MINUTES
A Special Meeting of the Andover Park/Recreation Commission was called to order
by Chairman MEnd at 7:10 p.m., September 21, 1978.
Commission Members Present: Anderson, LeFebvre and Nichols
Commission Members Absent: Curtis, Meyer and Rogers
Also Present: Dave Pillatzke, Engineer from T.K.D.A.
Derril Burger - Rum River Forest Pre. Plat
Dean Lutterman - Wobegon Woods Pre. Plat
Harvey Kadlec - Kadlec Add. Pre. Plat
Jim Conroy - Pond View Pre. Plat
Linda Johnson & Bruce Hay - Johnson's Field
RUM RIVER FOREST PRELD!INARY PLAT
Mr. Burger presented the Commission with a preliminary plat they had not seen before.
There was no proposed park land shown on this plat, only a small 80' river access
shown as Outlot A. It was felt to use the term "outlot" was now illegal. Lots
11 and 12, Block 1, would abut this "Outlot A" making one contiguous park. Dave
Pillatzke stated these lots do not meet City Code for buildable lots at this time.
If the Commission accepted these lots and the boat access, they would never be able
to provide any bathroom facilities without a lot of fill. Mr. Burger stated he
would lose $50,000 on these lots and he plans on filling them as he can get fill
for 50~ a yard. He suggested possibly tots 5 and 6, Block 4, as a possible park
site. Steve Nichols didn't think people would walk that far from the river to these
lots to have a picnic. The Commission all agreed that the 75' river access was
much too narrow to be of any use. Chairman Mand asked ~~. Burger if he would be
willing to fill Lots 5 and 6, Block 4. He said no, any fill obtained on site would
be put on other lots as he has to raise the lots 3 ft. above flood plain level.
Dave Pillatzke then explained the street drainage and run off in that area. He
asked Mr. Burger if he was planning on putting in bituminous streets. Mr. Burger
said he would not commit himself at this time but was almost certain they would be
blacktopped. Chairman Mand asked what the river setback was. Mr. Burger thought it
was 100 ft. Bill LeFebvre asked about the land on the river at the north end. Mr.
Burger stated there is a high cliff in that area not suitable for a boat landing.
He was then asked what the park dedication fee would be on this property. Mr. Burger
wasn't sure but thought it was taxed at $90,000 which would mean $9,000 in park
dedication fees. Dave Pillatzke asked if the elevation of the river had been shot
and Mr. Burger stated he didn't know if it had been done. Again, Chairman Mand asked
if he, Mr. Burger, would consider filling in the area (Lots 5 & 6, Bl. 4) and he
stated he preferred not to get involved in that. In the lengthy discussion that
followed, it was felt there would be excess fill available from future plats in the
area and the Park/Recreation Commission could arrange to fill the proposed park
area at their direction in order to have some control over where the fill would be
placed.

MOTION by Nichols, seconded by Anderson, to recommend that the City Council accept
Lots 5 and 6, Block 4, totalling 7.0 acres, plus the area which is now termed Outlot
A; said Outlot A is to be revised to show a minimum of 125 ft. river frontage and
125 ft. road frontage (154th Ave. N.W.) as dedicated park land, and that the-balance
be cash in lieu of land provided that the above described property shown on the
revised preliminary plat presented to the Park/Recreation Commission by lAr. Derril
Burger on September 21, 1978 is the same as shown on the final plat of Rum River
Forest, with the exception of the added river and road frontage. Motion carried
unanimously.
WOBEGON WOODS PRELIMINARY PLAT AND KADLEC ADDITION PRELIMINARY PLAT
Mr. Lutterman representing Wobegon Woods and Mr. Kadlec representing Kadlec
Addition came jointly to request the Commission to accept money in lieu of land
on both their plats since they were so small with the stipulation that this money
be used to dredge out the pond in nearby White Oaks Country Estates. Mr. Kadlec
offered to spend 20 brs. of his time in dredging. It was decided it would be best
if the City arranged to have it dredged due to the slopes having to be figured out
by our engineering firm plus inspections. Mr. Lutterman and Mr. Kadlec mentioned
they have received requests from the residents in the area to have White Oaks
Country Estates park improved. Mr. Kadlec then offered $3,000 in lieu of park
land and 1~. Lutterman offered $4,000.00. Since the Kadlec plat is 57 acres and
Wobegon is 37.3 acres, in order to be equitable to both, Dave Pillatzke figured
out on his calculator that the money amount should be $4,245 on the Wobegon Woods
plat and $2,755 on the Kadlec Addition plat. Mr. Lutterman and l~. Kadlec were
agreeable to this. These amounts are more than 10% of the assessed value.
MOTION by Mand, seconded by Nichols, to recommend that the City Council accept
money in lieu of park land on both the Wobegon Woods and Kadlec Addition plats;
further that a maxiumum of $4,245.00 derived from the Wobegon Woods plat and a
maximum of $2,755.00 derived from the Kadlec Addition plat be spend only for the
improvement of Vl.hite Oaks Country Estates Park, as specified by the developers.
Motion carried unanimously.
POND VIEW PRELIMINARY PLAT
Mr. Conroy requested the Commission to accept money in lieu of land since this
plat is so small. When asked about the shopping center, Mr. Conroy stated the
proposed store would be similar to the Penney's at 109th & University. A break
was taken from 9:30 to 9:45 in order to look at Mr. Conroy's shopping center plan.
MOTION by Mand, seconded by Anderson, to recommend to the City Council to accept
money in lieu of park land on the Pond View plat and that the money be used to
improve parks in that area. Motion carried unanimously.
JOHNSON'S FIELD
Linda Johnson introduced her brother-in-law, Bruce Hay, who owns 50 acres east of
Johnson's Field. She stated they definitely did not want to give up Lots 5, 6 &
7, Block 3, and are now offering an alternative. She asked Mr. Hay if they could
purchase 3 acres from him and if he would dedicate 5 acres prior to his developing
'\ his land. Mr. Hays agreed to this and stated if the Commission/City Council,
) accepted this alternative, he would have his attorney draw up some type of an
agreement. He then presented a topographical map and stated the proposed park
would have frontage on Round Lake. Dave Pillatzke commented that most of the
area was below the 872' flood plain level. Chairman l~d said he had walked out

