Comm. #6-78-9 For publication on June 23, 1978 o James Conroy Rezoning (Pond View) Public Hearing o o o o o 0 ~ 01 ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING June 27, 1978 MINUTES The Regular Meeting of the Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on June 27, 1978 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota. Commissioners Present: d'Arcy Bosell, Walter Dick, Ralph Kishel, and Jeannine Pyron Also Present: Chuck Wetzler, Engineer from T.K.D.A., and others Minutes Motion by Commissioner Bosell, seconded by Commissioner Kishel, to approve the June 13, 1978 meeting Minutes. Motion carried unanimously. Johnson's Field Preliminary Plat Continued Public Hearing (Comm. #4-78-6) Present for discussion on this plat: Linda Johnson - owner, James Kurth - Surveyor, and many interested residents of Dehn's Addition. Engineer Wetzler said that he and Mr. Kurth had talked several times about the drainage problems in this plat. The drainage on Guarani Street should drain into the ponding area at the South end of the plat. A 45' drainage easement has been provided. The other concern was the ponding area in the NW corner. It is a matter of concern that there is enough storage area for the water coming off of County Road 7 and from this plat. They were asked how to insure that with a great deal of rain it isn't going to flood out the home with the walkout basement that is adjacent. Mr. Kurth said they show an elevation of 873.4 as his lowest basement elevation. The lowest spot in the water storage area is 867.5 but that is where the road (147th) will be built. 870 is the lowest point in the ponding area now. Engineer Wetzler said he would contact the County Highway Department to see how County Road 7 is draining in there. He will also check to determine how much of this plat will be draining to this ponding area to come up with some assurance that we aren't going to flood that basement out. They also discussed the drainage in the SE corner of the plat. Commissioner Dick, "If you get a 1" rain, you are going to have 792,000 gallons of water running through there. 1" of rain per acre is 126 ton water, 36,000 gallons per acre. 22 acres of Johnson's Field drains toward l45th and Guarani. This, in effect, means 36,000 gallons times 22 is 792,000 gallons of water which will be flowing in a SE direction. Now this assumes that all of the water would be running off, you cut that in half assuming that some of it goes down. Is that drainage ditch going to take care of it?" o o o o ~ Planning and Zoning Commission Meeting Minutes - June 27, 1978 Page 2 Mr. Kurth explained that the water comes down Guarani and they will turn it into Lot 7, Block 3. Instead of the runoff onto l45th, it will be run North and into the ponding area on Lot 7. After looking at the soil information, Engineer Wetzler said the only place that shows peat is Lot 7, Block 3 and that lot is also wet now. Otherwise the soil borings don't indicate any problem. Discussed the ability of Lot 7 to hold the runoff from this plat. The Anoka County Soils and Wetlands map shows 178 acres of wetland in this area. There are a series of ditches and wetlands between this plat and Round Lake. It was explained that all the runoff will be contained in the plat, the other low areas won't be affected. Concern was expressed about the septic systems in Dehn's Addition and the City park land being flooded. The residents were informed that the pond on Lot 7 would just get a little deeper, they would actually get less runoff into their area. Discussed the width of l45th and whether it is adequate to handle additional traffic. Chairman Retzlaff asked for public input. o Bob Dehn, of l44th Lane, informed the Commission and Engineer of the dredging, etc., that was done in the past. Suggested the Engineer check into this. He was concerned that all of the water might be drained out of their pond. Bob Dehn, Jr., of l44th Lane, expressed his concern to the Commission of the runoff and where it is going from Johnson's Field Plat. The Park Commission hasn't made a recommendation on this property yet. It will be on their Agenda on July 6, 1978. Linda Johnson had called the City of Anoka regarding the proposed park in Anoka near the High School. She was told there would be baseball fields, golf, riding, trails, etc. Discussed Ordinance 10, Section 9.04 (B) and 9.05; Ordinance 8 Section 3.33. Items to be taken care of before approval can be given: flood plain must be designated on the plat; the Park and Recreation Commission's recommendation; the evaluation of the water storage on l47th; and the City Engineers review of the provisions of Ordinance 10 in Section 9.04 and 9.05. Motion by Commissioner Bosell, seconded by Commissioner Kishel, to continue the Johnson's Field Preliminary Plat Continued Public