Approval of Minutes - October 26, 2004 DATE: November 23, 2004 Request The Planning and Zoning Commission is asked to approve the minutes from the October 26, 2004 meeting. 0 • f 11 0 0 PLANNING AND ZONING COMMISSION MEETING — OCTOBER 26, 2004 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on October 26, 2004, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Tim Kirchoff, Tony Gamache, Rex Greenwald, Dean Vatae, Jonathan Jasper and Michael Casey. Commissioners absent: There were none. Also present: City Planner, Courtney Bednarz City Engineer, Dave Berkowitz Associate Planner, Andy Cross Planning Intern, Chris Vrchota Others APPROVAL OFMINUTES. October 12, 2004 Chairperson Daninger noted there was slight duplication on pages two and three which should be deleted. Motion by Gamache, seconded by Casey, to approve the minutes as amended. Motion carried on a 7 -ayes, 0 -nays, 0- present, 0- absent vote. PUBLIC HEARING: COMPREHENSIVE PLANAMENDMENT (04 -03) TO UPDATE THE SEWER STAGING PLAN. Mr. Bednarz explained the City has completed a sewer study and determined how the existing sewer trunk system will provide sewer service to remaining undeveloped areas within the Municipal Urban Service Area (MUSA). Mr. Bednarz discussed the staff report with the Commission. r s Regular Andover Planning and Zoning Commission Meeting Minutes — October 26, 2004 Page 3 • Commissioner Gamache wondered how a property could be split into two pieces. Mr. Bednarz explained how sewer could be brought to the property from two different sewer trunks. Ms. Betty Wahlstrom, 1260 Crosstown Boulevard, and Diane Danhill, 1220 Crosstown Boulevard stated they understood the sewer will be going in and they felt it would be to the best interest of the City and County if they run the sewer through their property because it would be less cost and they are already working with developers so it would be an asset to them also. They also asked if the City could consider putting town homes on Crosstown as a buffer. Motion by Gamache, seconded by Casey, to close the public hearing at 7:21 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Vatne asked what the capacity is estimated to be on the Crosstown section of the trunk. Mr. Berkowitz stated the key point is the Yellow Pine Lift Station. He stated what is recommended through the report is to utilize the Crosstown Trunk and then to maximize the lift station and design it so it handles all of the discharge from north of Crosstown including whatever would contribute to the Crosstown Trunk. He stated the governing would be the actual lift station. They can only design that to a certain size and they have looked at the maximum size and would run that at one hundred percent • capacity. He stated they have to determine a line and draw the line so they do not run into future capacity issues. Commissioner Greenwald asked what the time frame is for the lift station to the east of 154 Lane and how much would it cost. Mr. Berkowitz stated the lift station is considered a lateral lift station which will handle another section when developed and costs around $125,000. Commissioner Kirchoff asked if Mr. Schippers lot and the lot to the east help the development by providing access to the development. Mr. Berkowitz stated that was correct. He showed how the roadway will run through the development in the future. Chairperson Daninger recapped what was proposed for the staging plan. Commissioner Jasper asked if staff was in favor of the requests from residents to be moved up in the plan except for Mr. Schippers front portion of his lot. Mr. Bednarz stated they are not. There are properties that were moved back because they are being served by a different sewer trunk to allow capacity to be spread through out the City in a more efficient manor. Commissioner Vatne stated if they move forward with the Crosstown Trunk, there is potential development going on, he could see them getting into a similar situation as what happened north of 161 ". He wondered if Mr. Bednarz envisioned that type of process. Mr. Bednarz stated that was a different situation because they already arrived at that Regular Andover Planning and Zoning Commission Meeting Minutes —October 26, 2004 Page 5 • PUBLIC HEARING: PRELIMINARYPLAT FOR ANDOVER MARK ETPLACE 2N" ADDITION LOCATED AT 2218 BUNKER LAKE BOULEVARD NW. Mr. Vrchota explained the applicant is proposing to create one new lot for commercial development near the northeast corner of Andover Marketplace. Mr. Vrchota discussed the staff report with the Commission. Commissioner Greenwald stated he remembered discussing this particular lot when the first part was developed and he thought staff did a good job. Motion by Greenwald, seconded by Gamache, to open the public hearing at 7:45 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. There was no public input. Motion by Greenwald, seconded by Kirchoff, to close the public hearing at 7:45 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Jasper asked what was going to be developed. Mr. Vrchota stated they have not received anything specific on this. • Commissioner Kirchoff asked if there was enough parking for this lot. Mr. Vrchota stated it will be with the shared parking. Commissioner Vatne asked if it was typical that they would be going this far into a preliminary plat without specifics on a tenant and more detail. Mr. Vrchota stated this would all be handled during the commercial site plan review process. Chairperson Daninger explained the process for commercial development. Motion by Greenwald, seconded by Gamache, to recommend to the City Council approval of Resolution No. , approving the proposed plat subject to the conditions listed in the attached resolution and any additional items of concern. