Comm. #8- 83- 1 Variances/Doubles/Garages o o 0 ~ 01 AN DOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING AUGUST 9, 1983 MINUTES The Regularly Scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman d'Arcy Bosell at 7:35 P.M., Tuesday, August 9,1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Commissioners Absent: Also Present: Apel, Spotts, Rogers, Schreiner Knutson, Perry Ray Slaback, Schriptek Recovery Systems; Patricia Heidelberger; Ray Sowada and Robert Palmer, Andover Fire Department; Lee Hennen; Tom Mattson; Jim McQuay; Andy Lantos; Mike Goodwin; others Approval of Minutes J u 1 y 21, 1983 MOTION by Apel, seconded by Rogers to approve the minutes of July 21, 1983 as written. Motion carried on a 4 yes, 1 present (Spotts) vote. July 26, 1983 MOTION by Schreiner, seconded by Spotts to approve the minutes of July 26, 1983 as written. Motion carried on a 4 yes, 1 present (Rogers) vote. August 2, 1983 MOTION by Schreiner, seconded by Spotts to approve the minutes of August 2, 1983 as written. Motion carried on a 4 yes, 1 present (Apel) vote. Schriptek Recovery Systems Special Use Permit Public Hearing, Cont. (Comm. #7-83-2) Chairman Bosell reopened the public hearing. Robert Palmer, Andover Fire Department - stated that they had another meeting with Mr. Slaback and came up with a more workable proposal for opening the fire lanes. They would like to set a target date of January 1, 1984 to have the lanes cleared. Because of the barrels that have been found, the Fire Department is going to have to work with Schriptek on the fire lanes. Mr. Slaback noted that.hopefu1Jy by:Fall the'firstfire lanes will be cleared. Chairman Bosell asked Mr. Slaback what happened when they encountered the barrels. Mr. Slaback stated that the barrels were discovered Friday afternoon and the superintendent notified the Fire Department. Come of the barrels had leaked so they were covered with sand. Bob Hutchison from the County went to the site on Saturday morning and the PCA came out today (August 9th). The PCA suggested that Mr. Slaback dig a pit, put a plastic liner in it, put the barrels in the pit and cover them with sand and a tarp. Mr. Slaback asked the PCA to ( ;ke a sample and have it analyzed so they know what they are delaing with and the PCA said tney wouldn't because it was too costly. PCA also suggested that they take a semi-trailer, cut some holes in it, put the barrels in there and leave the back door open for ventilation. u u Regular Planning Commission Meeting August 9, 1983 - Minutes Page 2 " I '\~chriptek, Cont.) Bob Palmer stated that if they put the barrels in a trailer, they have a good chance of explod- ing. Mr. Slaback also noted that Bob Hutchison called the Spill Hotline and no one had returned his call. The County has been working with them but the holdup is with the PCA. He also spoke to the Fire Chief who said the solid type barrels should be put in the pit and not to touch the leaking barrels. Discussion was on the contents of the barrels, with Bob Palmer stating that they smell like cleaning solvents from the printers. Mr. Slaback said that Cecil Heidelberger told him the barrels contain fiberglass. Mrs. Heidelberger said that Cecil told her the barrels contain pa i nt. Commissioner Schreiner asked if the PCA is going to shut the operation down and Mr. Slaback replied that they are not. Bob Palmer felt that when we run into something new, PCA should test it so the Fire Department knows what they are dealing with. It was suggested that Mr. Slaback keep a record of what happened and when it happened. Commissioner Spotts suggested that in the License Conditions, Number 3 under operation, we should add 'with a tentative target date of planned progression as feasible as possible pertaining to weather or unknown elements.' Mrs. Heidelberger noted that since the last meeting two people have filed suits against Cecil in conciliation court for having tires on their properties. She asked if there would be a problem if those tires have to be removed right away. Commissioner Schreiner said that could be negotiated with the fire department. Commissioner Rogers asked Mr. Slaback if he has a procedure to follow for handling hazardous waste. Mr. Slaback said no, the PCA was supposed to provide one but haven't as yet. Chairman Bosell stated that the Planning Commission kind of set up a procedure for him - contact the Fire Department and the County. She suggested that Item 12, Operation should be changed to read 'notify the Environmental Services Department and the Andover Fire Department...'