Hearing to the next regularly scheduled meeting in July (the 11th). o Motion carried unanimously. (J o o o o o o Planning and Zoning Commission Meeting Minutes - June 27, 1978 Page 3 John Sonterre Variance Continued (Comm. #6-78-3) The Sonterre's weren't at the meeting so this will be continued until the July 11th meeting. Clifford Chapman Variance Continued (Comm. #6-78-4) This item had been continued to allow time for some research into the past history of these lots and the zoning. The Commission read the minutes from the Planning and Zoning Commission and the Town Board. Chairman Retzlaff said that according to our City Attorney that the past actions still stand - that certain lots are buildable and certain lots are unbuildable. Mr. Chapman said when he divided the lots they were legal on December 31, 1970. The Commission reminded Mr. Chapman that the lots became "too small" when Ordinance 8 was adopted on January 1, 1971. The Town Government attempted to remedy the situation for him in 1972 by rezoning the property and allowing him to build on every other lot. Discussed the 39,000 or 40,000 square foot septic system requirement in Ordinance 8 for a R-3 lot. The one lot is designated by the Town Board as unbuildable. Discussed Ordinance lO, section 9.06; Ordinance 8, Section 4.04B. Motion by Commissioner Kishel, seconded by Commissioner Dick, that the City of Andover Planning and Zoning Commission recommend to the City Council denial of the Clifford Chapman Variance on Plat 65915, Parcel 5788 wherein he asks to take 23' from Lot L, which is a buildable lot, and join it to Lot M, which according to a motion passed by the Town Board of Grow Township on November 28, 1972 is not buildable. The reason for the denial being: 1) that Lot M would still not meet the provisions of Section 4.04 of Ordinance 8B, i.e. 60% of the required 2~ acre lot. 2) that action taken by the Town Board was reasonable in rezoning the area to R-3 - under these stipulations that Lot M was not buildable. 3) the variance is not consistent with the area by reason that every other lot is to be built on. 4) the granting of such a variance would be inconsistent with the Comprehensive Development Plan of the City. Vote on motion: yes - Commissioner Bosell, Commissioner Kishel, Chairman Retzlaff, Commissioner Dick; present - Commissioner Pyron. Motion carried. This will be on the City Council Agenda on July 18th. o o o o o Planning and Zoning Commission Meeting Minutes - June 27, 1978 Page 4 Boyswood Sketch Plan (Comm. #6-78-5) Mr. Gloyd Boyum presented a proposed plat in Section 14, zoned R-l with 57 acres and 15 lots. The Commission advised him of the following: the width of the streets should be 66'; corner lots should be 15' wider; cul-de-sac maximum length is 500'; block length is 1320' maximum; the exceptions are not allowed as shown. Mr. Boyum was asked to revise the drawing and come back for another review. Programmed Land Special Use Permit Public Hearing (Comm. #6-78-6) o Glenn Shaw, of Programmed Land, and William Smith, 18435 Rum River Boulevard, were present to explain their request. They are planning to mine, remove and sell peat from a portion of the Ghostley Farm, located North of Round Lake. The proposed access road onto County Road 7 may be used as a future street. They discussed Ordinance 8, Section 4.24 - they do not have the final contours because they are not sure of just how deep the peat goes. One test hole was dug about 10' deep and they hadn't reached the bottom of the peat. It is approximately 2' above ground water. Chairman Retzlaff asked for public input - no one responded. Motion by Commissioner Kishel, seconded by Commissioner Bosell, to close the public hearing. Motion carried unanimously. Motion by Commissioner Bosell, seconded by Commissioner Pyron, that the Planning and Zoning Commission recommend to the City Council approval of the application for a Special Use Permit for Programmed Land, Inc. on the property described as: W 3/4 SW~ NW~ Section 20, Township 32, Range 24 and N~ NW~ SW~ Section 20, Township 32, Range 24 for mining, removal and sale of peat from the interior of said property under Ordinance 8, Section 4.24 for the following reasons: 1) application was made; 2) a proposed plan for a finished grade was submitted; 3) the removal route was designated; 4) this operation would not be detrimental to the health, safety or public welfare of the community; 5) it would not be in disagreement with the Comprehensive Development Plan; 6) there was a public hearing held and no opposition was noted; and 7) it meets the criteria of Ordinance 8, Section 5.03 (B). Motion carried unanimously. This will be on the City Council Agenda on July 18, 1978. c=) G. M. Investment Proposed Road (Comm. #6-78-7) Gilbert Menkveld appeared at the meeting to