MINUTES
The regularly scheduled Andover Planning and zoning Commission meeting was called to order
by Chairperson d'Arcy Bosell at 7:33 P.M., Tuesday, January 12, 1982 at the Andover City
Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota.
Commissioners Present: Anstett, Ape 1 , Kishel, Lobb, Scherer

MOTION by Kishel, seconded by Anstett to approve the minutes as corrected. Motion carried
on a 4 yes, 2 present (Lobb, Apel) vote.

Commissioner Apel, who is the head of the Firearms Committee, stated that they have held
two meetings. The first meeting was largely a discussion on whether or not hunting should
be allowed in Andover. They decided that the direction that the committee should take would
be to try to provide for hunting and update the Firearms Ordinance in a manner that would
make it more easily enforceable. The second meeting was last Tuesday (January 5th) and some
progress was made at that meeting. Commissioner Apel provided the Commissioners with copies
of everything that was handed out at the Committee meeting. He also stated that the follow-
ing are the members of the committee: Ken Taylor; Dennis Johnson; Don Fuchs; Paul Asted;
John Mollencamp; Barbara Humphreys. One item of concern that was discussed was how to let
people know we have a firearms ordinance. One suggestion was signs on our boundaries that
say 'Firearms Ordinance Enforced'.Permits were discussed with Ken Taylor saying that
the people hunting also register with the landowner. Frank Schoonover, a resident of the
city, presented the committee with what he thought would work in the city.
Commissioner Scherer asked if there was any discussion about hunting on non-private
property. Commissioner Apel noted that they talked about that and felt that the State
Trespass Law should take care of it. However, once again our problem is enforcement.
Commissioner Apel also noted that the Committee will be meeting every first and third
Tuesday night at 7:30 P.M. He tried to find someone who is against hunting to be on the
Committee but couldn't find anyone.
[~ohn Zillhardt, 3753 - 145th Avenue N.W. - stated that he and his wife sent a letter to the
~ity citing their reasons for not allowing hunting in populated areas. He stated that it's
dangerous because of the number of houses and children around. They live on the shore of
Round Lake and it's a very unhealthy situation. He stated that with the popUlation steadily
increasing, he would like to see a good strong ordinance.

--Commissioner Lobb asked why we want another ordinance when we can't enforce the ones we have
now. Chairperson Bosell felt that if it's properly posted and the people are notified, it
should help the problem. She noted that the Sheriff said if we come up with boundaries, they
should be easily defined.
Bruce Perry, 17337 Roanoke Street N.W. - stated that there are some people who butcher their
livestock by shooting them with a rifle. Some consideration should be made for this situation.
Commissioner Scherer noted that there are very few people who use a pistol, revolver, or
rifle for anything other than target practice. The problem in our community is people who
do not live here but come out here to hunt.
This item will be continued on January 26, 1982 at which time Commissioner Apel will have
another report from the committee.
Ordinance 8, section 6.02 Amendment Public Hearing, Continued (Comm. #10-81-6)
Chairperson Bosell reopened the public hearing.
Commissioner Kishel noted that the City Engineer prepared some drawings of streets in Blaine
and Coon Rapids showing different rights-of-way and setbacks.
Commissioner Anstett asked what we have that tells us what the setback is. Commissioner
Kishel noted that in the past it has been 40 and 50 feet.

~ity Engineer Schrantz noted that at the last meeting we were discussing what would be a
reasonable setback for Andover. He noted that the drawings he gave the Planning Commission
with the grader on them are what he proposes we use. If a street is going to be an urban
street with no parking, we could still build a rural section and have a 35 foot setback.
Thirty-five feet is the minimum setback we should have anywhere. He also noted that he
wrote an amendment to Ordinance 10 to be compatible with the amendment to Ordinance 8. In
that amendment he changed 'service street' to 'frontage road'; put in a definition for road-
bed; and changed the right-of-way width on different types of streets.
Commissioner Anstett asked if there were to be some kind of energy alternative roadway where
it would fall. City Engineer Schrantz stated that in all of the examples he provided, there
is room for a path or sidewalk. He noted that in the rural section it's harder to establish
that however. Commissioner Anstett asked that some consideration be given to paths.
commissioner Kishel noted that there is federal and state money appropriated for bike paths.
Commissioner Anstett stated that it's logical that we would take advantage of money if it's
available. Commissioner Kishel didn't feel that the city would be able to expend money for
paths. Chairperson Bosell noted that if someone in the rural area wanted their road improved
and they wanted a bike path, they could have that and still meet the setback requirement.
Commissioner Anstett noted that there is a community in Arizona that has built their city
with trails. Commissioner Scherer stated that places like that have problems with rape,
robbery, etc. In Carver they have remote cross country ski areas and the only way they can
do anything is to have a ski patrol because of the crime.

" ;Lty Engineer Schrantz suggested that in Ordinance 10 under Collectors, we could add 15 feet
-for trails. Commissioner Kishel noted that on county roads, if there's going to be a bike
trail, the County acquires enough right-of-way to provide for it. City Engineer Schrantz
noted that the streets in Andover are quite adequate for bike trails. Commissioner Anstett

felt it would be compatible with the Comprehensive Plan to put something in the ordinance
for trails.
Chairperson Bosell felt that under Section 9.03 of Ordinance 10 we could put in a, paragraph
about trail systems. City Engineer Schrantz also noted that we could have a definition in,
Section 4 for trails.

City Engineer Schrantz will draft a definition for trails and make a provision in Ordinance
10 for trails. This item will be continued on January 26, 1982 at which time a public
hearing will also be held on Ordinance 10.

Chairperson Bosell noted that at the last meeting the Commission was wondering why the City
Attorney had sent this to the Commission. The clerk noted that the reason was that the
attorney is having a hard time trying to prosecute violaters of the Party Ordinance because
it does not say anything about noise.

.' 'here amplifiers are used. The draft noise ordinance does not deal with amplifiers.

Commissioner Kishel noted that under Section 6 amplifiers are addressed (device for the
production or reproduction of sound).
commissioner Anstett suggested that there be a variance provision because if you have a
field party with a band the music will carry past the property lines.
Commissioner Lobb will research this item and report back.
This item will be continued on January 26, 1982.
MOTION by Lobb, seconded by Anstett to adjourn. Motion carried unanimously. Meeting
adjourned at 9:36 P.M.
