'kI. . ,,~, ~e"(<l S53tJ3 p~ (612) ?SS-SltJtJ PARK/RECREATION COMMISSION MEETING - JUNE 7, 1979 MINUTES The Regularly Scheduled Meeting of the Park/Recreation Commission was called to order by Chairman Mand at 7:34 p.m., June 7, 1979, at the Andover City Hall, 1685 Crosstown Blvd. N.W. Commission Members Present: Commission Member Absent: Also Present: Anderson, LeFebvre, Meyer, Nichols & Rogers Longbella Lary'Car1son & Sylvia Britton - Woodland Terrace Preliminary Plat - LakeRidge Sketch Plan Dan Christensen - Christensen Sketch Plan Pa t Ahern d'Arcy Bose11 - P & Z Chairman DAN CHRISTENSEN SKETCH PLAN This sketch plan consists of 9 lots on 27.76 acres in Section 12. The one street will connect to 170th Ave. in Pingers Addition which has a large park. ~Ar. Christensen expressed a desire to donate cash in lieu of land. North Birch Creek park is approx- imately 4 blocks away. The Commission felt they would recommend cash in lieu of land since the park would be less than three acres and there will be two large parks in the vicini ty . LAKERIDGE SKETCH PLAN This sketch plan consists of 238 acres in Section 20. The park land shown is 22.4 acres and has two accesses. Mr. Carlson stated the park area is not buildable, but is ideal for bal1fie1ds. He went on to explain the topography of the land. The park reviewal committee met with Mr. Carlson at the site last Monday night. There is also a hill in the park that would be suitable for sliding if some reshaping was done. d'Arcy Bose11 advised nothing was mentioned at the P & Z meeting regarding the proposed park. Mr. Ahrens, who lives in the area, asked what kind of a park this would be as it is now a nature area. Mr. Carlson commented he saw three deer while mowing the area. Glen Rogers stated the park is suitable for teen and adult programs such as softball, soccer, etc. plus hockey. Mr, Ahrens was concerned that the City might want to put a drag strip, or something similar, in the park. Mr. Carlson then explained this sketch plan is in the process of being changed somewhat due to some lot frontages and street lengths. The park might expand somewhat on the northeast side making the walkway larger. However, if they are still short of the required 10%, he asked to pay the difference in cash. Since the shortage is so small, the Commission felt this was reasonable. Glen Rogers asked that the park be staked so staff doesn't end up mowing private property. Mr. Carlson stated he puts corner irons in all his plats. The roads will also be blacktopped. Mr. Carlson felt the east entrance could be used for a parking lot. However, Chairman Mand thought a lot at the end of the 153rd cu1 de sac would be a better location since the area is flatter. He then asked Mr. Carlson if there would be any excess fill generated by road construction, thinking that possibly any excess could be used to reshape the existing hill. Mr. Carlson did not know as the road profiles were not done. o WOODLAND TERRACE PRELIMINARY PLAT Mr. Carlson advised the Commission of some of the problems he has with this plat. Of special interest to the Park Commission is that the park is now shown as a holding pond. Page #2 - June 7r\979 ~ ~ark/Recreation ~ssion I'-/ting o o Mr, Carlson is meeting with the City Engineer next Monday to discourage this as he is not planning on the park being a ponding area, There is no place for the water to naturally drain in~is entire area which creates a problem. o At the Public Hearing, a few residents from Chapman's objected to the size of the parking area, its location, and added traffic. Mr, Carlson explained to them this is a neighbor- hood park which would not create an excessive amount of traffic. The ballfield would be used for Little League and they usually come in a car pool. One Chapman resident stated she was sure her teenagers would drive to the park. He felt the majority of Chapman's residents were in favor of having the park improved, There will be four accesses to the park. When the plat is redrawn, there will be an easement off 135th La. The Commission, for the record, recommends the parking lot be placed off Poppy St, and not increased in size. MOTION by Rogers, seconded by Anderson, to recommend that the City Council accept the park land as shown on the Woodland Terrace Preliminary Plat and that the approximate deficiency of 2.4 acres be cash in lieu of land in the amount of 10% of the market value; further that this money be placed in escrow to be spent for improvement of this park and adjoining Chapman's Park. Motion carried unanimously. ORDINANCE 10D d'Arcy Bosell stated this was referred back to the Park/Recreation Commission by the City Council. She did not obtain Councilperson Jacobson's not~on this amendment nor his notes on the swimming pool ordinance. MEETING DATE Since the next meeting falls during 4th of July week, the next regularly scheduled meeting will be on Thursday, June 28, 1979. ROSELLA SONSTEBY The Commission received copies of a letter written by Mrs. Sonsteby which states in part that she is willing to sell the City two lots she owns on Round Lake for a canoe access, The price for the two lots is $30,000 - $10,000 cash - $20,000 for future development. Noted was these are two unbuildable lots. Also mentioned in the letter is a petition by the residents for this access. The secretary knew of no requests for park property in this area. The Commission decided to write Mrs. Sonsteby a letter explaining their disinterest in purChasing her property since the County access is so close, CROOKED LAKE BOAT LANDING Mr. HelIum has again complained of trespassers. Suggested was posting a copy of the letter from Mr. Johnson, Principal of Crooked Lake School, stating