MINUTES
The Regularly Scheduled Andover Planning and Zoning Commission Meeting was called to order by
Chairperson d'Arcy Bosell at 7:30 P.M., Tuesday, October 27, 1981 at the Andover City Hall,
1685 Crosstown Boulevard N.W., Anoka, Minnesota.

Page 4, Commissioner Johnson's comments: Add the word 'arbitrarily' before rezoned.
Page 4, under Neighborhood Business Zones discussion, add the following: 'Commissioner
Anstettasked Councilman Peach where the Planning Commission should consider the center of the
city to be. Councilman Peach stated the following: "I would hope that you would be looking and
telling us where. You should largely function apolitically. You plan and we politicize."
MOTION by Johnson, seconded by Anstett to approve the minutes of September 22, 1981 as amended.
Motion carried unanimously.

MOTION by Kishel, seconded by Johnson to approve the minutes of October 13, 1981 as corrected.
Vote on motion: Yes - Anstett, Johnson, Kishel, Scherer; Present - Bosell, Apel. Motion
carried.
Lakeside ~tates Preliminary Plat Public Heat.ing, Cont. (Comm. #8-81-8)
Chairperson Bosell explained that the developer has withdrawn his plat.
MOTION by Kishel, seconded by Anstett to close the public hearing. Motion carried unanimously.
Jerry Windschitl, 2312 South Coon Creek Drive - noted that when this plat was reviewed by
the City Council it was the concensus of the Council that a north-south street should be
constructed. Mr. Windschitl went back to his surveyors to see if they could redraw the plat
to include this street and it didn't work out. He stated that from an economic standpoint
he had no choice but to withdraw.

Chairperson Bosell noted that this lot split is Mr. Windschitl's alternative to the plat.
Jerry Windschitl - stated that he is simply splitting off a 330' x 330' parcel from the
approximately 40 acres.

Mr. Windschitl explained that as soon as he gets a 2! acre parcel split from the 40 acres he

Chairperson Bosell stated tha~according to the ordinance, a list of property owners must be
included with the request and there is no list with her material. The secretary explained
that the City Clerk said that since the people were notified of the plat (Lakeside Estates),
it was not necessary to notify them again.
Chairperson Bosell noted that the City Council directed Mr. Windschitl to include in his plat
a north-south street. This lot split precludes that ever happening. She wondered if the
Commission was considering future developments when the stub street is being blocked off.
Commissioner Kishel questioned whether it would be feasible to put an easement along the
side of the property for a future street. Mr. Windschitl stated that he hasn't explored that
with his surveyors. He also noted that the problem with a road coming through that part of
the property is that it would be going through the best part of the property. Commissioner
Kishel noted that in a resubdivision you would be talking about grading, filling and land-
scaping the property. Sometimes the roads do go through the highest and driest part of the
property. You take material from there and fill in the low spots on the property.
Discussion continued on whether an easement should be dedicated with the concensus of the
Commission being that it should be required.
This item will be continued to November 10, 1981 to give the applicant time to contact his
surveyor.
Agricultural Preserve Ordinance Public Hearing, Cont. (Comm. #3-81-6)
Chairperson Bosell reopened the public hearing.
Commissioner Anstett noted that she wrote a report on the study done on ag preserve which will
go to the City Council with the ordinance. The Commissioners all felt the report was well
written and sufficient for the Council. It was suggested that Commissioner Anstett make
some notes on what the Comprehensive Plan says in the pages she referred to in her report.
Chairperson Bosell asked if we want to leave Bunker Lake Park on the agricultural Preserve
eligibility map. Commissioner Apel felt it could be left in; it doesn't mean that we have
to give a contract to someone in that area if they apply.
At this time the Commissioners reviewed the ordinance. The following changes were made:
Page 2, q. the word 'outdoor' was added in the last sentence between 'not' and 'recreation'.
Page 3, 4.B.g(2) - This section was changed to read: 'the parcel on. which the dwelling unit
is located must have at least 300 feet of frontage along a road which has been accepted and
is maintained by the city'.
Page 4, D - Conditional Uses is changed to Special Uses.
Page 4, 4.D.d., the second sentence after the word 'including', add 'but not limited to'.
The eighth sentence, add the word 'and' after game reservation.
ge 4, 4.E - Change the word 'conditional' to 'special'; also change . conditional , in the
_irst sentence to 'special'.
Page 5, Section G - change to read, 'Shall be as set forth in Ordinance 8N....

