The Regular Meeting of the Planning and Zoning Conunission l'las called to order at
7:30 p.m., by Chairperson d'Arcy Bosell on October 23, 1979, at the Andover City
Hall, 1685 Crosstown Boulevard NW, Anoka, Minnesota.
Commissioners Present: Byron Copley, Ralph Kishel, Larry Retzlaff, Richard Okerlund,
George Lobb and Walter Dick
Also Present: Mark Schumacher, TKDA; William Baker, Jr.; Mr. Menkveld;
and Vergal Buescher

On Page 3, with regard to the motion on the Ed Lutz Proposed Road, the motion
was seconded by Copley.
In the same motion l'li th regard to the Ed Lutz Proposed Road, the third l1eason
of the motion should have the l'lords: ...of the intersection to the origiIL..., dele.t.ed
from the motion.
On Page 4, the last sentence of the second paragraph, the word eastment should
be corrected to easement.
On Page 4, third paragraph, third line dOl'ln where it says: as the plat meets
the ordinances of the City is in comformance with the... The word and should be
inserted between City and is.
On Page 4, third paragraph, last sentence. There should be a dash inserted
so that it reads: . .. the placement of l70th is orderly planning and the best use
of the land - cannot be shortened any possible way.
With regard to the Christine Haluptzok Road Location, the l'lord ask should be
deleted and the word tell inserted instead.
In the motion of the Boehland Variance, the word item should be deleted and
the word land inserted.
Page 5 at the very top, the sentence that says: She suggested that Mr. Stenquist
sell this as one large piece of property..., should be deleted. Chairperson Bosell
stated that the intent of her comment was that Mr. Stenquist either sell it as a
large piece of property or increase that piece of property so as to have larger
lots to split.

Page 6, Natural Screening for Junkyards, the sentence that says:
that the landfill could be required to do some fencing in the future.
should be deleted and Anoka Auto Wrecking inserted.
NOTION by Lobb, Seconded by Kishel, that the minutes of October 9, 1979 be approved

Commissioner stated that he is going to send a letter to the Legislative Commission
on Minnesota Resources, James R. Grossman, Chairperson and also to Dr. Ray Sterling
at the Underground Space Center at the University of Minnesota.

This item was deleted from the agenda.
Verbal Report fram Commissioner Retzlaff on Strawberry Commons
Commissioner Retzlaff stated that the City Council met on Tuesday,
and on a 3 - 2 vote, did not pass the Strawberry Commons Rezoning.
that the rezoning requires a 4/5 vote to pass.

William Jackson Baker, Jr., l66ll yttrium St. N.W. - stated that the request is for
a Special Use Permit to offer a real estate office out of the building located at
16326 Round Lake Boulevard.
Chairperson Bosell Opened the public hearing at this time.
Mr. Baker stated that he is currently operating the real estate at this location
and then learned that you need a special permit unless it is a business done out
of the home. There is no one living in the building at the present time. Mr. Baker
also stated that he had talked to someone from City Hall and that there was a
misinterpretation. He said he was informed about the size sign he could have.
Chairperson Bosell said that there is a Sign fee that needs to be paid. She also
stated that these people have already gone to a lot of expense with haVing the
phones installed. Chairperson Bosell asked if there was anyone in the audience
with any comments.
Lloyd Reimann, 2813 - 142nd Avenue - stated that he felt this was a good location
for this business. He said it didn't bother him up in the industrial area.
MOTION by Retzlaff, Seconded by Dick, that the Planning and Zoning Commission
recommend to the Andover City Council denial of the Special Use Permit for l-lilliam J.
Baker, Sr. and Uilliam J. Baker, Jr. at 16326 Round Lake Boulevard, and that the
the Special Use Permit does not meet the provisions of Ordinance 8, Section 7.03.
Motion carried on a 6 - yes, 1 - abstained by Copley because of relationship in
the business. This will go to the City Council on November 20th.

Chairperson Bosell reminded Mr. Baker that the Planning and Zoning Commission is
only an advisory Commission, and that he should be present at the City Council
meeting to present this to them.
MOTION by Retzlaff, Seconded by Lobb, to close the public hearing on tba Baker
and Sons Special Use Permit. Motion carried unanimously.

