ANOKA, MINNESOTA 55303 (612) 755-5100 PARK/RECREATION COMMISSION MEETING - FEBRUARY 2, 1978 MINUTES The Regular Monthly Meeting of the Park/Recreation Commission was called to order by Chairman Mand, February 2, 1978 at 7:40 p.m. at the Andover City Hall, 1685 Crosstown Blvd. N.W. Commission Members Present: Rogers and Strandmark Commission Member Absent: Pahl Also Present: Tim Erkkila - Midwest Planning & Research Sylvia Britton - Fox Meadows Preliminary Plat Additior.sto Agenda: Fox Meadows Preliminary Plat Tennis Court Lighting Bids APPROVAL OF MINUTES MOTION by Strandmark, seconded by Rogers, to approve the Minutes of the January 5, 1978 meeting. Motion carried unanimously. COMPREHENSIVE PARK DEVELOPMENT PLAN The preliminary draft of the Comprehensive Park Development Plan was reviewed at length. Some of the suggestions made by Tim Erkkila were to - 1. Acquire land along the Rum River - if it is designated as a scenic river, there will probably be grants available to improve it. 2. Dispose of all the small parks such as Meadowood South. 3. Enter into a joint powers agreement with the County Park Dept. - to be continued - FOX MEADOWS PRELIMINARY PLAT Wes Mand looked at the proposed park and said it was a nice piece of land. MOTION by Rogers, seconded by Strandmark, to accept the designated park land shown on the Fox Meadows Preliminary Plat as presented to the Commission provided it meets the acreage requirements per ordinance. Motion carried unanimously. COMPREHENSIVE PARK DEVELOPMENT PLAN - CONTINUED Highlights of the discussion that followed were: ~~. Tim Erkkila believes large improvements, such as tennis courts, should be in one centralized large park area and not in small neighborhood parks. The surrounding residents will eventually complain of noise, lights and traffic. Judy Strandmark would like to see the park maps reduced to 8 1/2 x 11 with an overlay which would show what equipment, etc. is best suited for each park. Tim Erkkila said he would give us a cost estimate on this. Wes Mand stated he would check into this also. 3. A correction will be made in the trail portion of the plan. The dots and dashes for summer trails and winter trails are reversed. 4. On the subject of obtaining funds to to go would be to go out and sell a bond have a large enough population and there develop issue. is just parks, Glen Rogers thought the only way Tim Erkkila disagreed. Andover doesn't too much open space at this time. 5. Tim Erkkila believes we should have a minimum of $20,000-$30,000 budgeted per year for park equipment and improvements. 6. The Maplewood Ordinance would not serve Andover's needs. Maplewood is almost fully developed so they can get away with the costly park dedication fees. If we adopted a similar ordinance, it would scare the developers out and they would simply go elsewhere. 7, Ordinance #10 definitely needs to be changed. It should read "At the discretion of the Park/Recreation Commission, the developer shall be required to either.....". We should also accept 10% of the market value of the land after it is platted, not raw land value in the case of cash in lieu of parks. 8. It was decided not to hold any public hearings on the park development plan. The feeling is only those few residents who want their parks fully developed would come and would not be interested in the overall plan. A joint City Council/Park/Recreation Commission meeting will be scheduled sometime the middle of March in order for Tim Erkkila to present the plan to the Council. 9. An addition to the plan will be proposed park land should have street frontage on two sides and natural barriers when they abut lots. TENNIS COURT LIGHT BIDS Since there is a chance the location of the 1978 tennis courts will be changed from Northwoods to City Hall, the lighting contractor will be asked to run heavy cable to the posts, install a time clock, a manual switch on the post to reduce vandalism, plus a separate box to prevent overloading City Hall's system. LYLE BRADLEY - CROSS COUNTRY SKIING Wes Mand stated Lyle Bradley wanted the City to sponsor a cross country ski tour down the Rum River, Since he didn't show up, it was thought he probably gave up the idea. The remaining items on the agenda will be carried over to the next meeting in March. MOTION by Strandmark, seconded by Rogers to adjourn meeting. Since this season has ended, I recommend that the Public Works Dept. be authorized to take bids on a 78-9 2 stage 32" 10 h.p. snowthrower in late August of 1978 and submit these bids to the Park/Recreation Commission at that time for their approval or disapproval. Please keep in mind that a policy of at least 3 bids should preclude any purchase thus giving the Parks Dept. the lowest price per item purchase. u?~ d ~~- Robert A. lfuscovitz RAM/rb Bob: The policy of this City has always been that for items of less than $1,000 (minimum) bids are not taken, but rather quotes are secured from three (3) dealers. The reason for this is that the bidding process is a somewhat costly process, and therefore, a purchase of $500, $600 does not justify it. I do agree with this because if a precedent were, established to go out for bids on items over, say $200. we would have to advertise, etc. on 500/0 of our purchases. State Statute sets , the limit of $10,000 for the requirement of bids. They would like a written report on last year's summer rec program with regard to attendance, also a report on the community school program and what you plan for the 1978 summer rec. program. I realize this is short notice, this was requested at the January meeting and I just plain forgot. If you or Nancy can't come, please call and I will reschedule for April. We have a little problem on the location of the 1978 tennis courts. We got the grant for them to be located in Northwoods Add. Enclosed are minutes for the background plus a copy of the letter received from the park planner. Would