The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was
called to order by Chairperson Daninger on May 25, 2004, 7:00 p.m., at the Andover City
Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota
Commissioners present: Chairperson Daninger, Commissioners Tim Kirchoff, Tony
Gamache, Dean Vatne, Jonathan Jasper (arrived at 7:09
p.m.) and Michael Casey (arrived at 7:15 p.m.).

Mr. Bednarz explained that the Planning Commission is asked to review a preliminary
plat with four urban residential lots located at the northeast comer of 133 Avenue NW
and Jay Street NW. The Planning Commission and Council previously reviewed this
proposal as a sketch plan.
Mr. Bednarz discussed the staff report with the Planning Commission.
Commissioner Kirchoff asked how far the existing Jay Street driveway from the
intersection of 133rd was. Mr. Bednarz stated this is fifteen feet from the intersection.

Commissioner Kirchoff asked if this driveway were to be moved. Mr. Bednarz stated the .
existing driveway would be relocated onto 133 because there would be a new lot there.
Commissioner Gamache stated the residents behind the lots were concerned about the
drainage area. He wondered if this new drainage area they are proposing going to
alleviate some of the concerns of the residents. Mr. Bednarz stated the drainage area will
be lower than the backyards of the adjacent homes. Commissioner Gamache stated this
should take care of the concerns. He asked what the purpose of sharing the driveway is.
Mr. Bednarz stated he believed this was to limit the number of accesses onto 133
Commissioner Jasper arrived at 7:09 p.m.
Commissioner Gamache asked if they were to change the collector street ordinance,
would the driveways comply on the road. Mr. Bednarz stated it would not because the
trips per day would be between 3200 and 3600 trips per day according to the
transportation plan.
Commissioner Vatne asked in terms of the shared property, this would also require a
variance. Mr. Bednarz stated the driveways would also require a variance to the 5 foot
setback from interior property lines.
Commissioner Kirchoff asked if the combined driveways would allow the two homes to
use the driveway to turn around in. Mr. Bednarz stated it looked like there was sufficient
room to do this.
Commissioner Vatne asked under the proposed amendment if 133 would be classified
as a major or a minor collector street. Mr. Bednarz stated this would be a major collector
road.
Commissioner Kirchoff asked if the lots in Coon Rapids directly to. the south have
existing driveways on 133 Mr. Bednarz stated there were some driveways on 133
directly to the south.
Motion by Gamache, seconded by Vatne, to open the public hearing at 7:12 p.m. Motion
carved on a 5 -ayes, 0 -nays, 2- absent (Casey and Greenwald) vote.
Mr. Gary VanKamp, 13318 H St., wondered if the previous plan had three
driveways and it was now reduced to two. The applicant nodded it was true.
Mr. VanKamp was concerned about the flood pond shape because it abuts his property.
He also was concerned that allowing an access onto a collector street will open it up to
others putting driveways on collector streets.

• Ms. Julie Magnon, 13257 Jay Street in Coon Rapids, wondered if they had any idea what
type of houses are going up. She wondered if it was ever discussed to put less than three
new houses on the property. Chairperson Daninger stated the issue of the number of
houses was discussed previously.
Ms. Linda Oberlander, 13315 Jay Street, stated three houses on this lot seem to be a lot.
She stated she was mainly concerned because she is the neighbor next to him and she was
concerned about the value of the houses put on the lots.
Motion by Gamache, seconded by Kirchoff, to close the public hearing at 7:19 p.m.
Motion carried on a 5 -ayes, 0 -nays, 1- absent (Greenwald) vote.
Mr. James Napier, Midwest Land Surveyors, stated the homes will be split entry and 2
walkouts. He stated the houses will be in the $250,000 range. As far as the ponding,
they have over compensated for this to allow for storm water.
Commissioner Jasper asked if there were four lots with one not being built on. Mr.
Bednarz stated there are still four lots and the City owns a lot next to these. All four lots
will be built upon.
Commissioner Vatne asked if the existing home faced west. He stated the new house will
have the driveway going out onto Jay Street and assumed this would also face west. Mr.
• Napier thought the builder will have the front of the home face south. It will be like a
side load garage. Commissioner Vatne asked if the other homes will face south also. Mr.
Napier stated that was, correct.
Commissioner Vatne asked if they sent the plans to the Coon Creek Watershed District
for review. Mr. Napier stated it is in review scheduled for final approval at the
Watershed District meeting on June 15''.
Chairperson Daninger wondered what the alternate plan was. Mr. Napier explained the
alternate plan for a private street to the north was not feasible due to neighborhood
opposition and the need to use a portion of the area for storm water drainage.
Commissioner Gamache stated they are already giving a variance for the driveways on
133' He does not want to give a variance for the driveways on 133` and the shared
driveway. He stated a shared driveway is not a good idea and he did not like the idea of
this.
Commissioner Kirchoff asked if they would have a problem having separated driveways.
Mr. Napier stated they would rather do that this way.
Commissioner Vatne stated his concern was driveway access at all onto a collector street.
• Commissioner Gamache stated the City of Coon Rapids has driveways on this road on
the other side of the street. Commissioner Kirchoff agreed.

