Comm. #9-83-1 Ivywood Estates Preliminary Plat Public Hearing Rosella Sonsteby Rezoning Public Hearing o 0 ~ 0& AN DOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 27, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman d'Arcy Bosell at 7:34 P.M., Tuesday, September 27,1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Apel; Perry; Rogers; Spotts Commissioners Absent: Knutson; Schreiner Also Present: Jim Schrantz, City Engineer; Pat Olson, Department of Natural Resources; Lee Hennen; Thomas Mattson; Jeff Caine, Caine and Associates; Rosella Sonsteby; others The first item of business to be considered was a discussion on how the Planning Commission felt about Gerhardt Denning, 2526 North Ferry Street, Anoka, constructing a pole building on a parcel of land in Andover that does not have a principal structure on it. The property is located on 167th Avenue and consists of 20 acres. The building will be 16' x 20'.and will be used to store a tractor and garden equipment. Chairman Bosell noted that the ordinance does allow for a pole building to be constructed prior to the principal building by Special Use Permit. This property is in the rural area. Commissioner Apel felt that Mr. Denning should apply for a Special Use Permit and the Commission concurred. Approval of Minutes September 13, 1983 MOTION by Spotts, seconded by Rogers to approve the minutes of September 13, 1983 as written. Motion carried unanimously. Ivywood Estates Preliminary Plat Public Hearing (Comm~ #7-83-4) Chairman Bosell opened the public hearing. Jeff Caine, Caine & Associates - noted that he revised the setbacks to 40 feet and added the setback line on the river lots, which is 30' from the bluff line. The location of the ordinary high water mark was questioned. Pat Olson, Department of Natural Resources noted that on this plat the ordinary high water mark is measured from the pond. ) Discussion was on the cul-de-sac with the concensus being that it serves no purpose. developers had no problem with eliminating that cul-de-sac. Pat Olson - felt that the lots, except those on the river, are very wide for future sewer. Chairman Bosell noted that they have to be at least 39,000 square feet to support a septic system and when sewer does come in, they can be divided. i:; The 8 u Regular Planning Commission Meeting September 27, 1983 - Minutes Page 2 , \ ) . Lee Hennen, 2320 North Ferry Street, Anoka - asked if the city would have any objections to deeding the property known as Outlot A to the lots that are not on the river so that those people have an access. Chairman Bosell noted that they can do that but it will have to be written in the restrictive covenants and they have to be filed at City Hall. Pat Olson asked if they plan to build a road down to the river. Jeff Caine stated it will only be a walkway. Ms. Olson felt that the DNR would have to make a certification that the river lots are not ever going to be subdivided. City Engineer Jim Schrantz noted that the 150 foot setback from the river should be shown on the plat so we don't have problems like those we have encountered recently. Chairman Bosell noted that the depth of some of the lots is only 135 feet and should be 150 feet, but considering the land, there is not much that can be done about that. This should be noted as a variance. Jerry Lapham, 14913 - 7th Avenue - expressed concern regarding the drainage from this plat. He felt that the water would drain down 7th Avenue to the south end of his property. Jeff Caine stated that the water will go down 7th Avenue to the property south of the plat that is owned by Lee Hennen. Doug Anderson, 4511 - 148th LaneN.W. - asked if the easement that goes to the river, which is north of his house, will be blacktopped. Chairman Bosell noted that it will not. City Engineer Schrantz reviewed the Andover Review Committee's memo regarding this plat noting that the soils are suitable and that the house elevations are on the grading plan. Everything else in the memo has been taken care of. Chairman Bosell noted that on the legend, the minimum lot size should say that the riparian lots are 4 acres and the non-riparian lots are 39,000 square feet or more. The setback from the river should be shown as 150 feet from the ordinary high water mark. The lot lines will have to be adjusted because the cul-de-sac is being eliminated. Variances that will be required are for lot depth on Lots 1 and 2, Block 2 and Lot 3, Block 3. We must also indicate that the lots will front on interior streets, not 7th Avenue. The future subdivision will allow for smaller lots, but in accordance with Ordinance #52, the non-riparian lots can be no smaller than 12,500 square feet and the riparian lots can never be subdivided. It was decided that a motion will be made on this plat, the developer will come back to the Planning Commission on October 11th with corrected copies of the plat and that the recommend- ation will go to the City Council on October 18th. MOTION by Apel, seconded by Rogers to close the public hearing. Motion carried unanimously. "- 'OTION by Apel, seconded by Spotts that the Andover Planning and Zoning Commission recommend to the City Council approval of the preliminary plat known as Ivywood Estates, legally described as 'Government Lot 4, Section 19, Township 32, Range 24, Anoka County, Minnesota u u Regular Planning Commission Meeting September 27, 1983 - Minutes Page 3 . , ~ ,)vywood Estates, Cont.) and Government Lot 5, Section 19, Township 32, Range 