No one was present in the audience on this item and Chairperson Bosell asked that
this be continued to the next meeting.
Menkveld's Green Acres Preliminary Plat Public Hearin~ (Comm. #10-79-3)
At this time Chairperson Bosell opened the public hearing.
Hr. Menkveld stated that the preliminary plat is very similar to the sketch plan
that IE brought in earlier this year. There are 26 lots, which will be serviced by
sewer. There are 6 or 7 lots of record which will be incorporated in this plat.
Dahlia Street will be extended to serve these lots.
Commissioner Kishel said that the existing zoning is Rl and the proposed zoni."lg
is R4. Mr. Menkveld stated that he will request for a rezoning to accompany this.
Chairperson Bosell stated that a fee has to be paid, and a public hearing held
regarding the rezoning. Commissioner Retzlaff felt that the two lots marked
G. M. Investments should be included in the plat. Also a third lot on the north
side should be included. Chairperson Bosell stated that when the preliminary is
in its final stage it will have to go before the Park Board.
Mark SchWTlacher of TKDA went over his letter regarding this preliminary plat.
He stated that first the extension of Dahlia street to 14lst Avenue should be
studied before maldng the final decision. Second, the developer will need to
submit a street Sign plan and sanitary sewer Sign to TKDA. Third, the preliminary
plat must be approved by the Coon Creek Watershed District. With regard to the
engineering matters, it was recommended that Mr. Menkveld and Mark Schumacher
get together to discuss and resolve any.
Commissioner Okerlund asked why Dahlia street would not be extended to 14lst.
Mr. Menkveld explained that the engineers before said that because of the soil
problems in that particular area it would be best for the City and Hr. Menkveld
not to construct it.
Lloyd Reimann, 2813 - 142nd Avenue - asked Mr. 11enkveld whatever happened to the
pond that was suppose to be dug out. }fro Menkveld stated that he didn't believe
that anyone from his corporation said that was going to be a pond and left as a
nature area. Reimann said that it is all peat in this area and asked how he is
going to build here. Mr. Menkveld said that MOst of the peat has already been
removed from this area, and that there will be soil correction work done. Reimann
asked if Mr. Menkveld is going to develop this himself. HI'. Menkveld stated that
he is plamrlng on putting in the streets, the sewer, do all the platting and then
market the lots.
Peter VonVett, 2890 - 14lst Avenue N.W. - states that he would definitely want to
see Dahlia street ccnstructed and extended. Its been on the maps but has never
be built.

Sonney Lowell, 13990 Flora st. Il.W"'- feels the same as Pete VonVett and wishes
to see this street constructed and put in. He states that there are quite a
few children in this area and wants to keep his ldds alive. The traffic flow
now is quite heavy in this area and there are speeders on the road already.
Russell rentz, 14222 Ivywood St. N.W. - asked if the drainage ditch loIould be

left open. Mr. Menkve1d replied by saying that he has no control over it since
it was put in bU the City. (Chairperson Bosell is going to check to see if this
is a drainage easement) Hr. Ientz asked Mr. Menkveld why he has to put in so
many lots. Why couldn't he put less in and sell them for more to get the same
amount of money. Mr. Menkveld does not feel they are too small. Mr. Ientz stated
that most of the people moved out in this area and paid a little more for the
streets and sewer so they could have a little more elbow room, and a little more
value able home.
We1la (sp) walch! 2938 14lst Avenue N.W. - addressed the com:nission specifically
and stated that he people out in this area bought there because it was zoned
two and a half acres, they had more room for their children, and wouldn't have
the closeness of inner city life. She further stated, "That's what we want and
we expect the Com:nission to uphold that for us".
Murina I.enzmeier/~s~~8 - 141st Avenue N.\-l. - stated that one of her main concerns
is the road that is not included at this time from Dahlia to 14lst. She has two
children and does not want any more traffic than is already . present . in this area.
Carolyn Reagan (sp). 1379 Flora St. N.W. - says that she is totally opposed to the
houses in this development. She feels that most of the traffic coming into Green
Acres enters on Crocus Street and says that this is where most of the kids ride
there bikes and play. If the new road is put in or not Crocus street will still
have most of the traffic. She also stated that many of the people in this area
do not even mow about the future development. Chairperson Bosell explained that
public notice is put in the Anoka Union, and that property owners within 350 feet
are all notified by letter.

