PARK COMMISSION MEETING - SEPTEMBER 20, 1979
MINUTES
The Regularly Scheduled Meeting of the Park Commission was called to order by Chairman
Mand at 7:36 p.m., September 20, 1979, at the Andover City Hall, 1685 Crosstown Blvd. N.W.

BffiCHWOOD POND PRELD.HNARY PLAT
This preliminary plat consists of 27.54 acres, 8 residential lots. Dan Christensen
reported to the Commission what had taken place regarding this plat since last June. He
stated he went to the County Assessor's Office and learned the market value of the land
was $11,700.00. He thought this was low and offered to pay $1500.00 in lieu of land.
Park land was mentioned but the Commission felt, due to the size of the plat and North
Birch Creek and Pingers Park being so close, money in lieu of land would be the wisest
choice.
MOTION by LeFebvre, seconded by Rogers, to recommend the City Council accept $1500.00 in
lieu of park land on the Birchwood Pond Preliminary Plat.
Discussion: Chairman Mand thought $1500.00 was a little bit too low. He felt the figure
should be closer to the actual sale price of the land. Pine Hills paid $1100.00 for a
1.2 acre deficiency. In order to be somewhat consistent, he thought $2000.00 would be a
better figure to present to the Council. Glen Rogers commented Coon Rapids is presently
assessed 3% below actual market value. Mr. Christensen stated he did not know what it
would sell for as this is the first time he has platted anything. He, too, agreed that
$1500.00 was still low and then offered $2000.00. Motion and second withdrawn.
MOTION by LeFebvre, seconded by Rogers, to recommend the City Council accept $2000.00
lieu of park land on the Birchwood Pond Preliminary Plat. Motion carried unanimously.
Discussion: Mr. Christensen was advised the Park Commission was just an advisory board;
the City Council had the final say in the amount of money or land. Road locations and
drainage was then discussed. In response to several questions, Mr. Christensen said the
County has a 75 ft. easement on Crosstown for future widening and that l70th Ave. will
connect with Ham Lake's 3rd St. He understands Ham Lake is going to blacktop 3rd St. next
year. Bill LeFebvre asked what was in Pingers Park. Mr. Christensen stated he wasn't
sure but thought there was a ballfield.
1980 Budget

Chairman Mand advised the Commission members present of the budget cuts made by the City
Council. Salaries were cut to $8,000 as they are not going to hire another person. The
Summer School program was cut out completely as they felt it is too expensive for the
number of people attending. They cut Operating to $630 in order to balance the budget.
Repairs;Maintenance - cut to $1050. Small Tools - cut to $700. Professional Services -
cut to $200 so there will be no professional park planning done. Glen Rogers stated Game
Time will do site plans free of charge because they want to sell you their equipment.
Capital OutlayjImp,-Equipment was cut to $13,500. In the past park dedication fees have
been used to offset these items. This no longer is the case. The Council cut $9500 out
of park_dedication revenue and stated any park dedication fees received in 1980 can be
spent for park improvement or accumulated. It is assumed any interest gained would be

credited to this account. He was not sure if they cut Commission salaries or not. Also,
there is nothing in the budget as far as capital improvement items are concerned so a
,,_) tractor, a 4 wheel drive and a tanker will not be purchased in 1980.
EQUIPMENT PURCHASES
The Commission was told the City Council turned down the request for a new hockey rink.
Chairman Mand advised he talked to Pat Lindquist yesterday and she told him there was no
money in the budget for equipment purchases. She explained that Parks had overspent in
the past so money had to be taken out of other department's budgets....a "rob Peter to
pay Paul" thing. Also in past years park dedication money has been minimal. He had
diffiCulty understanding this lack of money as there is always a surplus but commented he
was not a bookkeeper. In getting down to specifics, the City had to pay about $6,000
over and above the grant money and the matching City funds for the Northwoods tennis court
lights. Other than that, the only large items purchased were a weed eater, a lawn mower
and a spare tennis court net. The double assessment payment this year was then discussed.
Glen Rogers stated in Coon Rapids neighborhood residents pick up any park assessment as
it is a benefit to the park in their area. This only amounts to a few dollars extra per
household. He also asked for a copy of the quarterly report. Suggested was to sell some
of the City parks, such as the two in Meadowood. Chairman Mand stated he was sure Bill
Hawkins told him this was illegal. Glen Rogers said it has been done in Coon Rapids.
The secretary was asked to check this out. She was also asked to get a bill from Chuck
Lund fbr the park improvement on his plat. On the subject of sandpoints, Chairman Mand
stated he had called several companies to get current prices. Blake Drilling does test
holes for $1.50 to $2,00 a foot; for another $1.50 to $2.00 they will put sand points in
the holes. He felt possibly the Fire Department might be interested in deep sand points
rather.than a cistern system.
MOTION by LeFebvre, seconded by Rogers to adjourn. Meeting adjourned 9:00 p.m.

