SPECIAL PLANNING AND ZONING COMMISSION MEETING
MARCH 29, 1983
MINUTES
A special meeting of the Andover Planning and Zoning Commission was called to order by Chair-
man Bosell at 7:30 P.M., Tuesday, March 29,1983 at the Andover City Hall, 1685 Crosstown
Boulevard N.W., Andover, Minnesota.
Commissioners Present: Apel, Perry, Knutson, Rogers, Spotts
Commissioners Absent: Schreiner
Chairman Bosell noted that in the materials received tonight is a copy of a proposed
Manufactured Homes ordinance.
Chairman Bosell noted that in the Neighborhood Business district, the height will be changed
to 35 feet as that is what it is in all of the other districts.
Commissioner Perry felt that under Conditional Uses in the Neighborhood Business district
we should add Day Care Centers. This would include places like Kinder Kare and Learning Tree.
Chairman Bosell asked if the teachers in these places have to be certified. Commissioner
Perry stated that the supervisory personnel have to be certified. She also noted that a
day care center usually provides care from 6:00 a.m. to 6:00 p.m. and is not a learning
center, whereas a nursery school is a learning center.
Commissioner Rogers asked if a person taking care of children in their home would have to
be certified. Commissioner Perry stated that they have to be licensed, but not certified.
The City Council felt these types would not need so many regulations. The state governs
this type of day care center.
Commissioner Perry felt that the definition Nursery, Day is antiquated and should be changed.
Chairman Bosell noted that this is a problem area and something more specific should be
added.
Commissioner Perry asked why a barber/beauty shop is limited to three chairs or less. Chair-
man Bosell noted that a larger salon is usually found in a large shopping center.
Commissioner Knutson asked if the minimum lot size in the NB district is going to be 10,000
square feet. The present ordinance requires a minimum of 2 acres.
Commissioner Perry stated that she would prefer to rezone a property to NB that is 2 acres
rather than one that is 10,000 square feet. If it is left at 10,000 square feet, we are
going to have little NB zones allover the city.
Commissioner Apel felt that the NB lot size should not be too much different than our
residential lot size.
Chairman Bosell suggested having a non-residential lot size of two acres and within that
~hey would be able to break it down to 10,000 square foot lots. She noted that Bill's
~uperette was built on a 2 acre lot and when they added the liquor store, they split it into
two one-acre lots. She also felt that when we rezone a property to Neighborhood Business
we want to have the business clustered rather than having them scattered allover the city.

'--Oiscussion centered on the parking requirements for a Neighborhood Business district. It
was noted that if we had a two acre NB zone and they came in with a site plan to develop they
would have to meet the setbacks, parking, and landscaping requirements. With a 10,000 square
foot lot size, it was felt that there wouldn't be enough room for everything. It was also
noted that parking requirements are missing from the draft ordinance.
It was the concensus of the commission that 10,000 square feet is not acceptable as a Neighbor-
hood Business lot size. It was felt that 20,000 square feet might be more appropriate.
Also questioned was the minimum width, which has been reduced from 100 feet to 85 feet.
Chairman Bosell noted that the setbacks seem to be adequate, with the front and rear yards
being 40 feet and the side yard being increased from 10 feet to 15 feet.
Commissioner Perry questioned why only 35% of the land could be covered by buildings. She
felt that it was too small of an area. She also noted that if we are going to encourage
more commercial development, we should allow more than 35%.
Chairman Bosell thought that part of the reason was that up to a couple of years ago we didn't
have sanitary sewer and they needed the room for septic systems.
Commissioner Perry felt that rather than requiring so much green area, we should require
buffering.
Chairman Bosell questioned if a person could meet the parking requirements, using 20,000
square feet as a guideline, after using 35% of the land for a building and having 35% green
area. She also noted that we should probably have two different lot sizes for Neighborhood
Business, one in the rural area and one in the urban area.
Commissioner Perry agreed with Chairman Bosell 's suggestion because if we left it at 20,000
square feet, a developer would expect to be able to have a 20,000 square foot NB zone in
the rural area.
Commissioner Apel noted that in the non-sewered areas, all requirements of Ordinance 37 would
have to be met, which include 39,000 square feet of land.
Going to Permitted Uses in the NB zones, Chairman Bosell noted that a laundromat in a non-
sewered area might be a problem. Commissioner Rogers noted that the cost factor might
prohibit a person putting a laundromat in a non-sewered area.
Commissioner Knutson noted that the old ordinance allows retail shopping and the draft says
Specialty Shop(Consignment). A Kinney Shoe Store would not be allowed in this district then.
He also noted that there are a lot of things that could not go into a Neighborhood Business
district.
Chairman Bosell questioned what a specialty shop would include if it is left in the ordinance.
Commissioner Knutson felt that a convenience store should be limited to a certain number of
square feet. It was also noted that we need a definition for a convenience store.

, ~ was questioned whether we want professional offices to come in for a special use permit,
-with Commissioner Apel noted that they are usually high traffic generators.
Chairman Bosell asked what the difference is between a professional office building and an
office building. The ordinance includes a definition for office uses but not for a professional

-office building or office building. Rather than having professional offices, we should just
say office buildings. It was decided that Office Uses would be listed under permitted uses
and professional offices would be eliminated from conditional uses.
Chairman Bosell noted that a definition is needed for small engine repair.
Going on to Limited Business District, Chairman Bosell noted that in the first section (A.
Purpose), it states that a Limited Business District may include high quality commercial
areas such as an "office Park" development. She asked what an office park is. Commissioner
Spotts noted that it would be a small cluster of office buildings.
Chairman Bosell noted that we should have a definition for "office Park'. She also noted
that the lot area is 20,000 square feet, which is the same as we are recommending for a
Neighborhood Business District. There is no lot depth listed.
Commissioner Apel noted that if you build a 6400 square foot building you will need 32 parking
spaces which would still leave at least 35% for the green area.
Commissioner Apel asked what a Motor fuel station is. It was noted that it is probably a
wholesale dealer like Berg Oil.
Chairman Bosell asked why we would not allow kennels or animals kept overnight in a veterinary
clinic. Commissioner Perry agreed that we should allow animals to be kept overnight.
Discussion centered on different cities that have strip shopping centers which include such
uses as restaurants, dry cleaners, churches, car washes, etc. In other cities, these are
their limited business centers.
Commissioner Perry felt that the City of Andover would not look favorably at mixing activities
such as those mentioned. She also didn't feel that the area which we now have zoned Limited
Business should be so near a neighborhood (Red Oaks).
Chairman Bosell asked if we should have a certain number of acres required for LB zoning or
20,000 square foot lots allover the city.
After considerable discussion on lot sizes, it was agreed that for Neighborhood Business
zones, the minimum lot size would be 20,000 square feet and the maximum size would be 2!
acres; for Limited Business the minimum lot size would be 20,000 square feet with a maximum
of 5 acres; for Shopping Center the size would be five acres or greater.
Regarding a Limited Business in the rural area, it was noted that we will have to have in
the ordinance a statement that says in the rural area you have to have 39,000 square feet
to build on rather than the 20,000 square feet required in the sewered area.
There was some question regarding the definition of a Rest Home. It was the concensus of
the Commission that the definition be changed to read "A private home for the care of
children, the aged or inf~~m or place of rest for those suffering bodily disorders. Such
a home does not contain equipment for surgical care or for the treatment of disease or
injury."

~./bmmissioner Knutson noted that the setbacks for the side yard are less in Limited Business
than in Neighborhood Business and felt they should be changed. Commissioner Perry suggested
that we leave the setbacks as they are but put in a section dealing with buffering.
