Comm. #11-83-2 Rosella Sonsteby Vacation of Easement Bialke-DeGardner Variance o 0 ~ ~ ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING NOVEMBER 22, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman d'Arcy Bosell at 7:40 P.M., Tuesday, November 22,1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Knutson, Perry, Spotts Commissioners Absent: Apel, Rogers Also Present: James Schrantz, City Engineer; Rosella Sonsteby; Ben Bialke Rosella Sonsteby Vacation of Easement Public Hearing (Comm. #11-83-1) Chairman Bosell opened the public hearing. Rosella Sonsteby, 4151 - 141st Avenue N.W. - stated that the way the legals are worded, the easement was not vacated to the west as she thought it was supposed to be. Her attorney felt that it should be corrected. Chairman Bosell asked if the easement to the east has been taken care of. Mrs. Sonsteby noted that it has. City Engineer Schrantz stated that he thought it was vacated at the time the plat was approved. However, when the Council passed the resolution, it was vacated from Vintage Street to the east. David Jablonic, 14269 Woodbine Street N.W. - stated that his concern is what the city plans to do with the end of Woodbine Street. They would like it to remain as a dead end as children play out there and they feel that it is safe. Harry Moberg, 14279 Woodbine Street N.W. - noted that his feelings are the same. He didn't see any reason in having a big U-turn at the end of that street for the snow plow. Jim Schrantz explained that Woodbine is a problem area because the snow plow has to back down the street because there is no place to turn around. If a cul-de-sac is constructed, that indicates that itJis the end of the street. If you leave it as it is, it means that the street will be extended. If the easement is vacated, that would mean that Woodbine Street would be extended in the future. Mrs. Sonsteby stated that if she will be expected to put in a cul-de-sac, the easement might as well remain where it is. After more discussion on the construction of a cul-de-sac at the end of Woodbine, Chairman Bosell noted that the vacation of the easement and the cul-de-sac are two different issues. Mrs. Sonsteby stated that she is opposed to having a cul-de-sac there. ~missioner Perry asked if we could just vacate the easement within the plat. Chairman Bosell noted that we could; however, it would serve no purpose. If we vacate, it has to be the whole easement or nothing. If they don't vacate it to the west because of the Woodbine situation, they should advise the Planning Commission so we can review it further. We also suggest that the Council discuss the cul-de-sac on the end of Woodbine and let the Planning Commission know their feelings. MOTION by Spotts, seconded by Knutson to close the public hearing. Motion carried unanimously. MOTION by Spotts, seconded by Knutson that the Andover Planning and Zoning Commission recommend to the City Council approval of a request by Rosella Sonsteby to vacate an easement lying west of Vintage Street starting in Rosella's~Additionand continuing west for the following reasons: 1) A public hearing was held; however, most of the discussion centered around the possibility of constructing a cul-de-sac on Woodbine Street; 2) It would not be detrimental to the development of additional property;.3) It would clear the title on the plat; 4) the vacation does not render any property in that area landlocked at this time. Motion carried unanimously. This will go to the City Council on December 20, 1983. Bialke-DeGardner Variance (Comm. #11-83-2) Ben Bialke, 641 - 90th Lane N.E. - stated that they are requesting a variance because of a problem concerning the former owner of the Bialke-DeGardner Subdivision. One of the lots they want to build on is not five acres in size. This was discovered when they went to have the property recorded. The parcel is only about 4-3/4 acres. MOTION by Spotts, seconded by Perry that the Andover Planning and Zoning Commission recommend to the Ci ty Council approval of a variance requested by Bia 1 ke-DeGardner for the property known as Tract "A", Bialke-DeGardner Metes and Bounds Subdivi.sion for the following reasons: l} There are practical difficulties and hardships caused by the characteristics of the land and not the property owner; 2) A public meeting was held and there was no opposition; 3) It is necessary because of the meets and bounds requirement of five acres or greater; 4) It is consistent with the Comprehensive Plan. Motion carried unanimously. This will go to the City Council on December 20, 1983. Recess 8:50 - Reconvene 9:03. r-'dinance 8 Update '--' At this time, the Commissioners explained what they felt was the city's philosophy is concerning development with the concensus being that the city's intention is to be a bedroom Planning Commission Meeting November 22, 1983 - Minutes Page 3 o o :- \', ~~0mmunity and not to be concerned with large commercial development. Commissioner Knutson felt that the two could be mixed. Commissioner Spotts felt that if the city wanted big corporations like Control Data to locate in Andover, they could get them out here. Commissioner Perry stated that in talking to people in the community, most of them moved out here because of the rural atmosphere. They moved here because it is a bedroom community and they would like it to stay that way. She also felt that the big corporations like Control Data would be looking at the first tier suburbs (Roseville, Blaine, etc.) before they look at Andover. The companies looking at Andover would be those that don't have the status of a Control Data. Chai,rman Bosell felt that the highway system serving Andover is a problem for commercial deve 1 opment. The secretary will retype those sections of the ordinance that have been reviewed and changed and mail them out to the Commissioners prior to the next meeting. Further discussion on the update will be on the agenda for December 13th. MOTION by Knutson to adjourn. Motion carried unanimously.