The Regularly Scheduled Meeting of the Park Commission was called to order by Chairman

PARK SITE PLANS
Chairman Mand advised the Commission two other students from the University are preparing
park site plans for Rum River Forest. Barb Breza and Debby Dunbar were given a city map;
the park areas were pointed out to them. They stated they would like to prepare a plan for
a larger park. Suggested were Barnes, Hawk Ridge, Fox Meadows, City Hall or LakeRidge.
The girls stated they would look at these parks, select one and return to City Hall for more
information. Barb advised this course will be offered winter and spring quarters; possibly
other students would be willing to prepare more park site plans.
RED OAKS PARK
Kathy Pahl and Bev Aufderhar requested the pond in Red Oaks West be shoveled and flooded this
winter. There are three sandpoints at this location. They were advised of the budget cuts
made by the City Council and also the Public Works Dept. will be spending most of their time
plowing and grading as this portion of the budget was also cut. Bill LeFebvre commented the
Hockey Association will probably have to maintain the rink at City Hall this winter. Glen
Rogers felt the City has some obligation to maintain the parks and should provide money and
manpower to provide help. Mrs. Pahl then asked if it would be possible to borrow the pump
and some hose so the neighbors could flood it as has been done in the past. The Commission
felt something like this could be worked out. The secretary was asked to check with Ray
Sowada to see if he would agree to loan out this equipment.
NORTIDVOODS EAST PARK
Steve Johnson, who lives next to the back stop, has asked that a fence be installed between
his property and the park. He has an underground sprinkler system and is worried it will be
damaged by kids constantly cutting through and playing in his yard. Chairman Mand thought
a fast growing natural fence, such as Russian Olive trees, would serve the purpose. Glen
Rogers asked what was there first, his house or the backstop. Steve Nichols said the backstop
was there first. Glen thought Mr. Johnson created the problem so he should solve it. Also
a policy should be established for fencing parks. Edna Meyer commented she would rather see
trees and shrubs, which would be less costly, instead of fencing. Possibly the Scouts could
plant them as they are always looking for projects. The secretary was asked to write a
letter to Mr. Johnson asking what type of natural fencing he would prefer (trees, shrubs or
a hedge), and also' ask him if he would be interested helping plant them and if he would be
willing to water them once they are planted.
~UND'S EVERGREEN ESTATES
~~e Commission was advised a motion was needed to authorize the payment of $3,637.20 to Chuck
Lund for clearing the park. The Engineers feel this bill was reasonable for the amount of
work done.

"he site work done in the park located in Lund's Evergreen Estates. Motion carried unanimously.
Discussion: There is $441.68 left out of the $4078.88. Steve Nichols thought something
such as a swing set should be purchased this year before the money is lost. Glen Rogers felt
seed and fertilizer should be purchased with this money, Sharon Anderson corrnnented she
thought the Commission should go and look at the park before deciding what to do. Everyone
agreed with her suggestion.
1979 BUDGET
The Commission received copies of the estimated expenditures to 12-31-79 prepared by Pat
Lindquist and noted several errors in subtraction. Questioned was the salary figure of
$10,000. Bob Muscovitz left in February; Frenchy Stone wasn't hired until June; the CETA
boys didn't cost anything so they felt this figure was unrealistic. Rentals at $1,000 was
questioned. They don't believe they should be chargroapproximately $600 for Xerox rent as
the machine is not used that much for Park Commission business. The $1500.00-for TKDA
professional services seemed very high. The only park related item they did this year was
to rebid the Northwoods tennis court lights and made a few inspections. The postage figure
was also questioned as the Commission receives very little in the mail.- the City Council
and P & Z minutes are picked up at the meetings. Transporation at $50.00 was questioned as
no one plarnto turn in mileage except possibly the Chairman to attend a meeting in St. Paul
this month and possibly one more before the end of the year. Printing is estimated at $80.00.
The Commission questioned if they would use $80.00 worth of printing (letterhead, envelopes,
publications) this year. A question arose as to why no money was budgeted for office supplies
or printing this year. No one seemed to know or remember. There was some confusion over the
definition of printing. The line item for schools was also disputed as they know of no plans
for anyone to attend any park-related schools. The tax item was questioned. The Commission
was told the $31.00 covered back taxes on Hartfiel's Park causmby the quit claim deed not
being signed. Under electricity, if $255.00 was spent for nine months, how could an estimated
$305.00 be spent in the next three months? The secretary advised the Commission the figures
are based on a percent, 10% of this and 20% of that. The Commission felt the percentages
should be reduced to a more realistic figure. The double assessment was again discussed.
Glen Rogers reiterated his earlier comments regarding this and felt the City should change
their assessment policy. He does not feel the entire City should pay for street improvements
to neighborhood parks. The capital outlay figures were discussed at length. The end result
was a request to Pat to furnish the Commission a detailed explanation of how she arrived
at her figures by the October 18th meeting. Also, the Commission would like to know why
the $772.00 allocated out of 1977 surplus for the City Hall tennis court change order came
out of the 1979 budget. Chairman Mand stated he was upset because he asked Pat at the last
Council meeting how much the park board had to spend this year and she told him she thought
a couple thousand and now tonight he sees they are almost $8,000 in the hole. In response
to a question, the Commission was told the books are audited once a year. Glen Rogers stated
he would like to purchase a copy of the 1980 budget.
LakeRidge Hill
Chairman Mand advised the Commission of an upcoming meeting (date not yet set) with Lary
Carlson, the City Engineer, and Ray Sowada regarding the shaping of this hill and asked
the members to attend if at all possible.

