Comm. 1F12-77-2 Comprehensive Development Plan Update o for publication on January 6, 1978 o C) o C) o o 0 CITY 01 ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING January 10, 1978 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on January 10, 1978, at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: d'Arcy Bosell, James Elling, Ralph Kishel, Jeannine Pyron, and Gary Schwendinger Also Present: Rex Stockwell, City Engineer from T.K.D.A., and others Minutes Motion by Commissioner Elling, seconded by Commissioner Kishel, to approve the Minutes of December 27, 1977. Motion carried unanimously. Cunningham Addition Preliminary Plat (Comm. #7-77-4) Engineer Stockwell presented a letter (copy attached) dated 1-10-78 to the Commission regarding the Cunningham Addition revised plat received 1-3-78. Mr. Stockwell reviewed the letter with the Commission. Some of the items discussed were: 1) regarding Ordinance 10 - Section 9.06 (a), the final computation came out to 16.67 lots allowable and Mr. Hane shows 16. Discussed the 13,000 and 15,000 square foot requirements of Ordinances 8 and 10 and how to calculate the number of lots allowable. 2) lots 4 and 14 with the 20' radius requirement would be less than 13,000 square feet and also lots 8 and 13 on the cul-de-sac would be a problem. 3) required grading plan would show first floor elevations and street grades and would make the plat drawing more readable. 4) flood plain area - 866' elevation would affect lots 8, 9, 10 and 11. 5) utility and drainage easements are not shown. Engineer Stockwell explained that there are already utilities in on Crocus Street and he assumed the back lots would be served by utilities in the street (140th Circle). 6) street jog (140th Circle - l40th Lane) is 130' and Ordinance 10 requires a 150' minimum. Engineer Stockwell explained that because it is a short cul-de-sac with little traffic the jog shouldn't be a problem. 7) Coon Creek Watershed Board reviewed the plat when there were 7 lots involved. It is recommended that the Watershed Board be presented with the revised plat, as now shown, containing 16 lots. ) , ) lJ u '. j' Planning and Zoning Commission Meeting Minutes - January 10, 1978 Page 2 James Hane, developer of the property, said that l40th Circle is considered a minor street and, until the Ordinance is changed, it required a 50' street. He had revised the plat showing a 50' street and the lots somewhat larger. The Chairman said he would contact the City Attorney as to the legality of this (the 50' street right-of-way). Therefore, the Commission didn't accept Mr. Hane's revised plat. Mr. Hane asked for the position or opinion of the Planning and Zoning Commission regarding requiring a 15,000 or 13,000 square foot lot size. A question has recently arisen regarding the interpretation of Section 9.06 (a) of Ordinance 10. The Commissioners all agreed that the Ordinance requires a 13,000 square foot lot size as minimum in this area. Discussed 50',60', and 66' street right-of-way widths. The Ordinance requires 50', surrounding streets are 60', the Engineer has been requesting 66', and developers have been giving a 66' street right-of-way. There is a problem also with the 120' depth on lots 11, 12, 14, 15, and 16 because the ordinance requires 130' minimum. Discussed the minimum allowable zoning in this area versus the existing larger lots. Mr. Hane will revise the plat and present it again on January 24, 1978, at the Planning and Zoning Commission Meeting. '\ .) Mar;orie Weise Variance Request (Comm. #1-78-1) Mrs. Weise owns a 50' wide lot on Crooked Lake in the SW corner of Section 33. She is requesting a variance in order to sell the lot to the adjacent property owner to the North. The South line of this lot is the Andover/Coon Rapids dividing line. Motion by Commissioner Elling, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommend to the City Council approval of the Marjorie Weise Variance Request under Ordinance lOB Section 17.01 in that there was no public opposition and it is not detrimental to the area. Motion carried unanimously. This will be on the City Council Agenda on February 7, 1978. Junkyard Ordinance Discussion (Comm. #1-78-3) " .' The Chairman referred to the City Council Minutes of 12-20-77 which stated the City Attorney will be working with the Planning and Zoning Commission to draft a new junkyard ordinance. The League of Minnesota Municipalities is sending other City's ordinances covering junkyards for the Commission to use as samples in preparing a new ordinance. Discussed past history of Andover junkyards. A Special Meeting will be set up with the Attorney to take care of this matter. /' '- ) \ '.J u u .~ '\ "-~' Planning and Zoning Commission Meeting Minutes - January 10, 1978 Page 3 Quinlan Variance Request (Comm. #1-78-2) Pam Quinlan stated that the reason for the request is that the 6-acre parcel, on South Coon Creek Drive in Section 28, is only 230' wide on the fron~ and 330' wide on the back lot lin~ and they are selling the land. She said the parcel was a lot of record since 1972 when they bought it. However, apparently it wasn't recorded because they have never gotten a separate tax statement for the 6 acres. The Commission and Pam Quinlan had much discussion over what this would be a variance from - Ordinance 10 Sections 14.01, 14.02, 16.03, and/or 17.01. Also discussed: whether another variance would be needed by the buyers under Section 16.03 in order to get a building permit; recording land and how it is done; chopping land into chunks by variance instead of planned, orderly subdividing; requiring a letter of permission from the fee owner; financial hardship and how it might be determined. / Motion by Commissioner Schwendinger, seconded by Commissioner Kishel, to deny the Variance because I do not see enough justification or the Ordinance that permits this. Amendment by Commissioner Kishel, seconded by Commissioner Schwendinger, to add reasons: it is not in conformance with Section 14.01 (3) and Section 16.03; specifically the 300' in Section 14 in width and as to Section 16 - the requirement of 330' in width. Vote on amendment: yes - Commissioner Schwendinger, Commissioner Kishel; no - Commissioner Pyron, Chairman Retzlaff, Commissioner Elling, Commissioner Bosell. Amendment defeated. Vote on motion: yes - Commissioner Schwendinger; no - Commissioner Elling, Commissioner Bosell, Commissioner Pyron, Commissioner Kishel, Chairman Retzlaff. Motion defeated. Discussion: the land to the West is open; the Quinlans still own a number of acres which she is attempting to sell - probably to a developer; the property is in the Urban Planning District; past history of allowable variance s. \ \. ) '\ ) ~ , \ I "-J o , '__ _,I '. Coon Creek Drive, and lying Westerly of the line described as follows: Commencing at the E. ~ corner of said Section 28; thence S. 880 41 minutes, 31 seconds W. along the East-West ~ line of said Section 28 a distance of 3318.68'; thence S. 520 56 minutes 01 second W. a distance of 585.83' to the actual point of beginning of the line to be hereby described, said point being the centerline of S. Coon Creek Drive; thence S. 150 30 minutes 10 seconds E. to the S. line of said NE~ of SW~. Commissioner Kishel stated '. / his objection was that he didn't recognize this as a legal tract of land. The Variance will be on the City Council Agenda on February 7, 1978. Comprehensive Development Plan Update (Comm. #12-77-2) Chairman Retzlaff explained that David Licht, of Midwest Planning, is unable to attend so discussion will be continued until another meeting can be arranged.
