(612) 755-5100 REGULAR PLANNING AND ZONING COI1MISSION MEETING JANUARY 8, 1980 MINUTES The Regular meeting of the Planning and Zoning Commission was called to order at 7:30 p.m. by Chairperson d'Arcy Bosell on January 8, 1980, at the Andover City Hall, 1685 Crosstown Boulevard N.W., Anoka, Minnesota. Page 3, Item #2, the word want should be inserted after, Whether you... Page 3, Items #2 & #3: #2 should be corrected to say: Decide how much solar access you want to protect, whether you want to protect the access to the top southern facing top of the roof or to the entire south facing wall or perhaps to an area of the south yard. Item #3 is correct as written. Page 4, paragraph 4, Item #3, the word comparible should be corrected to comparable. Page 4, paragraph 11, the spelling of Bolsell should be corrected to Bosell. Page 4, paragraph 12, second line, the word closess should be corrected to closest. MOTION by Kishel, Seconded Lobb, to approve the minutes of December 11, 1979 as corrected. Motion carried on a 3 - yes, 1 - present vote. December 17, 1979 Page 2, second paragraph, eighth line, the word thoses should be correct to those. Page 2, paragraph four, tenth line, the spelling of the word enviornmental should be corrected to environmental. Page 2, paragraph six, second line, the word rule should be deleted and the word rural inserted here. ,..... Page' 3, seven lines from the bottom, the word graphis should be corrected to graphics. Page 4, second paragraph, the word to at the end of the first line should be deleted. Page 4, paragraph six, first line, the word Commision should be corrected to Commission. Page 5, paragraph nine, fourth line, add the words "acre tract" after 40. Page 5, paragraph 10, third line, the word The should be changed to They. Page 6, under the motion to adjourn, the word adjour should be corrected to adjourn. MOTION by Lobb, Seconded by Kishel to approve the minutes of December 17, 1979 as corrected. Motion carried on a 3 - Yes, 1 - Present vote. Chairperson Bosell stated that Item #1 on the agenda can be deleted because it has been determined that the easements are private so it will not be necessary for a vacation of easement. o Rezoning of Urban Service Area/Continued Public Hearing Chairperson Bosell reopened the public hearing at this time. Commissioner Kishel said that he would go with the original proposal and that was to outline the Urban Service District and zone it au except for those areas where there is multiple housing. Discussion: The Commission discussed changing the Urban Service Line to go straight across Round Lake, go south of Lund's to 7th Avenue, go north on 7th Avenue and then west on the north side of Meadowwood. Mark Schumacher said that he was going to talk with someone from Metropolitan Council to find out what the formal procedure is in order to change the present Urban Service Area line. Daryl Berger, 4925 Woodland Circle, Minnetonka - stated that he plans on selling 10 a9res i~wo parcels of his property. He is coming in with a sketch plan on January 22nd4wanted~to know if this 10 acres has to be included in the sketch plan? He plans ^ on selling this 10 acres in the near future. The Commission stated that Mr. Berger should not include it in the sketch plan if he plans en selling it before he comes in with his preliminary. Otherwise, the property must be included in the sketch plan and the preliminary. It was recommended that ~~. Berger apply for a variance from the moratorium before the 22nd and if the variance is not necessary, his money will be refunded. The Commission discussed the area in the east part of the Urban Service Area inbetween Lund's Evergreen Estates and Hartfield's (sp) Estates. The Commission is considering changing the zoning on this area from R3 to au. The Co~~ssion then discussed the area in the southern portion of the Urban Service Area along County Road 116. The Commission is considering rezoning this area to Limited Industrial and also the area south of this which is presently zoned General Business would be changed to Limited Industrial. The Commission discussed the area near the Substation which is presently zoned General Business to be changed to Limited Industrial also. Chairperson Bosell requested that the public hearing be continued until the meeting on February 12, 1980. She also requested that public notices be sent out regarding these proposed changes. Other then a few exceptions, all other property is proposed to be zoned au. (Recess taken at 8:55 p.m. to 9:05 p.m.) (Mark Sch~~acher, TKDA, left at this time). Continued Public Hearing/Ordinances 8 & 10- Ordinance 8: The Commission discussed definitions they had previously talked about and changed. Those are: Floor