Don. Hall.boy. 11538 Risling Boulevard - has an interest in this development because
he owns a lot on the corner of Heather and 142nd. He dislikes very much the size
of the lots. He feels that at the very minimum this area should be zoned R3.
He says that the development is going to create much nnre traffic and what this
means to him is that these streets are going to be repaired more often and this
is going to be assessed to the owners. He is not in favor of the development.
William Sack (sp). 139th and Flora - would like to see Dahlia Street extended
and would also like to see the lot sizes a little larger.
Chairperson Bose11 asked Mr. Menkveld if he would consider rezoning this area
R3 instead of R4, and making the lots a little larger in size. She also said
that this would require a variance because the lots would not have the full depth.
Mr. Henkveld said that this would be a possibility. BoseH strongly recommended
that Mr. Henkveld go before the Park Board and also the Coon Creek Watershed. She
said that the City requires written conformation of the Watershed's findings.
Chairperson Bosell felt that the ordinances have to be gone through with this
preliminary plat and recommended that Mr. Menkveld get a copy of the ordinances
and do this.

Dave Almgren is to check on the elevaticn; The contiguous properly has to be
looked at and decided if it needs to be included in the preliminary plat; This
has to be brought before the Watershed; The engineering request on Dahlia Street;
The Park Board has to review the prelilninary plat; All ramifications of Ordinances
8 and 10 must be complied with; The drainage has to be dealt with; and the letter
from TKOA. A rezoning application should be filed.

The public rearing on Menkveld I s Green Acres Preliminary Plat will be continued
to the 13th of November, or whenever Mr. Menkveld is ready to come back before
the commission.
(A recess was taken at 9:1Q p.m until 9:20 p.m.)
Vergal Buescher Variance (Comm. #10-79-4)
Vergal Buescher, 9335 Kiowa Trail, Chaska - explained that he owned a farm in Ham
Lake and Andover and decided to liquidate the property. He sold the property in
Ham Lake very easily. He then sold a piece of land to Donald Osman which is at
a deadend of 167th and Virdin. He has 35 acres of property remaining which he
has a prospective buyer for, but needs to give Mr. Osman a road easement to his
property.so that his home will be legal.
Commissioner Kishel suggested that a public street be built and dedicated to the
City into this property, and then the prospective buyer could come in and request
a variance for the length of that driveway to the building site.
A motion was made at this time but withdrawn. Mr. Buescher will ask his attorney
whether he can grant conveyance of the easement to the City, and Chairperson Bosell
said that she will ask the attorney for the City, Bill Hawkins, the same question.
This matter will be brought back before the Planning and Zoning Commission on the
13th of November. The Commission will also check with Dave Alrngrem to see if he
would give a variance as described above.
Rezoning - Urban Service Area
Commissioner Retzlaff requested that we publish a notice of public hearing per the
state statutes for an intramoratoriu:n, an extra ordinance regulating the development
of land within the City of Andover for the purpose of protecting the planning process
for the health, safety and welfare of the City. The moratorium would affect all
properties within the Urban Service District other than those zoned R4.
It would be identical to Ordinance 43, specifically Sections 3, 4 & 5, and then the
dates.
Vicki is directed to have notice put in the paper for the public hearing.
The moratorium request will be held on the 13th of November.
Notice should also be published for the public hearing for rezoning of all properties
contained in the Urban Service District in the City of Andover.
The rezoning public hearing will be held on the 27th of November.
Notice should be published for the amending of Ordinances 8 and 10. (Of Ordinance
8, specifical~ 4.04 and 6.02).

The Commission agreed that the agenda for November 27th should be closed so that
only the public hearings on Rezoning and amending Ordinances 8 and 10 will be on
the agenda for that meeting.
(There will be a special 'Work session for the Commission members of the Planning
and Zoning Commission on Tuesday, October 30th, to discuss Ordinances 8 and 10).
Natural Screening for Junky'ards
This item will be discussed at the special meeting on October 30th.
MOTICN by Okerlund, Seconded by Copley, to adjourn the meeting. Motion carried
unanimously. The meeting 'Was adjourned at 10:35 p.m.
