MINUTES
The Regularly Scheduled Planning and Zoning Commission meeting was called to order by
Chairperson d'Arcy Bose11 at 7:31 P.M. on Tuesday, July 8, 1980 at the dover City Hall,
1685 Crosstown Boulevard N.W., Anoka, Minnesota.
Commissioners Present: Ape1, Kishe1, Johnson, Lobb, Scherer
Commissioners Absent: Anstett
Also Present: City Engineer Larry Winner; Steve Chinander; Tom Olson, Attorney
at Law; Rosella Sonsteby; Peter Rauen
Chairperson Bose11 welcomed John Scherer to the Commission.
Approval of Minutes
June 24. 1980
MOTION by Kishe1, seconded by Lobb, to approve the minutes of June 24, 1980 as written.
Motion carried on a 5 yes, 1 present vote.
Rosella Sonsteby Sketch plan (Comm. #6-80-5)
Rosella Sonsteby, 4151 - 141st Avenue N.W. - Stated that the lots she is proposing to plat
at this time would be for twin homes. With the exception of Lots 12 and 13, all the lots are
more than 14.000 square feet which is required by the ordinance. Lots 12 and 13 are smaller
because 142nd Avenue is being extended out to Round Lake Boulevard.
Chairperson Bose11 asked Ms. Sonsteby how wide 142nd Avenue will be. Ms. Sonsteby stated
she has shown it as 66 feet wide except for a part that is 60 feet wide.
Commissioner Kishe1 stated that some of the lots are much too large. Ms. Sonsteby noted
they are large because there is a lot of low land in that area.
Chairperson Bose11 stated that the cul-de-sac has to have a 60 foot radius. She also
mentioned that Ms. Sonsteby should go before the Park Board prior to coming back to the
Planning and Zoning Commission. Another item is that the ordinance requires that all of
the owner's contiguous property must be platted.
This item will be continued when Ms. Sonsteby returns with a preliminary plat.
Steve Chinander Special Use Permit Public Hearing (Comm. #6-80-6)
Chairperson Bose11 opened the Public Hearing.
Torn Olson, 3400 W. 66th Street, Minneapolis, attorney representing Mr. Chinander - stated that
Mr. Chinander is requesting a Special Use Permit to construct a duplex on the corner of
r-'?8th Avenue and Crosstown Boulevard. The properties to the west of this lot are residential;
'--be properties on 138th Avenue are duplex and three and four unit buildings. They have
received a letter from the Anoka County Engineer stating they do not want any driveway access
onto Crosstown Boulevard. The duplex would be facing 138th Avenue and would conform with the
existing properties on that street.

~D the city to have a duplex at this location. The property would be unmarketable as a
building site for a single family dwelling.
Commissioner Kishel noted that the lot depth is only 110 feet and would require a variance.
There was a brief discussion on whether the property would have to have a central water
system or one well or two wells. It was suggested that Mr. Chinander contact the building
inspector regarding this matter.
MOTION by Kishel, seconded by Lobb to close the public hearing. Motion carried unanimously.
MOTION by Kishel, seconded by Apel that the Andover Planning and Zoning Commission recommend
to the City Council approval of the Special Use Permit for Steven J. Chinander to construct
a duplex on the property located on the northeast corner of County State Aid Highway #18 and
l38th Avenue N.W., legally described as: All that part of the South 1/2 of the Northeast 1/4
of Section 33, Township 32, Range 24, Anoka County, Minnesota, described as follows:
Commencing at a point on the South line of said South 1/2 of the Northeast 1/4; thence North
at right angles to the said South line a distance of 420.00 feet; thence West and parallel
with the South line of said South 1/2 of the Northeast 1/4 a distance of 566.20 feet; thence
on a tangential curve concave to the Northeast having a radius of 385.51 feet and having a
delta angle of 30 09' for a distance of 202.88 feet; thence North 59 51' West and tangent
to said curve a distance of 159.96 feet to the actual point of beginning of the tract of
land to be described; thence continuing North 59 51' West a distance of 152.38 feet; thence
North 30 37'55" East and parallel with centerline of County State Aid Highway Number 18 a
distance of 29.6 feet; thence deflect to the right on a tangential curve concave to the
Southeast having a radius of 2136.92 feet and having a delta angle of 17 00' 30" for a
distance of 80.4', said curve being parallel with the centerline of County State Aid Highway
Number 18; thence South 59 52'05" East a distance of 149.94 feet; thence South 30 09' West
a distance of 110.00 feet to the actual point of beginning. Together with an easement for
road purposes., for the following reasons: 1) A public hearing was held; no opposition was
met as to the Special Use Permit; 2) The use would be compatible with the surrounding area
in that there are several duplexes along l38th Avenue and the property would serve its highest
and best use with a duplex constructed on it; 3) The Special Use Permit would not be contrary
to good planning nor would it be detrimental to the health, welfare and safety of the general
public; 4) The condition being that the lot would front on l38th Avenue and have access there-
on which would lend to the safety of the travelling public inasmuch as County Road 18 is a
heavily travelled county road; 5) The County Engineer has written his approval to access onto
l38th Avenue rather then County Road 18; 6) A variance should be granted at the same time for
the lot depth not meeting the required 130 feet when it fronts on l38th Avenue; 7) The size
of the lot is more than adequate to meet the area requirement; 8) The parcel is presently
served by sanitary sewer; 9) This property is not served by public water and the solution to
that will be looked at by the building official; 10) It meets the basic intent and application
of the ordinances of the City of Andover.
Motion carried unanimously. This will go to the City Council on August 5, 1980.

This amendment went to the City Council with a recommendation for approval and was referred
back to the Planning Commission. The Council was in agreement with Section 8.04 but not
Section 8.03, Design Features dealing with road easements for cross streets. The City
Attorney noted that once the cross streets are dedicated, it becomes a public right of way
which can then be used by bikers, snowmobilers. etc.
Commissioner Kishel stated that the best way to handle this would be to have the property
owner bring in a lot survey to the Building Inspector showing the location of the house.
Taking into account the future subdivision. the Building Inspector will determine if the
location is acceptable.
MOTION by Kishel. seconded by Scherer that the Andover Planning and Zoning Commission
recommend that when an individual applies for a building permit on a 2~ acre lot. he shall
submit a lot survey showing the location of the proposed structure on the lot so that it
will be located in conformance with the proposed resubdivision of said lot. The home should
be placed so that it will not be in conflict with the proposed street pattern of said re-
subdivision.
Motion carried unanimously.
Visual Standards Implementation (Comm. #4-80-6)
Chairperson Bosell stated that the Commission could advertise for someone to update our
ordinances so that they will be consistent with the Comprehensive Plan. The Recording
Secretary will place the ad.
The City Council did not go along with the Commission's recommendation regarding galvanized
buildings. However, this would tie in with updating of the ordinances.
This item will be continued to the July 22nd meeting.
MOTION by Lobb. seconded by Scherer to adjourn the meeting. Motion ~arried unanimously.
