The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was
called to order by Chairperson Daninger on June 24, 2008, 7:00 p.m., at the Andover City
Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota_
Commissioners present: Chairperson Daninger, Commissioners Tim Kirchoff,
Michael Casey, Valerie Holthus (7:05 p.m.), Devon
Walton, Douglas Falk and Dennis Cleveland.
Commissioners absent: None.

May 27, 2008
Motion by Casey, seconded by Kirchoff, to approve the minutes as presented. Motion
carried on a 5 -ayes, 0 -nays, 1- present (Walton), 1- absent ( Holthus) vote.
PUBLIC HEARING: CONDITIONAL USE PERMIT (08 -06) TO ALL 0WA DRIVE
THROUGHAT 1730139' LANE NW.
Mr. Bednarz explained the application is requesting a Conditional Use Permit to
construct a drive- through for a new building in Andover Station North.
Commissioner Falk wondered if the drive thru will be one way. Mr. Bednarz stated it
would. Commissioner Falk asked if the center island would be painted or made of
concrete. Mr. Bednarz stated it will be a raised concrete island.
Commissioner Falk recommended extending the island further west so traffic will not try
to get through the one way. Mr. Bednarz believed the intent was to keep vehicles from
turning the wrong way into the drive thru. He stated they can take a look at this again to
• see how this can best be accomplished. He noted this will be signed also.

Commissioner Casey asked if the second unit was the proposed dry cleaning operation. •
Mr. Bednarz showed on the drawing the space that the dry cleaner would encompass.
Motion by Walton, seconded by Falk, to open the public hearing at 7:08 p.m. Motion
carried on a 7 -ayes, 0 -nays, 0- absent vote.
No one wished to address the Commission.
Motion by Walton, seconded by Casey, to close the public hearing at 7:08 p.m. Motion
carried on a 7 -ayes, 0 -nays, 0- absent vote.
Commissioner Cleveland wondered how much fiuther south did the City think the
building should come. Mr. Bednarz stated there are a few options including pivoting the
building slightly as well as moving the building forward on the site a few feet. The
concern is that a vehicle exiting the drive thru needs enter the exit lane before they are
able to see if traffic is approaching from the west. With the long straight run coming
from the daycare speed could be an issue and could be a potential area for accidents.
Chairperson Daninger asked if there is a shared access agreement between the businesses.
Mr. Bednarz stated that was correct. Chairperson Damnger asked if staff is
recommending having the trash enclosure at the entrance. Mr. Bednarz indicated staff is
asking for it to be moved from where it is shown on the plan.
Chairperson Daninger stated he never recalled seeing a shared drive thm anywhere else
in the City. Commissioner Walton stated Wells Fargo and Caribou share a drive thm but
there are not any blind spots when leaving the drive thru. He noted this one will exit
right into the flow of traffic.
Commissioner Cleveland wondered if by moving the building it will affect the parking
layout. Mr. Bednarz thought it would. He stated the design currently exceeds the
number of required parking stalls, so do have some ability to adjust the parking area. The
most at risk will be the center island parking area.
Commissioner Walton wondered if the square footage of the building where the dry
cleaning will be driven by the applicant or driven by architecture.
Ms. Laura Heppner, 12341 Drake Street, Coon Rapids, stated it is about what she needs
in order to operate her business.
Commissioner Walton asked if she had experience on how many drop off type orders
they expect to use that drive thru lane. Ms. Heppner stated she did not but indicated she
could check with other dry clean businesses with drive thru windows. She thought it
would vary on the time of day and season. She thought if the transaction would take
longer than just passing through to drop off the laundry the person would be asked to •
come in to finish the transaction.