. Mr. Slaback questioned Item 14 regarding the maintenance of the haul routes. Chairman Bosell felt this should be deleted as Mr. Slaback is not going to be the one hauling the tires in. Commissioner Rogers asked if Mr. Slaback is hiring a company to haul the shredded tires out. Mr. Slaback stated he is and they will be using enclosed trailers. (Commissioner Schreiner responded to a fire call at this time - 8:29 p.m.) Chairman Bosell noted that in a motion, the following items should be noted: 1) A site plan was received indicating the boundaries of the property in question, showing the location of adjacent roadways; 2) Statement of use to recycle tires was noted; 3) hours of operation; , ~Bonding; 5) County license requirements have been reviewed and agreed to with the attached 'pl~posed license conditions; 6) The City of Andover would require an annual review; 7) An agreement has been reached between Schriptek and the Fire Department as it relates to fire lanes and perimeter roads; 8) Serialized weight slips for incoming and outgoing product; 9) Hazard plan continue to be developed in conjunction with Item 12 under Operation section u u Regular Planning Commission Meeting August 9, 1983 - Minutes ,D~ge 3 , ) (Schriptek, Cont.) License Conditions; 10) a public hearing was held with public input received but no opposition. Chairman Bosell also noted that we would like to receive the serialized weight slips at certain intervals. Commissioner Spotts felt that we should just have them available for inspection by the City. MOTION by Spotts, seconded by Rogers to close the public hearing. Carried unanimously. MOTION by Apel, seconded by Spotts that the Andover Planning and Zoning Commission recommend to the City Council approval of a Special Use Permit requested by Schriptek Recovery Systems International, Inc. to recycle waste tires at 2050! Bunker Lake Boulevard N.W., for the following reasons: 1) The proposed use will be extremely beneficial to the health, safety and general welfare of the community; 2) It will not cause serious traffic congestion or' hazards; 3) It will have a beneficial effect on the surrounding property values; 4) It is definitely in harmony with the general purpose and intent of the zoning ordinance and the Comprehensive Plan; 5) It will greatly improve the scenic beauty of the area. A public hearing was held and there was no opposition. Some of the specifications under which the Special Use Permit will be granted are: 1) A site plan has been received and reviewed including topo- graphical maps, aerial photos and ground photos, boundaries in question, the location of major roadways and procedures for the reduction of the waste tires; 2) Statement of use has been received indicating that the use of the permit will be to recycle waste tires; 3) Hours of operation have been agreed upon; 4) Bonding has been reviewed; 5) The Special Use Permit will be issued in conjunction with the Anoka County licensing procedures; 6) The Special Use Permit will be annually reviewed; 7) The Special Use Permit will be issued pursuant to Schriptek Recovery System working hand in hand with the Andover Fire Department to ensure safe removal of the tires; 8) Serialized weight slips showing incoming and outgoing loads will be available for review by the City of Andover; 9) Hazardous waste handling plan will be entered into with the Andover Fi re Department and the Anoka County Envi ronmenta 1 Services Department and wi 11 be continually reviewed and updated. Motion carried unanimously. This will go to the City Council on August 16, 1983. T.Mattson/L. Hennen Sketch Plan (Comm~ #7-83-4) Jeff Caine, Caine & Associates - presented copies of the sketch plan whi~h was revised since the City Council reviewed it on August 2, 1983. Mr. Caine noted that they are platting 57 acres on the river just north of Meadowood, west of 7th Avenue. The property is presently zoned R-2 and is in the Metropolitan Urban Service Area. Inasmuch as the City Council told them they could go to smaller lot sizes, they would like to have the property rezoned to R-4. Because sanitary sewer is not yet available in that area, they would like to show a resubdivision on the plat and only allow houses on every third lot until sewer is available. The park land is adjacent to the Meadowood park. Chairman Bosell noted that according to Ordinance lOG, if you have a future resubdivision, you have to make sure that when houses are built they are situated on the lot so that it can be subdivided as shown on the plat. .,lo.ff Caine noted that the lots on the river are all at least 4 acres as is required in the ,__)nic River Ordinance. Chairman Bosell noted that if the property is rezoned to R-4, the corner lots have to be 90 feet wide and the interior lots