SPECIAL PLANNING AND ZONING COMMISSION MEETING
APRIL 5, 1983
MINUTES
A special meeting of the Andover Planning and Zoning Commission was called to order at 7:45
P.M., Tuesday, April 5,1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover,
Minnesota for the purpose of discussing the proposed revisions to Ordinance 8.
Commissioners Present: Perry; Knutson; Schreiner
Commissioners Absent: Ape1; Rogers; Spotts
Beginning with the section dealing with Shopping Center District, the Commissioners questioned
the statement in the Purpose stating that construction can be expected within two years
following the rezoning. It was noted that in the present ordinance it reads that construction
must begin within 2 years or be 50% completed within 5 years or the city can initiate a re-
zoning.
Commissioner Schreiner felt that that language should be incorporated into the new ordinance.
Commissioner Knutson noted that the original language is in the draft ordinance under general
provisions in Section 4.18. It was noted that at some point in the Neighborhood Business and
Shopping Center districts, Section 4.18 should be referenced so people requesting copies of the
ordinance are aware of the requirement.
Commissioner Perry noted that the draft suggests changing the building coverage from 30% to
40%; the height regulation should be changed from 45 feet to 35 feet as the Fire Department
does not have the equipment to fight fires in taller structures.
Commissioner Perry asked if we are going to require a shopping center to have sanitary sewer.
Commissioner Schreiner felt we should so that the shopping centers stay in the urban area
which is where they belong. Commissioner Knutson also felt that we should require sanitary
sewer.
It was decided that the sanitary sewer requirement will be added under (G), Considerations
for Rezoning, as number 1.
Commissioner Perry noted that in the old ordinance there are guidelines for rezoning to
Neighborhood Business and Shopping Center but none for the other commercial districts. If
a person wanted to rezone some property to General Business, what would we have to decide
whether or not they can do it.
Chairman Bosell stated that in the Administrative section, we should have something dealing
with rezoning. Commissioner Perry felt that we should have the criteria for rezoning spelled
out in Limited Business and General Business as well as the other commercial zones.
The concensus of the Commission was to take Section 4.18 and change it as follows: "Before
approving a site plan or zoning any non-residential use, the following conditions must be
met. (A) The area will be located adjacent to a thoroughfare or collector street as shown
on the Comprehensive Plan or as indicated as a potential non-residential site on such plan.
(B) Submission of a plot plan for site and building plan review as established in Section
~ of this Ordinance. (C) If construction has not begun within 24 months, or if the
~roject is not 50 percent completed within five years, any further development of any type
shall require a Special Use Permit and the Planning Commission may move to initiate a re-
zoning back to that in effect prior to rezoning." Section (D) of 4.18 will be as the
individual districts require.

Chairman Bosell noted that the conditions for rezoning should be in every non-residential
district.
Going to Permitted Uses, Retail shopping centers will be changed to Retail Shopping.
Commissioner Perry asked if we are going to just have restaurants and cafes and not list a
deli as a permitted use. Chairman Bosell noted deli should be included and also a definition
for deli must be included.
We also need a definition for personal services. Personal and professional offices will be
changed to 'offices'. Retail sales and services to include grocery, drugs, hardware, appliances
and furniture will be changed to 'Retail sales and services'. Radio and television repair will
be deleted.
Under Conditional Uses, Chairman Bosell asked if open sales lot would include a car lot and
a flea market. It was suggested that we could add to open sales lot the following: 'exclusive
of auto sales lots and flea markets'. Motor fuel station will be changed to service station.
Going on to General Business, Chairman Bose11 noted that we want to have a district size.
Presently in the city we have 120 acres zoned General Business.
Commissioner Knutson felt that the district size should be 10 acres with the minimum lot size
of 20,000 square feet.
It was noted that we need a minimum lot depth. The rear yard setback will be 40 feet rather
than the 30 feet suggested in the draft; the side (interior lot line) will be changed to 30
feet instead of 10 feet; building coverage will be changed to 40 percent; the height regulation
will be changed to 35 feet.
The amount of green area was questioned as it is listed as 25 percent for General Business
and only 10 percent for Shopping Center. It was the feeling of the Commission that a Shopping
Center should have more green area than a General Business zone.
Commissioner Perry noted that under Permitted Uses, open sales lots are permitted and she felt
that as long as they are allowed in General Business we should take them out of Shopping Centers.
Going through the list of permitted uses the following changes were made: Auto sales and
used car lot will be changed to automobile sales and service and used car lot; Restaurants
will also include cafe and deli; Wholesale business and distributors and warehousing related
to it will be changed to Wholesale business, distributors and warehousing; Bakery or confection-
ary shop for the production of articles to be sold at retail on the premises will be changed
to Bakery or confectionary shop; Farm, boat, airplane, auto equipment sales will be changed
to Farm, boat, airplane, automobile equipment sales; Bowling alleys and recreational enter-
tainment- a definition is needed for recreational entertainment; Carpeting or woodworking
shops will be deleted; Retail plumbing shops will be deleted; Funeral Chapel or mortuary with
caretaker apartment will-be changed to Funeral Chapel or mortuary (may include caretaker
apartment); Church will be changed to churches; Tile, carpentry and woodworking shops and
showrooms will also include carpeting shops; Retail sales of sporting equipment including
boats and snowmobiles(inside storage only) will be changes to Retail sales and service of
sporting equipment; Mortuaries and funeral homes will be deleted; Farm equipment sales (not
. 'cluding outdoor storage) will be deleted; Service station and/or garage will be added.

Commissioner Knutson stated that he would like to see as a permitted use some sort of machine
shop, plastics factory or something similar. We will need a description for this item.

be deleted; Motor fuel station and/or garage will be changed to Service Station.
The following under Conditional Uses will be deleted: Apartment for business owner; (with
kennels) will be de1ted from Veterinary clinic or offices; Automobile and truck repair; offices
and shops for small contractors(no exterior storage); sporting equipment-exterior storage;
small engine and boat repair; Warehousing.
The following items need to be inserted in each of the commercial districts: District size;
minimum lot depth; change height to 35 feet; requirements for rezoning.
The next work session on the ordinance will be at 7:30 P.M., Tuesday, April 19, 1983.

\~Jnder the Purpose section of Limited Business, it was decided to eliminate the last sentence
which reads, "Also, the "LB" district can be used as a transitional district or buffer
between noncompatible uses such as intense commercial ("GB") and residential uses."
Chairman Bosell stated that we can either have an introductory statement to the business
districts requiring buffering or we could have buffering as a separate section in each of
the business districts.
Commissioner Ape1 noted that he would like to see it as an introductory statement.
The next work session on the ordinance will be at 7:30 P.M., Tuesday, April 5, 1983.