Commissioner Walton stated he liked the overall design of the building but was
concerned about the drive thru and blind comer and would like it brought back to the
architect so make it more of a delta look at the release point so it is not so blind.
Motion by Cleveland, seconded by Casey, to recommend to the City Council approval of
the proposed conditional use permit subject to the conditions in the attached resolution
with corrections as discussed. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote.
Mr. Bednarz stated that this item would be before the Council at the July 1, 2008 City
Council meeting.
PUBLIC HEARING: CONDITIONAL USE PERMIT (08 -07) TO ALLOW DRY
CLEANING PROCESSING AT 1730139 LANE NW.
Mr. Bednarz stated the applicant is requesting a Conditional Use Permit to allow dry
cleaning processing within a new building in Andover Station North.
Commissioner Walton wondered where the venting would be located. Mr. Bednarz
thought it depended on the mechanical design of the building.
Ms. Heppner stated the machines are not vented out anywhere they are all contained
within the machine. There will not be any disbursement of fumes.
Commissioner Kirchoff stated there was some discussion of the site in the past where
some of the neighbors were having issues with headlights going into the property and he
wondered if this was the site with concern. Mr. Bednarz thought this site contained the
headlights within and there would not be a problem with it
Motion by Walton, seconded by Casey, to open the public hearing at 7:19 p.m. Motion
carved on a 7 -ayes, 0 -nays, 0- absent vote.
There was no other public input.
Motion by Walton, seconded by Casey, to close the public hearing at 7:20 p.m. Motion
carried on a 7 -ayes, 0 -nays, 0- absent vote.
Motion by Walton, seconded by Casey, to recommend approval of the proposed
Conditional Use Permit subject to the conditions in the attached resolution. Motion
carried on a 7 -ayes, 0 -nays, 0- absent vote.
Mr. Bednarz stated that this item would be before the Council at the July 1, 2008 City

SUBJECT: PUBLIC HEARING Conditional Use Permit (08 -08) amending Conditional
Use Permit (03 -15) to extend the approval of temporary structure for Andover
Christian Church at 16045 Nightingale Street NW.
INTRODUCTION
The applicant is requesting an amendment to the conditional use permit to extend the timeframe
for the removal of the temporary classrooms on their property by five years.
DISCUSSION
As per section 12 -6 -6 of the Andover City Code, temporary structures in any district require a
conditional use permit. The conditional use permit process allows for the review of the proposed
location of the temporary structures in order to minimize potential impacts on adjoining
properties.
The temporary classrooms were originally requested by Family of Christ Lutheran Church in
1998. A four -year extension was granted to the church in 1999 and a five -year extension was
granted in 2003. This extension was in effect when Andover Christian Church, the current
property owners, purchased the property in 2004. It is set to expire in November.
The attached letter from the applicant outlines the current use of the classrooms, the church's
need for the classrooms, and their future plans for the site. The attached photos show the
location and condition of the building.
Applicable Ordinances
Chapter 12 -5 -6 B of the Andover City Code provides the following criteria for the issuance of a
Conditional Use Permit:
1. In granting a Conditional Use Permit, the City Council shall consider the advice and
recommendation of the Planning and Zoning Commission and:
a. The effect of the proposed use upon the health, safety, morals and general welfare of
occupants of surrounding lands.
b. Existing and anticipated traffic conditions, including parking facilities on adjacent
streets and land.
c. The effect on values of property and scenic views in the surrounding area, and the
• effect of the proposed use on the Comprehensive Plan.
2. If it shall determine by resolution that the proposed use will not be detrimental to the .
health, safety, morals, or general welfare of the community, nor will cause serious traffic
congestion or hazards, nor will seriously depreciate surrounding property values, and that
said use is in harmony with the general purpose and intent of this title and the comprehensive
plan, the City Council may grant such permits.

That part of the northwest quarter of the southeast quarter of Section 15, Township 32, Range 24
lying southerly of the southerly right -of -way line of County State Aid Highway number 20 and
lying northwesterly of the following described line: beginning at a point on the west line of said
quarter quarter 663 feet south of the northwest corner thereof, then east parallel with the north
line thereof 402 feet, then northeasterly to a point on said southerly right -of -way line 300 feet

WHEREAS, Andover Christian Church has requested a Amended Conditional Use Permit for a five
year time extension on the removal of the temporary classrooms, and;
WHEREAS, the Planning and Zoning Commission has reviewed the request and has determined that
said request meets the criteria of City Code, and;
• WHEREAS, the Planning and Zoning Commission finds the request would not have a detrimental
effect upon the health, safety, and general welfare of the City of Andover, and;
WHEREAS, the Planning and Zoning Commission recommends to the City Council approval of the
Amended Conditional Use Permit request;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby
agrees with the recommendation of the Planning and Zoning Commission and approves the Amended
Conditional Use Permit for the time extension for five years for the removal of the temporary
structures on said property with the following conditions:
1. The conditional use permit shall expire on August 31, 2013 at which time the temporary
structure shall be removed.
2. The Conditional Use Permit shall be subject to a sunset clause as per section 12- 14 -6 -D of
the Andover City Code.