can be 85 feet in width. The side yard setback on corner lots will be 20 feet. She also noted that the sketch plan has to be submitted to the Anoka County Highway Department. Lots 1,2 and 3 of Block 1 have to have 300 feet of frontage. Discussion was on whether or not the Department of Natural Resources would approve this plat. It has been discussed with the DNR over the phone and a copy of the plat will be sent to them. Recess 9:10 P.M. - Reconvene 9:25 P.M. Variances/Doubles/Garages (Comm. #8-83-1) Mike Goodwin, 8424 Shady View Lane, Maple Grove - owns the double at 2140-42 - 140th Lane N.W. that was destroyed in the July 3rd storm. He noted that they have found out they need to have a double garage for each unit. Prior to the storm, they had a double garage that came out on Quinn Street. He would like to rebuild his 24' x 24' garage and only have a single garage for each unit. Two double garages will not fit on the lot. The house has to be enlarged as it was only 760 square feet per unit and the ordinance requires that each unit has to be 800 square feet. He also noted that the garage slab is already there. Jim Mcquay, owner of 2118-20 - 140th Lane N.W. - stated that he would like to build a 24' x 24' attached garage. Even with that, they will need a variance as it will be 8 feet from the property line instead of the required 10 feet. Commissioner Apel felt the variances should be granted as this all came about because of the storm. Mike Goodwin stated that as owners, they are trying to do something different so the neighbor- hood will look better. Andy Lantos, 3616 - 161st Avenue N.W. - owner of 2062-64 - 140th Lane N.W. Noted that his lot is the same as Mr. Goodwin's and they are thinking of doing something similar to what he is doing. Mr. McQuay felt that it would be a hardship to the land to require two double garages. It will end up looking like an army camp. He also noted that Mr. Malm, owner of 2128-30 - 140th Lane, couldn't be here tonight but would like to do the same thing that Mr. McQuay wants to do. MOTION by Apel, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council approval of variances requested by Jim Mcquay, 2118-20 - 140th Lane N.W.; Andy Lantos, 2062-64 - 140th Lane N.W.; Robert Bell, 2108-10 - 140th Lane N.W.; Donald Malm, 2128-30 - 140th Lane N.W.; Mike Goodwin, 2140-42 - 140th Lane N.W., for the following reasons: 1) A hardship was created due to the straight line winds of July 3, 1983, completely destroying the buildings on the above mentioned properties; 2) The granting of the variances will not adversely affect the existing or potential use of adjacent lands; 3) They are in conformance with the Comprehensive Plan; 4) They are necessary to the reasonable use of the land; 5) The ordinance which we will be varying from is Ordinance 8U, Section 6.02, Minimum Requirements for garages. Variances will also be granted pursuant to Ordinance 8, Section 6.02, Minimum luirements for side yard setback for the following properties: 2108-10 - 140th Lane N.W., '~.]8-20 - 140th Lane N.W. and 2128-30 - 140th Lane N.W. The side yard setback on these properties will be 8 feet rather than the required 10 feet. Motion carried unanimously. This will go to the City Council on August 16, 1983. u u Regular Planning Commission Meeting August 9, 1983 - Minutes .D~ge 5 \. j Amendment/Swimming Pool Ordinance, Cont. (Comm. #7-83-3) Commissioner Spotts felt that the swimming pool ordinance as written is adequate and shouldn't be changed. It was suggested that this ordinance, if it needs to be changed, should be the same as Ordinance 8U regarding accessory buildings. MOTION by Spotts, seconded by Apel that the Andover Planning and Zoning Commission recommend to the City Council that the Swimming Pool Ordinance, adopted in 1979, is adequate to cover any situation in the construction of a swimming pool. Motion carried unanimously. This will go to the City Council on August 16, 1983. Ordinance 8 Amendment/Junkyards Public Hearing (Comm. #7-83-5) Chairman Bosell opened the public hearing. She noted that when the ordinance was amended to eliminate junkyards and auto reduction yards from the different zoning districts, we neglected to remove it from the definition section. MOTION by Spotts, seconded by Rogers to close the public hearing. MOTION by Apel, seconded by Spotts that the Andover Planning and Zoning Commission recommend to the City Council adoption of an amendment to Ordinance 8 as presented. Motion carried unanimously. This will go to the City Council on August 16, 1983. A special meeting will be held at 7:30 P.M., Thursday, August 18th to review the draft administrative section of Ordinance 8.
