Commissioners Present: d'Arcy Bosell, Walter Dick, James Elling, Ralph Kishel, Jeannine Pyron Commissioner Absent: George Hamilton Also Present: Dewey Kasma, City Engineer - T.K.D.A., and others Minutes Motion by Commissioner Kishel, seconded by Commissioner Elling, to approve the April 25, 1978 Minutes. Motion carried unanimously. James Refrigeration Variance (Comm. #5-78-1) Chairman Retzlaff has asked Attorney William G. Hawkins for clarification on the NB zoning lot size requirement. Attorney Hawkins stated that 2 acres is required for a business in the NB district. Charlie James, James Refrigeration, stated, 'We are requesting a variance from Ordinance 8 Section 6.02. My interpretation is that the Ordinance was written previous to the time that sewer was available and we feel that this lot, 1.05 acres approximately (Plat 65933, Parcel 1610) is an adequate size for the business we are planning." He was asked what size lots were used in other cities for convenience stores. Ham Lake was about 140 x 200 unserviced; Wyoming was 150 x 100 with all utilities; Lindstrom is 3/4 of an acre with sewer and water; Buffalo is 1.1 acre with sewer and water; Mora is 7/8 of an acre with all utilities. Discussed Ordinance 8, the Variance section, that states a variance may be granted if a hardship exists that has to do with the characteristics of the land and not the property owner. This land does not have any hardship characteristics. Mr. James said the hardship for him is that the owners of the other 3 parcels want such a large amount of money for that land that it isn't economically feasible to buy it. Discussed whether it is feasible to require 2 acres in the area where City sewer is available to operate a business. Perhaps the intent is that the NB 2-acre size requirement is for the initial zoning and then a cluster of businesses can be allowed in that 2-acre NB area. o o o o o Planning and Zoning Commission Meeting Minutes - May 9, 1978 Page 2 The original sketch that was submitted is being revised. Mr. James said he has instructed their architect to provide a redwood fence across the rear of the parcel and has increased the landscaped area off the County Road from 15 to 20 feet. Discussed the driveway off Bunker that is 75' into the turn lane. Mr. Redepenning, of the Anoka County Highway Department, approved the sketch as submitted. Talked about alternatives for ingress and egress to avoid traffic hazards. The Commission felt it would be better to shift the driveway to the East. There is one sewer stub on Parcel #1610. Again discussed pages 51, 52 and 53 of the Comprehensive Plan. Mr. James said, "I think the 2-acre thing has more applicability in regard to zoning, in that by setting the minimum lot size you avoid spot zoning." Motion by Commissioner Elling, seconded by Commissioner Bosell, to continue to the next meeting to allow time to revise the sketch showing new driveway approaches, setbacks and the fence. Vote on motion: yes - Commissioner Bosell, Commissioner Dick, Commissioner Elling, Commissioner Pyron; no - Commissioner Kishel, Chairman Retzlaff. Motion carried. o James Refrigeration Special Use Permit Continued Public Hearing (Comm. #4-78-2) Chairman Retzlaff stated that it is his intention to continue the public hearing on the Special Use Permit until there has been action on the variance. Motion by Commissioner Elling, seconded by Commissioner Dick, to continue the James Refrigeration Special Use Permit Public Hearing. Motion carried unanimously. Dostaler-Hane Addition Preliminary Plat Public Hearing (Comm. #4-78-5) Chairman Retzlaff called the public hearing to order. James Hane and Iven Dostaler were present. Engineer Kasma reviewed the letter (copy attached) from T.K.D.A. dated 5-5-78 with the Commission. #1 - there are no utilities to be shown on the property; #2 - the intent is to extend from the existing storm sewer serving Meadowood to the intersections of the Dostaler-Hane Addition; #3 - the acreages shown aren't very accurate because they have rounded off the numbers but they will be correct on the final plat; #5 - they will move the existing barn if necessary - the barn is about 22' from the property line. o There is