SPECIAL PLANNING AND ZONING COMMISSION MEETING
SEPTEMBER 29, 1981
MINUTES
A Special meeting of the Andover Planning and Zoning Commission was called to order by Chair-
person d'Arcy Bosell at 7:35 P.M., Tuesday, September 29, 1981 at the Andover City Hall,
1685 Crosstown Boulevard N.W., Anoka, MN.

Commissioner Anstett reviewed her report on the items questioned at the last meeting. She
noted that she talked to John Haft, legal counsel for Metropolitan Council. The first item
she asked about was the AgP-2 zoning. Mr. Haft explained that the model ordinance was
written before the Ag Preserve law was passed. AgP-2 was considered to be an expansion zone.
As a result of her discussion with Mr. Haft, Commissioner Anstett suggested that we leave
AgP-2 out of the ordinance.
Chairperson Bosell concurred, noting that if we include AgP-2 we might be misleading
people. Commissioner Apel noted that this ordinance draft looks good as it stands.

Chairperson Bosell noted that the Comprehensive Plan refers to an agricultural district. This
could be an alternative to the AgP-2 district. By having an agricultural district a new
neighbor would know that the property is agricultural.
It was the concensus of the Commission to eliminate AgP-2 from the ordinance. It was also
decided that AgP-l be referred to as AgP.
Commissioner Anstett noted that Chairperson Bosell's recommendation that the last sentence
under Legislative Intent and Findings of Fact be deleted met with approval from Mr. Haft.
He noted that the entire paragraph could be dropped since it essentially applies to AgP-2.
Commissioner Anstett stated that in regard to the map that has to be included with the
ordinance, Mr. Haft felt we could do either of two things: 1) identify a portion of the
city, by drawing a line across 1/2, or as much as we decided on, arbitrarily, probably by
following the MUSA, or; 2) identifying pieces within the city, using actual properties only.
Mr. Haft was in favor of naming the specific parcels at the property owner's request.
Leroy Johnson, 125 Bunker Lake Boulevard NW. - stated that he would like to put ponds in his
property for catfish. He spoke to Metropolitan Council and they said he could do that and
still be eligible for ag preserve. He asked if he would be giving up his Green Acres
designation if he puts his property in ag preserve.
It was explained to Mr. Johnson that the tax rate for ag preserve is the same as that for
Green Acres. Commissioner Scherer noted that the purpose of the ag preserve ordinance is
to protect the property owners from urban development.
Chairperson Bosell asked if the Commission wanted all of the property north of the MUSA line
to be ag preserve or if each property owner should be asked if they want to be included.
Ocommissioner Kishel felt we should have the property owners decide if they want to be in
g preserve. Commissioner Apel noted that we cannot declare a property ag preserve; the
owner has to request it.
It was decided that the area to the north and east of the MUSA line be the eligible zone.

The next item Commissioner Anstett questioned Mr. Haft about was the terms 'farm dwelling' and
:non-farm dwelling'. He explained that as long as the density did not exceed 1 per 40, either
,ould be on the property. Commissioner Anstett asked Mr. Haft how migrant worker dwellings
would fit in the zoning. Mr. Haft felt that we should leave the matter of migrant worker
dwellings up to the State Department of Health.
Commissioner Anstett then mentioned that the term Outdoor Recreation Area should be used
rather than recreation area.

It was questioned whether we should have the definitions in the ordinance read the same as
those in Ordinance 8. It was decided that they could vary slightly.
The Commission then went through the Ordinance to make corrections and changes.

The definition for Single Family Dwelling should be changed deleting the words 'free-standing
mobile or' as mobile homes are not allowed in the city unless they are in a trailer park.
The wording of the second paragraph of section 3.b on page 3 was questioned. It was noted
that this paragraph could mean that once this ordinance is adopted, all properties in the ag
preserve district would be automatically rezoned. The City Attorney will be asked what this
paragraph means.
Commissioner Lobb felt that 4.D.f., home occupations, should be deleted from the ordinance.
He noted that there is no definition for home occupations in this ordinance. If this is
supposed to be agricultural, it should not allow for home occupations.
Commissioner Johnson felt that it should not be deleted. He explained that the farmer's wife
might have some kind of home occupation not related to the farming operation.
It was the concensus of the Commission to leave home occupations in the ordinance.
Commissioner Scherer questioned the distances agricultural service establishments have to be
from driveways affording access to fields. He felt that 'or field' should be deleted.
Commissioner Johnson concurred.
Section 5.E.d will be changed to read 'All agricultural service establishments may require
screening from the public view' rather than 'All agricultural service establishments shall
be screened'.
The definition from Ordinance 8 for Home Occupations will be added to this ordinance.
This ordinance will be sent to the City Attorney for his comments prior to the Public Hearing,
which will be October 13th.
Chairperson Bosell asked for a volunteer to attend the next City Council meeting in her place.
Commissioner Apel will represent the Commission.
OTION by Anstett, seconded by Lobb to adjourn. Motion carried unanimously. Meeting adjourned
at 10:30 P.M.