Chairperson Daninger stated his concern is they were putting driveways on an already •
busy street and they would have to give three variances for driveways.
Mr. Rousseau stated the other alternatives were putting the driveways behind and they
could not do this because of neighbor's opposition and the pond going through there. He
questioned the number of cars on the road during the day at 3,300 because the last time
they were talking about it, it was closer to 2,000. Chairperson Daninger stated this still
exceeds their maximum. Mr. Bednarz stated the count accounts for build out in the
future and not current traffic. Mr. Rousseau stated the area is fully developed except for
his land and he did not think there would be any more traffic coming through.
Commissioner Vatne stated he thought there will be additional traffic in the future with
building to the north, west and east generally will cause more traffic.
Commissioner Jasper stated his decision is the same as at the sketch plan review. He
thought they were trying to force too much in a small area
Commissioner Kirchoff stated all four of the lots are conforming to their ordinances in
the City. He stated this is an infill proposal. He stated he would support a variance for
the driveways coming out onto 133 Commissioner Casey concurred with
Commissioner Kirchoff.
Chairperson Daninger stated he agreed that the lots are the right size but what are in front •
of them are the variances and the driveways. He wanted to make sure Commissioner
Kirchoff was fine with this. Commissioner Kirchoff stated he was ok with this.
Motion by Gamache, seconded by Casey, to recommend to the City Council approval of
Resolution No. , approving the Preliminary Plat of Hanson Meadows with the
changes of the double driveway being split into two driveways and proposing they pass
the variance for the driveways on the collector street. Motion carried on a 3 -ayes, 3 -nays,
1- absent (Greenwald) vote.
Mr. BednarL stated that this item would be before the Council at the June 15, 2004 City
Council meeting.
A comment from a member of the audience was there are only two driveways on 133 in
Coon Rapids and they belong to older homes.
PUBLIC HEARING: REZONING (03 -09) TO CHANGE THE ZONING FROM

• Mr. Bednarz explained that the Planning Commission is asked to review the proposed
rezoning of the subject property. The property is proposed to be incorporated into the
Sophie's Manor development.
Mr. Bednarz discussed the information with the Planning Commission.
Commissioner Jasper asked for clarification on which piece of property was being added.
Mr. Bednarz showed on a map the additional property.
Motion by Kirchoff, seconded by Gamache, to open the public hearing at 7:38 p.m.
Motion carried on a 6 -ayes, 0 -nays, 1- absent (Greenwald) vote.

Motion by Gamache, seconded by Vatne, to close the public hearing at 7:38 p.m. Motion

Commissioner Vatne stated the areas that are transitional residential are pretty straight
forward and times have changed.
Motion by Gamache, seconded by Vatne, to recommend to the City Council approval of
Resolution No. , approving the rezoning request based on the fact that times and
conditions have changed. Motion carried on a 6 -ayes, 0 -nays, 1- absent (Greenwald) vote.
Mr. Bednarz stated that this item would be before the Council at the June 1, 2004 City
Council meeting.
PUBLIC REARING: AMENDED PRELIMINARY PLAT OF SOPRIE'S MANOR
LOCATED AT 1021 AND 1155 CROSSTOWN BOULEVARD NW.
Mr. Bednarz explained that the Planning Commission is asked to review an amended
preliminary plat to allow the Gordon Hines property located at 1155 Crosstown
Boulevard to be incorporated into the Sophie's Manor Preliminary Plat.
Mr. Bednarz discussed the staff report with the Planning Commission.
Commissioner Vatne asked for clarification, there was a proposal of adding a turn lane at
Xeon St. He wondered if this will be a right turn lane and a left turn lane. Mr. Bednarz
stated the proposal would be for two exit lanes coming out onto Crosstown.
Commissioner Vatne stated it was an additional lane off of Xeon and not Crosstown. Mr.
Bednarz stated this was correct. There would be two exits and one entrance.

