Comm. #8-78-1 Roger Erickson Variance o o o o o o 0 ~ 01 ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING August 8, 1978 MINUTE S The Regular Meeting of the Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on August 8, 1978 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota Commissioners Present: d'Arcy Bosell, Walter Dick, Don Jacobson Commissioners Absent: Ralph Kishel and Jeannine Pyron Minutes of July 25, 1978 Motion by Commissioner Bosell, seconded by Commissioner Dick, to approve the Minutes. Vote on motion: yes - Chairman Retzlaff, Commissioner Bosell, Commissioner Dick; present - Commissioner Jacobson. Motion carried. Pine Hills Preliminary Plat Continued Public Hearing (Comm. #5-78-6) The Commission had received a revised plat and a letter of review from T.K.D.A. dated 8-7-78. The Commission members and Tom O'Malley, surveyor from Caine and O'Malley, discussed the various items that the Engineer had mentioned that should be changed or corrected. On the future resubidvision plan, the frontage on the lots on the cul-de-sac don't look like they will meet the minimum requirement - Mr. O'Malley will recheck this. The lots along l6lst will front on the interior streets. Discussed having a variance on the definition of "lot frontage" for the lots on l6lst. There should be a temporary cul-de-sac on the South end of Orchid Street. The Commission considered Lot 1, Block 3 as a corner lot that backs on Round Lake Boulevard. The l59th cul-de-sac is 640' long. Mr. O'Malley said that they could make it shorter but thought it would make a better street extension in the future as shown. It was suggested he contact Northern Natural Gas Co. to get a letter of approval on the plat. He shows 4.48 acres of park. The Park and Recreation Commission had previously recommended land and money dedication. Since the property has been redrawn since that recommendation, they will go back to the Park and Recreation Commission for further discussion. Chairman Retzlaff called for public input - no one responded. Motion by Commissioner Jacobson, seconded by Commissioner Bosell, to continue the public hearing. Motion carried unanimously. This will be on the Agenda on August 22, 1978. o o o o c=> Planning and Zoning Commission Meeting Minutes - August 8, 1978 Page 2 Registered Land Survey - James Stack Property in Section 18 (Comm. #8-78-2) Tom O'Malley presented his proposal for the Stack property. There are some jogs in the Section as a result of the land he has previously sold out. The land is registered and he has already tried filing one legal and has been turned down by the Registrar of Titles because the legal now is '~ery"long. They try to avoid the long legals so they force developers to use a Registered Land Survey to subdivide registered property. In this case there are 6 proposed tracts. Four of them are larger than 5 acres. Two of them are smaller than 5 acres but they are intended to be joined with existing adjoining parcels. There would be 3 new building sites - Tracts B, E, and F. State Law provides for a means of subdividing property by filing a map called a Registered Land Survey. These tracts are then all described by reference to the plat filed with the Registrar of Titles. o Discussed Ordinance 10, Section 12. The Commission had no prior information on this item and were unfamiliar with Registered Land Surveys. Chairman Retzlaff said that he would be contacting the City Attorney and City Engineer on this to get further information. This will be on the next Planning and Zoning Commission Agenda. Pond View Preliminary Plat Cont'd Public Hearing (Comm. #2-78-5) James Conroy Rezoning (Pond View) Cont'd Public Hearing (Comm. #6-78-9) Motion by Commissioner Bosell, seconded by Chairman Retzlaff, to cont.inue the preliminary plat and rezoning. Motion carried unanimously. Ordinance #37 Amendment (Comm. #5-78-8) An opinion from the City Attorney has not been received. This will be continued to the next meeting. Discussion of Ordinances 8 and 10 Revision (Comm. #6-77-6) Chairman Retzlaff will discuss this with the City Council. The Commission briefly discussed the moratorium ordinance which will soon be expiring and perhaps rezoning the R-2 and R-3 areas of the RURAL portion of the City. Dean Lutterman Revised Sketch Plan (Comm. #5-78-4) o Mr. Lutterman had brought in copies of his sketch which were mailed to the Commission. Since that time he has again revised the sketch. He has eliminated one lot. Lot 2 in the SE corner will be bigger. The cul-de-sac to the South is about 400'. He mentioned giving money in lieu of land for park dedication. He was advised that the revised sketch looks good and to proceed with the preliminary plat. o o f , ~-) o o Planning and Zoning Commission Meeting Minutes - August 8, 1978 Page 3 Roger Erickson Variance (Comm. #8-78-1) Mr. Erickson would like to apply for a building permit to construct a garage but he doesn't have frontage on a road. The building permit for his house was issued in June of 1971. The property is located off of Nightingale Street in Section 22. The parcel was recorded in July, 1971. Discussed Ordinance 8, Section 4.04 (C). Mentioned constructing a road that meets current City standards and the cost involved. The property should never have been subdivided as it is. and the house should never have been allowed to be built. The driveway they use is an easement. Chairman Retzlaff will contact the City Attorney and this item will be on the next Planning and Zoning Commission Agenda. James Fields Discussion (Comm. #8-78-3) :~'j Mr. Fields is selling a house on Round Lake Boulevard and was planning '-J to divide a large parcel of land and sell 3 acres along with the house. The 3 acres would have 138' of frontage on Round Lake Boulevard. The house has been there for 35 years. It was recommended that Mr. Fields convey 5 acres and apply for a variance on the 300' ordinance requirement for frontage.
