(612) 755-5100 REGULAR PLANNING AND ZONING COMMISSION MEETING FEBRUARY 12, 1980 "-- MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Andover was called to order at 7:31 P.M. by Chairperson d'Arcy Bosell on February 12, 1980 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Anoka, Minnesota. Commissioners Present: Byron Copley, Ralph Kishel, Larry Retzlaff, George Lobb, a ,_ Richard Okerlund, Walter Dick. ~~~~~t Commissioners Absent: None i 0 vp-,l Also Present: Mark Schumacher, T.K.D.A.; Derril Burger, David Szykulski, Jack Menkveld and interested residents. Approval of Minutes January 22, 1980 Page 3 where Ordinance 10 is discussed should be corrected to read "the number of miles of streets on the plat." MOTION by Retzlaff, Seconded by Kishel approved as corrected. Vote on motion: Copley, Kishel, Retzlaff, Lobb, Dick.) that the minutes of January 22, 1980 be 1 present (Okerlund), 6 yes (Bosell, At this time, Chairperson Bosell explained that the next regularly scheduled meeting would be on February 26, 1980; however, that is Precinct Caucus Night and we are not allowed to have any meetings after 8:00 P.M. It was agreed that the meeting will be scheduled for Thursday, February 28, 1980 at 7:30 P.M. G. M. INVESTMENT REZONING PUBLIC HEARING' (COMM. tFl-80-3) Jack Menkveld, an officer of G.M. Investment Company, Box 547, Anoka, Minnesota, explained that they are requesting the rezoning of 6.01 acres which are in the Urban Service Area from R-l to R-4. He stated there are three sewer stubs now serving that area. In October at the public hearing on concern about the size of the lots. G. M. Investment apply for rezoning R-4. this plat, several people from the area showed The Commission, at that time, requested that to R-3 rather than R-4. However, they want Mr. Menkveld explained that the land that is not going to be developed would be lots of record, not outlots. Chairperson Bosell asked if anyone in the audience had any comments to offer. Mr. Retzlaff throught that the rezoning should be done before looking at the preliminary plat. , ' '---' John Scherer, 1560 Andover Boulevard - asked where this plat is and what impact this would have on sanitary sewer in that area. Motion carried unanimously. MOTION by Retzlaff, seconded by Okerlund that the Planning and Zoning Commission recommend to the Andover City Council denial of G. M. Investment Company's request for rezoning for the following reasons: 1) That there was considerable opposition at previous public hearings as to the lot size proposed (R-4); 2) That rezoning to R-4 would not be compatible with the surrounding nature of the neighborhoods. Motion carried unanimously on a 7-0 vote. This will go to the City Council on March 4, 1980. MENKVELD'S GREEN ACRES PRELIMINARY PLAT PUBLIC HEARING (COMM. 4F10-79-3) Chairoerson Bosell opened the public hearing and asked Mark Schumacher of T.K.D.A. to review his letter regarding this plat., It was brought up that the plat does not cover all of the contiguous property. Mr. Menkveld mentioned that he had deeded the property not shown on the plat to Gilbert and Jack Menkveld per the City Clerk's recommendation. Chairperson Bosell questioned whether this could be done as Jack Menkveld is an officer of G. M. Investment Company. The City Attorney will be contacted for his opinion on this matter. The Commission discussed the streets being only 50 feet and not 66 feet. Mr. Menkveld was not aware of the ordinance changing the street requirement. With 66 foot streets there is a problem because the lots won't contain 13,000 square feet. A variance would be required because of the lot depth. The way the plat is drawn, it does not fit R-4 zoning. The park dedication was brought up. Mr. Menkveld thought it had been agreed by the Park Commission that no dedication would be required as park land had been previously donated. Mr. Menkveld was informed that this is not true and that the Park Commission will have to research this item. A letter from the Coon Creek Watershed must be received regarding their determination of this plat. Several other items regarding the plat were discussed: The preliminary must show what the street surfaces will be; Lot 13 does not have minimum frontage-a variance will be required for this lot; there is no storm drainage plan for the plat; the cul-de-sac just makes 500 feet; the size of lots 6 and 7 has to be determined-it looks like they are too big. Mr. Menkveld again stated that he does not want to request R-3 zoning. He thinks it would be easier to go with R-4. Commissioner Retzlaff feels the Commission should wait for the City Council's decision on the rezoning request before they proceed with the preliminary plat, and an opinion from the City Attorney on the contiguous property. o Mark Schumacher talked to Mr. Menkveld about the soil but has received no soil borings. He said that the smaller lots will mean more children which will overcrowd our schools; the wells will be too close and they will have to have city water put in. Winslow Holasek, 1159 Andover Boulevard - Wanted to know why the preliminary plat is on the agenda when the rezoning was denied. This item will be continued until we receive an op~n~on regarding the contiguous land from the City Attorney and the City Council decides on the rezoning. REZONING OF THE URBAN SERVICE AREA Chairperson Bosell opened the Public Hearing on the rezoning of the Urban Service