MINUTES
The Regularly Scheduled planning and Zoning Commission meeting was called to order at 7:38 P.M.
by Chairperson d'Arcy Bosell on Tuesday, April 8, 1980 at the Andover City Hall, 1685 Cross-

MOTION by Retzlaff, seconded by Lobb, to approve the minutes of March 25, 1980 as corrected.
Motion carried unanimously.
Good Ridge Acres Preliminary Plat Continued Public Hearing (Comm. #8-79-1)
At the request of the developer, this item will be continued to April 22, 1980.
R.L. Germundsen, Inc. Special Use Permit Public Hearing (COIlI!lI. #3-80-4)
Chairperson Bosell opened the public hearing.
Bob Germundsen, 20195 Connie Drive - stated that he owns two lots in Johnson's Oakmount Terrace
and would like to build a duplex on one of the lots. The duplex would not be an economy type
duplex; it would be a luxury duplex.
Diane Doolittle, 4301 - l44th Lane N.W. - presented a petition from the people in the area.
Stated that the petition shows everyone is opposed to the Special Use Permit being granted.
Mary Jo Tresco - 4300 l45th Lane N.W. - noted that she did not receive a notice of the public
hearing.
Dan Schyma, 4322 - l45th Lane N.W. - said that one of Mr. Germundsen's lots (lot 12) butts up
to his backyard. Building a duplex in this area is the first step in getting sanitary sewer.
He is very much against it.

Chairperson Bosell reviewed Ordinance 8, Section HHH, which deals with multiple dwellings.
,~e ordinance states that multiples must be served by sanitary sewer. Chairperson Bosell
~~lained that previously a man had made a request to build doubles on l38th and Crosstown
and was denied because they were not consistent with the surrounding area.
Bob Germundsen - asked if our building inspector was aware of this. (He was told that he
is aware of it.)
Karen Ames, 4310 - l44th Avenue N.W. - Asked that it be noted in the record that there are
14 people in attendance who are opposed to this Special Use Permit.
Joe Albright, 14438 - l44th Lane N.W. - Asked what would prevent someone else from coming in
with the same type of building if we allow this one in.
Chairperson Bosell stated it is a possibility; however, one thing that would stop them would
be the land area requirement.
Joe Albright - wanted to make sure it was put in the record that 100 percent of the people
are opposed to this Special Use Permit.
MOTION by Retzlaff, seconded by Kishel to close the public hearing. Motion carried unanimously.
MOTION by Retzlaff, seconded by Anstett, that the Andover Planning and Zoning Commission
recommend to the City Council denial of the R.L. Germundsen, Inc. request for a Special Use
Permit on the property described as Lots 11 and 12 of Johnson's Oakmount Terrace for the
following reasons: 1) That there was considerable opposition at the public hearing as to this
use on this particular parcel of Iand; 2) That this proposed use is inconsistent with the
surrounding uses; 3) That this proposed special use is not in conformance with Ordinance 8,
Section 7 under residential M-l and that townhouses are not to exceed 8 units per building
with public sanitary sewer and water service; 4) That this property does not have public
sanitary sewer nor does it have public water.
Motion carried unanimously. This will go to the City Council on May 6, 1980.
Rolling Creek Trails Preliminary Plat Public Hearing (Comm. #10-79-2)
Chairperson Bosell opened the public hearing.
Jim Merila, Merila-Hanson, Inc. - stated they are proposing a subdivision of approximately
138 acres into 41 - 2~ acre lots. There will be two intersections on Andover Boulevard and
the possible extension of l43rd Avenue. There will be one cul-de-sac (Albatross). They have
met with the Park Board but the matter of park dedication has not been resolved as yet.
Chairperson Bosell stated that the Park Board was going to wait until after April 24th when
the City Council will make a recommendation on the rezoning.
Mr. Merila commented that they will be meeting with the Park Board again on April 17th. In
the event the property is rezoned, they will again meet with the Park Board.
Mr. Merila also stated they have submitted their plat to the Coon Creek Watershed;
the Watershed has not made a final review of it but agree with the general concept.

parks. Mr. Merila stated they would be willing to give cash in lieu of land if the city won't
accept it.