Re: Conditional use permit
Andover Christian Church purchased the property at 16045 Nightingale St. NW in
Andover. At the time of the purchase we were aware that the property included a
portable building. We were also advised that the permit for the building would expire in
about five years. We moved into the new building in March of 2004.
• The conditional use permit is set to expire in November of this year. Andover Christian
Church would like to extend the Conditional Use Permit. Andover Christian Church is
using the portable building for classrooms for our Junior and Senior High students. The
number of students that currently use the portable classroom is on average 20 -30 on
Sundays.
The portable building has been well maintained during the time Andover Christian
Church has owned the property. Siding repairs have been done to areas of the building
that were in need of repairs. Last summer new stairs were installed to the exit door. The
portable building is finished with siding that matches the main building and blends in to
the main building as to appear to be part of the main structure.
The location of the portable building is to the East of the main building and is not readily
visible from Nightingale St NW. In addition the location of the portable building on the
East side also places it near a wooded area that shields it from view of the neighborhood
to the East. The portable building blends in with the main building and although it is
visible form 161" Street NW it is not readily identifiable as a portable building. Photos
have been attached.
Andover Christian Church has maintained the interior of the building to provide for the
safety of the people using it. Andover Christian Church needs this building for classroom
space and requests that the City of Andover renew the Conditional Use Permit for this
• buildinv.

Currently Andover Christian Church is utilizing all the available classroom space •
including the portable classroom. Without the portable classroom Andover Christian
Church would suffer undue hardship and be in need of additional classroom space. At
this time Andover Christian Church is expecting to continue to grow as a Church and
may need to expand in the future. At this time Andover Christian Church would like to
renew the conditional use permit for 5 years. This would allow us to utilize the space and
not suffer a hardship while we plan for the future.

detrimental effect upon the health, safety, morals, and general welfare of the City of
Andover; and
WHEREAS, a public hearing was held and there was no opposition to the request; and
WHEREAS, the Planning and Zoning Commission recommends to the City Council
approval of the Amended Special Use Permit as requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover
hereby agrees with the recommendation of the Planning and Zoning Commission and approves
the Amended Special Use Permit on said property with the following conditions:
1) That the applicant obtain all necessary building permits.

WHEREAS, the Planning and Zoning Commission recommends to the City Council
approval of the Conditional Use Permit Amendment request, and;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover
hereby agrees with the recommendation of the Planning and Zoning Commission and
approves the Conditional Use Permit to allow a preschool and a time extension of five
years for the removal of the temporary classrooms, subject to the following conditions;
1. The preschool shall substantially conform with the description provided in the
letter from the Family of Christ Church dated November 17, 2003 and stamped
received by the City of Andover November 18, 2003.
2. The applicant shall obtain all necessary licenses and approvals from the State of
Minnesota.
3. The preschool shall conform to all applicable building and fire codes.
4. The temporary classrooms shall be removed by November of 2008 or at the time
the Family of Christ sells the church, whichever comes first. In the event that the

subject property is sold to another church, the temporary structure shall be
allowed to remain no longer than November of 2008. •
5. The Conditional Use Permit shall be subject to a sunset clause as defined in City
Code 12- 15 -7D.
Adopted by the City Council of the City of Andover on this 16"' day of
December, 2003.

SUBJECT: PUBLIC HEARING Conditional Use Permit (08 -09) to allow a house to be
moved to 14355 Crosstown Boulevard NW.