Ordinance 8 Amendment Public Hearing (Comm. #10-81-2)
Chairperson Bosell opened the public hearing.
Commissioner Anstett questioned whether the farmers will have to pay the rezoning fee when
they apply for agricultural zoning. Chairperson Bosell felt they should as the fee is not that
high and it covers the administrative costs of the city, such as notification to the surrounding
property owners. She didn't feel the city could bear the costs.
Chairperson Bosell questioned Section 6.02, Minimum Requirements, Lot Area Per Dwelling, which
requires 10 acres for agricultural and agricultural preserve. It was noted that in agricultural
preserve you have to have at least 40 acres, but the parcels can't be less than 10 acres each
and for agricultural 10 acres ~the minimum for Green Acres.

Commissioner Kishel was directed to come up witH an amendment to Ordinance 8 amending the
minimum.requirements for front yard setbacks. A public hearing will be held on the amendment
on November 10th.
MOTION by Kishel, seconded by Anstett to close the public hearing. Motion carried unanimously.
MOTION by Anstett, seconded by Johnson that the Andover Planning and Zoning Commission recommend
to the City Council adoption of the Agricultural Preserve Ordinance as amended at the Planning
Commission meeting on 10/27/81.
Motion carried unanimously. This will go to the City Council on November 17, 1981.
MOTION by Anstett, seconded by Scherer that the Andover Planning and Zoning Commission recommend
to the City Council approval of an amendment to ordinance~as corrected at the 10/27/81 Planning
Commission meeting, to bring Ordinance 8 up to date including Agricultural and Agricultural
Preserve Districts.
Motion carried unanimously. This will go to the City Council on November 17, 1981.
At this time, the Commission had a discussion with John Peterson of Good Value Homes regarding
an amended Special Use Permit they are requesting. This will be on the November 10th agenda.
t1r. Peterson explained that when Northglen was platted there were 48 twin home lots and they
thought they could build any type of twin home on these lots. However, according to the
Special Use Permit the only type allowed was the Chippewa II and III. They will be requesting
an amended Special Use Permit that will enable them to build a new model which will be slab on
grade, with 928 square feet and an attached double garage. They will be selling these twins
for about $45,900 which would mean, with minimum down, a person's house payment would be about
$700.00 per month.
Chairperson Bosell asked if Good Value had any of these homes built anywhere. Mr. Peterson
stated they don't, but they have a plat approved in Blaine with this home included. Chairperson
Bosell asked if there is anything similar that the Planning Commission could look at. She also
~ed that any family will have a lot of stuff and without a basement, there isn't much room
_" storage.
Mr. Peterson noted that there are some quad homes in Brooklyn Park that are 800 square feet and
are slab on grade, which would be similar to those proposed by Good Value.

Chairperson Bosell stated that Northglen is a person's introduction to the city. When it was
.~tted it was going to look orderly and well kept. Her concern is that when you don't have
. . .basement, there is junk all around. She suggested that the Commission.ers view some of the
areas where there are homes similar to what Good Value is proposing so they are more aware of
what Mr. Peterson is talking about.
Review of Neighborhood Business Zones, Cont. (Comm. #6-81-1)
Commissioner Scherer noted that in his report he didn't deal with those Neighborhood Business
zones that had operating businesses on them unless there was a large portion of undeveloped
land.
Going through the reports, the Commissioners had the following comments/suggestions:
County Road 7 and Valley Drive (Tom Thumb Store) - All concurred it should remain NB.
County Road 7 and l4lst Avenue (Rosella Sonsteby property) - It was questioned whether a
property that was grandfathered in could legally be rezoned by the city. Commissioner Scherer
recommended that the northern part of the property be rezoned to residential and the southern
part be left NB. Commissioner Anstett stated that a property on a well traveled street close
to the city would be a good place for a business. Chairperson Bosell felt it might make more
sense to rezone it to GB. The secretary will check with the City Attorney to see if grand-
fathered in properties can be rezoned before the Commission proceeds further with this property.
County Road 9 and Bunker (Chutich property) - Chairperson Bosell and Commissioner Kishel both
agreed that this property was rezoned to NB and was not grandfathered in. It was the general
concensus that it remain NB.
South side of Bunker next to Professional Building (Chapman property) - all felt it should
remain NB.
Bunker Lake Boulevard and Crosstown (Next to Speedy Market) - retain NB classification.
Nemeth property on Crooked Lake Boulevard - This was grandfathered in and should remain NB
as the store burned down and some time should be given to Mr. Nemeth to decide what he is going
to do.
Hockinson Property (Across from Nemeth's) - also grandfathered in; should retain NB zoning.
Crosstown and l39th (Conroy property) - the Commission had a great deal of trouble with this
property mainly because of the traffic situation on that corner. Commissioner Johnson noted
that he would like this continued to the next meeting so more research could be done on this
property.
This item will be continued at the November 10th meeting.
MOTION by Apel, seconded by Anstett to adjourn. Motion carried unanimously. Meeting adjourned
at 10:35 P.M.
