MINUTES
The Regular Meeting of the Planning and Zoning Commission was called
to order at 7:30 P.M. by Chairman Larry Retzlaff on April 11, 1978
at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka,
Minnesota 55303.

Motion by Commissioner Kishel, seconded by Commissioner Elling, to
approve the Minutes of March 28, 1978. Motion carried unanimously.
G.M. Investment Co. Special Use Permit Public Hearing (Comm. #4-78-1)
G. M. Investment Co. had not provided the required information to
hold the public hearing. This will be on the Agenda on 4-25-78.
James Refrigeration Special Use Permit Public Hearing (Comm. #4-78-2)
James Refrigeration has not provided the required information to hold
the public hearing. This will be on the Agenda on April 25, 1978.
Dostaler-Hane Addition Sketch Plan (Comm. #4-78-5)
James Hane and Iven Dostaler were present to discuss their sketch
plan. The property has been on recent Planning and Zoning Agendas
as the "Gloria Aylmer Sketch Plan". The proposed development is in
the NWt of Section 30 between 7th Avenue and Lipan Street. There
are 15 l-acre-plus lots in R-2 Zoning. They have put extra width on
the lots on 7th Avenue. The streets are 50' as the roads are in the
adjoining addition of Meadowood. Lot 1 - Block 1, a corner lot, would
have 162' of frontage on Lipan but should have 180'; but, as it is
shown, the road lines up with l46th Lane in Meadowood. The rest of
the plat appeared to be acceptable according to the Commission.
Doug Shernell Special Use Permit Public Hearing (Cornm. #4-78-4)
Chairman Retzlaff called the public hearing to order. Mr. Shernell
has a building on the East % of Lot 3, Block 1, Pankonin Addition
which is zoned GBthat he wishes to use as a business place to sell
used truck parts. He is fencing the property with 8' high rough sawn
wood and will be disassembling trucks and putting the fenders, etc.

Mr. Shernell has applied for his junkyard license already but must
wait approval on it until the City Council has approved this Special
Use Permit. He will be taking trucks apart but it will be different
from a junkyard because everything is going to be enclosed.
Chairman Retzlaff called for public input. Steve Nichols, 2634 - l40th
Lane NW, "Is this going to be another of our eyesores that the City has
no control over like we have now? We have about 6 junkyards there
now. The City cannot stop them; they can't seem to regulate them;
they have laws but don't seem to do much about them. They are a general
eyesore to the whole area. Is this going to look like that?"
It was noted that Mr. Shernell is already "ahead of the game". He
is putting up the fencing now and everything looks pretty good.
Chairman Retzlaff explained that the City is in the process of dealing
with the junkyard owners. Fencing is going up along Bunker and changes
can be noticed almost every day with people attempting to comply with
the Ordinance.
Mr. Shernell was questioned about the amount of business that is carried
on with the service road not constructed. The drives are badly rutted
now in the Spring. Discussed parking facilities, unconstructed service
road and how and when it may be improved, off-street parking and Ordinance
8 Section 8.08 and Section 5. Some action should soon be taken to
improve the service road. He was commended for his fence but it was
suggested that it would be in Mr. Shernell's best interest to maintain
a good access to the business. and review off-street parking in Ordinance 8.
Motion by Commissioner Bosell, seconded by Commissioner Kishel, to
close the public hearing. Motion carried unanimously.
Motion by Commissioner Bosell, seconded by Commissioner Kishel, that
the Planning and Zoning Commission recommend to the Andover City Council
approval of the Doug Shernell Special Use Permit for the operation
of a truck reduction yard under Ordinance 8 - Section 7.03 - Special
Uses - for the following reasons: (1) the use would be consistent with
the already existing uses in that area; (2) there was a public hearing
held and some dissension was noted; (3) the criteria for the Special
Use has been met, i.e. fencing; and (4). it would not adversely affect
the surrounding area.
Discussed Ordinance 8 Section 5.03 in relation to Special Use Permits
and this area.
Amendment by Chairman Retzlaff, seconded by Commissioner Kishel, that
the said Special Use Permit will not be detrimental to the health,
safety, morals or general welfare of the Community nor will cause
serious traffic congestion nor hazards nor will seriously depreciate
surrounding property values.

This will be on the City Council Agenda on May 2, 1978.
Johnson's Field Sketch Plan (Comm. #4-78-6)
Linda Johnson, owner of the property, and James Kurth, from Kurth Surveying,
were present to explain the sketch. The property is in Section 30,
zoned R-4, between Dehn's Addition, 7th Avenue and Round Lake Estates.
They have shown 28 lots. Four of the lots (2, 3, 6, and 7) show 38,000
square feet but they can shift the layout to the South to meet the
39,000 square foot minimum. They have 2 outlots on the drawing. Outlot
B can be combined with an adjacent lot. They will, perhaps, talk to
the owners of the property next to Outlot A in order to make some arrangement
for selling that property to them. The roadway easement on the North
property line is owned by Bruce Hay, owner of the property to the East
of Ms Johnson's. Their agreement is that he will give the 66' of roadway
and she will be responsible for the construction. A temporary cul-de-sac
would be on the East side of this property. They were advised that
Mr. Hay would have to be on the plat as owner if this agreement is
carried out. Lots 23 and 28 don't meet minimum frontage requirements.
Lot 12 has frontage on 3 streets. Discussed matching their street
with the existing Guarani Street in Round Lake Estates.
They will consider the items discussed and proceed with the preliminary
plat.
Seventh-Day Adventist Church Special Use Permit Public Hearing (Comm. #4-78-3)
Chairman Retzlaff opened the public hearing. Pastor Jarnes was present
to represent the church located at 15036 Round Lake Boulevard. They
are conducting an elementary school (grades 1-5) from 9 - 3:30, 5 days
a week and need a Special Use Permit in order to comply with Ordinance
8. They started the school at the beginning of the 1977 school year.
Pastor James said the enrollment wouldn't exceed 30 students in the
school as far as they knew now. There are 100 members in the Church.

the Planning and Zoning Commission recommends to the City Council
approval of the Special Use Permit for the Minnesota Conference Association

G. M. Investment Co. Variance Continued (Comm. #3-78-2)
Jerry Green was present to represent G. M. Investment Co. The concern
at the last meeting was about new wells in this area. It was discovered
that there had been one well servicing a number of buildings and now
a new well was drilled for each dwelling.
Motion by Commissioner Bosell, seconded by Commissioner Kishel, that
the Andover Planning and Zoning Commission recommend to the City Council
the granting of the variance for G. M. Investment Co. on the property
described as Plat 65933 Parcel 2180 from the provision of Ordinance
8 Section 6.02 - lot frontage - and the provision of Ordinance 8 Section
7.01 - the requirement of City water. The variance on the lot frontage
would be in conformance with the other lots in the area and would present
undue hardship to require an extra 4' on this one lot; there is no
City water available in the City of Andover therefore it cannot be a
requirement; and it is consistent with the area and not detrimental to
the health, safety, morals and general welfare of the Community.

Jerry Green had attended a symposium, just before this meeting, regarding
housing in Anoka County for the low and middle income brackets. Mr.
Green informed the Commission of the items discussed and felt the City
of Andover should be providing some land for low and middle income
families.

Motion by Commissioner Bosell, seconded by Commissioner Elling, to
adjourn. Motion carried unanimously.