24, Anoka County, Minnesota, except the North 625.00 feet of the east 733.00 feet, except part platted as Anoka County High- way Right-of-Way Plat No.7, for the following reasons: 1) A public hearing was held. There was no serious opposition; 2) The plat conforms to the principles and intent of the Comprehensive Plan; 3) It will not adversely affect the health, safety or welfare of the residents. Approval is contingent upon the following items being corrected on the preliminary plat: 1) That the grading being done be properly shaded so it can be readily seen; 2) That the lots be marked with the 150 foot setback from the ordinary high water mark; 3) The legend be amended to include the setback; 4) The legend be changed to indicate the two types of lots - riparian lots are 4 acres; non-riparian lots are 39,000 square feet with a future resubdivision to lot sizes no smaller than 12,500 square feet; 5) The lots abutting 7th Avenue be fronted on interior streets. The plat will be subject to the following variances: 1) Lots 1,2 and 3, Block 4 and Lots 1 and 2, Block 2 will vary from the lot depth require- ment (Section 6.02, Ordinance 8); 2) Lots 1 and 2, Block 1 will vary from the frontage requirements as will Lot 3, Block 3. These variances are necessary to allow the reasonable use of the land. A copy of the restrictive covenants will be filed at City Hall. Anoka County has been notified and we are waiting for their letter. Pat Olson from the Department of Natural Resources was present and offered input. Motion carried unanimously. This will go to the City Council on October 18, 1983. The corrected copy of the plat will be reviewed at the October 11th Planning Commission meeting. Recess 8:45 - Reconvene 9:08 Rosella Sonsteby Rezoning Public Hearing (Comm. #9-83-1) Chairman Bosell opened the Public Hearing. Rosella Sonsteby, 4151 - 141st Avenue N.W. - noted that she would like to rezone her property on 7th Avenue to General Business. She stated that she was under the impression that it was already zoned GB. Looking back at the Town Board minutes, it was always referred to as commercial property. She is leaving a strip of land 350 feet wide along 141st Avenue zoned as M-2. Chairman Bosell noted that in the ordinance update, we are recommending that the minimum district size for General Business is 10 acres. This property meets that requirement. The lot size will have to be 39,000 square feet because of the lack of sanitary sewer. Commissioner Perry asked Mrs. Sonsteby what kinds of businesses she was planning to put into this area. Mrs. Sonsteby stated that at this time she did not know. Chairman Bosell asked how the realignment of Bunker Lake Boulevard will affect this property. Mrs. Sonsteby stated the County has said that it will go 100 feet north of Slim's Motor Clinic. Commissioner Spotts noted that if this parcel is rezoned, there is only one other parcel in the city that is zoned M-2 and asked if there are any other areas being considered for M-2 zoning. Chairman Bosell noted that there are none. ; was noted for the record that there was no public present for this item. MOTION by Spotts, seconded by Rogers to close the public hearing. MOTION by Spotts, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council approval of a rezoning requested by Rosella Sonsteby to rezone the North 23 acres of the Southwest one-quarter of the Southeast one-quarter of Section 30, Township 32, Range 24, Anoka County, Minnesota to General Business from Neighborhood Business and M-2 for the following reasons: 1) The request is in harmony with the Comprehensive Plan and Ordinance 8, Section 5.02; 2) In the update of the Zoning Ordinance, the recommended district size for General Business is 10 acres and this property meets that requirement. Approval is contingent upon the minimum lot size being 39,000 square feet until such time as sanitary sewer is available, at which time it will revert to 20,000 square feet. The minimum lot size will also depend on the SAC unit guidelines. A public hearing was held and there was no opposition. Discussion was on the realignment of County 116 since it may ingress and egress on that property. Motion carried unanimously. This will go to the City Council on October 18, 1983. Ordinance 8 Update The Commission started going through the General Provisions section of the ordinance. In the first section, Application of this Ordinance, the word 'morals' will be deleted. Under Non-conforming Uses and Structures, sections D, H, I and J will be deleted. In the Lot Provisions section, part A, Anoka County Registrar of Deeds will be changed to Anoka County Recorder. Also, public street right-of-way will be changed to read as it does in the new amendment to Ordinance 8. Part B, the fourth sentence will have 'dwelling' added after single-family detached. On page 4-5, the paragraph reading 'In the Rural District, the 60 percent requirement, etc.' will be deleted. Paragraph (C) will be changed to read 'There shall be no more than one principal building on one lot in all residential districts, except in a Planned Unit Development.' Paragraph (D) will be changed to read 'An access drive to the principal building shall be provided and constructed according to minimum driveway standards, etc.' Paragraph (E) will be eliminated. The Planning Commission will hold a special meeting to continue discussion on the General Provisions at 8:00 P.M., Tuesday, October 4th. MOTION by Apel to adjourn. Motion carried unanimously.
