AGENDA Johnson's Field Preliminary Plat Continued Public Hearing Pond View Preliminary Plat Continued Public Hearing James Conroy Rezoning (Pond View) Continued Public Hearing Pine Hills Addition Preliminary Plat Continued Public Hearing Donald Janssen Variance Continued Derril Burger Sketch Plan Ordinance #37 Amendment (Amending Mandatory Septic System Pumping Section) Discussion of Ordinances 8 and 10 Revision For publication on July 21, 1978 o o o o o o 0 ~ 01 ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING July 25, 1978 MINUTES The Regular Meeting of the Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on July 25, 1978 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota Commissioners Present: d'Arcy Bosell, Walter Dick, Jeannine Pyron Commissioner Absent: Ralph Kishel Also Present: Chuck Wetzler, Engineer from T.K,D.A., and others Minutes of July 11, 1978 Motion by Commissioner Dick, seconded by Commissioner Pyron, that the Minutes be accepted as read and listed. Motion carried unanimously. Johnson's Field Preliminary Plat Continued Public Hearing (Comm. #4-78-6) Engineer Wetzler discussed with the Commission his letter of 7-21-78 reviewing the revised plat. The new plat shows adequate storm water storage for anticipated runoff in NW corner of plat. Discussed park dedication - Linda Johnson said she would still prefer to donate cash in lieu of land. In discussing a possible septic system for Lots 6 and 7, Block 3, James Kurth (surveyor) said that they may develop these lots last and, also, in a restudy of the flood plain, the elevations may come down lower. They could fill the lots even though they are in a flood plain area. HUD has been requested to do a further flood plain study. Chairman Retzlaff asked for public input - no one responded. Discussed the temporary cul-de-sac shown in Lund's Round Lake Estates on Guarani Street. It is shown being about 25' North of l47th Avenue. They mentioned several recent plats where roads had to be connected with a similar situation. Discussed the possible creating of double frontage lots in Lund's Round Lake Estates in Block 3 and 4. After looking at Lund's preliminary plat resubdivision plan, it shows lots facing the l47th Avenue in Johnson's Field as a possible plan. Discussed Ordinance 10, Section 9.06 F. Motion by Commissioner Bosell, seconded by Commissioner Pyron, to close the public hearing section of the meeting. Motion carried unanimously. o o o o o Planning and Zoning Commission Meeting Minutes - July 25, 1978 Page 2 o Motion by Commissioner Bosell, seconded by Commissioner Pyron, to recommend to the City Council approval of the Johnson's Field Preliminary Plat (located at: the S. 66' of the NW~ of the NE~ of Sec. 30, T. 32, R. 24, Anoka County, MN together with: the SW~ of the NE~ of Sec. 30, T. 32, R. 24, Anoka County, MN except that part platted as Dehn's Addition and except parcels number 1210, 1350, 1365, 1370, 1380, and 1400 as described and filed in the County Auditor's Office.) for the following reasons: 1) it is compatible with the Comprehensive Development Plan of the City. 2) it conforms with the design standards established by Ordinance 10. 3) there was a public hearing held with both in favor and against responses being received; especially dealing with the handling of storm water. 4) there has been a recommendation from the Park and Recreation Commission for the acceptance of park land (Lots 6 and 7, Block 3) and money in lieu of land. However, the developer wishes to donate money to the City and chooses to exercise that right. 5) the plat has been reviewed by the City Engineer and found to be satisfactory under the City's Engineering standards. It should further be considered that the adjacent land (Lund's Round Lake Estates) in the creation of this plat, becomes the holder of double frontage lots. However, the future subdivision plans of that development look for a road to be developed in the location of l47th Avenue and, therefore, would not create difficulty within the City (see Ordinance 10, Section 9.06F). Amendment by Chairman Retzlaff, seconded by Commissioner Bosell, that the Planning and Zoning Commission recommends that Guarani Street be extended to connect with Guarani Street in Lund's Round Lake Estates and said road be constructed. Amendment carried unanimously. Amendment by Chairman Retzlaff, seconded by Commissioner Pyron, to amend item #1 and #2 of the main motion to read: 1) the plat is compatible with the intent of the Comprehensive Development Plan. 2) the plat meets the provisions of Ordinances 8 and 10. Vote: yes - Chairman Retzlaff, Commissioner Dick, Commissioner Pyron; present - Commissioner Bosell. Amendment carried. Vote on motion: carried unanimously. This will be on the City Council Agenda on August 15, 1978. Pond View Preliminary Plat Cont'd Public Hearing (Comm. #2-78-5) James Conroy Rezoning (Pond View) Cont'd Public Hearing (Comm. #6-78-9) o No one present - Motion by Commissioner Bosell, seconded by Commissioner Dick, to continue the preliminary plat and rezoning. Motion carried unanimously. o o o u u u o Planning and Zoning Commission Meeting Minutes - July 25, 1978 