(612) 755-5100 u REGULAR PLANNING AND ZONING COMMISSION MEETING NOVEMBER 13, 1979 MINUTES The Regular M:leting of the Planning and Zoning Commission was called to order at 7:30 p.m., by Chairperson d'Arcy Bosell on November 13, 1979, at the Andover City Hall, 1685 Crosstown Boulevard NW, Anoka, Minnesota. Commissioners Present: Byron Copley, Ralph Kishel, Larry Retzlaff, George Illbb and Walter Dick Commissioner Absent: Richard Okerlund Also Present: Mark Schumacher, TKD~ Christine Haluptzok Canfield, Vergel Buescher, and others Approval of Minutes October 23, 1979: Chairperson Bosell wanted it to be noted for future reference that there ~ere no tapes made of the October 23rd, 1979 meeting because of a malfunction of the tape recorder. On Page 3, Fifth paragraph where it says submit a street sign plan and a sanitary sign. The words sign in both places should be corrected to design. On Page 4, second to the last paragraph, fourth line down, where it says Bosell strongly recommended . .. The word strongly should be deleted, and the word recommended should be changed to directed. Referring to the same page and paragraph above, the word confirmation is misspelled and should be corrected to conformation. On Page 5, Under the Vergal Buescher Variance, the street name Virden should be corrected to Verdin. On Page 5, under Rezoning, the second line of the first paragraph, where it says intra moratorium, the word intra should be corrected to interim moratorium, and in the same paragraph the word extra should be deleted. Same paragraph, last sentence, where it says properties within the urban service district other than those zones R4. The language from Section 3 should be the correct form used here so as to include Rl, R2, R3, R5, Ml, M2, etc. On Page 5, third paragraph, where it says the moratorium request will be held on November 13th, the words public hearing should be inserted after moratorium and the word request deleted. Then, there should be two new subdivision titles inserted for clarification of the different public hearings. They should be respectively Rezoning Public ./, Hearing, and Ordinance 8 and 10 Amendments. \.J MOTION by Retzlaff, Seconded by Dick to approve the minutes as amended. Motion carried on a 6-0 vote. o o ') PlanrIJ anI""oning Commission Heeting November 13, 1979 - ~linutes Page 2 u Chairperson Bosell added 3 items to the agenda at this time. Item No. 5 is a reminder of the special meeting on Thursday evening with the City Council. Item No. 6 was a reminder about the meeting at the Anoka City Hall regarding the Energy Agency, and Item No. 7 is a brief discussion regarding Menkveld's Green Acres. Christine Haluptzok Canfield Road Location (Comm. ~5-79-8) Christine Canfield and Eugene R. Peters (8774 Jefferson St. N. E.) - were present and stated that the easements had been signed and a newer drawing, which should have been (Commissioner Okerlund was present at this time) included in this evening I s material for review. Mark Schumacher stated that approval will be contingent upon TKDA I S review of the construction plan of the street showing the proposed grades, drainage, etc. Chairperson Bosell recommended that ~~s. Canfield talk to the surveyors to find out who to get as an engineer to draw up the street design and submit that to TKDA when it is finished. MOTION by Copley, Seconded by Kishel, that the Planning and Zoning Commission of the City of Andover recommend to the City Council that the Christine Haluptzok Canfield Road Location proposal be allowed to be constructed with a temporary cul-de-sac that exceeds the maximum length as defined in Ordinance 10, 9.03, with an easement continued along both properties to the end that has been conveyed per Attorney Hawkin's letter because it is in orderly planning and is the best use of the land. (The legal descrip- tion from the document that has already been executed should be inserted.) Motion carried unanimously on a 7-0 vote. Vergal Buescher Variance (Comm. #10-79-4) Vergal Buescher of Chaska was present with the potential buyer of the 35 acres, Mr. Rasmussen. Mr. Buescher stated that Mr. Osmond, the other owner of the attached property is unwilling to be part of the road construction. Commissioner Retzlaff felt that from the Warren Spannus opinion which was given to the Commission by Attorney Hawkins there was no need for a variance on this matter. HOTION by Retzlaff, Seconded by Copley, that the Andover Plarming and Zoning Commission recommend to the City Council that the Vergal Buescher Property be allowed to be issued a building permit and that a variance for this particular application is not necessary inasmuch as the property has the 300 feet of width and is 5 acres