a low area along Lipan Street which will be filled by the developer during the time of street construction. The width of the lots at the setback line should be shown. The future resubdivision should be shown. The Park and Recreation Commission is asking for money in lieu of park land for this development. o o o o o o o Planning and Zoning Commission Meeting Minutes - May 9, 1978 Page 3 There is an extra lot on Kiowa Street compared to the sketch plan that was submitted. The developers were asked to submit a letter from the Anoka County Highway Department stating their approval of the plat. Mr. Hane showed the Commission a revised preliminary plat eliminating the barn and making Lot 7, Block 1 large enough to comply with ordinance frontage requirements. Chairman Retzlaff asked for public input from the people in the audience and no one responded. Motion by Commissioner Kishel, seconded by Commissioner Pyron, to close the public hearing. Motion carried unanimously. Motion by Commissioner Kishel, seconded by Commissioner Pyron, to continue the Dostaler - Hane Addition Preliminary Plat to the next meeting to give the developer time to revise the preliminary plat. Motion carried unanimously. Galen Ferrian Special Use Permit Public Hearing (Comm. #5-78-2) Chairman Retzlaff called the public hearing to order. Mr. Ferrian stated he wants to get a permit (and license) to disassemble cars and sell used auto parts. The name of his business - American Auto Wrecking. When asked if he intended to put up a building he replied, "No, not right at this time". He has not made application for the junkyard license. According to Ordinance 8, Section 3.02 (0000) he has to have a building to sell used auto parts. Mr. Ferrian already has a house on the property. He is putting up cedar fencing across the front and metal fence around the rest. He has had the property for approximately 3 years. On 6-1-76 the City Council denied a Special Use Permit application for Mr. Ferrian on this property. Mr. Ferrian asked what size building he would need. The Commission advised him to contact the Building Inspector about it. Commissioner Pyron stated her opinion, '~nder Section 5.03 A (of Ordinance 8) the permit shall be granted for the particular use and not for a particular person or firm and I am against a Special Use Permit for another disassembly of junk autos - for the sale of used auto parts. I feel that the amount of the same type of business that we have along Bunker Lake Boulevard does, under B (Ordinance 8 - Section 5.03), affect the Comprehensive Plan for the community of Andover. I have two feelings. I have one that is personal to the City of Andover for my desires and hopes for it's future and I have another that I must sit here and conform with City Ordinances and personally I feel you have been sitting on the property for 3 years as fee owner and you have conducted business from there for exactly what you are coming here for or similar to." o o o o o o o Planning and Zoning Commission Meeting Minutes - May 9, 1978 Page 4 Mr. Ferrian said that he has just started putting cars there October. William Battson, 1331 - 45th Avenue NE, Minneapolis, informed the Commission that he owns the junkyard adjacent to Mr. Ferrian. There is 40 acres there that is primarily all junkyards. He questioned why the Commission said Mr. Ferrian had to have a building because he (Mr. Battson) doesn't have to have a building. Mrs. Galen Ferrian, '~e started out a junkyard but for quite a While he hasn't had cars there because he was working a job trying to save money to start a junkyard. He does have 4 children and it's quite a hassle financially to pay for all the fencing and the building. If you give him some lenience he will comply. I think we need junkyards to recycle metal. It helps the consumer to get car parts cheaper. It creates jobs because he hires other people to help him. I don't think it's bad to have all these businesses together because we all help each other. If we don't have the right part for a customer, we send people to the other businesses and the others do the same. It is zoned for junkyards." Motion by Commissioner Bosell, seconded by Commissioner Elling, to close