Comm. #3-83-3 o Ken Slyzuk Eligibility for Agricultural Preserve Ken Slyzuk Rezoning Public Hearing Northglen 2nd Addition Sketch Plan o 0 e<<, 01 ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING MARCH 22, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman d'Arcy Bosell at 7:35 P.M., Tuesday, March 22, 1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Apel, Knutson, Perry, Rogers, Schreiner, Spotts Commissioners Absent: None Also Present: Kenneth Slyzuk; John Peterson, Good Value Homes; John Uben, Howard Dahlgren & Associates Approval of Minutes March 2, 1983 MOTION by Rogers, seconded by Schreiner to approve the minutes of March 2, 1983 as written. Motion carried unanimously. March 8, 1983 MOTION by Spotts, seconded by Perry to approve the minutes of March 8, 1983 as written. Motion carried unanimously. Chairman Bosell noted that the Planning Commission has a work session scheduled for Tuesday, March 29th; however, no one is available to take minutes. She asked if the Commissioners still wanted to meet that evening. They all stated that they would like to meet that evening. Ken Slyzuk Eligibility for Agricultural Preserve (Comm. #3-83-1) Chairman Bosell noted that the eligibility part of this request is necessary because each parcel has to be at least 40 acres or more. Commissioner Perry asked if Parcel #4801 is an easement. Mr. Slyzuk noted that it is their private road. Chairman Bosell asked how big Parcel #4801 is. Mr. Slyzuk stated that it is 33 feet by 1/2 mile. () Chairman Bosell asked how big the parcel is that has the house on it. Mr. Slyzuk stated that it is 2! acres; it was part of the 80 acres they bought. Chairman Bosell stated that the parcel must be 2! acres exactly or it cannot be included in agricultural preserve. Parcel 4801 does not meet the size requirements and probably cannot be included in this request. She also noted that she has a problem putting the house property in agricultural preserve. The sewer ends right at the driveway and if this property is put in agricultural preserve, that will stop the sewer where it presently is. The property could not be assessed for sewer and if Mr. Slyzuk's septic system failed, he could not even hook up to the sewer. She asked him if he would consider withdrawing this parcel from his request. Mr. Slyzuk stated that he would withdraw that parcel. Chairman Bose11 noted that she would check with the City Attorney on the legality of including Parcel #4801 in this request. Because it's contiguous to Parcel #7200, it might be eligible. MOTION by Perry, seconded by Schreiner that the Andover Planning and Zoning Commission recommend to the City Council approval of the request of Kenneth Slyzuk for eligibility for agricultural preserve for the following parcels of property: Plat 65924, Parcel 0602; Plat 65922, Parcel 7g~0; Plat 65921, Parcel 7200; Plat 65928, Parcels 2400, 9000, 3200, 9450 and 9300, Plat 65922, Parcel 4801, with a notation being made that a question on Plat 65922, Parcel 4801 as to the legality of the private road between the two parcels will be checked with the City Attorney. The request meets the intent and purpose of Ordinance 57 and 57A. Motion carried unanimously. This will go to the City Council on April 19, 1983. Ken Slyzuk Rezoning Public Hearing (Comm. #3-83-2) Chairman Bosell opened the public hearing. She asked what the total acreage is of the parcels being requested to be rezoned. Mr. Slyzuk stated that without the property that the house is on, it is approximately 230 acres. Commissioner Perry asked if Mr. Slyzuk could tell the Commission how many acres are in each parcel. Mr. Slyzuk noted that Parcel #0602 is 25 acres; Parcel 7810 is 29 acres; Parcel 7200 is 40 acres; #2400 is 37.9 acres; Parcel 9000 is 40 acres; Parcel 3200 is 20.6 acres; Parcel 9450 is 20 acres; Parcel 9300 is 20 acres and Parcel 4801 is 33' x 2640'. Chairman Bose11 asked if all of the property is used for agriculture. Mr. Slyzuk noted that it is all used for agriculture except for a small part that has trees on it. Mr. Slyzuk stated that they produce carrots, radishes and potatoes. They start farming in mid-April. He has three year around employees, a Mexican family that comes in April until November, 7 or 8 other people who come in August and work until approximately November 10th and in the summer they hire