HomeMy WebLinkAboutAugust 2, 1983 o 0 ~ 0& ANDOVER o SPECIAL PLANNING AND ZONING COMMISSION MEETING AUGUST 2, 1983 MINUTES A special meeting of the Andover Planning and Zoning Commission was called to order at 8:00 P.M., Tuesday, August 2, 1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota, to continue the Schriptek Special Use Permit Public Hearing. Commissioners Present: Commissioners Absent: Also Present: Knutson, Perry, Spotts, Schreiner, Rogers (Bosell arrived at 8:30) Apel Ray Slaback, Schriptek Recovery Systems; Mr. and Mrs. Cecil Heidelberger; Robert Palmer and Ray Sowada, Andover Fire Department; others Schriptek Recovery Systems Special Use Permit, Cont. (Comm. #7-83-2) Commissioner Schreiner attended a meeting at the county regarding this item and reported the following: Basically the county went through the conditions for the license. Mayor Windschitl and Councilman Jim Elling asked that all the documents relatingtp. Cecil Heidelberger be eliminated.as they could possibly be damaging. The performance bond was $5,000 but has been upped to $12,500. The performance bond will only cover the tires that Mr. Slaback brings in. The $12,500 bond is for 25,000 tires; the $5,000 bond was for only 10,000 tires. The city asked that something be added for hazardous waste; the PCA is supposed to come up with some sort of procedure. Regarding the scale, Mr. Slaback doesn't want to spend $47,000 for a stationary scale if the PCA is going to shut him down. The number of tires brought in 'and the number of tires going out is left open to negotiation. The concensus was that a $5,OOO:cash bond should be required. Commissioner Rogers questioned why the hours for processing was left open. Commissioner Schreiner noted that our ordinance does not allow any processing to occur before 7:00 A.M. and no later than 6:00 P.M. Robert Palmer, Andover Fire Department - explained that as far as fire protection, our Fire Department is capable of handling it; the rescue squad is on duty week days from 6:00 P.M. until 6:00 A.M. and all day and night on weekends; the Fire Department also has extrication equipment. He then reviewed his memo regarding the operation, stating that they want 20 foot fire lanes with 4 north-south lanes and 2 east-west lanes. Within three months the tire piles shall not exceed a height of 10 feet or exceed an area of 80' x 80' and additional lanes be put in so that all fire lanes within the tire storage area will be 100 feet on center. Steel posts be be set at all corners of piles as markers of the pile width. Corner property lines to be located and steel posts set to designate said corners. Lanes are to remain open at all times. No type of storage or parking shall be allowed within the fire lanes at any time. Any type of gates or barricades shall be easily accessible to the Fire Department with the use of bolt cutters. The inside building operation shall have the approval of the Building Inspector and Fire Marshal prior.to start up. If any hazardous materials are discovered, the handling must comply with the Pollution Control Agency and Uniform Fire Code Article 80. Commissioner Schreiner also noted that according to Ordinance 44, the remaining portion of the land has to be fenced. Basically, the only portion that needs to be fenced would be Othe southern part. Cecil Heidelberger _ asked why the back part has to be fenced. He noted that the City Council said they could use tires as a fence. Robert Palmer noted that there might be a situation where a fire lane might not be able to be cleared out right away. Ray Slaback stated that he has cut up all of the tires that have been brought in since he has been there. One of the things that he doesn't like about the agreement is the time period, which is six months. He then asked if he bought some property on the other side of Bunker and applied for a license if he would be denied. Chairman Bosell stated that he would not. Cecil Heidelberger - noted that in the past three months they have spent $140,000 to get this operation going. The city is not thinking of what they have done to get it going. He also stated that he got rid of the barrels of ink; the PCA didn't do anything about it, so he did. Commissioner Spotts asked how long the recapable tires would be left on the site. Mr. Slaback noted that they are usually sent out every day. Regarding the time period for the license, Chairman Bosell suggested that it run from August 16, 1983 to August 16, 1984. Mr. Slaback felt that the bond fee was too high; he is being punished for something he didn't do. He was also against paying a $1,000 1 icense for a six month period, noting that if it was for one year he would have no objections. Commissioner Rogers asked Mr. Slaback what he wiJl do with the big tires that are brought in. Mr. Slaback stated they will be quartered and then shredded. Discussion centered on the hours of operation, with Mr. Slaback stating that he would like to be able to shred 24 hours a day. He asked if 16 hours a day would be agreeable. He also stated that he could schedule the trucks bringing the tires in so they wouldn't be coming in after 8:00. Commissioner