it be possible to enter into a joint powers agreement with the school district to have the double court located at Crooked Lake School - the thinking is that if there is opposition at the public hearing from the residents, maybe the state would o.k. the Crooked Lake School site. Muscovitz DATE: 1-4-78 REFERENCE: Warming House I have received many complaints regarding the closed warming house by the hockey rink. At present I do not open it up unless an adult is going to be there for some length of time. It would be wise to establish some sort of rink-skating hours and hire or get volunteers to sit in the warming house for the City's protection. During the holiday season I received phone calls from all areas of the City asking if the warming house will be open if they drop their kids off to skate. I have told them that I would open it only if they are going to be staying here while their kids skate. The feeling of the park board is that they should know what you have done before it goes to Councilor Capital Improvements. In view of the above, the City Council is requesting that you hold a Public Hearing as soon as possible to receive testimony from the Northwoods' residents relative to their feelings on having the court in their neighborhood park. Items covered that were thought to have a possible negative reaction by the neighborhood were: 1) Added traffic because of this being a total City facility. 2) Lights from the courts bothering nearby neighbors. 3) Noise Another possibility discussed in the event that the Public Hearing would indicate that there is some opposition, would be building it on Crooked Lake School property under a joint-powers agreement. Weare investigating that pos sibility. A location such as the School would be within the criteria set out by the State Planning Agency and should not jeopardize the Grant. ~/}/y Patricia K. Three (3) shall be appointed for a term of one (1) year, two (2) shall be appointed for a term of two (2) years, and two (2) shall be appointed for a term of three (3) years. Terms shall expire on January 1. Original and successive appointees shall hold their offices until their successors are appointed. Vacancies during a term shall be filled by the City Council for the unexpired portion of the term. B. Compensation All Commission members shall serve with such compensation as may be set from time to time by resolution of the City Council. 1.2 PARK COMMISSION CHAIRPERSON The City Council shall appoint a Chairperson from among the appointed Commission members for a term of one year; the Commission may create and fill such other offices as it may deem necessary for it's own administration. The Commission ~hairperson shall attend City Council meetings upon the request of the City Council. 1.3 MEETINGS The Parks Commission shall hold at least one regular meeting per month on the first Thursday of the month. The Commission may hold as many additional meetings per month as the City Council or Park Commission may deem necessary. The Commission shall adopt rules for the transaction of business and shall keep a record of it's resolutions, transactions and findings. '\ ) ( ') '-.J / '\ u. -2- ~ ) 1.4 This Commission shall study ~d advise the City Council concerning the City parks and ~ecreation programs. 1.5 The Commission is responsible to the City Council for all property and programs relating to parks and recreation. The Commission shall be responsible for maintenance, improvements, upkeep and operation of all'public parks. SECTION 2. The use and occupancy of public parks and recreation areas owned by, and/or rented by and located in the City of Andover shall be subject to the following regulations: 2.1 No firearms, air rifles, B. B. guns, sling shots, explosives or fireworks shall be brought into or used in park areas. 2.2 Gambling, excessive use of alcoholic beverages or abusive, boisterous, profane or indecent language, conduct or attire will not be allowed. 2.3 No person shall possess, display, consume or use narcotics or drugs in any park. (Drugs shall mean any controlled substance, , as defined by Chapter 152 of Minnesota Statutes and successor ) Statutes, the possession of which is a violation of Minnesota Statutes 152.09 and successor Statutes.) 2.4 No advertising, selling or solicitation is allowed in parks or recreation areas. A. A permit may be issued by the City Clerk for the selling of food and nonalcoholic beverages. 2.5 Pets must be kept under control. No person in a park shall hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw missiles at any animal, reptile or bird; nor shall any person remove or have in his possession the young of any wild animal or the-eggs' or nest or young of any reptile or bird; exception to the foregoing is made in that snakes known to be poisonous, such as rattle snakes or other hazardous to human safety may be killed or removed. No person shall give, offer or attempt to give to any animal any tobacco, alcohol or other known noxious substance. 2.6 It shall be unlawful to remove, cut or otherwise deface any tree or ground cover within any park without permission from the Park Commission or City Clerk. "' ,j u L) -3- ~) 2.7 It shall be unlawful to willfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, playground equipment, tables, benches, fireplaces, railings, paving or paving materials, public utilities or parts or appurtenances thereof, signs, notices (whether temporary or permanent), monuments, stakes, posts, equipment, facilities or park property or appurtenances, whatsoever either real or personal. 2.8 It shall be unlawful to litter, or cast, or allow rubbish or trash of any nature to remain undisposed in or about any park. 2.9 It shall be unlawful to throw, discharge or otherwise place of cause to be placed in the water of any fountain. pond, stream, river, bay or other body of water, whether in or adjacent to any park or any tributary stream, storm sewer, or drain flowing into such water, any substance, matter or thing (liquid or solid). which will or may result in pollution of said water. 