Area and gave a brief history of this rezoning request. Discussion at a City Council meeting in August 1979 was that 2~ acre developments in the Urban Service Area does not allow for orderly extension of sanitary sewer lines. Then in September the City Council felt that by having 2~ acre lots in the Urban Service Area, we would not obtain the maximum benefit out of the sewer line. They suggested limiting building to only an R-3 zone until sewer becomes available. The intent of this rezoning is not to speed up the extension of the sewer but to provide for its use when it's in an area. The alternatives we have at this time are the moratorium and rezoning the property in the Urban Service Area. Richard Pearson, 2863 South Coon Creek Drive - Stated he was unhappy because when he moved out here, he had to have 2~ acres to build on and now we're trying to cut it down to R-4 size. Wanted to know if Metro Council had asked the city to rezone. Commissioner Copley explained that the intent of the rezoning is to prohibit 2~ acre developments because in several years when sewer does come through, the property owners would not be able to pay the heavy assessments. Mr. Pearson expressed concern that he would get sanitary sewer when he does not want it. Jim Hiltz, 4060 - l49th Avenue N.W. - Asked if the city had entered into any type of Comprehensive Plan. He was informed that we have had one sinee 1974 and that a pre- liminary draft of a revised Comprehensive Plan had just been submitted to our surround- ing communities for their review. Mr. Hiltz feels that by rezoning, we are limiting the use of the land to other things, such as multiple dwellings and commercial. Ken Heil, 1425 Andover Boulevard - Wanted to know why the Public Hearing notice said that the property now zoned R-l would be rezoned to R-4. It was explained that not all of the property would be rezoned to R-4. Mr. Heil said that most of the people moved out to Andover because there was plenty of space and that he does not want sanitary sewer. John Scherer, 1560 Andover Boulevard - Asked who was going to pay for the extension of Hanson Boulevard. Commissioner Kishel explained that it is a county state aid highway and that property owners will not be assessed for it. Mr. Scherer asked how people are assessed for sanitary sewer. Mark Schumacher of T.K.D.A. explained the city's assessment policy. o Jan Pasche, 2950 - l42nd Lane N.W. - Asked if Metro Council dictates that if you have smaller lots you have to have city water. Mark Schumacher explained that it was up to the city to put in city water. Planning and zc=Jng C~~sion Meeting February 12, 1980 Page 4 o o Rosella Sonsteby, 4151 - l4lst Avenue N.W. - She has lived in the area for 38 years and ~ ) all of her property is zoned R-l. She has tried to rezone it to R-3 or R-4 and has been '-/ denied. She is in favor of the rezoning so that she can plat her land and at least build on every third lot until sewer comes through. Winslow Holasek, 1159 Andover Boulevard - Asked if all of the Urban Service Area is going to be rezoned to R-4. It was explained that R-4 would be the smallest size that it would be rezoned to. Jerry Windschitl. 2312 South Coon Creek Drive - As Mayor of Andover explained what the public hearing was supposed to accomplish. Mayor Windschitl went into detail explaining the history of sewer extensions into Andover. He said that the Commission was getting too many questions regarding sanitary sewer when there are no immediate plans for the sewer to come through. Walter Vosika, 1414 Bunker Lake Boulevard - Asked the Mayor whether the sewer would be going up Hanson Boulevard. The Mayor said that it would only go up Hanson Boulevard if there were specific requests for it. Winslow Holasek - Asked if the city was planning to extend the Urban Service Area. Was told that we are looking at it for the purpose of rezoning it to industrial. Richard Pearson - Wants the city to develop a Comprehensive Plan with everything outlined in it such as R-l zones, sewer lines, parks, etc. Mayor Windschitl explained that we have a Comprehensive Plan which will be forwarded to Metro Council on June 1 for their review and approval. Percy Tomlinson, representing property owners at 1800 Andover Boulevard - Confused as to why we are here. Are we going to rezone everything to R-4 or are we going to have some kind of Comprehensive Plan? (Recess taken at this time from 9:45 to 10:00 P.M.) Rezoning/Urban Service Area, Continued Rosella Sonsteby - Explained to the audience that if the sewer comes through, all you have to do is come in for a lot split. It's a lot easier than platting. Chairperson Bosell stated that the Commission would like to get ideas from the public as to what they would like done with their land. Dick Schneider, 1343 Andover Boulevard - Does not live in the Urban Service Area, but is very confused. One person said that you cannot plat anything until sewer comes through and the Mayor said you can. Walter Vosika - Has 2 40's. One is in the Urban Service Area and the other is in the rural area. In 1973 it was rezoned to R-l from light industrial without his knowledge. Asked if this property could be rezoned back to light industrial. Commission told him he would have to apply for rezoning. o Peter Rauen. 