the public hearing. Motion carried unanimously. The Commission reviewed the 5-2-78 City Council motion of approval for a Special Use Permit for Doug Shernell. Motion by Commissioner Bosell, seconded by Commissioner Dick, that the Planning and Zoning Commission recommend to the City Council approval of the Galen Ferrian Special Use Permit (on the following described property: Lot 1, Watt's Garden Acres in Grow Township, except the West 1031' thereof, and except the South 122.5' thereof, according to the plat thereof on file in the Office of the Registrar of Titles of Anoka County, Minnesota; and the East 107' of the West 1031', lying North of the South 82.5' of Lot 1, Watt's Garden Acres in Grow Township, according to the plat thereof on file in the Office of the Registrar of Titles of Anoka County, Minnesota.) for the operation of a used auto reduction yard under Ordinance 8 Section 7.03, Special Uses, for the following reasons: 1) the use would be consistent with the surrounding area; 2) there was a public hearing held and supportive comments were noted; 3) the criteria for Special Use Permits is being met, i.e. fencing; 4) it would not adversely affect the surrounding area. It is further recommended that the following contingencies be completed: 1) that the license be applied for under Ordinance 9; and, 2) that a building be constructed as required under Ordinance 8, Section 3.02, (0000) definition of "Used Auto Parts". o o o o o Planning and Zoning Commission Meeting Minutes - May 9, 1978 Page 5 Vote on motion: yes - Commissioner Dick, Chairman Retzlaff, Commissioner Bosell; no - Commissioner Elling, Commissioner Pyron, Commissioner Kishel. Motion tied. Discussed proper procedure to follow. The Chairman asked for another vote on the motion. Vote: yes - Chairman Retzlaff, Commissioner Bosell, Commissioner Dick, Commissioner Kishel; no - Commissioner Pyron, Commissioner Elling. Motion carried. This will be on the City Council agenda on June 6, 1978. Harvey Kadlec Sketch Plan (Comm. #5-78-3) o Mr. Kadlec presented a sketch plan in Section 9 located between Round Lake Boulevard and White Oaks Country Estates and l68th Lane. The property is zoned R-l and he shows 13, 2~-acre lots with a 50' road. The North ~ of the land is solid oak trees. The South ~ is pines and open land which is the reason for the jog in the road. He lives on Lot 2, Block 3, White Oaks. The length of the street shown is 2210'. Mr. Kadlec will have to rearrange his "T" street to cut down on the length and also the South part can't go anywhere because it would go through a house on l68th if extended. The Commission and Mr. Kadlec discussed alternatives. such as temporary cul-de-sacs, making the property adjacent to White Oaks into 1 lot, etc. He must also change the streets from 50' to 66'. Mr. Kadlec was told he may come back with another sketch plan or proceed with a preliminary plat. Dean Lutterman Sketch Plan (Comm. #5-78-4) Mr. Lutterman's sketch is for approximately 57 acres in the South ~ of Section 4 located East of Round Lake Boulevard. Mr. Lutterman has a problem with street length. The Commission suggested breaking it up with temporary cul-de-sacs. He shows a street jog onto Heather Street which needs correcting. There are a number of lots that don't have adequate street frontage. The zoning is R-l and the lots are 2.5 acres or more in size. He shows 17 lots. He was advised of the requirement for Park dedication. Mr. Lutterman was advised to come back with another sketch plan. Charles Hartfiel Proposed Road Location (Comm. #5-78-5) o Mr. Hartfiel has 40 acres North of Hartfiel's Estates that he wants to divide into 8 5-acre metes and bounds parcels. o o o o " ~ Planning and Zoning Commission Meeting Minutes - May 9, 1978 Page 6 He is coming before the Planning Commission to get approval on the location of the proposed street. The street would go through Lot 7, Block 1 of Hartfiel's Estates. The Commission was concerned about the homeowners on Lot 6 and Lot 8 even though the developer would divide the remaining property on Lot 7 with these lots. The Commission had received a letter from T.K.D.A. dated 5-5-78 recommending, because of the lenth of the street, that