Areas, Planned Unit Development, Lot Provisions, and the change of the 6.02 ~linimum Requirements chart (single garages being attached instead of detached). A new change was brought up: Section 7.03 under Special Uses, GI, the words "sale or storage of used auto parts in GI only". HOTION by Kishel, Seconded by Okerlund, that the Andover Planning & Zoning Com~ssion recom~end to the City Council approval of the amendments to Ordinance 8, Section 3.02, definitions EE Floor Area: Square footage of ground covering of dwelling exclusive of garage; Section 3.02, ~~ Planned Unit Development: Planned unit developments shall include all developments having two (2) or more principal uses or structures on a single parcel of land and shall include townhouses, mobile homes, modular homes, single and two-family homes, apartment projects involving more than one building, residential subdivision submitted under "density zoning" provisions, multi-use struc- tures, such as an apartment building with retail at ground floor level, churches and church sChools, schools, industrial complexes, and similar projects; Section 4.04, Lot Provisions, (A) A lot or parcel of land for which a deed or contract for deed has been recorded in the office of the Anoka County Register of Deeds upon, or prior to, the effective date of this Ordinance shall be deemed a buildable lot provided it has frontage on a public street right-of-way which has been accepted and is currently maintained by the City and said space requirements for the district in which it is located can be maintained or adjusted to conform as follows: a lot or parcel or land of record upon the effective date of this ordinance which is a Residential District and which does not meet the requirements of this ordinance as to area, width, or other open space, may be utilized for single family detached purposes provided the measure- ments of such area, width and yard space are within sixty (60) percent of the require- ments of this ordinance; but said lot or parcel shall not be more intensively developed.; Section 6.02, ~lininum Requirements shall specify that~~{ng1~ garages be attached.; ~ Section 7.03, Special Uses under GI will have the words "sale or storage of used autot '.J.J-!O parts in GI only", deleted, for the following reasons: 1) To improve and update the ordinances so as to protect the health, safety and welfare of the City of Andover; 2) A public hearing was held and there was no opposition. Motion carried unanimously on a 4-0 vote. This will go to the City Council on February 5th, 1980. Continued Public Hearing on Ordinance 10 Discussion: The Commission discussed changing the street width from 50 to 66 feet. They also discussed new language for 16.02 Access under Ordinance 10. MOTION by Okerlund, Seconded by Kishel, that the Planning and Zoning Commission recommend to the City Council approval of amendments to Ordinance 10, amending the following: Section 9.03, Streets, change Minor Streets measurement from 50 feet to 66 feet; Section 16.02, Access, to read: No permit for the erection of any building shall be issued unless such building is to be located upon a parcel of land abutting a public street right-of-way which has been accepted and is currently maintained by the City, or which has otherwise been approved by the City Council. This limitation on issuing permits shall not apply to planned unit developments approved by the City Council pursuant to the Zoning Ordinance.; for the following reasons: 1) A public hearing was held and there was no opposition; 2) It is more in conformance with Ordinance 8 as amended; 3) It is more consistent and orderly planning of the City; 4) It is not detorrent to the health, safety and welfare of the City of Andover. ~. dQ-/"O_ttu71l.L jcdl Motion carried unanimously on a 4-0 vote. This will also go to the City Council on ;!~1~v February 5th, 1980. MOTION by Kishel, Seconded by Okerlund, to close the public hearing. Motion carried unanimously. " ) '--- ' " ~ '--.,) , . . , '-. / o o P(_bing & Oing January 8, 1980 - Page 4 Commission Meeting Minutes Research/Surface Zoning & Amend~ent Ordinance #12 Chairperson Bosell stated that this item had been received from the Park Commission. She asked if anyone on the Co~mission understood what was meant by surface zoning of lakes. It was recommended that the Commission ask the Park Commission for a clarification of the meaning of surface zoning. Bosell said that she would call the DNR and Commissioner Okerlund said that he would stop by the DNR to see what regulations they have presently on Round Lake. This item will be continued to the meeting of January 22nd, 1980. MOTION by Kishel, Seconded by Lobb, to the adjourn the meeting. Motion carried unanimously.
