lots that could be split in this manner and also the minimum acreage. Some Cities use the Variance as the instrument for splitting lots. The book "Local and Regional Planning by Gunnar Isberg", that former Commission members have received, has information relating to waiving platting requirements. Discussed variances, how the updating and revising of the ordinances will be done, and who will do the revising. The Commission reviewed the "lot split" portion of the Coon Rapids Ordinance and requested examples of similar ordinances being used by other Cities. They also requested that the new members of the Commission be provided with a copy of Mr. Isberg's book. The Lot Split Ordinance discussion will be placed on the next Agenda for further review and more information. Ad;ournment Motion by Commissioner Johanson, seconded by Commissioner Elling, to adjourn. Since the Planning and Zoning Commission recommendation of approval on November 9, 1976, the City has received correspondence from the Coon Creek Watershed Board requiring the following: 1) 100 foot drainage easement, 50 feet on either side of the center- line of County Ditch No. 20. 2) Calculations and design for restricting the amount of run-off to that which would occur without any development based on a 100 year storm. We have also completed the final alignment of Prairie Road (MSAH #101) through this area. The final alignment varies considerably with that shown on the preliminary plat. The preliminary plat must be revised to conform with our final alignment. The Anoka County Highway Department has installed a new 36" CMP culvert under Andover Blvd. on County Ditch No. 20. The Coon Creek Watershed o o o o o u o .." ," "\ Andover City Council December 6, 1976 Page Two Board will no longer allow an increase in runoff from the plat into the ditch. The developer, therefore, cannot be required to increase the size of this culvert if the culvert is found to be too small. We will know what size culvert is necessary after the Comprehensive Storm Drainage plan is completed for the area. A t that time a replacement program for all inadequate culverts should be developed. As a result of the new information required, revised street profiles and drainage structures will be necessary in conjunction with an engineering study of present and future surface water runoff. We recommend the pre- liminary plat be referred to the Planning and Zoning Commission for the above revisions so the final stages of the preliminary plat can be completed.