INTRODUCTION
The applicant is seeking to move a house and detached garage from 14905 Crosstown Boulevard
approximately 3 /4 of a mile to the subject property.
DISCUSSION
City Code 9 -11 requires a conditional use permit for a house to be moved onto a property in the
city. The purpose of this permit is to allow review by the Planning Commission and Council to
ensure that the house will be compatible with the surrounding neighborhood. The attached
survey shows how the house can be located on the lot to conform to the applicable setback
regulations. Photographs of the proposed house and adjacent houses are also attached.
Additional Requirements
A building permit is also required to move structures. The building permit will ensure that the
home is placed on a new foundation that conforms to the International Building Code.
The City Code requires houses to be moved by a state licensed building mover. The mover must
notify the city of the time and date when the structure will be moved and provide a map of the
route. Finally, the site where the home was removed from is required to be restored to a safe and
sanitary condition. In this case that will include removal of the foundation and ensuring that the
grade of the property does not exceed a 4:1 slope. Ultimately, the city will grade the "sending"
property to allow for a parking lot expansion for Sunshine Park.
Additional Information
The lot for the new house was approved with a previous lot split. Subsequently, municipal sewer
and water were stubbed to the property and are presently available to serve the house.
Crosstown Boulevard is a county road. The applicant will need to obtain a driveway permit from
the Anoka County Highway Department.
• It should be noted that the applicant intends to move the existing detached accessory building at
14905 Crosstown Boulevard NW to the subject property. The moving of this structure will be
coordinated with the building permit.
It is also the applicant's responsibility to coordinate connection of the house to other utilities •
such as electricity, gas, telephone, etc.
Staff Recommendation
The City Code provides a process for houses to be moved in a safe manner if they are compatible
with the surrounding neighborhood. The house is compatible with the surrounding
neighborhood. Staff recommends approval of the request.
ACTION REQUESTED
The Planning Commission is asked to recommend approval or denial of the proposed conditional
use permit.

NW TO 14355 CROSSTOWN BOULEVARD NORTHWEST LEGALLY DESCRIBED AS:
That part of Lot 1, Block 1, THE OAKS, Anoka County, Minnesota, according to the recorded
plat thereof lying northeasterly of the following described line:
Commencing at the southeast corner of said Lot 1; thence on an assumed bearing of North 31
degrees 28 minutes 46 seconds East, along the southeasterly line of said Lot 1, a distance of
34.75 feet to the point of beginning; thence North 45 degrees 41 minutes 20 seconds West a
distance of 128.59 feet to the northwesterly line of said Lot 1 and there terminating.
WHEREAS, Ken Orttel, has requested approval of a conditional use permit to allow a house to
be moved to a lot in the City of Andover, and;
WHEREAS, the Planning and Zoning Commission has reviewed the request and determined that
said request meets the criteria of City Code and would not have a detrimental effect upon the
. health, safety, and general welfare of the City of Andover, and;
WHEREAS, the Planning and Zoning Commission recommends to the City Council approval of
the conditional use permit request;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby
agrees with the recommendation of the Planning and Zoning Commission and approves a
conditional use permit for a house to be moved to 14355 Crosstown Boulevard NW subject to
the following conditions:
1. The applicant shall provide proof of recording the deeds for lot split 05 -06 prior to a
building permit being issued to move the house.
2. The applicant shall obtain a driveway permit from the Anoka County Highway
Department. Any damage to the trail along Crosstown Boulevard caused by
construction of the new driveway shall be repaired by the applicant.
3. The applicant shall remove the existing foundation and ensure that the grade of the
property from where the house will be removed does not exceed a 4:1 slope.
4. Per City Code 9 -11 B.3. the house shall be moved within 180 days from the approval
of this resolution.

A Conditional Use Permit is requested to tllow the moving of a home currently located at
14905 Crosstown Blvd, Andover to a legal buildable lot at 14355 Crosstown Blvd,
Andover.
The ordinance states the reason for the CUP is for the City to assess the impact on the
surrounding properties. I have submitted photos of all properties that abut this parcel and
also those across the street from this parcel. The photos will show that the home to be
moved is of at least equal quality to the other homes in the area. When the lot was
approved two of the neighbors asked if I could guarantee that the home to be built on the
property would fit in with their existing homes. At that time I told them it would be
impossible to build a used home but I would do what I could to get something to fit.
The home being proposed would fit very well into this neighborhood. It is in very good
condition. The roof, siding, windows, and doors, are all new. Several of the plumbing
• faucets and other things that protrude through the siding still have price tags on them.
Most of the home had vinyl siding. The front is rough cedar and while I love bare cedar,
it does not age well and I would cover that with a light color solid stain to make it look
fresher. That is the only change that I can see needed on the exterior of the home. Any
interior work would be done in accordant-- with the building department rules and should
not apply in this matter.
There are quite a few trees on the lot and.I want to keep as much screening for the
abutting properties as possible and still have a good lot setting. The proposed location of
the home on the lot results in the least amount of tree removal.
There are no parking issues related to this request.
The move would be done on a County road and they have their own permit and safety
regulations for that. They have been consulted and there is no problem with their
regulations.
