"kI. . rI~, 11tt-e4~(a 55303 iD~ (6121 755-5100 SPECIAL PARK/RECREATION CO~AISSION MEETING - JANUARY 25, 1979 MINUTES A Special Park/Recreation Commission Meeting was called to order by Chairman Mand at 7:40 p.m., January 25, 1979, at the Andover City Hall, 1685 Crosstown Blvd. N.W. Commission Members Present: Commission Member Absent: Also Present: LeFebvre, Meyer, Nichols & Rogers Anderson d'Arcy Bosell - Planning & Zoning Commission Chairperson Chuck Lund, Steve Munstenteiger & Bruce Burton - Lunds Evergreen Estates Preliminary Plat Fire Chief Bob Palmer PROPOSED PARK ORDINANCE DISCUSSION 1.1 COMPOSITION - d'Arcy Bosell noted there is no mention of removal from office and suggested the Park/Recreation Commission use the same method as outlined in the Planning & Zoning Commission Ordinance, No. llC. Also delete the words "from time to time" under 1.1 B. 1.3 MEETINGS - change to read ...shall hold two regular meetings per month on the first and third Thursdays of the month. This would eliminate most of the special meetings in order to help the developers get their preliminary platsto the City Council. According to Ms. Bosell, if there is nothing urgent on the second meeting agenda, a meeting will simply not be held. 1.5 - change ....shall be responsible for coordinating... The way it is written now, it sounds like the Park/Recreation Commission actually work in the parks. SECTION 2. - change to read owned by, rented and/or leased by.... 2.2 - Bill LeFebvre questioned the sentence structure. To be continued. LUNDS EVERGREEN ESTATES Attorney Steve Munstenteiger explained Mr. Lund's attorney, Ron Peterson, was unable to attend and apOlogized for not being too familiar with the case. The Commission briefed him on what had transpired so far and explained the different uses between the City Hall park and a neighborhood park. Hopefully when the land is developed to the north and east of this plat, park land will be dedicated abutting Lots 1 & 2, Block 1, creating a larger park. Mr. Munstenteiger stated he had documents showing $147,000.00 was paid for this property and Mr. Lund was willing to donate $14,700.00. He was unaware the Commission desired park land. d'Arcy Bosell advised him of the future subdivision required with each plat. Glen Rogers advised City sewer is just three blocks away now and doubted whether any restrictive covenants would hold up in court once the residents are faced with public utility assessments. Mr. Lund and Mr. Burton arrived at 8:40 p.m. A break was taken in order to let Mr. Lund and the two attorneys confer. Meeting reconvened 9:00 p.m. o Attorney Burton asked what the Commission wanted. Chairman Mand advised him of the Council's f'eelings in the recent past. One plat was sent back to the Commission for either the full dedication of land or none at all. The reason the Commission selected Lots 1 & 2, Block 1 was so Mr. Lund would not have to go back to the Planning & Zoning Commission and then again to the Park/Recreation Commission for the full 10% dedication. The Commission felt it would in both the City's and the developer's best interests to take the two lots on the plat and the balance in cash. Mr. Burton then stated the $14,700.00 was a premium offer. Page #2 1 0 C ) Sp~cial-Park/Recreation Commisslon Meeting January 25, 1979 o o Mr. Lund then offered $16-17,000.00 in cash. ~'Arcy Bosell mentioned she thought the Council ;F )elt the land at the southwest corner of the plat would make good park land. The Commission '-disagreed due to the hazard of a park being located on two major arterial highways. Mr. Burton asked if park land is donated, when will it be improved? He was told as the need arises. Mr. Lund stated those lots are full of stumps. The Commission countered the City should have money to remove the eyesore. Mr. Lund then reiterated his earlier statements regarding the high cost of developing land. A figure of $4,078.88 was arrived at by taking the $14,700.00 offer and dividing that per acre and then multiplying that figure by the shortage of 2.12 acres. This money could be committed to cleaning up the park. 1~. Lund would then have a selling point to prospective buyers. The stump removal could be done at the time of the street construction since the heavy equipment needed will be there. Mr. Lund could pay the contractor for this stump ~removal and there would be no need to pay the City of Andover direct. However, if the removal costs less than $4,078.88, he would have to pay the difference. The City Engineer would oversee this operation. MOTION by Meyer, seconded by Rogers, to recommend the City Council accept Lots 1 and 2, Block 1, Lund's Evergreen Estates, as dedicated park land; the balance of 2.12 acres to be cash in lieu of land in the amount of $4,078.88 or services in lieu of the cash payment to grade, restore and develop the park area in accordance with plans approved by the City Engineer and the Park/Recreation Commission. Motion carried unanimously. Discussion: lAr. Lund asked if this could be placed on the next City Council'agenda. He was told every effort will be made to do so. He was also advised again the Park/Recreation is only advisory, the City Council makes the final decision. PROPOSED PARK ORDINANCE CONTINUED 2.4 A. Change to read - An exclusive use permit may be approved by the City Council and issued by the City Clerk forihe selling of food, alcoholic or non-alcoholic beverages as set out in Section 2.20. 2.5 Change to - Pets must be leashed or kept under control. d'Arcy Bosell said there could come a time when people would want to field train their hunting dogs in parks. 2.6 Change to read ...without consent from the Park/Recreation Commission and written permission from the City Clerk or her representative. 2.8 - Change to read - It shall be unlawful to litter, cast, bring in and dump, or allow rubbish or trash..... 2.9 - Correct two typographical errors ...place or cause...waters of any... 2.12 Change to read - ...shall be construed but. not limited, to prohibit... and ...or other such conflict~ of use. 2.13 - add ....miles per hour, or as posted, in City parks. 2.14 Change to read - Drivers shall confine the operation of any motorized vehicle to roads, parking areas, or such other areas as may specifically be designated as a temporary parking area by the City Council and/or designated representative. OO/Ac 4,000.00 $8,000.00 Based on estimated quantities and unit prices that the City has experienced on past projects, the total estimated cost for improvements to the proposed park property is $8, 000. 00.
