The Regular meeting of the Planning and Zoning Commission was called to order
at 7:30 p.m. by Chairperson d'Arcy Bosell on November 27, 1979, at the Andover
City Hall, 1685 Crosstown Boulevard N.W., Anoka, Minnesota.
Commissioners Present:
Byron Copley, Ralph Kishel, Richard Okerlund, Larry
Retzlaff, George Lobb and Walter Dick
Also Present:
Mark Schumacher, TKDA; Walter Vasecka (sp), and
Pat Anstead. (sp)
Approval of Minutes:
November 13, 1979
Page 3, last paragraph, where it talks about the moratorium; the entire
paragraph should be deleted.
MOTION by Retzlaff, Seconded by Kishel, to approve the minutes of November 13,
1979, as corrected. Motion carried unanimously on a 7-0 vote.
Chairperson Bosell added two items to the agenda at
Natural Screening for Junkyards, and No. 4 would be

Chairperson Bosell opened the public hearing.
Discussion: Chairperson Bosell suggested that in Ordinance 8 under the definition
section, Planned Development should be changed to Planned Unit Development.
Walter Vasecka (sp), 1414 Bunker Lake Boulevard N.W. - ask if when a person's propert
is rezoned, aren't they suppose to be notified? He stated that in saw the notice
in the paper of the public hearing and was listed there, but did not receive a
notice in the mail. He said his property was rezoned in 1973 and he was never
notified at that time either. Chairperson Bosell stated that this is in regard
to the Public Hearing on the Rezoning of the Urban Service District and will be
discussed when that item comes up on the agenda.

The following are the proposed changes for the chart. Under Floor Area per Dwelling:
one story unit would be 956 plus 100 square feet for each bedroom over two; carry
over through R2, R3 and R4,
one and half story would be 860 plus 100 square feet for each bedroom over two;
carryover through R2, R3 and R4,
two story would be 860 plus 100 square feet for each bedroom over three; carry through
R2, R3 and R4,
split entry would be 956 plus 100 square feet for each bedroom over four. The
dimensions for R2, R3 and R4 would remain the same.
Then under three family, add another division dealing with garages. Those
figures would be as follows:
one story, single garage.
(Same across the board for Rl, R2, R3 and R4)
one and a half story, single garage; same across the board.
two story, single garage; same across the board,
split entry, single garage; same across the board,
two family homes would be one garage per unit; same across the board,
three or more family homes, one and a half garage plus one and a half open spaces
per unit; same across the board.
Chairperson Bosell brought up the proposed change in Ordinance 8, Section 4.04,
the description under the permit section. It now reads: Provided it has frontage
on a public right of way. . ., but was suggested to change to: Provided it has
frontage on an accepted and/or maintained public right of way. Retzlaff stated
that you wouldn't want to put and/or in because there are some streets that the
City has not accepted, but that it is maintaining. Mark Scumacher suggested that
the maintained streets be grand fathered into accepted streets because the City
has maintained them for x-number of years. The Commission felt that it should
read: Provided it has frontage on an accepted and maintained public right of way.
It was the consensus of the Commission that in Ordinance 8, Section 4.04, Subsection
A and Ordinance 10, Section 16.02, as it pertains to permits and access, to ask
the City Attorney to give the proper language. (More specifically, the Commission
would like Attorney Hawkins to give the proper language to include the fact that
the right of way needs to be accepted and maintained; secondly, that there is not
a definition for right of way in Ordinance 8; and third, see if Ordinance 10 properly
addresses the definition).

commissioner Retzlaff stated that he has some definitions which he would like to
include in Ordinance 8. Copies of this will be provided for the other commissioners
to review.

The Commission also discussed the changing of the street width in Ordinance 10
from 50 to 66 feet.
It was agreed that this public hearing be continued to the meeting of December 11th
so that all amendments can be made at one time.
(A recess was taken at this time).
Public Hearinq/Rezoninq Urban service Area
Chairperson Bosell opened the public hearing.
commissioner Okerlund questioned if the strip of land south of the park area is
included in the Urban Service Area. Kishel indicated that this is the rifle range
area, and that it is not part of the Urban Service Area presently.
Chairperson Bosell stated that Commissioner Dick said he had not received notice of
the public hearing on this matter and felt that he should have. She said she would
check on this. Mark Schumacher discussed the sanitary sewer plan, and the directions
that TKDA sees it going in at this time. The Commission recommended that all property
within .the Urban Service District zoned Rl, be rezoned to R3. The Commission then
discussed the area along the railroad tracks, and felt that this area should be zoned LI.
Pat Anstead (sp), 720 N.W. Andover Boulevard - said that she and her neighbors would
object to the expansion of the Urban Service District. She further stated that
she is not hoping for sewer and hoped to keep this area residential. Ms. Anstead
said that she probably shouldn't speak for her neighbors, but stated that no one
was notified about this public hearing.
Chairperson Bosell explained to Ms. Anstead the different zones and their uses.
Bosell also said that notices on the public hearing were suppose to have been sent
to all landowners involved and landowners within 350 feet of the area. Bosell said
that she would check once again to see that the notices are properly sent to those
people involved.
The public hearing will be continued to the next meeting on December 11th.
Natural Screening For Junkyards
Discussion: Commissioner Okerlund felt that the wording in the revocation portion
of the ordinance needed something more exact. Copley suggested adding the words,
"stored materials" to the sentence so that it would read: If natural screening
changes in such a manner that stored materials corne into view of neighboring . . .
Also, the Commission felt that the portion pertaining to the fencing require-
ments should corne under Section B or this ordinance.

(Due to an oversight on the part of the Commission at the last meeting, this was
suppose to be sent to the City Council for their consideration on December 4th, 1979)

MOTION by Bosell, Seconded by Okerlund, that the Andover Planning and Zoning
Commission recommend to the City Council that the following amendments to Ordinance
44 be adopted:
1. Revocation: If natural screening changes in such a manner that stored
materials come into view of neighboring . " (The words stored materials be
added) .
2. That the fencing language be put up under Section B.
Motion carried unanimously on a 7-0 vote. This will go to the City Council on
December 4, 1979.

Public Hearinq On The Comprehensive Plan
Chairperson Bosell advised the commissioners that at the meeting on Monday,
December 17th, the Public Hearing on the Comprehensive Plan will be held. She
recommended that the commissioners go over the minutes from special meetings where
the Comprehensive Plan was discussed and be ready to make any amendments.
MOTION by Dick, Seconded by Okerlund, to adjoun the meeting. Motion carried
unanimously. The meeting was adjourned at 9:55 p.m.