Perry felt that if he was open 24 hours a day, the loaders will also be running for that time period. Patricia Heidelberger - noted that everyone is concerned about getting rid of the times and felt it would be feasible to let him operate 24 hours a day and the tire pi.le will disappear faster. Cecil Heidelberger stated that there are no more barrels on his property; the only place where there are barrels are on David Heidelberger's property. Commissioner Schreiner asked if Mr. Heidelberger could guarantee that there is no hazardous waste on his property. Mr. Heidel- berger said yes, there is nothing there any more. He said that all of the ink from the barrels was pumped out and taken to Minneapolis. Chairman Bosell noted that Mr. Slaback has agreed to contact the PCA immediately if he encounters any hazardous waste. ~r. Slaback stated that in the agreement, he would like it to say that any cats, loaders or '~ehicles will only be operated during daylight hours. . It was the concensus of the Commission that Item 13 under Operation will read: Receipt of , \ o o Special Planning Commission Meeting August 2, 1983 - Minutes Page 3 \ J (Schriptek, Cont.) new waste holidays. Operation tires shall not occur before 6:00 A.M. or after 8:00 P.M. or on Sundays or Processing of waste tires shall not occur before 6:00 A.M. or after 11:00 P.M. of exterior vehicles shall be limited to daylight hours. Item 5 under Operation was then discussed as to how many old tires should be processed.'~ for how many waste tires are received. Mr. Slaback noted that Owens-Illinois will be saving 1.5 million dollars per year by burning tires and they would like to receive 37,000 tons per year if everything works out. He has several other potential customers in the area also. He also noted that in a 100 mile radius of the Metropolitan area, 2.4 million tires are generated per year and there has to be some place to take them. It was decided that Item 5 would read: A monthly net reduction of the old waste tire in- ventory of at least 3 ton old waste tires processed for each 1 ton waste tires received shall be accomplished. Commissioner Spotts felt that we are putting too many restrictions on Mr. Slaback. Mr. Slaback noted that he would like to allow residents to come in during a certain time of the year and dump their waste tires free of charge. Recess 9:30 - Reconvene 9:43 The licensing period will be one year, from August 16, 1983 to August 16, 1984 and the fee will be $1,000 for a one year period. Commissioner Schreiner noted that he would like to see a stationary scale on the site rather than a portable one so that Mr. Slaback doesn't just close down and move out. Mr. Slaback noted that the portable scales weight 4 to 5 tons and would be very hard to move. Item 7 under Site regarding the sign - the last sentence will read: The sign and its' place- ment shall be subject to approval by the Department and the City. It was the feeling of the Commission that under Item 20, Operation, a monthly inspection by pest control agency was not needed. Bob Hutchison of the County had stated at a City Council meeting that there is no rodent problem at the site because there is not a food supply there and mosquitos do not breed in the tires. Mr. Heidelberger noted that the only animals in the tire piles are gray squirrels and woodchucks. This item will be changed to read: The licensee shall engage a qualified exterminator or pest control agency acceptable to the Department and the City to inspect the "Receiving/Processing Area" on or before May 31st of each year or if a valid complaint was filed with the City or the Department. A copy of the inspection report shall be sent to the Department and the City immediately. Chairman Bosell noted that at the August 9th meeting, the Planning Commission will deal with the Special Use Permit and noted that the following items should be included in the permit application: 1) Name, address and phone number of applicant; 2) Site plan with boundaries within 100 feet; 3) Surrounding uses and zoning; 4) Location of buildings and roadways; 5) ,Statement of use; 6) Hours of operation; 7) License and/or bond; 8) Review procedure. Other \ /items that needed to be addressed are: 1) Proposed reduction of tires; 2) Serialized weight 'slips; 3) Hazard plan; 4) Schedule of compliance with opening of fire lanes; 5) Pest control procedure if any encountered; 6) Noise regulations need to be adhered to. u u Special Planning Commission Meeting August 2, 1983 - Minutes Page 4 , ! (Schriptek, Cont.) Commissioner Spotts questioned why Mr. Slaback has to pay the county a $1,000 license fee when the city is going to be doing the inspections and issuing the Special Use Permit. Chairman Bosell noted that the county will be responsible for having him comply with the Waste Tire Ordinance. Commissioner Perry felt that the performance bond should be checked into because if it's not an ordinance requirement it will not be issued. Commissioner Spotts will attend the County meeting regarding this item on August 11th. MOTION by Rogers to adjourn. Motion carried unanimously. Meeting adjourned at 11:45 P.M.
