MINUTES
The regularly scheduled Andover Planning and Zoning Commission meeting was called to
order by Chairperson d'Arcy Bosell at 7:34 P.M., Tuesday, July 27, 1982 at the Andover
City Hall, )685 Crosstown Boulevard N.W., Andover, Minnesota.

Approval of Minutes
July 13, 1982
MOTION by Anstett, seconded by Elling to approve the minutes of July 13, 1982 as
written. Motion carried on a 5 yes, 1 present (Spotts) vote.
Firearms Ordinance Public Hearing, Cont. (Comm. #11-81-1)
Chairperson Bosell reopened the public hearing.

Commissioner Elling noted that he, Commissioner Apel and Frank Schoonover met to discuss
this ordinance and they decided that it will be left basically the same. Ordinance 12,
12A, 12B, and 12C will be eliminated and the new Firearms Ordinance will be number 61.
The definitions for rifle, shotguns and hand guns will be changed and BB guns will be
eliminated from the ordinance. The lot size for hunting on one's own property will be
10 acres or more. The description of the backstop will be redone and the ordinance will
have a disclaimer in it.
Commissioner Anstett asked how the slaughtering of livestock will be handled. Commissioner
Elling noted that it could be put into the ordinance as an exception. Commissioner
Anstett also felt that people slaughtering their livestock should not have to come in
to the city to get a permit. Commissioner Elling felt that the city should be notified
of who is hunting but that a fee should not be required. He noted that if someone is
hunting on their property and someone complains, the sheriff will be called. With a
permit, City Hall will know who is hunting.
Ken Taylor - stated that the fee was for those people who drive out here from the city
and just start shooting anywhere.
Commissioner Perry asked about hunting on Round Lake. Commissioner Elling stated that
it will be left as it is. Chairperson Bosell noted that because of the 500' requirement
and the fact that you can't hunt in open waters, Round Lake is more or less closed.
Commissioner Spotts felt that those people with larger parcels of land should be able
to hunt on them. He felt that we should have permits, but no fees.

Commissioner Elling will get the revised ordinance to City Hall to be retyped. The
clerk was asked to send several copies of the ordinance to Frank Schoonover. This item
will be continued on August 10, 1982.

Commissioner Perry felt that there is a need for the city to know in advance what is
happening. The procedure to be followed is not difficult.
The clerk was asked to contact the cities of Coon Rapids, Blaine and Lino Lakes to see
what advantages and disadvantages there are because of this act.
City Engineer Schrantz noted that there is an existing law now that says the same thing
as this act. Hennepin County has been doing this for years. One of the problems is
where there is a five acre subdivision and people cut out one acre and have it recorded.
He also noted that in the sewered area, a person could cut out the part of the property
his house is on, and let the land go tax delinquent. The only disadvantage he could
think of is that someone has to do the paperwork.

Kickoff Meeting - Ordinance Update - Barton-Aschman
Bill Short, Barton-Aschman - asked if the City Council has accepted the Planning
Commission's recommendation that his firm update the ordinances.
Chairperson Bose11 noted that they have and are waiting for Barton-Aschman to submit a
contract and work program. Mr. Short asked if he could get a copy of the Comprehensive
Plan. It was noted that there are no extra copies of the Plan at City Hall; however,
TKDA is supposed to have more printed. The clerk was asked to check to see if the City
Council recommended that TKDA do the printing rather than have Northwest Associated
Consultants do it.
Mr. Short explained that they will have a six step update program, starting with this
kickoff meeting.
City Engineer Schrantz asked if the updated ordinance will be in the same format as the
old ordinance. Mr. Short noted it will be. There will be an index, table of contents and
references. He stated that they will encourage the City Council members to attend
the Planning Commission review meetings.

Commissioner Elling asked if it would be possible to put margins on the sides so that
the sections of the old ordinance could be referenced to go along with the new ordinance.
Mr. Short noted that they could do that. Commissioner Elling also felt that it should
be double spaced so that it is easier to read and make changes.

Mr. Short noted that one of the problems in other communities has been accessory buildings.
Commissioner Anstett noted that that is a problem here also.
Chairperson Bosell felt that we need something for the rural area and something for the
urban area.
Mr. Short stated that one of the biggest changes they will suggest is to list the permitted
uses, accessory uses and special uses for each district rather than having a separate
section for each.
Commissioner Elling felt that two of the city's biggest problems are the landfill and the
junkyards. Commissioner Anstett noted that another problem is new businesses coming into
the city.
Chairperson Bosell stated that the rules are too general; all have some areas that are
too broad.
City Engineer Schrantz asked Mr. Short if they are going to look at setting up a site
plan procedure for industrial and commercial developments. Mr. Short stated'that they
could look at that.

Discussion was on the zoning map and rezonings. Chairperson Bosell noted that the city
has had trouble with the definition of Neighborhood Business.
Mr. Short stated that Shoreland Lot District is shown in the ordinance and that should
be compared with the Shoreland Management Regulations.
It was mentioned that there is a 1980 law that allows cities to request park land
dedication in a metes and bounds subdivision. The clerk was asked to check with the
City Attorney on this.