to the area (Linda Johnson and Mr. Hay had contacted him earlier about this
alternate) and it was true that most of it was low but it did have some high spots
and quite a few nice trees on it. He further stated the area could be filled at a
future date. As new developments come in the area, the excess fill could be hauled
into this area. Even though Round Lake can't be considered a recreational lake
at present, in the future it might be developed and become a useable lake for
swimming and boating. Mr. Hay then explained a little bit about mobile home parks
and open space requirements. When Mr. Hay does plat this property, Chairman Mand
would like to see a street along the front of the park and no residential lots
abutting it for ease of maintenance and to avoid complaints from neighbors. tIT.
Hay said he would not commit himself at this time to put a road there but something
could be worked out when he brings in the preliminary plat. He was asked if park
land could be dedicated on the 40 acre piece abutting Johnson's Field so there
would be a closer park to the residents in the area. Mr. Hay stated he did not
own this property outright, there are other people involved, but the 10 acre parcel
on the lake was his alone. Mr. Hay, with the aid of an engineer's scale, Dave
Pillatzke and his calculator, then drew this proposed park on the topographical
map, the size of which is exactly 8.37 acres. (A copy of this map will be made a
part of these minutes. This proposed park is in Plat #65929, Parcel #3750.) Chair-
man Mand asked Linda Johnson if it would be alright with her if the kids from Dehn's
Addition played on Lots 11 & 12 until such time as houses were built on these lots.
This was fine with her. Chairman Mand then requested a temporary road easement from
Mr. Hay in order to be able to get to the proposed park. Mr. Hay questioned this
as he stated he didn't know the meaning of a temporary easement - at some point in
time would this turn into a permanent easement? Chairman Mand said no, just a
temporary easement so we would have access to the property until such time as the
area is developed.
MOTION by Mand, seconded by Anderson, to recommend the City Council consider the
alternative of a 8.37 acre park along Round Lake on the 50 acres belonging to
Bruce Hay (65929-3750 and 65930-1800) to be land dedication for the Johnson's Field
plat and a pre-dedication of park land for tIT. Hay's future plat. In the event
the Council wishes to approve the above, we would also recommend that a temporary
easement be obtained to be in effect until such time as permanent streets are
constructed in order to give access to the park. Motion carried unanimously.
Discussion: The Council should be advised that the Park/Recreation Commission
prefers this piece of property over Lots 5, 6 & 7, Block 3, Johnson's Field
recommended earlier. Whether or not a previous motion could be rescinded is not
known at this time. Gary Anderson commented he liked tIT. Hay's proposal as he
would like to see the City accept as much lake property as possible. Steve
Nichols questioned if this was legal - to dedicate park before it is developed.
Chairman Mand stated, according to the attorney, this is perfectly alright.
Mr. Hay asked if he would have any problem if, when he starts developing this land,
they need storm sewer drainage through the park. He was told this would not cause
a problem as this has been done in the past in a few other parks. The Park/Recreation
Commission would simply recommend a covered pipe, not an open ditch.
PLATTING PROCEDURE
Some of the new plats discussed tonight were not far enough along in the platting
procedure to be referred to the Commission by the Planning and Zoning Commission.
/ It is the Commission's feeling that proposed park land could change for various and
sundry reasons and the developer would then have to return possibly causing an
unnecessary delay. There is also a chance that a final plat could be approved with
park land far different than presented on the preliminary plat shown to the

Planning and Zoning Commission. Motion carried unanimously.
Also some of the plats coming in do not show ar~ park land. It was felt park
land should be proposed on plats over 30 acres in size. The Planning and Zoning
Commission is to be advised of this.