2.10 It shall be unlawful for anyone to interfere with the Park Commission or their appointed representatives in the performance of their duty. \ 2.11 Active games shall be limited to designated play areas. ~) 2.12 No person or persons shall engage in racing or playing of any games which interferes with the general use of designated play areas. This section shall be construed to prohibit the use of sled, toboggans, snowmobiles on any skating rink. 2.13 It shall be unlawful to ride or drive a vehicle at a rate of speed exceeding twenty (20) miles per hour in City parks. 2.14 Drivers shall confine the operation of any vehicle to raods and parking areas or such other areas as may specifically be designated as a temporary parking area by the City Council, Police Officer, Park Commission or City Clerk. 2.15 It shall be unlawful to leave a vehicle standing or parked after 11:00 P.M. at night and before 6:00 A.M. in the morning except under the following conditions: A. When camping in an area designed for such purpose. B. When participating in an activity for which a permit has been granted by the City of Andover. '\ , ~ u u -4- ,-) 2.16 It shall be unlawful to build or attempt to build a fire except in such areas as designated for such purpose. No person shall drop, throw, or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco paper or other flammable material within any park area or on any highway, road or street ,abutting or contiguous thereto. 2.17 It shall be unlawful to solicit alms or contributions for any purpose, whether public or private within ~~y park area. 2.18 It shall be unlawful to paste, glue, tack or otherwise post,any sign, placard, advertisement or inscription whatever nor shall any person erec't or cause to be erected any sign whatever on any public lands or highways or roads adjacent to a park unless approved by the Park Commission. 2.19 Whenever any group, association or organization of fifty (50) persons or more desires to use park facilities for a particular purpose, such as picnics, sporting activities, parties or theatrical or entertainment performances, the representative of said group, association or organization shall first obtain a permit from the Park Commission or City Clerk. ,) A. The application for a permit ,shall contain: 1. The name and address of the applicant; 2. The name and address of the person, persons, corporation, or association sponsoring the activity; 3. The day and hours for which the permit is desired; 4. The park or portion thereof for which such permit is desired; 5. An estimate of the anticipated attendance; 6. Proof that an indemnity bond is in full force and effect to cover the proposed activity to protect the City from any liability of any kind or character and to protect City-property from damage; and 7. Any other information which the Park Commission or City Clerk shall find reasonably necessary to a fair determination as to whether a permit should be issued hereunder. B. The Park Commission or City Clerk shall issue a permit hereunder when: 1. The proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park; ) u u -5- "- , , / 2. The proposed activity and use will not interfere with or detract from the promotion of public health, welfare, safety, and recreation; 3. The proposed activity or use is not reasonably anticipated to incite violence, crime or disorderly conduct; 4. The proposed activity will not entail unusual, extraordinary or burdensome expense or police operation by the City or County. 5. The facilities desired have not been reserved for other use at the day and hour required in the application. c. A fee of $25.00 shall be collected at the time of issuing the permit, $20.00 shall be refunded to the holder of the permit if the park or public area used is properly cleaned up. If the park or public area used is not cleaned up within 24 hours, the City shall keep the entire $25.00. SECTION 3. W. Anoka, Minnesota 55303 In the time period since my presentation (March 16, 1978), I have reviewed the "draft" Park Systems Analysis and the Council recommendations and amendments. To the basic document I propose to make the following adjustments. 1. Review several of the existing parks to determine if a more favorable "dry acreage" figure is more accurate. 2. Mention the possible joint use arrangements near Bunker Lake Park and Meadow Creek School. 3. Revise the land acquisition section aspect of the "financial planning section" to show land values at $4,500/acre to 1983, $6,000/acre from 1983-1990, and $8,000/acre from 1990-2000. This section will be removed from the report and issued as a separate study. , ) In regard to a request for advise on setting up a parks capita I improvement five year budget, I believe the financial planning section covers it fairly well. I will add that you may wish to budget $30-35,000 per year for park development and begin seeking grant moneys each year. If necessary on an as requested basis, consultant help might be sought perhaps once or twice a year to help set up priorities, advise on grants and prepare park master plans for submission on grant applications. A previous letter to the Park Commission covered this topic. Mention was made of new parks plus historic sites. I propose that these be picked up in the Ci ty Comprehensive Plan Inventory. It is unfortunate that now, nearly a year after initial discussion on the project, the historic sites are maintained for the first time. In regard to advice on the maintenance and operations aspect of the park master plan report, I don't propose to deal with that topic. I believe we have provided some direction for parks in the City and also by way of two successful grants, our relationship has significantly improved the park system already.