Commissioner Vatne asked if this was acceptable to the County. Mr. Bednarz stated it •
was. Commissioner Vatne asked if there was a concern regarding the property matching
up across the street to this development. Mr. Bednarz stated this has all been addressed.
Commissioner Kirchoff asked if it was in their Ordinances to have double fronted lots on
Crosstown. Mr. Bednarz stated this portion of the preliminary plat has been approved by
the Council and double fronted lots are allowed.
Motion by Gamache, seconded by Kirchoff, to open the public hearing at 7:44 p.m.

Chairperson Daninger stated they have seen this as a sketch plan and as a preliminary plat
and there has been a lot of discussion regarding this and he has followed this and through
time and effort things have come around and been taken care of
Commissioner Vatne asked if this was a collector street going through the development.
Mr. Bednarz stated this would be classified as a minor collector street with the proposed
changes in language to the Comprehensive Plan. Commissioner Vatne asked if they had •
a variance for putting driveways on the collector street. Mr. Bednarz stated they did.
Motion by Gamache, seconded by Kirchoff, to recommend to the City Council approval
of Resolution No. , approving the amended plat subject to the conditions in the
attached resolution. Motion carried on a 6 -ayes, 0 -nays, 1- absent (Greenwald) vote.
Mr. Bednarz stated that this item would be before the Council at the June 1, 2004 City
Council meeting.
PUBLICHEARING. COMPREHENSIVEPLANAMENDMENT (04 -0i) TO
FURTHER DEFINES COLLECTOR STREETS AND TO REVISE LANGUAGE
CONCERNING GRADE SEPARATED RAILROAD CROSSINGS.
Mr. Cross explained that the Planning Commission is asked to review the revised
definition for "Collector Streets" and the revised language about grade separated railroad
crossings to be included in the proposed Comprehensive Plan Amendment.
Mr. Cross discussed the information with the Planning Commission.
Commissioner Vatne asked what was the distinction between at grade and separated
grade. Mr. Cross stated at grade means the railroad and the street are at the same level •

• and separated grade means the railroad and street are at two separate levels such as a
bridge going over.
The Commissioner reviewed what was discussed at the last meeting.
Commissioner Kirchoff stated in the Resolution where it is projected traffic. Should this
be clarified to say for the 2020 or a projected year. Commissioner Gamache clarified
Commissioner Kirchofff's question stating they should add a definition to the resolution
stating it should state 2020.
Motion by Gamache, seconded by Kirchoff, to open the public hearing at 7:58 p.m.
Motion carved on a 6 -ayes, 0 -nays, 1- absent (Greenwald) vote.

Motion by Vatne, seconded by Kirchoff, to close the public hearing at 7:58 p.m. Motion

Motion by Gamache, seconded by Kirchoff, to recommend to the City Council approval
of Resolution No. , approving the amendments to the Comprehensive Plan with the
addition of the definition as discussed.
• Commissioner Kircboff stated he has been in this business for quite a while and the
projected average daily traffic is not a true science. Commissioner Jasper stated that was
why they chose scenario three because that was the highest of the estimates. Chairperson
Daninger agreed.
Motion carved on a 6 -ayes, 0 -nays, 1- absent (Greenwald) vote.
Mr. Bednarz stated that this item would be before the Council at the June 15, 2004 City
Council meeting.
OTHER BUSINESS
Mr. Bednarz updated the Planning Commission on related items.
Mr. Bednarz mentioned that construction season has started. He noted the sites under
construction in the City along with updates on Andover Station.
Commissioner Gamache asked if there was any more information on the Clocktower
development. Mr. Bednarz stated they are still in discussions with the County for
additional accesses.

