Comm. #8-83-3 o Ernest Trettel Variance Square Footage Requirements/Two Story Homes o 0 ~ 01 ANDOVER iO REGULAR PLANNING AND ZONING COMMISSION MEETING AUGUST 23, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman d'Arcy Bosell at 7:31 P.M., Tuesday, August 23,1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Commissioners Absent: Also Present: Apel, Knutson, Perry, Rogers, Schreiner, Spotts None Mr. & Mrs. Ernest Trettel; David Almgren, City BUilding Official; Councilman Jim Elling Approval of Minutes August 9, 1983 MOTION by Spotts, seconded by Rogers to approve the minutes of August 9, 1983 as written. Motion carried on. a 5 yes, 2 present (Knutson, Perry) vote. Ernest Trettel Variance (Comm. #8-83-4) _ Chairman Bosell explained that the Trettels wish to build a new house on the lot that their present home is on. They are requesting a variance so that they can live in the old house until the new one is completed. Ernest Trettel, 1412 Andover Boulevard - noted that he owns 10 acres. When the new house is finished, the old one will be demolished. Commissioner Spotts asked if the house is in a disrepairable state. Mr. Trettel noted that it is. Chairman Bosell noted that the City Clerk said the house is almost to the point of condemnation. She also noted that if a motion is made to approve this variance we have to stipulate that the existing structure will be torn down and we should also put a 90 day time limit on it. Commissioner Rogers asked if we could tie the demolition of the old house into the issuance of the Certificate or Occupancy. Dave Almgren, Building Official stated that that is what we are going to do. Commissioner Spotts felt that the time limit should be longer than 90 days. Chairman Bosell explained that if they run into any probelms, they can get an extension. Commissioner Schreiner asked if anything from the existing house will be used in the con- struction of the new house. Mr. Trettel noted that they will be using two windows but that is all. Mr. Trettel presented a copy of his purchase agreement noting that the old house will be torn down. MOTION by Spotts, seconded by Rogers that the Andover Planning and Zoning Commission ('commend to the City Council approval of a variance requested by Ernest Trettel, 1412 ,,1dover Boulevard N.W., to vary from Ordinance 8, Section 4.04 (B) to allow construction of a new house on property already having a principal structure. Per an agreement between the property owner and Twin City Federal, the existing structure will be demolished upon Regular Planning Commission August 23, 1983 - Minutes Page 2 . \ ~) Meeting u '\rettel Variance, Cont.) ~- ~ completion of the new house. Reasons for approval are: 1) A hardship is created due to the physical condition of the existing structure on the property; 2) It will not adversely affect the existing or potential use of adjacent land; 3) It is in comformance with the Comprehensive Plan; 4) It is necessary to the reasonable use of the land. This variance is contingent upon the demolition of the old structure prior to the issuance of the Certificate of Occupancy. There shall be a 90 day time limit on the variance. Commissioner Rogers asked if the 90 days starts when the Council approves the variance. Chair- man Bosell noted that it starts from the day the building permit is pulled. Motion carried unanimously. This will go to the City Council on September 6, 1983. Square Footage Requirements/Two Story Homes (Comm. #8-83~3) Dave Almgren, Building Official noted that according to Ordinance 8, Section 6.02, a person could build a two story house with 480 square feet on each floor. This is on the agenda because Don Emmerich brought in a house plan with 1050 square feet on the first floor and 600 square feet on the second floor. This house would have fit anywhere but he wanted to build it in an R-2 zone where the minimum square footage requirement is 1200 square feet. Mr. Almgren noted that modified two-story houses are being built; they aren't a full two story and they are different than a story and a half. Commissioner Apel felt that the ordinance should be left as it is and if someone wants to build something different, he can come in for a variance. Commissioner Perry agreed with Commissioner Apel, stating that she has a concern over how many times we amend the ordinance to meet one person's needs. Commissioner Spotts stated that by amending the ordinance as suggested, we are trying to dictate economics. The house in question is a multi-level house and should be called that rather than a two-story or story and a half. Commissioner Apel felt that the suggested ordinance allowing 60% of the ground coverage to be used for the second floor would solve any problems. Dave Almgren noted that if you don't have the right language in the ordinance, you are going to have problems. Councilman Jim Elling felt it is silly to write an ordinance to cover all architectural possibilities. Discussion centered on wall height and if there is such a thing as a standard wall. Commissioner Spotts noted that FHA requires the first floor wall height to be 8 feet. Chairman Bosell noted that a public hearing is required on this amendment; the secretary will type an amendment, using the suggestion of the City Clerk that was provided and a public hearing will be held on September 13, 1983. \ , jcess 8:59 - Reconvene 9:13. V Regular Planning Commission Meeting August 23, 1983 - Minutes Page 3 u . '; this time, the Planning Commission discussed the Administrative Section of the update of 'vrdinance 8. Chairman Bosell noted that there are quite a few errors and she asked how much money the city had spent so the Planning Commission could go through the ordinance and correct grammatical errors and then go through it again to make sure that it makes sense. The first section 5.01, Administrator, will be changed to read as follows: 'The office of the Zoning Administrator is hereby established and shall be appointed by the governing body'. In the next section, 5.02 Duties of the Zoning Administrator, the first paragraph will be changed to read 'The Zoning Administrator shall enforce the provisions of this Ordinance as provided herein. In addition to the duties and powers of the Zoning Administrator under this Ordinance, express or implied, the Zoning Administrator shall have the duty and power to:' In all places where it says, conditional use permit, it shall be changed to say special use permit. It was the concensus of the Commission that for rezonings, variances and special use permits, they would be listed separately with a general statement, procedure, conditions and criteria. It was suggested that a section be added under rezonings that would read: 'Upon receipt of the rezoning request, rezoning signs shall be placed on the property to be rezoned not less than 10 days prior to the hearing.' Anywhere that a fee is listed, it shall be stricken and the following shall be added: '... a fee as set by City Council resolution...'. Commissioner Perry will retype that section that was reviewed for the next meeting. Chairman Bosell will go through the rest of the Administrative section and make the necessary changes and the rest of the Commissioners will go through the rest of the Definitions Section. The next work session on the update will be at 7:30 P.M., Tuesday, August 30, 1983. MOTION by Knutson to adjourn. Carried unanimously. Meeting adjourned at 11:15 P.M.