Mark Schumacher, T.K.D.A. - reviewed his letter of April 4, 1980. In addition to his comments
)~\the letter, it was noted that basement elevations and house locations, along with corner
~ radii need to be shown on the plat.
Commissioner Retzlaff stated that the future subdivision plan shows a half street and a half
cul-de-sac. He doesn't think it is a logical extension because there is a house 10 _ 15 feet
from it. He recommended that all of the south part of it be eliminated. He also noted that
Lot 6 of Block 5 and several other lots do not meet the frontage requirement.
Mark Schumacher commented that he was under the impression that you were allowed to show your
frontage on a tangent line. Lot 3 has 295 feet at the street, but because of the angle, you
would probably have 300 feet.
Chairperson Bosell requested the developer to reduce the scale on the plat to 1-200. She also
stated that we need a letter of consent from the fee owner stating he has no objections.
Winslow Holasek, 1159 Andover Boulevard - remarked that when Old Colony had their factory on
this site, chemicals were dumped on the property. He felt that some soil testing should be
done. The possible site of the dumping is the southern part of the proposed park along
Andover Boulevard just off the tree line.
The public hearing will be continued until the next regularly scheduled meeting or until a
revised drawing is complete.

Andover West Preliminary Plat Continued Public Hearing (Comm. #1-80-2)
Chairperson Bosell reopened the public hearing.
Mark Schumacher, T.K.D.A. - reviewed his letter of April 7, 1980 regarding the plat. He noted
that some of the items would need variances. He also stated that there are a few things that
he would like to discuss with the developer.
Chairperson Bosell commented that the lots that are 2~ times the average lot size would need
variances. Mr. Burger should be able to tell the Council why these lots have to be as large
as they are. This should come to the city in the form of a letter before the plat goes to
the council.
It was noted by the Commission that Cree Street as shown on the plat should actually be
Blackfoot Street.
Letters of approval from the County Highway Department, Northern Natural Gas and United Power
Association were presented to the Commission.
Dennis Seelen, 4680 - l47th Lane N.W.- asked when the stub streets on the plat would be
constructed. (It was explained that as each section of the plat is developed, the streets
would be constructed.)
Mr. Seelen - asked if the stub street going down to Mr. Henry's property would be maintained.
(Chairperson Bosell said that it would not as it would serve no purpose).

MOTION by Retzlaff, seconded by Kishel that the Andover Planning and Zoning Commission recommend
to the City Council approval of the preliminary plat for Andover West described as the NW~ of

660 feet of Section 19 thereof; and except, the land described as follows: Commencing at
the Southwest corner of the Southwest Quarter of the Southeast quarter of Section 19, thence
in an easterly direction along the south line of said Quarter a distance of 20 rods; thence
at right angles and in a Northerly direction a distance of 40 rods; thence at right angles
and in a Westerly direction a distance of 20 rods more or less to the West line of said
Quarter; thence in a Southerly direction along said West line a distance of 40 rods to