SUBJECT: PUBLIC HEARING: Lot Split (04 -02) to create two new rural residential lots
from property at 15952 Makah Street NW.

INTRODUCTION
The property owners have submitted a request to split off the northern 2.5 acres of their land to
make a new residential lot.
DISCUSSION
Both the new lot and the remaining lot involved in this split will conform to the 2.5 -acre size
requirement in the R -1 zoning district. The existing house is 11.8 feet away from the proposed
north property line. This meets the 10 -foot side setback requirement in the City Code. The new
lot, Parcel X (North) on the attached survey, conforms to the lot depth and lot area requirements
of the zoning district, but only has 270 feet of the required 300 feet of frontage. This, however,
complies with Chapter 12- 3 -4(A) of the Code, which states that a two -lot lot split must meet 2 of
the 3 requirements (lot width, depth, area) and at least 90% of the third. The 270 feet of frontage
comprises 90% of the required 300.
The specifications of the new property and the applicant's changed property are as follows:

The new lot will front onto Makah Street. The placement of the driveway must meet the required
5 -foot setback from a side property line. The driveway will easily meet the requirement that it be
placed 60 feet away from the intersection of Makah Street and 159 Avenue.

pursuant to Chapter 13 -1, and
WHEREAS, the applicant will provide a legal description and survey of a ten -foot drainage and •

WHEREAS, the applicant will pay the Park Dedication and Trail Fee for one new lot per Chapter
1 -7 -3 of the Andover City Code; and
WHEREAS, the Planning and Zoning Commission has reviewed the request and has determined
that said request meets the criteria of Chapter 12 -3 -4 and 13 -1 -3; and
WHEREAS, the Planning and Zoning Commission finds the request would not have a
detrimental effect upon the health, safety, morals and general welfare of the City of Andover; and
WHEREAS, a public hearing was held pursuant to state statutes; and
WHEREAS, the Planning and Zoning Commission recommends to the City Council approval of
the lot split as requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby
agrees with the recommendation of the Planning and Zoning Commission and approves the lot
split on said property with the following conditions:
1. The applicant is required to dedicate a ten -foot drainage and utility easement around the
perimeter of the new property.
2. Payment of park dedication fee based on the fee ordinance in effect at the time of Council
Approval for one new lot.
3. The lot split is subject to a sunset clause as defined in Ordinance No. 40, Section III(E).

INTRODUCTION
The Planning Commission is asked to review the proposed rezoning to allow the Whispering Acre
preliminary plat to move forward.
DISCUSSION
As with all rezonings, in order to change the zoning the City must establish one of the two following
findings are present:
1. The original zoning was in error.
• 2. The character of the area or times and conditions have changed to such an extent to warrant
the rezoning.
The proposed plat is consistent with the Comprehensive Plan as the property is designated Transitional
Residential (TR). This designation indicates that the property will transition from rural to urban with the
extension of utilities to the property. The property is located within the Metropolitan Urban Services area
(MUSA). City sewer and water is currently available to serve the three lots.
Staff Recommendation
The times and conditions have changed due to the fact that thee surrounding properties have developed at
urban densities and municipal utilities are available to serve the subject property. Staff recommends
approval of the proposed rezoning.

THE CITY COUNCIL OF THE CITY OF ANDOVER DOES HEREBY ORDAIN AS FOLLOWS:
City Code 12 -3 -5, The Zoning District Map of the City of Andover is hereby amended as follows:
Rezone land from R -1, Single Family Rural Residential to R4, Single Family Urban Residential
on approximately 2.5 acres (PID 36- 32 -24 -22 -0003) legally described as:
The North 218 feet of the West 249.72 feet of the North 10 Acres of that part
of Government Lot 1. Section 36, Township 32, Range 24, lying West of
Prairie Road, EXCEPT Road, Subject to easement of record.
2. The times and conditions have changed due to the fact that the surrounding properties
have developed at urban densities and municipal utilities are now available to serve
the subject property.
3. All other sections of the Zoning Ordinance shall remain as written and adopted by the
City Council of the City of Andover. •