they can park in the school parking lot. Ray Sowada will be asked to order a no parking sign of this area. PARK SITE PLANS Chairman Mand received a letter from Prof. McAvoy of the U. of Minn. He is doing a two year study of the Rum River which will be done next year, This study will be helpful in the site plan for Rum River Forest. PARK TOUR 1"--"" '-.) The park tour was set for two nights, June 14th and 27th, 6:30 p.m. r, 0 Page #3 - June 7~79 ParkjRecreation Commission Meeting o o EXCLUSIVE USE PROCEDURE AND RELATED FORMS C) Chairman MEnd stated the Council did not like the idea of keys to the back door being loaned out and felt this form should be disposed of. Once the lock box is installed at City Hall, there will be no need to loan out a key, (The green lock box presently at City Hall belongs to the Soderville Athletic Association.) The Council also questioned why non-league youth groups over 18 have to pay $50.00.as outlined in the proposed resolution. The secretary was asked to add the words "damage deposit" and send it back to the Council for their reviewal, GRANT APPLICATIONS Chairman MEnd reported Nancy Hagman and he attended the meeting held by the State Planning Agency on May 24th, Most of the Crooked Lake School project is not eligible for grant monies. He then went on to explain what was and was not fundable. A boat ramp on Crooked Lake has a very good chance of being 75% funded, Further, the DNR is going to purchase the two parcels between the parks. The City would be responsible for removing the houses and site preparation. He estimates it would cost approximately $10-$12,000 for a concrete ramp with parking for 3-4 cars and trailers and $8-$10,000 to clear the site with some landscaping. If this project is 75% funded, the City's cost would be about $5500.00. The Council, at their June 5th meeting, asked the Commission to apply for this grant. The School District is also going to apply for a grant. Mentioned was under the Park- School Guidelines, the City would be responsible for over 60% of the School District's cost. If they received a grant of only 12 1/2%, the City would have to pay 60% of the remaining 87 1/2%. This could amount to a sizeable sum. Also, if this comes to pass, the City would be responsible for the maintenance. It was the opinion of the Commission that the City's money should be spent in City parks instead of improving and maintaining school property. EQUIPMENT PURCHASE Chairman Mand explained the park dedication fees are used first for park expense before budget money is touched. The secretary was asked to obtain an up-to-date list of park expense so far this year by June 14th. There was some discussion in ordering backstops, soccer goals, etc. Exactly what to order will be decided during the park tours. There is poison ivy in Shady Knoll and Quickstrom parks - a weed sprayer plus poison should be purchased. The Commission also felt the City Council should serioUSly start thinking of hiring a full time park person due to the number of plats which have come in with usable dedicated park land. MOTION by Meyer, seconded by Nichols, to adjourn. Yesterday the Andover Deputy advised he has received many complaints of road bikes in Red Oaks West park and suggested a fence be strung across the Crosstown "entrance". (Ref. 2.14) Also, there have been complaints about bikes in Northwoods West park and pedal bikes on the tennis court surface. AN ORDINANCE ESTABLISHING A PARK COMMISSION AND REGULATING CONDUCT IN PUBLIC PARKS; PROVIDING FOR ENFORCEMENT; AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS. The City Council of the City of Andover does hereby ordain: SECTION 1. There is hereby created a Park Commission. 1.1 COMPOSITION The Parks Commission shall consist of seven (7) members. The members shall be appointed by the City Council by a majority vote. A member may be removed at any time by a majority vote of the City Council.. A. Terms of Office The seven (7) Commission members shall be appointed for a three year term. Terms shall expire on January 1. Original and successive appointees shall hold their offices until their successors are appointed. Vacancies during a term shall be filled by the City Council for the unexpired portion of the term. B. Absences Three consecutive unexused absences of a member from duly called Commission meetings shall constitute automatic resignation from office. Deter- mination that an absence is unexcused shall be in the discretion of the Commission Chairperson. C. Compensation All Commission members shall serve with such compensation as may be set by resolution of the City Council. 1.2 PARK COMMISSION CHAIRPERSON The City Council shall appoint a Chairperson from among the appointed Commission members for a term of one year; the Commission may create and fill such other offices as it may deem necessary for its own administration. The Commission Chairperson shall attend City Council meetings upon the request of the City Council. 1.3 MEETINGS The Park Commission shall hold two regular meetings per month on the first and third Thursdays of the month. The Commission may hold as many additional meetings o per month as the City Council or Park Commission may deem necessary. The Commission shall adopt rules for the transaction of business and shall keep a record of its resolutions, transactions and findings. 1.4 o () 0 0 This Commission shall study' and advise the City Council concerning the City parks and recreation programs. 05 The Commission is responsible to the City Council for all property and programs relating to parks and recreation. The Commission shall be responsible for coordinating maintenance, improvements, upkeep and operation of all public parks. 