Page 3 Donald Janssen Variance Continued (Comm. #7-78-2) Chairman Retzlaff had talked to City Attorney Ed Babcock about possible legal action that could be taken in the case and was advised that there was no legal action to be taken on this small conveyance. He thought that legal action would be inappropriate and would not be worth the City's time or expense to pursue it. Dennis Johnson was present to answer questions about the variance requested. He lives on Lot 9. Mr. Janssen lived on Lot 7 but also owned Lot 8 (Cedar Crest Estates) a designated unbuildable lot. Mr. Janssen sold the house on Lot 7 and the new buyers can't get a clear title. Mr. Johnson told of their misunderstanding about the location of the lot lines. Discussed past recommendation on conveying land by variance to fix building mistakes. Discussed Ordinance 10, Section 14.02 and, also, altering a plat (Cedar Crest Estates). The septic system would be about 6' from the lot line with this variance. Motion by Commissioner Bosell, seconded by Commissioner Pyron, to make a recommendation to the City Council for approval of the Donald H. Janssen Variance request on Lot 8, Block 3, Cedar Crest Estates to move the rear lot West point 13.15' East, not moving front North point, under Ordinance 10, Section 14.02 for the following reasons: 1) at the time of the conveyance of this property in 1974 there was an assumption made by all parties as to the property line and, in so assuming, allowed the drainage field for Lot 9 to be located on Lot 8. The approval of this variance would place the entire drainage system in the hands of the property owner of Lot 9 and, therefore, would clear title to the property for further conveyance. 2) a hardship would be created by not allowing this variance to be granted. 3) it will not adversely affect the existing or potential use of the adjacent land, since Lot 8 of this subdivision is an unbuildable lot of record. Motion carried unanimously. This will be on the City Council Agenda on August 15, 1978. Pine Hills Addition Preliminary Plat Continued Public Hearing (Comm. #5-78-6) Tom O'Malley, surveyor from Caine & O'Malley, presented new drawings of the proposed preliminary plat to the Commission and Engineer Wetzler. All the lots are now 2~ acres or more. All of the lots facing l6lst are 326' wide, otherwise they all have 345' or more. Chairman Retzlaff called for public input - no one responded. o o o o (.~ o o Planning and Zoning Commission Meeting Minutes - July 25, 1978 Page 4 Those present thought this plat looked good but would like further time to review it. Motion by Commissioner Bosell, seconded by Commissioner Pyron, to continue the public hearing to August 8th. Motion carried unanimously. Derril Burger Sketch Plan (Comm. #7-78-3) Mr. Burger's plat shows about 123 acres, 36 lots, 12.3 acres of park land and is located in Sections 18 and 19, West of 7th Avenue. The R-2 zoning of this property would normally allow I-acre lots but, because of the current moratorium ordinance, the lots are 2~-acres or more. Since the property fronts on the Rum River, The Minnesota Department of Natural Resources proposed '~ild, Scenic and Recreational Rivers Act" will have to be considered. The City hasn't adopted or approved it yet however. He was concerned about getting partially through the platting process and having the DNR's proposed management plan adopted requiring minimum lot size of 4 acres. The Commission advised him that they must review the plat according to existing ordinances. There is a problem with some of the lot frontages that don't meet the minimum requirements. He was advised to do some work on the lot widths and then proceed with the preliminary plat. Harvey Kadlec Revised Sketch Plan (Comm. #5-78-3) Mr. Kadlec showed the Commission his new drawing showing 13 lots with R-l zoning in Section 9, between Round Lake Boulevard and White Oaks Country Estates. Some of the lots are less than 2~ acres. There is a problem with the lots on the cul-de-sac regarding frontage. In order to save some trees he put a curve in the road which is the reason for the slight problem with lot sizes and frontages. Mr. Kadlec was advised that the plat looks good. Ordinance #37 Amendment (Comm. #5-78-8) Chairman Retzlaff had asked Attorney Babcock for an proposed amendment and no reply has been received. the next Planning and Zoning Commission agenda. op~n~on on the This will be on Discussion of Ordinances 8 and 10 Revision (Comm. #6-77-6) Chairman Retzlaff stated that the Ordinance revision and the Comprehensive Plan update could be done by Midwest Planning for about $8,200. The Commission had agreed that they didn't have the time to do the vast amount of work necessary. o o C) o (- ') l..,j o o Planning and Zoning Commission Meeting Minutes - July 25, 1978 Page 5 Motion by Chairman Retzlaff, seconded by Commissioner Dick, that the Planning and Zoning Commission recommend to the City Council joining in a contract with the firm of Midwest Planning for the purpose of updating Andover's Comprehensive Development Plan, in accordance with the Metropolitan Council's guidelines, for a sum of money not to exceed $9,000.