INTRODUCTION
The Planning and Zoning Commission is asked to review the preliminary plat for Whispering Acre, a
three lot urban subdivision. The applicant has proposed to subdivide the existing 1.2 -acre rural residential
lot into three urban residential lots.
DISCUSSION
Review Process
City Code Title 11 -3 outlines the requirements for preliminary plat review. The Planning Commission is
asked to review the proposal for conformity with the Comprehensive Plan, the requirements of the City
and to ensure the proposal makes the best use of the land.
The proposed plat is consistent with the Comprehensive Plan as the property is designated Transitional
Residential (TR). This designation indicates that the property will transition from rural to urban with the
extension of utilities to the property. The property is located in the Metropolitan Urban Services area
(MUSA) and Municipal utilities are available. A rezoning to Single Family Urban residential (R -4) will
also need to be approved.
City Code 11- 3 -2(3) Street Plan
All lots will have driveways accessing onto the existing 140 "' Lane.
City Code 11 -3 -4 Easements
In addition to the typical easements around the perimeter of each lot, there will be a drainage & utility
easement for a wetland in the rear yards each lot. This easement measures approximately 68 -feet in
depth. There will also be two easements for vehicle maintenance access.
Additionally, the City has been requested to vacate a 17' X 100' roadway easement located in the
southwest corner of the property. This easement was for a cul -de -sac, which no longer exists.

The lot sizes exceed the R -4, Single Family Urban Residential Zoning District requirements provided in
the Minimum District Provisions.

The Park and Recreation Commission has recommended that park dedication and trail fees be collected
for three lots in the proposed development. •
Grading Drainage and Erosion Control Plan
The Grading, Drainage & Erosion Control plan has been reviewed by the City Engineer and the Coon
Creek Watershed District. The Watershed District states that approval is contingent upon acceptable low
floor elevations, and the removal of a berm blocking a stone water outlet pipe located on two adjacent
properties (see attached letter).
City Code requires that the lowest floor be a minimum of three -feet above the 100 -year flood elevation.
As the Grading Plan indicates, the proposed lowest floor is four -feet above the 100 -year flood elevation.
When Crown Point East was developed, there was a discrepancy between the grading plan and what was
installed in regards to a storm water pipe located between two properties adjacent to the Whispering Acre
property. The storm water pipe was too short, and a berm was left in front of the outlet causing improper
drainage into the shared pond. The City engineer has contacted the affected property owners and the City
will remove the berm and extend the storm water pipe approximately 20 -feet. This will not affect the
elevation of the pond, but will divert drainage from the storm sewer further away from two existing
homes.
Tree Preservation
The Preliminary Plat does not indicate that any trees will be saved. The developer is still required to
submit a Tree Preservation Plan identifying this. Staff suggests that the developer investigate the
possibility of custom grading with the intent of preserving mature trees located in areas where the existing
grading will not be changed. These areas are located in the rear yards near the wetland easement.
Coordination with other Agencies 0
The developer is responsible to obtain all necessary permits (Minnesota Department of Natural
Resources, U.S. Army Corp of Engineers, Coon Creek Watershed District, Minnesota Pollution Control
Agency, LGU, Anoka County Highway Department and any other agency that may have an interest in the
site). Initial contact shall be made with the City Engineering Department regarding this item.
The developer is also required to meet the following City Ordinances and all other applicable ordinances:

WHEREAS, the Andover Review Committee has reviewed the preliminary plat; and
WHEREAS, pursuant to published and mailed notice thereof, the Planning and Zoning Commission has
conducted a public hearing on said plat; and
WHEREAS, as a result of such public hearing, the Planning and Zoning Commission recommends to the
City Council the approval of the plat.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees
with the recommendation of the Planning and Zoning Commission and approves the preliminary plat with
the following conditions:
1. Contingent upon the City Council's approval to rezone the property from R -1 Single Family
Rural Residential to R -4 Single Family Urban Residential
2. The developer obtains all necessary permits from the Coon Creek Watershed District, DNR,
Corps of Engineers, LGU, MPCA and any other agency that may be interested in the site.
3. The developer petition for city sewer and water.
4. Park dedication and trail fees for three lots shall be paid in compliance with the City Code at the
rate in effect at the time that the plat is approved by the City Council.
5. Contingent upon staff review and approval for compliance with City Code, policies and
guidelines.
6. Such plat approval is contingent upon a development agreement acceptable to the City Attorney.
A financial guarantee will be required as a part of this agreement to assure typical subdivision
improvements will be completed.

