. MINUTES
The Regularly Scheduled Andover Planning and Zoning Commission meeting was called to order
by Chairperson d'Arcy Bosell at 7:38 P.M., Tuesday, January 26, 1982 at the Andover City Hall,
1685 Crosstown Boulevard N.W., Andover, Minnesota.
Commissioners Present: Anstett, Apel, Kishel, Lobb
Commissioners Absent: Scherer
Also Present: City Engineer, James Schrantz; interested residents
Approval of Minutes
January 12, 1982
MOTION by Lobb, seconded by Anstett to approve the minutes of January 12, 1982 as written.
Motion carried unanimously.
Firearms Committee Report (Comm. #11-81-1)
Commissioner Apel reported that at the last meeting the Committee reviewed the mail that
had been received regarding the ordinance. At the next meeting various assignments will be
given to check into different items regarding firearms. Their goal is to have something
by the end of March. They have broken down firearms into three categories: self-protection;
c=Jcreational use; target shooting.
Chairperson Bosell suggested that the Committee have articles put in the Anoka Union and
perhaps the Andover Newsletter so that the residents of the city are informed as to what
is happening.
Rosella Sonsteby, 4151 - 141st Avenue N.W. - stated that she resents not being able to dis-
charge a firearm on her own property. She felt that the city is violating her constitutional
right to bear arms. She also noted that the city is going to be making criminals out of
the residents because many of them shoot woodchucks, skunks, etc. that are damaging gardens.
She felt that rather than taking away the right to discharge firearms, the city should quit
issuing liquor licenses. She reported an incident where several people got drunk and started
shooting out windows of homes and school buses. Ms. Sonsteby also felt that the city should
have an ordinance about snowmobiles and hot air balloons because of the noise they make.
Commissioner Apel stated that most of the people do not want an ordinance that would totally
prohibit firearms.
This item will be continued until February 9, 1982 when Commissioner Apel will have another
report on the progress of the Firearms Committee.
Ordinance 8, Section 6.02 Amendment Public Hearing, Cont. (Comm. #10-81-6)
Chairperson Bosell reopened the public hearing.
Commissioner Kishel noted that in conjunction with this amendment an amendment to Ordinance
( ) should also be adopted so the two ordinances are consistent. He felt that the way the
amendment is written should be sufficient for what we need. Ramsey and Ham Lake should also
go along with what we're doing.

~I'IJTION by Kishel, seconded by Lobb to close the public hearing. Motion carried unanimously.
MOTION by Kishel, seconded by Lobb that the Andover Planning and Zoning Commission recommend
to the City Council adoption of an amendment to Ordinance 8 for the following reasons: 1)
it updates the required setbacks along the thoroughfares in the city to correspond with the
County in better planning of the city; 2) it would be complimentary to the Comprehensive
Plan; 3) it would clarify Ordinance 8, Section 4.15, 'Setbacks along Thoroughfares'.
Motion carried unanimously. This will go to the City Council on February 16, 1982.
Ordinance 10, Amendment Public Hearing (Comm. # 1-82-1)
Chairperson Bosell opened the public hearing.
Commissioner Kishel noted that the reason for this amendment is to clarify certain definitions.
Service street has been changed to 'frontage road'; roadbed has been defined; trails were
defined; section 9.03 (Streets) has been updated with new right-of-way dimensions.
Commissioner Anstett felt that 'arterial I should be changed to either 'intermediate arterial'
or 'principal arterial'. She read the definitions of both arterials from the Comprehensive
Plan. Discussion continued on this with the concensus being that it should be left as 'arterial '.
Commissioner Anstett also noted that the Comprehensive Plan deals with trails, which is a
reason we should have them included in our ordinance.
(-'TION by Kishel, seconded by Lobb to close the public hearing. Motion carried unanimously.

MOTION by Kishel, seconded by Apel that the Andover Planning and Zoning Commission recommend
to the City Council adoption of the proposed amendment to Ordinance 10 as submitted to coincide
with Ordinance 8 to provide for good planning in accordance with the Comprehensive Plan.
Motion carried unanimously. This will go to the City Council on February 16, 1982.
Noise Control Ordinance (Comm. #12-81-1)
The secretary played a tape that Commissioner Lobb made reporting his findings on various
cities' noise ordinances. He noted that Ham Lake does not have a noise ordinance. They have a
public nuisance ordinance which deals with noise. The City of Blaine also has a public
nuisance ordinance. Their ordinance states that the use of radios, amplifiers, etc. used in
such a way as to disturb others is unlawful. The police in Blaine handle most of the noise
problems. Osseo has a public nuisance ordinance that has no teeth to it. The City of Coon
Rapids has a noise ordinance that is pretty complex. Their statement of policy covers
everything. The ordinance does not give any decible ra~ings. However, the only place where
we could use a decible meter would be in an industrial zone where it would be an ongoing
thing. The ordinance states that radios, etc. cannot .b.e operated as to disturb. others +
between the hours of 11:00 P.M. and 7:00 A.M. We could be more restrictive and say they
cannot be played as to disturb others any time of the day, the reason being that there are
people who work nights and sleep during the day. The ordinance also contains a section on
exhaust. Dirt bikes, snowmobiles, etc. have to have a muffler on them. Commissioner Lobb
felt this would be a good feature to have in an ordinance. He felt that Coon Rapids has the
,h~st way of handling the noise problem. He also noted that most of the cities had something
(~cover the industrial zones but nothing to cover parties, snowmobiles, etc. He stated that
he spoke with Mayor Windschitl and he didn't seem to think there is too much of a problem
except with dirt bikes. Commissioner Lobb noted there are two ways of determining noise _
one is with a decible meter and the other is simply a judgment call. He didn't feel that

we need a noise ordinance at this time.
Chairperson Bosell noted that Ordinance 8 has a Nuisance Characteristics section which
includes noise. She felt that maybe this section would be sufficient.
Commissioner Lobb will contact the City Attorney to find out exactly what it is he wants
the Commission to come up with and the secretary will send the City Attorney a copy of the
Coon Rapids ordinance so he is familiar with it.
This item will be continued on February 9, 1982.
Chairperson Bosell noted that the Commission's second meetinq in Februa~y should be rescheduled
as February 23rd is Precinct Caucus Night. The Commission will decide on February 9th when
the meeting will be held.
MOTION by Lobb, seconded by Apel to adjourn. Motion carried unanimously. Meeting adjourned
at 9:00 P.M.