seek favorable opinions from the Planning and Zoning Commission regarding a parcel of land in Section 15 that he wishes to build a road on to provide access to a 40 acre parcel without road frontage. o o o o o Planning and Zoning Commission Meeting Minutes - June 27, 1978 Page 5 The Commission discussed maximum length of cul-de-sac of 500' and this is ~ of a mile long. This would be in keeping with the Comprehensive Plan because there would be one house on the 40-acre parcel. Discussed the number of parcels that would become buildable because of the road being built. None of the Commission members objected to this proposal so Chairman Retzlaff will go before the City Council stating that this Commission would be favorable to the proposed road. This will be on the City Council Agenda on July 18, 1978. Ordinance #37 - Septic System Maintenance - Proposed Amendment (Comm. #5-78-8) Chairman Retzlaff informed the Commission members of his plan to amend the '~andatory Maintenance" portion of the ordinance. He suggested deleting the part that states the system must be pumped once every 4 years. The Commission and Richard Schneider, former Andover Mayor and concerned Andover resident, agreed that an amendment such as that ~ would be satisfactory. Chairman Retzlaff will contact City Attorney Ed Babcock to ask him to draft the amendment as proposed. Dehn Variance (Comm. #6-78-8) This item was deleted from the agenda. Discussion of Ordinances 8 and 10 Revision (Comm. #6-77-6) This will be continued until the Planning and Zoning Commission agenda on July 11, 1978. Pond View Preliminary Plat Public Hearing (Comm. #2-78-5) Chairman Retzlaff called the public hearing to order. The escrow deposit was not paid by Mr. Conroy, the developer of the plat. The Commission discussed proper procedure to follow. It was agreed to go ahead with the discussion if Mr. Conroy paid the money at the office in the morning. Gred duMonceaux of Bordner Consultants presented the drawings of the proposed rezoning site plan to the Commission. After a brief discussion on procedures to follow, Chairman Retzlaff opened the public hearing on the rezoning also. o James Conroy Rezoning (Pond View) Public Hearing (Comm. #6-78-9) Mr. duMonceaux showed the Commission their proposal. to develop a small community or neighborhood business the people near by. They are attempting center to serve o n '- () '--- o o Planning and Zoning Commission Meeting Minutes - June 27, 1978 Page 6 They show one access onto l39th Avenue and one access on Crosstown Boulevard. The service access to the center would be on the pond side of the property. They are thinking about a small supermarket, banking facilities, and perhaps a hardware store, etc. The Commission informed Mr. duMonceaux of the recent action by the City approving a small convenience store to be constructed at the corner of Crosstown and Bunker Lake Boulevard. He was not aware of this development or the proposed hardware store on Round Lake Boulevard and Bunker. They pointed out the City's Comprehensive Plan statement regarding commercial development within a l~mile radius. (Commissioner Pyron left the meeting) They discussed Ordinance 8 Section 4.17 regarding the requirement for a market feasibility study to be submitted. (Commissioner Dick left the meeting.) Lou Rossburg, 2407 - l39th Avenue, questioned what will be going into this development. He was concerned about how the City would regulate whether a disco, massage parlor or some type of business would be allowed to be constructed and operate in this residential area. o Al Schrupp, 2322 - l39th, said that he was in favor of having some shopping closer to our community. He thought it would enhance the neighborhood if it is done right. Discussed other commercial development in the area. The adjacent property owners questioned whether this would bring on premature extension of City water. It was suggested that the developer have a market feasible study done and brought in so the Commission members could have a chan~e to review it before the meeting. Motion by Commissioner Kishel, seconded by Commissioner Bosell, to continue the two public hearings to July 11, 1978. Vote on motion: yes - Chairman Retzlaff, Commissioner Kishel, Commissioner Bosell. Motion carried unanimously. Valley View Estates 2nd Addition Engineer Wetzler presented a letter and explained to the Commission that bids had gone out for construction of the roads in this plat and he wanted the City to okay them before the bids are let. The Commissioners felt that these were engineering types of problems and he was the best person to take care of them. The Commission referred the 6-27-78 letter of Mr. Wetzler.to the City Council for approval. o Ad iournment Motion by Commissioner Kishel, seconded by Commissioner Bosell, to adjourn.
