The Regular Heeting of the Planning and Zoning Commission was called to order
at 7:30 p.m., by Chairperson d'Arcy Bosell on July 24, 1979, at the Andover
City Hall, 1685 Crosstown Boulevard NW, Anoka, Minnesota.
Commissioners Present: Byron Copley, Ralph Kishel, Richard Okerlund, George Lobb
and Walter Dick
Commissioner Absent: Larry Retzlaff
Also Present: Lloyd Reimann
Chairperson Bosell welcomed back Walter Dick to the Commission.
Approval of Minutes
June 26, 1979:
MOTION: by Copley, Seconded by Lobb, to approve the Minutes of June 26, 1979.
Vote on motion: yes - Copley, Kishel, Okerlund, Lobb, Bose1l; present - Dick.
Moticn carried.
July 10, 1979:
The word acting should be inserted in the first paragraph before the word Chairperson.
Page 3, first paragraph, ...recommendation is forth coming from the Watershed District.
The word District inserted.
Page 3, last paragraph, change two and :!. half, to, two and ~ half.
MarION: by Lobb, Seconded by Kishel, to approve the Minutes of July 10, 1979, as
corrected. Vote on motion: yes - Kishel, Lobb; present - Okerlund, Dick, Bosell
and Copley. Motion carried.
Public Hearing Ordinances 8 and 4
Chairperson Bosell opened the public hearing at this time. It should be noted that
at this time there lias nobody in the audience.

Discussion: The two definitions that Commissioner Retzlaff had found and proposed
a couple of weeks ago were read. They are: Mobile Home: A housing unit designed
for transportation after fabrication on streets and highways on its own wheels or on
a flatbed trailer to the site where only minor assembly operations are necessary.
Modular Home: A non-mobile hOUSing unit that is basically fabricated at a central
factory and transported to a building site where final installations are made perma-
nently affixing it to the site.

Commissioner Copley suggested that the words, built to meet the State Uniform Building
Codes, be added to the definition of modular homes. Are modular and manufactured homes
construed to be the same? It was suggested that each one have a Special Use Permit
and be looked at on an individual basis and have a hearing of neighbors surrounding it.
Lloyd Reimann, 2813 142nd Avenue NW - was present in the audience. Chairperson Bosell
asked if he could offer any comments or suggestions. Lloyd had opposition to the Terra
Firma Estates who were proposing a home by his. He felt that the pitch on the house
was not adequate, and the looks of the house were cheap in comparison to the other homes
in the neighborhood. He thought the ideas of the Commission were good.

MOTION by Bosell, Seconded by Lobb, that the Planning and Zoning Commission of the
City of Andover has reviewed the mobile home definition and it's their consensus that
that definition is adequate as written. Further that Ordinance 8 be amended to
include the definition for modular homes after the mobile homes definition. Modular
Homes: A non-mobile housing unit that is basically fabricated at a central factory
a:iid'transported to a building site where final installations are made permanently
affixing it to the site, built to meet or exceed the Uniform Building Code. Also,
page 10, Section 7.03, residential districts include the definition for modular
homes.
Vote on motion: yes - Okerlund, Lobb, Dick, Bosell and Kishel.

Discussion - Lot Split Ordinance #40 & 40A
Discussion - It was suggested that changing the ordinance to say, only lots, and
making some reference of it being in the sewered area would clear this up.
The changes proposed by the Commission for Ordinance 40A are as followS: The title
'Would read, "An Ordinance Regulating the Splitting of Residential Lots Serviced by
Municipal Sanitary Sewer Within the City of Andover." Section I - Definition 'Would
read, A residential lot split is any division of a lot into not more than two (2)
lots when one or both divided lots have a Width of less than 300 feet and are less
than five (5) acres in size. A, would read, No residential lot shall be divided
unless the resultant lots have at least the minimum T.4idth, depth and square footage
as required for any lot in the zoning district wherein the lot is located. B, no
change. Delete C.
MOTION by Rishel, Seconded by Okerlund, that the Planning and Zoning Commission of
the City of Andover recommend the adoption of the proposed Ordinance as amended,
Ordinance #40A for the following reasons: 1) The original intent of the lot split
ordinance was to allmi individuals suffering hardships by reason%of municipal sani- ~ ;
tary se">'ier being installed and resulting in special assessments ~cam')f-overly burden- 'l-I(~7q
some to the property miner of lots in subdivision containing large frontage; 2) The f
intent has been misconstrued to allmi parcels in urban areas containing metes and
bounds parcels of land to come in for a lot split, where in effect the variance (Ordi-
nance 8, Variance section) could just as well take care of those certain cases;
3) The proposed ordinance as amended would restrict the lot split specifically to
municipal sewered areas as originally intended; 4) The ordinance is consistent with
the Comprehensive Plant, and; 5) The ordinance as amended would take care of any
extreme hardships for large residential lots that have municipal facilities placed

in front of their property.
Vote on motion: yes - wbb, Dick, Bosell, Kishel and Okerlund. Vote carried
unanimously. A draft of the proposed ordinance as amended will be sent on to the
City Attorney for review.
Item #3, Advisement of meeting with the City Council and Midwest Plannin~
A meeting has been scheduled with the City Council for August 8, 1979 at 7:30 p.m.
at the Andover City Hall, at which time Midwest Planning will have new plans prepared.
Item #4. Park Dedication Section of the Ordinance
Chairperson Bosell asked if George wbb woold recap the information on this subject
per the April 24, 1979, Planning and Zoning Commission Minutes.
J.mION by wbb, Seconded by Dick , that the Andover Planning and Zoning Commission
recommend to Wes Hand" Chairman of the Park Commission, that the attached (copy of
minutes from April 24, 1979) is the recommendation of the Andover Planning and Zoning
Commission.
Vote on motion: yes - Dick, Bosell, Klshel, Okerlund, and wbb. Motion carried unan-
mously. This will be forwarded to Wes Mand.
llDTION by Dick, Seconded by IDbb, to adjourn. Motion carried unanimously. The meeting
was adjourned at 9:18 p.m.