or more in size and with the opinion handed down by the State Attorney General Warren Spannus (from the Brooklyn Park Land Matter, October 11, 1979), as provided by Attorney vlilliam Hawkins defining what a five acre metes and bounds conveyance constitutes, that this particular parcel meets those requirements and thusly a building permit would have to be issued to it, and that it abuts on a public street. Discussion: There was some concern about what happens to the Osmond property. Hark Schumacher asked about the Osmond property and what would happen if he were to sell the five acres by itself, the easements, etc. Chairperson Bosell would like an opinion on this matter. This will go to the City Council on o o PlannC) anWning Commission Meeting November 13, 1979 - }Bnutes Page 3 ( , Public Hearing - Moratorium/Development of Land '-.J Chairperson Bosell opened the public hearing at this time. Chairperson Bosell then went over some of the different points that the Planning and Zoning Commission had been charged with by the City Council to look at as possibilities in the Urban Service District. Possible actions listed were: 1) To implement a moratorium, if in agreement; 2) Make a recommendation that no develop- ment be allowed on other than sewered lots in the Urban Service District; 3) Obtain from people who have developed industrial parks their problems and ramifications they have encountered in doing this type of thing. Harrisman and Ellen (sp Real Estate ent - stated that he represents some people that own property north of Bunker Lake Par. His question was, what is the Urban Service Area, and does the particular property he is talking about fall within that area'l This was explained to him, and the property in question did fall within the Urban Service Area. Commissioner Retzlaff recommended that the Commission focus on the moratorium and restrict the development of land within the Urban Service District in parcels other than R3 or R4 and that any further development of R3 or R4 be restricted to those properties which have sewer extended to them. The other Commissioners were in favor of this recommendation. Commissioner Retzlaff further recommended a one year time period on the moratorium. (Recess taken at this time to get some fresh air and check out the fuel oil odor). Everyone was in agreement with the one year time limit. MOTION by Kishel, Seconded by Lobb, to close the public hearing at this time. lI.otion carried unanimous]y. HOTION by Retzlaff, Seconded by Kishel, that the Andover Planning and Zoning Commission recommend to the City COlmcil an adoption of Ordinance # , an interim ordinance regulating the use and development of land within the City of Andover within the Urban Service District and the district from the east bOlmdr,y of the Urban Service District to the east bOlmdry of Section 26 & 35, to the east from Andover Boulevard to Bunker Lake Boulevard for the purpose of protecting the planning process and the health, safety and welfare of the City for a period of one year (12 calendar months) from the date of adoption. Motion carried lmanimous]y on a 7-0 vote. Chairperson Bosell stated that if the City COlmcil approves this recommendation at their meeting on December 4th, this item will be before the Planning and Zoning Commission at their last meeting in December on the 17th, and recommended that everyone be prepared at that time. o o o Planne] an()ning Commission Meeting November 13, 1979 - Minutes Page 4 ,- \ . ) '--.) Natural Screening ror Junkyards (Comm. #10-79-6) Commissioner Okerlund went over his ideas ror variance procedures as rar as the rencing provisions ror a junkyard ordinance. He stated that natural screening is acceptable when junk races junk, or when junk faces nothing, as the proposed language. The proposed time period with regard to revoking the variance is 30 days after the situation changes. Commissioner Retzlaff agreed with Okerlund that a variance provision should be adopted ror screening. It would be proposed as an amendment to Ordinance t~4, Section 5c. Commissioner Okerlund's language of option 2 would be used, adding neighboring businesses, public roads and public lands. The revocation language would be as rollows: Revocation of variance: If' natural screening changes in any manner such as comes into view of neighboring residences, businesses, public roads and public lands, upon such change the variance will be revoked immediately and an applicant has 30 days to provide screening as in compliance with this ordinance. Fencing shall be non-climbable rence with a minimum of 6 feet in heigt~. ChairpelJion Bosell said that she would have Vicki type up a draft of this to discuss at the next meeting.