about 12 high school kids. MOTION by Spotts, seconded by Rogers to close the Public Hearing. Motion carried unanimously. MOTION by Spotts, seconded by Ape1 that the Andover Planning and Zoning Commission recommend to the City Council approval of the Kenneth Slyzuk rezoning request for the properties described as Plat 65924, Parcel 0602; Plat 65922, Parcels 7810 and 4801; Plat 65921, Parcel Parcel 7200; Plat 65928, Parcels 2400, 9000, 3200, 9450 and 9300, which properties are approximately 230 acres. The request meets the requirements of Ordinance 57 and 57A; the property is within the area designated as being appropriate for agricultural preserve;' it is in compliance with the Comprehensive Plan goal of protecting and preserving the community's rural and open space character; a public hearing was held and there was no opposition. It is requested that the City Attorney check the legality of including Plat 65922, Parcel 4801 in this request. / , " ) Motion carried unanimously. This will go to the City Council on April 19, 1983. o Planning and Zoning Commission Meeting March 22, 1983 - Minutes Page 3 / \ Northglen 2nd Addition Sketch Plan (Comm. #3-83-3) j John Peterson, Good Value Homes - presented a new sketch plan to the Commission. He stated that if everything goes according to schedule they will begin selling the lots in this plat in October. He noted that last week they went to the City Council with a different sketch plan showing the park in the northern part of the plat and lots in the southern part. The City Council didn't llke that idea as they would need a lift station and the Council felt the southern area was a better place for the park. u John Uben, Howard Dahlgren & Associates - noted that they are trying to keep a circulation system going north and south and east and west through the plat. The western portion of the plat will be the last area to be developed. They are waiting for the County to figure out if they are actually going to realign Bunker Lake Boulevard. He also noted that the park area is about 35 acres; 10 acres are above the flood plain. The rest is storm easement and swamp. The outlot to the north will be left as an outlot; it will probably go to the city as a drainage pond. Chairman Bosell asked if that outlot will be deeded to the City. Mr. Uben replied that it will. Chairman Bosell noted that it should then be labeled 'pond'. Mr. Uben then explained that the lots that abut Round Lake Boulevard have double frontage. There will be a ten foot buffer between Round Lake Boulevard and the backs of these lots. He also noted that 1/3 of this plat is in the flood plain. One of the items they have not settled on yet is an access to the park from within the plat. He also noted that there are 205 lots with the average lot size being 13,323 square feet. Chairman Bosell noted that the structure shown on the plat along Round Lake Boulevard does not exist and should be removed from the plat. Also, 139th Avenue no longer exists. They also need to determine how many acre feet of ponding they need. She asked if this is a joint venture with Dick Hand. John Peterson stated it is although nothing has been signed yet. If the deal falls through, Good Value will continue with platting only their property, relocating the park in the northern portion of the plat. He also stated that it is their current plan to to this plat in phases. Commissioner Rogers asked how much land the county will take if they do realign Bunker Lake Boulevard. Mr. Peterson stated that the road will go through the center of the park. They have asked the county to go along the borders of Anoka and Andover if possible. Commissioner Schreiner asked what the length is of the cul-de-sac on the western part of the plat. Mr. Uben noted that it is exactly 500 feet. Commissioner Rogers noted that he did not like the cul-de-sac that is in the northern part of the plat because he felt there would be maintenance problems. Chairman Bosell noted that there will probably be one variance required for the length of the street going through the middle of the plat. Commissioner Rogers felt that the size of the park was not big enough for the number of lots. He stated that the Park Board would like more soccer fields and this area is not / ',suitable for that. , / MOTION by Apel to adjourn. Meeting adjourned at 9:05 P.M.