FOR THE VIOLATIONS OF ITS PROVISIONS.

Commission.
1.\ COMPOSITION The Park Commission shall
consist of seven (7) members. The members shall be
appointed by the City Council by a majority vote. A
member may be removed at any time by a majority
vote of the City council.
A. Terms of Office The seven (7) members shall
be appointed for three (3) year staggered terms.
Terms shall expire on January 1. Original and
successive appointees shall hold their offices until
their succ'essors are appointed. Vacancies during a
term shall be filled by the City council for the
unexpired portion of the term. -
B. Absences Three consecutive unexcused ab-
sences of a member from duly called Commission
meetings shall constitute automatic .resignation.'
from office. Determination that an absence Is
unexcused shall be in the discretion of the Com-
mission Chairperson.
C. compensation All Commission members shall
serve with such compensation as may be set by'
resolution of the City council.
1.2 PARK COMMISSION CHAIRPERSON The

for a term of one (1) year; the commission may
create and fill such other offices as it may deem
necessary for its awn administration. The Com-

1.3 MEETINGS The Park Commission shall hold
regular meetings on tne first and third ThUrsdays of
each month. The commission may hOld as many
additional meetings per month as the City councilor

beverages, or engaging in offensive, obscene or
abusive language or boisterouS and noisy conduct
tending reasonably to arouse alarm, anger or
resentlment in others will not be allowed.
2.3 No advertising. unapproved selling or
solicitation Is allowed In park or recreation areas.
A. An Exclusive Use Permit may be approved by
the City council and issued by the City Clerk for the

playing of any games which interferes with the
general use of designated play areas. This section
shall be construed, but not limited. to prohibit the use
of sleds. toboggans. snowmobiles on any skating
rink, or other such conflicts of use.
2.9 No one shall ride or drive a vehicle at a rate of
speed exceeding that posted In City parks or fifteen
OS) miles per hour.
2.10 Drivers shall confine the operation of any
, motorized vehicle to roads. parking areas; or other
areas specifically designated as a temporary
parking area by the" City council and/or their
designated representative.
2.11 It shall be unlawful for any self-propelled
vehicle. inclUding but not limited to motor vehicles
as defined in Minnesota Statute, Chapter 169. other
self. propelled vehicles, go-carts, and snowmobiles,
to travel within City parkS, except on establlshed'
roadwayS, trails, or other areas designated for such
purpose within said parkS.
2.12 City parkS and recreation areas shall not be
occupied or used nor many motor vehicles be parked
therein between 11 o'clock p.m. and 6 o'clock a.m.
except:
A. When camping.
B. When participating in an activity for which a
permit has been granted by the city of Andover. .
2.13 It shall be unlawful to build or a"empt to bUlle:

If any section, subdivision, sentence. clause or
phrase of this ordinance is for any reason held to be
unconstitutional, such decision shall not lIftect thE
validity of the remaining portions of this ordinance.
The Council hereby declares that it would have
passed this ordinance. any section, subdivision.
sentence, clause or phrase thereof. irrespective of
the fact that anyone or more sections, subdivisions,
sentences,ctauses or phrases be declared un-
constitutional.
SECTION 4. VIOLATION AND PENALTY.
Any person. firm or corporation violating any of
the provisions in this ordinance shall be Quilty of a
misdemeanor, lInd upon conviction thereof shall be.
punished by a fine and/or imprisonment as
established by law.
SECTION 5. The City .Council may at its discretion
waive sections of this ordinance.
This ordinance shall take effect upon adoption and
publication as required bylaw. Adopted by the City
council of the City of Andover this 23rd day of
August. 1979.