At their meeting on April 26, 2004, the Board of Managers of the Coon Creek Watershed DiMrict tabled the
above referencod project pending resolution of the following stipulations:
1. Receipt of escrows. Performance Escrow. $558.00, Wctland Escrow: SI070.00
2. Provide a drainage and utility easement around the wetland/stormwater pond.
3. Complete the Declaration of Restrictions, Affidavit of Landowner, Consent to Replacement, and Proof of
Property Ownership for the replacement wetland.
4. Provide evidence that property owners affected by changes in drainage have been notified and
acknowledge the changes proposed.
5. Provide silt fence around the mitigation area once it is constructed. •
6. Clarify and resolve stormwater and flooding issues.
On May 3,20D4, Ed Matthiesen, CCWD Engineer, and Todd Hass, Assistance City Engineer for the City of
Andover met with Tom Blomberg to discuss the resolution of the drainage problem in Block 5 of grown point
East. Review of certified grading plans confirmed that the houses and lot grading were constructed according to
the approved grading plans for Crown Pont East dated 10/15/03 except for the berm blocking the Outlet pipe. A
site visit confirmed that the only drainage problem is the bum blocking the outlet pipe. The berm will be
corrected prior to or concurrent with construction of the 14e Lane NE project.
Upon resolution of the low -floor elevations and plan for removal of the berm, al] CCWD stormwater issues
bave been resolved, therefore, this project will be reviewed at the May 24, 2.004 CCWD Board of Managers
Meetiog.

SUBJECT: PUBLIC HEARING: Conditional Use Permit (04 -05) to allow on sale liquor for
proposed Andover Bowling Center at 13633 Martin Street NW.

INTRODUCTION
The proposed bowling center would be located directly south of Tanner's Restaurant as shown on
the attached plan. A liquor license is a conditional use in the General Business Zoning District. If
this use is approved for the subject property the applicant will also need to obtain Council approval
of a liquor license under the terms of City Code 13 -1.
DISCUSSION
The role of the Planning Commission as relates to this application is to determine if on sale liquor is
an appropriate use for the property. If the use is deemed appropriate, the Commission may attach
reasonable conditions to ensure that the use will be in keeping with the character of the surrounding
area.
The number of on -sale intoxicating liquor licenses that may be issued is regulated by the State. In
cities of the second class (population between 20,000 and 100,000) not more than 18 licenses plus
one per 2,500 population over 45,000 can be issued. Presently, three licenses of this variety have
been issued.
Staff Recommendation
Staff recommends approval of the proposed on sale liquor conditional use permit. This use is
consistent with the surrounding area and the Andover Station Design Guidelines which designate
the area as appropriate for entertainment uses.
ACTION REQUESTED
The Planning Commission is asked to review the proposed on sale liquor conditional use permit and
make a recommendation to the City Council.
The design and layout of the building will be reviewed by the Andover Review Committee through
the Commercial Site Plan process. If the Planning Commission has suggestions concerning the
design or layout of the building, these items will be addressed through the Commercial Site Plan
process.

A RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR ON SALE LIQUOR AT
13633 MARTIN STREET NW LEGALY DESCRIBED AS;
Lot 12, Block I Andover Station II, Anoka County, Minnesota
WHEREAS, Daniel Dahlin has requested approval of a conditional use permit for on sale liquor on
the subject property, and;
WHEREAS, the Planning and Zoning Commission has reviewed the request and has determined
that said request meets the criteria of City Code 12 -15 -6 Conditional uses, and;
WHEREAS, the Planning and Zoning Commission finds the request would not have a detrimental
effect upon the health, safety, and general welfare of the City of Andover, and;
WHEREAS, the Planning and Zoning Commission recommends to the City Council approval of the
conditional use permit request;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby
agrees with the recommendation of the Planning and Zoning Commission and approves for on sale
liquor on the subject property subject to the following:
1. The applicant shall be required to obtain an on -sale liquor license from the City Council.
2. The applicant shall complete the Commercial Site Plan process with the City of Andover.
3. The conditional use permit shall be subject to a sunset clause as defined in City Code
12 -15 -6.
