Comm. #10-83-4 Ada Orr Rezoning Public Hearing o 0 ~ ~ ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING NOVEMBER 8, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to)' order by Chairman d'Arcy Bosell at 7:32 P.M., Tuesday, November 8,1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Commissioners Absent: Also Present: Apel, Knutson, Perry, Rogers, Spotts Rogers Ada Orr; others Approval of Minutes October 25, 1983 MOTION by Spotts, seconded by Apel to approve the minutes of October 25, 1983 as written. Motion carried on a 2 yes, 3 present (Bosell, Perry, Knutson) vote. Ada Orr Rezoning Public Hearing (Comm. #10-83-4) Chairman Bosell opened the public hearing. Ada Orr stated that she has approximately 147 acres that should like to have rezoned to agricultural preserve. Harvey Lewis noted that according to the notice he received, it looks as though his property is included in Mrs. Orr's request and asked if this was the case. It was noted that his property is not included. Commissioner Knutson asked if the property is being farmed at the present time. Mrs. Orr stated that all of it with the exception of the lowland is being farmed. She does not farm it, but rents the land out. Chairman Bosell noted that we must first determine if the property is eligible for agricultural preserve before rezoning it. She stated that there is one residence per 40 acres, it meets the size requirements and the property is all contiguous. Commissioner Perry noted that on the restrictive covenant, those properties which belong to Ken Orr and Harvey Lewis should be noted as exceptions. Mrs. Orr was requested to get the legal descriptions for those properties so that they can be added to the covenant. MOTION by Spotts, seconded by Apel to close the public hearing. Motion carried unanimously. MOTION by Spotts, seconded by Apel that the Andover Planning and Zoning Commission (~ recommend to the City Council approval of eligibility of rezoning for the property known ~ as the Ada M. Orr property described as Plat 65903, Parcels 10, 600, 1200 and 1800 for the following reasons: 1) It is in compliance with Minnesota Statute 473H. The rezoning is recommended for approval for the following reasons: 1) The property meets the size requirement, being 40 acres or greater; 2) It is in compliance with Ordinance 57, in that Planning November Page 2 ~) (Orr Re~oning, Cont.) o and Zoning Commission Meeting 8, 1983 - Minutes o the logical and proper long-term use is agriculture and to preserve and protect said agricultural land from unnecessary encroachment by non-agricultural uses; 3) It will not be detrimental to the health, safety or general welfare of the community; 4) It will not seriously depreciate surrounding property values; 5) The use is in harmony with the intent and general purpose of the Zoning Ordinance and the Comprehensive Plan. A public hearing was held; there was no opposition. Motion carried unanimously. This will go to the City Council on December 6, 1983. Inasmuch as there were n01lother agenda items, the Commiss i on continued worki ng on the draft of Ordinance 8. Commissioner Spotts noted that he spoke to some people and they said that we should use the words zero lot line and party wall together. Height and Setbacks for High Structures - this section should be in the administrative section and should read: Buildings or structures in excess of 35 feet shall meet the following criteria: 1) setback from any lot shall be at least equal to the height; 2) the distance between any two detached principal buildings shall be no less than one-half the sum of the heights of the two structures or buildings. The last paragraph of this section will remain where it is and shall read: Any structure exceeding the maximum height established in each district shall require a Special Use Permi t. The Shopping Center section was dealt with at a prior meeting. After considerable discussion on the Planned Unit Development section, Commissioner Spotts stated that he would redo this section. MOTION by Knutson to adjourn. Motion carried. Meeting adjourned at 11:05 P.M. The next work session on this ordinance will be Tuesday, November 15, 1983 at 8:00 P.M.