the developer relocate the road. Ordinance 10 states the maximum length of a cul-de-sac should be 500' and this street as drawn is approximately 1500'. It was suggested that Bluebird Street be extended into this 40-acre parcel rather than going through Lot 7. A number of alternatives were brought up to avoid going over the 500' maximum cul-de-sac length. Mr. Hartfiel and Tom O'Malley, Caine & O'Malley Land Surveyors, will redraw the sketch. Rosella Sonsteby Sketch Plan (Comm. #5-78-7) o Mrs. Sonsteby and Mr. O'Malley presented a sketch plan consisting of 20 lots in the South ~ of Section 29. Some of the lots are R-l zoning size, some of the lots are zoned R-3, and some of the lots are now zoned R-l but they propose to rezone them to R-3. Some of the comments made during the discussion: the cul-de-sac is too long; the lots are too small; some of the land is low marshland; suggested combining some of the lots and show them divided in the future resubdivision plan; some of the area is refilling with water now - it was drained to put in the storm sewer and now it is coming back up again; Mrs. Sonsteby suggested the 4 parcels (#1720, #1730, #1740 and #1750) West of Woodbine and South of l43rd Avenue in Auditors Sub. 82 could be the park land for this development since there aren't any houses there yet; there are about 66 acres in this proposed subdivision; the difficulty in drawing the roads in because of the low areas. It was suggested the sketch be redrawn and brought back for another review before going ahead with a preliminary plat. Stanley Knoll Sketch Plan (Comm. #5-78-6) Mr. O'Malley presented the sketch plan in the South ~ of Section 17 located South of l6lst Avenue and West of Round Lake Boulevard. The acreage is 70.5, with 24 lots shown and 9.8 acres of park. They are proposing to divide the property in accordance with Section 4.20, Density Zoning, of Ordinance 8. o (\ \J o c) o o o o Planning and Zoning Commission Meeting Minutes - May 9, 1978 Page 7 After being advised the proposed sketch is unacceptable, particularly because of Ordinance 43 - the Moratorium Ordinance, Mr. O'Malley presented a revised sketch with 19 lots. The lots are 2.5 acres, or more, but some of the frontages don't meet the minimum requirements. All of the contiguous land is not shown and there is no park land shown. Mr. O'Malley may come back with another sketch plan or go ahead with the preliminary plat. Discussion on Ordinance #37 - Septic System Maintenance (Comm. #5-78-8) This item will be discussed at the Special Planning and Zoning Commission Meeting on May 10, 1978. Sonterre Sketch Plan (Comm. #5-78-9) No one was present and the Commission has received no information on the proposed sketch plan. Adiournment Motion by Commissioner Bosell, seconded by Commissioner Dick, to adjourn. Motion carried unanimously. The proposed subdivision consists of approximately 20 acres and is located on the east side of Lipan Street, between 145th Lane N. W. and 146th Lane N. W. Following are our comments regarding the proposed plat: ,i 1) All existing utilitie s including, but not limited to, telephone, elect ric, and gas shall be shown on the preliminary plat. 2) Storm sewer should be extended from the existing system, to provide catch basins at 145th Lane N. W. and at 146th Lane N. W. on Lipan Street. 3) Recalculate the areas shown on the lots. Some of the areas checked do not agree with the lot dimensions. 4) Lot 7, Block l, will require a set-back variance, as shown, on the preliminary plat. 5) Lot 6, Block I, may require a variance as the existing barn is within the 40 foot front yard set back. 6) Lot I, Block I, will have to front on 146th Lane N. As you will note, ground water was not encountered at any of the three testho1es. 1 Percolation tests were run at shallow testholes adjacent to the three testholes. The results were as follows: Testhole Percolation Rate 1 2 3 2 1/2 minutes per inch 1 minute per inch 3 minutes per inch Predominantly fine sand soils were observed at the site. We do not anticipate any problems with regard to house or drainfield construction from soil or water conditions. Testho1e locations are shown on the grading and drainage plan.
