Harold Mayes Variance Rosella Sonsteby Discussion C,J C) ~oIANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING DECEMBER 14, 1982 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairperson d'Arcy Bosell at 7:33 P.M., Tuesday, December 14, 1982 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Apel, Elling, Perry, Spotts Commissioners Absent: Anstett Also Present: James Schrantz, City Engineer; James Glatt; Barb Feltl; Harold Mayes; Rosella Sonsteby; others Approval of Minutes November 23, 1982 MOTION by Spotts, seconded by Elling to approve the minutes of November 23, 1982 as written. Motion carried on a 3 yes, 2 present (Apel, Perry) vote. James Glatt Rezoning, Continued (Comm. #11-82-5) Chairperson Bosell reopened the pUblic hearing. c=)Mike Walker, 1640 - 177th Avenue N.W., Cedar - stated that he can't see any reason why Mr. Glatt should be denied this rezoning; is in favor of approval. He noted that Mr. Glatt has been a good neighbor. Barb Feltl, 1750 - 177th Avenue N.W. - read a letter from Harvey and Alice Lewis of 1755 - 177th Avenue, which states: "We the undersigned have found Jim Glatt to be a good neighbor and find nothing offensive or objectionable in his farming operation. We feel he should be allowed to continue operating as he has without interference. We wholeheartedly approve the rezoning of his land from residential to agricultural." Mike Walker - asked if this will go to the City Council next. Chairperson Bosell noted that it does. Commissioner Elling asked Chairperson Bosell if she had talked to the City Attorney regarding the residence on this property. She noted that she had and Mr. Hawkins said that the request deals specifically with the land. It does not entail what is going on with the land. The fact that the city has become aware of some irregularities should have nothing to do with the rezoning. MOTION by Elling, seconded by Apel to close the public hearing. Motion carried unanimously. MOTION by Apel, seconded by Spotts that the Andover Planning and Zoning Commission recommend to the City Council approval of the James Glatt rezoning to Agricultural Preserve in accordance with Ordinance 8, Section 5.02 the property described as: Plat 65903, Parcels 09200, 9225 and 9300, noting the following: 1) A public hearing was held and we received . statements from the neighbors in facor of the rezoning; there was no opposition; 2) The rezoning would be in compliance with the Comprehensive Plan; 3) The health, safety, and general welfare of the community are not affected; 4) Surrounding property values will not be adversely affected. I. }. an onlng ommlsslvli_2etlng 14, 1982 - Minutes L,j '\ , )arold Mayes Variance (Comm. #12-82-1) Harold Mayes, 14964 Round Lake Boulevard - stated that his house burned down on September 18, 1982 and he is trying to rebuild it. Clair Lillis, 1550 - 6th Street N.W., New Brighton - noted that he is a real estate agent working with Mr. Mayes. Noted that the variance request if for the setback for the garage. The property has a very steep bank and in order to build a garage the cost would be great. He stated that they are asking for about a five foot variance. They are not clear on what the requirement is from the lake. They will be using the foundation from the original house and building on that. Commissioner Elling asked if they are going to push the old stuff off and start new. Mr. Pariseau, Nature Homes - Noted that they are going to try to use part of the old structure. Mr. Mayes just put in a new fireplace and they are going to use that. They will also be using the existing well and septic system. Commissioner Elling asked where the drainfield is located. Mr. Pariseau noted that the septic tank is to the south of the home. It has a lift pump and also a second tank. Commissioner Elling noted that when the county was acquiring right-of-way for the upgrading of Round Lake Boulevard, it was discovered that the septic system was within the right-of-way. Mr. Pariseau stated that the cover on the upper tank is on the Mayes' property; however, they are not sure as to where the drainfield is located. \. '-Chairperson Bosell noted that the setback on Round Lake Boulevard is 50 feet. She asked the City Engineer what impact our Flood Plain Ordinance has on this property. Mr. Schrantz stated that the house has to be above 870. After checking the flood maps, Mr. Schrantz noted that it is above the flood hazard. Commissioner Elling asked when they planned to start construction on the new home. Mr. Pariseau noted that they would like to begin as soon as possible. Chairperson Bosell stated that the garage has to be at least 10 feet from the lot line. MOTION by Elling, seconded by Perry that the Andover Planning and Zoning Commission recommend to the City Council approval of the Harold Mayes variance for the property located at 14964 Round Lake Boulevard from Ordinance 8, Section 6.02 allowing for the setback requirement for a new garage and Section 4.33 due to the topography of the land, noting the following: 1) Granting the variance is necessary to the reasonable use of the land; 2) It is within the framework of the Comprehensive Plan; 3) There was no public opposition; 4) It will pose no adverse affects. Motion carried unanimously. This will go to the City Council on January 4, 1982. Rosella Sonsteby Discussion Mrs. Sonsteby noted that she would like to plat 14 acres of her property for single family , -homes rather than twin homes as she previously platted. She presented a sketch plan to \ ~he Commission asking if there would be any problems with what she has proposed. Chairperson Bosell explained to Mrs. Sonsteby that she will have to go to the City Council for conceptual approval prior to coming to the Planning Commission with a preliminary plat. L. ) Discussion centered on the park dedication with Mrs. Sonsteby suggesting several alternatives. Mrs. Sonsteby was unhappy with the decision the Park Board made on her previous plat. It was suggested that she could donate land outside of her plat for park purposes. Another suggestion was donating parkland adjacent to the park that Good Value is proposing as part of Northglen II.