Township 32, Range 24, Anoka County, Minnesota, for the following reasons: 1) the plat has
received approval from the County Highway Department; 2) the engineering firm of T.K.D.A.
has reviewed the plat and recommends approval; 3) that the plat is subject to meeting road
standards of the City of Andover; 4) a public hearing was held and no opposition was met to
the intent of the plat; 5) the plat would require the follOWing variances: a) Lot 9 of
Block 7 because it is more than 2~ times the average lot size (Ordinance 10, Section 9.06).
This variance is requested for topographical reasons, the lay of the land.; b) variance for
cul-de-sac length on Inca Circle, in excess of 500 feet per Ordinance 10 to minimize access
to County Road 20; c) block lengths on l53rd Avenue N.W. between Highway 7 and Fox Street,
l52nd Avenue N.W. between 7 and Fox Street, l54th Avenue and Hopi Street Between Eldorado
and l55th Avenue N.W., l53rd Avenue N.W. and Blackfoot Street between Eldorado and l55th Avenue
N.W. All of the above for topographical reasons; 6) that a letter has been received from
United Power Association with no objections; 7) that a letter of recommendation has been
received from Northern Natural Gas with no objections; 8) that the Park Board has reviewed
the plat and has made a recommendation to the City Council regarding park land; 9) that the
plat is consistent with the Comprehensive Plan of the City of Andover and meets the basic intent
and application of its ordinances, that all lots have frontage on interior streets and they
should not front on County 7 or County Road 20. That Lot 13, Block 7, Lot 1, Block 12, Lot
5, Block 14, Lot 1, Block 14 and Lot 3, Block 13 all face on interior streets, not stub streets.
Discussion: Jevon Lieborg, Route 1, Rogers - thought that at the last meeting on this item
there was opposition to this plat. (Chairperson Bosell stated that there was no opposition
to the intent of the plat.)
Motion carried on a 6-0 vote. This will go to the City Council on May 6, 1980.
Gary Reuss Variance (Comm. #3-80-3)
This item will be deleted inasmuch as Mr. Reuss has not appeared at the last two meetings.
Carlson/Boulais Variance (Comm. #3-80-5)
Theresa Berglund, 11446 Quinn Street, Coon Rapids - representing Mr. Carlson and Mr. Boulais
stated that the north piece on the sketch is owned by a Mr. Harper. He would like to buy the
property south of his, which is 4.5 acres. The two parcels would be combined to become one
parcel. This came in as a variance rather than a lot split because a new lot is not being
created.
MOTION by Retzlaff, seconded by Kishel that the Andover Planning and Zoning Commission recommend
to the City Council approval of the variance for A.O. Carlson and K.E. Boulais as described on
,'.'q application form and allow the creation of one parcel as a result of splitting off 230.35
~~t by 791.87 feet from parcel 3600 breaking off the west 791.51 feet of that part of the
West 1/2 of the NW~ of Section 4, Township 32, Range 24, Anoka County, Minnesota lying south
of the North 1842.08 feet thereof and lying north of the south 330.00 feet thereof, said
measurements being made at right angles to the West, North and South lines thereof and attach
that to the parcel at 17845 Round Lake Boulevard creating one lot of record. Reasons for

,-) it complies with the basic intent of the Comprehensive Plan, and; 3) it does not affect
the health, safety or welfare of the residents of the City of Andover.
Motion carried unanimously. This will go to the City Council on May 6, 1980.
Florian Backowski Sketch Plan (Comm. #3-80-6)
Florian Backowski, 16027 Nowthen Boulevard - stated that he purchased this property
Smith and would like to split it into three parcels. Each parcel will be 2~ acres.

plat.
This item will be continued when Mr. Backowski returns with a preliminary plat.
Philip Hughes Discussion (Comm. #3-80-7)
A letter was received from Mr. Hughes who owns a duplex at 2462-64 l38th Avenue N.W. He
would like to split the duplex and sell each part to individual owners. Mr. Hughes did not
appear as he lives in Alaska.
Discussion was on whether the Commission could act on a letter.
MOTION by Retzlaff, seconded by Lobb, that the Andover Planning and Zoning Commission recommend
to the City Council that no further action be taken on this until it comes in in the form of
some type of official request, either as a variance, a Special Use Permit or other appropriate
document.
Motion carried on a 5 yes, 1 no vote. (Chairperson Bosell voted no as she feels the Commission
is obligated to make a recommendation).
Discussion: Commissioner Kishel felt the Commission should never have received this letter.
Chairperson Bosell stated they received it because we will be getting another similar request
for Bunker Lake Estates.
This will go to the City Council May 6, 1980.
Ordinance #10 Amendment (Comm. #1-80-7)
The changes suggested in the approval of minutes will be incorporated into the ordinance
amendment.
Commissioner Kishel commented that some subdividers are surprised that we are requiring this
information on plats outside of the Urban Service Area.
Chairperson Bosell stated that after April 24th, in the Urban Service Area there will be no
land left that would apply under this because it would all be R-4. If this occurs, this will
only apply to the rural section of the city.

,-) an R-4 size with 101 lots. The proposed park is 4.2 acres with temporary storm water
ponding in the park area. There would be two walkways into the park; each walkway would
be 25 - 30 feet wide.
Chairperson Bosell asked why they picked 60 feet as the width for the streets instead of
66 feet. Mr. Nelson stated that in most rural communities the streets are 60 feet wide.
Chairperson Bosell commented that this property is presently zoned R-l and asked what Good
Value planned to do. Mr. Nelson stated they would like to rezone it to R-4.
Chairperson Bosell explained what the City Council will be doing on April 24th regarding the
rezoning.
Commissioner Retzlaff suggested Good Value get on the next Park Board agenda to see what they
want.
This will be continued when the developer returns with a preliminary plat.
MOTION by Kishel, seconded by Apel to adjourn the meeting. Motion carried unanimously.
