Comm. #12-78-6 Ordinance 10D Discussion For publication on December 22, 1978 o o o 0 ~ 01 ANDOVER o C) REGULAR PLANNING AND ZONING COMMISSION MEETING December 26, 1978 MINUTE S The Regular Meeting of the Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Larry Retzlaff on December 26, 1978 at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota. Commissioners Present: d'Arcy Bose11, Don Jacobson, Ralph Kishe1, George Lobb and Jeannine Pyron Commissioner Absent: Walter Dick Minutes Motion by Pyron, seconded by Lobb, to approve the Planning and Zoning Commission Meeting Minutes of December 12, 1978. Vote on motion: yes - Retzlaff, Bose1l, Pyron, Jacobson, Lobb; present - Kishel. Motion carried. Lund's Evergreen Estates Preliminary Plat Continued (Comm. #9-78-13) C) Bruce Grivna, of Egan, Field and Nowak, was present to represent Mr. Lund. The Commission and Mr. Grivna reviewed the letter from T.K.D.A. dated 12-21-78. The road easement on Block 4 hasn't been vacated yet but they are working on it. Block 3 is longer than the 1320' maximum block length requirement but the Commission didn't feel that it was a problem. The Park and Recreation Commission and the developer didn't agree on park dedication but that Commission did make a recommendation to the City Council. C) Motion by Jacobson, seconded by Pyron, that the Planning and Zoning Commission of the City of Andover recommends to the Andover City Council approval of the preliminary plat for Lund's Evergreen Estates on the following described property: The W. ~ of the NEt of Section 27, Township 32, Range 24, except the S. 217.8' of the E. 200' thereof and except that part described as follows: Beginning at a point in the S. line of said NEt, therein distant 1595' W. of the SE corner of said NEt; thence Westerly along said S. line 500'; thence Northerly, at a right angle, 217.8'; thence Easterly, parallel with said S. line, 500'; thence Southerly to the point of beginning. The Commission recommends approval based on the following reasons: 1) a public hearing was held and there was no public opposition; 2) the plat meets the Ordinances of the City and is in conformance with the Comprehensive Development Plan; 3) the plat has been reviewed by the City Engineer; 4) the Commission recommends a variance for the length of Linnet Street for Block 3 of the plat because it exceeds the 1320' requirements of the City; 5) the Commission also recommends that all lots in the plat front on interior streets; 6) since the Commission has not received any decision from the Park and Recreation Commission as to park land or park fees, we recommend the Council determine their wishes in this regard; 7) the Commission also recognizes a private road easement across Lot 3 of Block 4 of the plat and recommends to the Council the road easement be eliminated before final approval is given; and 8) a letter of approval from the Coon Creek Watershed Board was received. Motion carried unanimously. This will be on the City Council Agenda on January 16, 1978. o C) L) u Planning and Zoning Commission Meeting ~ Minutes - December 26, 1978 ,/ Page 2 Pond View Preliminary Plat Continued Public Hearing (Comm. #2-78-5) James Conroy submitted revised copies of the plat to the Commission. The revised plat shows one more lot than the last one he presented. He said that the First Banking System is interested in Lot 3, of the proposed plat, instead of Lot 2. Lot 2 was recently rezoned to Neighborhood Business designation but Lot 3 is R-4, single family residential. He was advised that he would have to go through the same rezoning procedure for Lot 3 as he did for Lot 2. Mr. Conroy requested that the public hearing for Pond View be continued until February 27, 1979. Variance Request - Melva Johnson/Gar-Jac Const./Dale Schmidt Cont'd (Comm. #12-78-1) '\ , ) Melva Johnson, the realtor involved, was present. She had a copy of the listing contract and the purchase agreement. The variance is being requested for the proposed Tract B because of the lot width of 260'. They discussed the possibility of Tract C also needing a variance but it was unclear exactly how wide the lot would be. The sketch showed 300' plus or minus for the East to West property lines. It was determined that discussion should center around Tract B, the property on which the variance was requested. Discussed various ways of dividing the land to feasibly get enough width or frontage and still keep the tracts at a marketable size. Melva Johnson didn't think that the purchaser of Tracts Band C would be interested in combining them into one, over l8-acre lot. It was mentioned that these lots meet the intent of the Comprehensive Development Plan because they are large lots but the Ordinance states the lots should be at least 300' wide. Motion by Kishel, seconded by Lobb, that the Andover Planning and Zoning Commission recommends approval of the Gar-Jac Construction and the Dale Schmidt Variance request, per the attached drawing. Reasons for approval being: 1) the variance is not inconsistent with the Comprehensive Development Plan; 2) the variance would allow Tract B to have 260' of frontage on C.S.A.H. 18, as opposed to the 300' minimum requirement, however this variance is not inconsistent with the past variances granted; 3) the physical dimensions of the land create a hardship if a variance is not granted; 4) the parcel is compatible with the R-l zoning, having over 2~ acres, and it is compatible with the City's Comprehensive Development Plan in the intent to preserve the Rural community; and 5) the provision under which the Commission is recommending approval of the variance is Ordinance 10, Section 14.02. Discussion: question on whether this is consistent with past variances, a 9.7 acre parcel would be keeping the "Rural Atmosphere" but it still doesn't have sufficient frontage, how far below the 300' is the Commission going to recommend granting a variance. \ , ) Vote on motion: Motion carried. yes - Pyron, Lobb, Retzlaff, Kishel; no - Jacobson, Bosell. This will be on the City Council Agenda on January 16, 1979. o .,J u u r \ ,) Planning and Zoning Commission Meeting Minutes - December 26, 1978 Page 3 Proposed Rum River Ordinance Discussion (Comm. #9-78-6) The Commission asked that the ordinance be retyped as revised and continued to the next agenda for further discussion. Parking Ordinance Amendment Discussion (Comm. #12-78-4) The City Council referred the parking ordinance to the Planning Commission for rewriting. It was agreed that ''motor'' should be deleted and that the word ''vehicle'' wa s sufficient. Also "public" streets was unnecessary and just the word "streets" was enough. They changed, in Section 2, "Act of the City Council" to"Resolution of the City Council". Section 1 was changed to now state, "It shall be unlawful for any person to leave, park, permit or allow any vehicle to stand or remain upon any City street or right-of-way or on the traveled portion of the road or to obstruct the flow of traffic, unless for an emergency, between the hours of one (1) o'clock A.M. and six (6) o'clock A.M. of each day". Section 4 would now read, '~ollowing the declaration of a snow emergency by the City, it shall be unlawful to park or permit to be parked, or to continue to park or permit to stand any vehicle upon any City street until such time as the snow has been plowed from said street or the snow emergency declaration lifted." Section \ 8 was changed to state, "Any person, firm or corporation violating any of the ) provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished as defined by State Law." Motion by Retzlaff, seconded by Pyron, that the Andover Planning and Zoning Commission recommends to the City Council adoption of Ordinance 33A, an Ordinance amending the City's Parking Ordinance, inasmuch as the proposed parking ordinance 33A will remedy some of the existing or ongoing problems that the City has incurred with vehicles being parked in excess of 24 hours and overnight parking of trucks and semitrailers on residential streets and that the proposed Ordinance 33A would invoke limited parking and totally restrict parking between the hours of 1 A.M. and 6 A.M. Motion carried unanimously. This will be on the City Council agenda on January 16, 1979. Ordinance lOD Discussion (Comm. #12-78-6) There will be a public hearing on this proposed amendment on January 9, 1979. The Commission discussed Section 9.07.10 which states the P and R Commission will establish separate budgeting, etc. Als~ in 9.07.12, having a ceiling on adding the 1%.