1.6 Fees and deposits shall be reviewed by the Commission on an annual basis and a recommendation made to the City Council, SECTION 2. The use and occupancy of public parks and recreation areas owned, rented and/or leased by and located in the City of Andover shall be subject to the following regulations: 2,1 No firearms, air rifles, B.B. guns, sling shots, explosive or fireworks shall be brought into or used in park areas. 2.2 Gambling, excessive use of alcoholic beverages, or abusive, boisterous, profane or indecent language, conduct or attire will not be allowed. 2.3 No person shall possess, display, consume or use narcotics or drugs in any park. (Drugs shall mean any controlled substance, as defined by Chapter 152 of Minnesota Statutes and successor Statutes, the possession of which is a violation of Minnesota Statutes 152.09 and successor Statutes.) 2.4 No advertising, selling or solicitation is allowed in parks or recreation areas. A. An Exclusive Use Permit may be approved by the City Council and issued by the City Clerk for the selling of food, alcoholic or non-alcoholic beverages as set out in Section 2.21. 2.5 Pets must be kept leashed or under control. Horses will be allowed only in designated areas. No person in a park shall hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw missiles at any animal, reptile or bird; nor shall any person remove or have in his possession the young of any wild animal or o the eggs or nest or young of any reptile or bird; exception to the foregoing is made in that snakes known to be poisonous, such as rattle snakes or other hazardous to human safety may be killed or removed. No person shall give, offer or attempt ~ '\- to o give to any anilnQ any tobacco, alcohol or o O. other known nOXlOUS substance. 2,6 It shall be unlawful to remove, cut or otherwise deface any tree or ground cover o in any park without consent from the Park Commission and written permission from the City Clerk or her representative. 2.7 It shall be unlawful to willfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, playground equipment, tables, benches, fireplaces, railings, paving or paving materials, public utilities or parts or appurtenances thereof, signs, notices (whether temporary or permanent), monuments, stakes, posts, equipment, facilities or park property or appurtenance, whatsoever either real or personal. 2,8 It shall be unlawful to litter, cast, bring in and dump, or allow rubbish or trash of any nature to remain undisposed in or about any park. 2.9 It shall be unlawful to throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, stream, river, bay or other body of water, whether in or adjacent to any park or any tributary stream, storm sewer, or drain flowing into such water, any substance, matter or thing,(liquid or solid) which will or may result in pollution of said water. 2.10 It shall be unlawful for anyone to interfere with the Park Commission or their appointed representatives in the performance of their duty. 2.11 Active games shall be lilnited to designated play areas. 2.12 No person or persons shall engage in racing or playing of any games which interferes with the general use of designated play areas, This section shall be construed, but not lilnited, to prohibit the use of sled, toboggans, snowmobiles on any skating rink, or other such conflicts of use. 2.13 It shall be unlawful to ride or drive a vehicle at a rate of speed exceeding fifteen (15) miles per hour, or as posted, in City parks. 2.14 Drivers shall confine the operation of any motorized vehicle to roads, parking areas, o or such other areas as may specifically be designated as a temporary parking area by the City Council and/or their designated representatives. 2.15 o It shall be unlawful o () C) for ~ny self-propelled vehicle, including but not limited to motor vehicles as defined in Minnesota Statute, Chapter 169, other self-propelled :--\ vehicles, go-carts, and snowmobiles, to travel within City parks, except on '---- . established roadways, trails, or other areas designated for such purpose within said parks. 2.16 It shall be unlawful to leave a vehicle standing or parked after 11:00 p.m. at night and before 6:00 a.m. in the morning except under the following conditions: A. When camping in an area designed for such purpose. B. When participating in an activity for which a permit has been granted by the City of Andover. 2.17 Public parks and recreation areas shall not be occupied or used between 11:00 p.m. and 6:00 a.m. the following day except under the conditions outlined in Section 2.16. 2.18 It shall be unlawful to build or attempt to build a fire except in such areas as designated for such purpose. No person shall drop, throw, or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco, paper or other flammable material within any park area,' on any highway, road or street abutting or contiguous thereto. 2.19 It shall be unlawful to solicit alms or contributions for any purpose, whether public or private within any park area. 2,20 It shall be unlawful to paste, glue, tack or otherwise post any sign, placard, advertisement or inscription whatever, nor shall any person erect, or cause to be erected, any sign whatever on any public lands or highways or roads adjacent to a park unless approved by the City Clerk, 2.21 No person or organization shall use a park or park area for group celebrations, meetings, entertainment, etc., which are considered "exclusive use" except through the use of a permit issued by the City Clerk. Any person, firm or corporation violating any of the provisions in this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine and/or imprisonment as established by law.