4110 - l47th Lane N.W. - The only thing he has not heard are any forecasts for need of a sewer system in the city. John Scherer - Asked who made the decision on whether or not an area gets sanitary sewer. Mark Schumacher explained the process. Chairperson Bosell suggested that a special meeting be held on February 19, 1980 at Planning February Page 5 d f\ r-'\ . . an z~bg Co~s~on Meet~ng 12, 1980 o o 7:30 P.M. to discuss what should be done with the R-l parcels in the Urban Service r" Area. ,--I ANDOVER PROPERTIES VARIANCE (Comm. #1-80-4) Derril Burger, 5925 Woodland Circle, Minnetonka - Is proposing a general plan to develop 330 acres ultimately. The initial part he wishes to develop lies West of 7th Avenue, north of l49th Avenue. He is proposing basically the same kind of develop- ment as Lund's Round Lake Estates, which lies just south of his property. He is requesting that the 40 acres be excluded from the moratorium. Discussion was on whether or not Mr. Burger's property and Lund's Round Lake Estates should be excluded from the Urban Service Area. The problem of refunding Sewer Avail- ability Charges was mentioned. Jim Hiltz, 4060 - l49th Avenue N.W. - Does not see any reason why Mr. Burger's request should be denied. The appeal process contained in the Moratorium Ordinance was explained. MOTION by Copley, seconded by Retzlaff that the Andover Planning and Zoning Commission recommend to the City Council that they grant Andover Properties a variance from the moratorium of the property described as the N~ of the S~ of the SW~ of Section 19 for the following reasons: 1) It is consistent with the Comprehensive Plan; 2) It does not adversely affect the health, safety and welfare of the City of Andover. Motion carried on a 7-0 vote. This item will go to the City Council on March 4th. DAVID SZYKULSKI VARIANCE (Comm. ffl-80-5) Davidszykulsk~ 752 - l40th Lane N.W., is requesting a variance from the front yard setback so that he can add a 24'x25' garage on to his house. He would like to turn the existing garage into living space. He only has a three bedroom house and he has five children. Mr. Szykulski showed pictures to the Commission of his house and plans for the new garage. Mr. Szykulskiwas asked if he had considered any alternatives such garage in a different location or adding a room on to the house. wants to build it where the plans show because his present garage he added on to the house more heating costs would be involved. as building the He stated that he is heated and if It was sugges ted that Mr. Szykulski build a 24' x22 I garage which would eliminate the need for a variance. He stated that he needs the bigger garage because he is also going to add on an entry way, which he really needs and if he had to build only a 24'~ 22' garage, he would not build it. MOTION by Retzlaff, seconded by Kishel that the Planning and Zoning Commission recommend to the City Council approval of the variance for David and Sharon Szykulski at 752 _ l40th Lane N.W., Andover, from the front yard setback as described in the application and the positioning of the garage in this location for the following reasons: 1) It does not adversely affect the health, safety and welfare of the residents of the City of Andover; 2) It does not compromise the intent of the Comprehensive Plan; 3) Nor does it c=) compromise the intent of the ordinances of the City of Andover. Vote on motion: 5 Yes (Retzlaff, Dick, Copley, Kishel, Okerlund) 2 No (Bosell, Lobb) This item will go to the City Council on March 4th. CROOKED LAKE SURFACE USE ZONING (Comm. #1-80-8) The Park Commission has requested that the Planning and Zoning Commission look at surface zoning of Crooked Lake to control the size of motors and to look at the possibility of prohibiting hunting on Round Lake. The Commissioners were each given a model ordinance by the Park Commission. George Johnson, 2924 - l32nd Avenue, Coon Rapids - Is concerned with the number of boats on the lake. There have never been any accidents on the lake and he is worried that with the new boat ramp there will be more boats on the lake and this will cause problems. Discussion centered around the boat ramp that the Park Commission is proposing and the fact that the residents on the lake don't want anyone else on their lake. Bob Peach, 15830 University Avenue Ext. - The DNR proposes to control the number of boats on the lake by the number of parking spaces we provide, which is 8. Chairperson Bosell stated that if they cannot come up with an agreement that is agree- able to everyone concerned, the DNR will come in and surface zone the lake if we request them to. Dan Randall, 13256 Gladiola Street, Coon Rapids - Said they do not really have a problem now, but when the ramp is put in, they will have a problem. Discussion was on how the Commission could restrict too many boats from being on the lake - whether they should restrict large motored boats from being on the lake at certain times of day and who would enforce these restrictions. This item will be continued until a recommendation/or direction is received from the City Council. ORDINANCE 8 AMENDMENT (Comm. #1-80-6) This item will be continued to the February 28 meeting. ORDINANCE 10 AMENDMENT (Comm. #1-80-7) This item will be continued to the February 28 meeting. ANDOVER WEST SKETCH PLAN This item was not on the published agenda but was discussed briefly. It was decided by the Commission that Mr. Burger should return with a preliminary plat. Commissioner Dick left the meeting at this time (11:49 P.M.)