AN ORDINANCE ESTABLISHING A PARK COMMISSION AND REGULATING CONDUCT IN PUBLIC
PARKS; PROVIDING FOR ENFORC:EMENT; AND PRESCRIBING PENALTIES FOR THE VIOLATIONS
OF ITS PROVISIONS.
The City Council of the City of Andover does hereby ordain:
SECTION 1. There is hereby created a Park Commission.
1.1 COMPOSITION The Park Commission shall consist of seven (7) members.
The members shall be appointed by the City Council by a majority vote.
A member may be removed at any time by a majority vote of the City Council.
A. Tenns of Office The seven (7) members shall be appointed for
three (3) year staggered tenns. Tenns shall expire on January 1.
Original and successive appointees shall hold their offices until
their successors are appointed. Vacancies during a term shall be
filled by the City Council for the unexpired portion of the term,
B. Absences Three consecutive unexcused absences of a member from
duly called Commission meetings shall constitute automatic
resignation from office. Determination that an absence is
unexcused shall be in the discretion of the Commission Chairperson.

of food, alcoholic or non-alcoholic beverages as set
out in City Resolution.
2.4 Pets must be kept leashed or under control. Horses will
be allowed only in designated areas. No person in a park
shall hunt, molest, harm, kill, trap, chase, tease, shoot
or throw missiles at any animal, reptile or bird; nor shall
any person remove or have in his possession the young of
any wild animal or have the eggs or nest or young of any
reptile, mammal or bird; exception to the foregoing is made
in that snakes known to be poisonous, such as rattlesnakes
and/or other hazards to human safety may be killed or removed.
2.5 It shall be unlawful to remove, cut or otherwise deface any
tree or ground cover in any park without consent from the Park
Commission and written permission from the City Clerk or an
appointed representative.
2.6 It shall be unlawful to willfully mark, deface, disfigure,
injure, tamper with or displace or remove any buildings,
bridges, playground equipment, tables, benches, fireplaces,
railings, paving or paving materials, public utilities or
parts or appurtenances thereof, signs, notices (whether
temporary or permanent), monuments, stakes, posts, equipment,
facilities or park property or appurtenances, whatsoever
either real or personal.
2.7 It shall be unlawful for anyone to interfere with the Park
Commission or their appointed representatives in the
performance of their duty.

2.8. No person or persons shall engage in racing or playing of any
games which interferes with the general use of designated
play areas. This section shall be construed, but not limited,
to prohibit the use of sleds, toboggans, snowmobiles on any
skating rink, or other such conflicts of use.

2.9
No one shall ride or drive a vehicle at a rate of speed exceeding
that posted in City parks or fifteen (15) miles per hour.

Drivers shall confine the operation of any motorized vehicle to
roads, parking areas, or other areas specifically designated as
a temporary parking area by the City Council and/or their
designated representative.
2.11
It shall be unlawful for any self-propelled vehicle, including but
not limited to motor vehicles as defined in Minnesota Statute,
Chapter 169, other self-propelled vehicles, go-carts, and snowmobiles,
to travel within City parks, except on established roadways, trails,
or other areas designated for such purpose within said parks.
2.12
City parks and recreation areas shall not be occupied or used nor
may motor vehicles be parked therein between 11 o'clock p.m. and
6:o'c1ock a.m. except:
A. When camping.
B. When participating in an activity for which a permit
has been granted by the City of Andover.
2.13 It shall be unlawful to build or attempt to build a fire except in areas
designated for such purpose. No person shall drop, throw, or otherwise
scatter lighted matches, burning cigarettes or cigars, tobacco, paper
or other flammable material within any park area, on any highway, road
or street abutting or contiguous thereto.
2.14 It shall be unlawful to post any sign, placard, advertisement or ~
inscription, or cause to be erected, any sign on any City park lands,
or highways or roads adjacent to a park unless approved by the City
Clerk or an appointed representative.
SECTION 3 . VALIDITY, CIAUSE.
If any section, subdivision, sentence, clause or phrase of this
ordinance is for any reason held to be unconstitutional, such
decision shall not affect the validity of the remaining portions
of this ordinance. The Council hereby declares that it would have
passed this ordinance, any section, subdivision, sentence, clause
or phrase thereof, irrespective of the fact that any one or more
sections, subdivisions, sentences, clauses or phrases be declared
unconstitutional.
SECTION 4. VIOIATION AND PENALTY.
Any person, firm or corporation violating any of the provisions in
this ordinance shall be guilty of a misdemeanor, and upon
conviction thereof shall be punished by a fine and/or imprisonment
as established by law.

The City Council may at its discretion waive sections of this
ordinance.