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Mr. Bednarz stated CVS will be opened this coming Sunday and he was not sure about when Walgreens would open. Commissioner Greenwald asked if they had any luck on the comer property at Andover Station South. Mr. Bednarz stated the property continues to be marketed by Ryan Companies and they have not seen an official submittal at this time. Chairperson Daninger stated he noticed some building going on at Clock Tower Commons. Mr. Bednarz stated the fi - amed building is a Conoco and they are seeking offers for the remainder of that site but there is not anything under review. Commissioner Greenwald wondered what was going on with the bowling alley. It was indicated they had not heard anything. Chairperson Daninger stated there will be three seats available for the Planning and Zoning Commission this year if any one is interested. SUBJECT: Conditional Use Permit Amendment (04 -08) for a drive -thru window at Lot 5, Block 1, Andover Clocktower Commons DATE: November 23, 2004 INTRODUCTION The applicant is requesting to amend their Conditional Use Permit to add a drive -thru window at the south end of the proposed retail building. The window would provide drive -thru service for a future coffee shop. DISCUSSION As per section 12 -13 -3 of the Andover City Code, a drive- through window is a conditional use in the Shopping Center (SC) zoning district. The Conditional Use Permit (CUP) review process allows for the review of the planned design for traffic circulation, stacking, and potential impacts from noise and lighting on neighboring properties. Drive- through windows have previously been approved for a bank and fast -food restaurant in Andover Clocktower Commons. Impact on neighboring properties will be limited, as the site is bordered by retail development on three sides and Hanson Boulevard to the west. Access and stacking for the proposed drive- through would be on the west side of the building, with the order board and window on the south side. The site plan has been modified to allow drive aisles as recommended by the Fire Department. The City Code does not govern hours of operation of the drive- through window, though the Planning Commission can make this a condition of approval if they deem it necessary. Applicable Ordinances Chapter 12 -5 -6 B of the Andover City Code provides the following criteria for the issuance of a Conditional Use Permit: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the planning and zoning commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent • streets and land. c. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the comprehensive plan. CITY OF ANDOVER COUNTY OF ANOKA • STATE OF MINNESOTA RES. NO. As part of our PUD approvals (Resolution R157 -03) for this project, a drive -thru was allowed for both the bank and fast -food restaurant, but was not specifically allowed for the retail building. In our discussions with the possible tenants, it has become obvious that coffee shops require a drive - through window for customers. Therefore, we are proposing to locate the coffee shop on the south side of the retail building. This would allow customers to use the existing one -way drive behind the retail as the drive -thru. We have modified the site plan to include directional signage for this coffee drive -thru lane. The drive -thru lane is a one -way access 24 feet wide. As recommended by the City Fire Department, we have maintained a minimum 20 -foot wide drive aisle in all locations. This resulted in the need to shift the restaurant building south approximately 5 -6 feet, which will reduce the clocktower plaza area slightly. No other changes are proposed. Stacking in excess of ordinance requirements can be accommodated on site, while maintaining a 12 -foot emergency bypass lane in the rear of the building. We believe is consistent with the intent of the ordinance and we note that emergency vehicles would have access to the retail building from the front of the building and from Hanson Boulevard. The order board is located on the south side of the retail building, which would minimize the impact on surrounding properties, as the site is surrounded by retail on three sides and Hanson Boulevard on the west. We have reviewed the ordinance standards and believe that the request is consistent with the Conditional Use Permit standards for a drive -thru in the Shopping Center (SC) District and the approved Planned Unit Development for Andover Clocktower Commons. This is a project that has been worked on periodically over the past three years. During this time a large number of ordinance sections have been identified as being in need of revision. DISCUSSION Background The Zoning Ordinance portion of the City Code (Title 12) was adapted from a model zoning ordinance created by the League of Minnesota Cities in the 1960's. There have been a number of specific text amendments over the years but a comprehensive update has never been completed. As a result there are a wide variety of issues to be addressed. The revisions range from modernizing the ordinance to correcting conflicts to adding specificity to ease understanding and enforcement. Attached is a table that lists each potential revision by City Code section. The table includes a brief description of the issue and what is needed to correct it. Process This evening's goal is to discuss the process that will be employed to complete the Zoning Ordinance update. Staff has been involved in this process in other communities and suggests the following approach. The table will be divided into manageable groups for discussion at a series of worksessions. Each issue identified in the table will be addressed in more detail in a standardized report format. Once agreement has been reached on a particular issue, we will move on to the next. Once all of the issues have been resolved, a revised ordinance will be brought forward for approval. Due to the large number of items, an in depth discussion of each could cause this process to take a year or longer. Many of the issues are simple corrections that do not require in depth discussion. Staff proposes to bring forward these items in a larger group first. At the December 14 meeting, The Commission will be asked whether it desires more discussion of each item. If it does not, the item will be considered resolved and ready for adoption. If the Commission feels more discussion of a particular issue is warranted, that issue will be brought forward for discussion at a later date.
