D.A. smith Builders Variance Ordinance 8 Update o 0 ~ 01 ANDOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING FEBRUARY 22, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman Bosell at 7:34 P.H., Tuesday, February 22, 1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Commissioners Absent: Also Present: Apel, Knutson, Perry (arrived at 8:15), Rogers, Schreiner Spotts Jim Schrantz, City Engineer; John Hitchcock, D.A. Smith Builders Approval of Minutes February 8, 1983 MOTION by Apel, seconded by Rogers to approve the minutes of February 8, 1983 as written. Motion carried on a 3 yes, 2 present (Knutson, Schreiner) vote. D.A. Smith Builders Variance (Comm. #2-83-1) John Hitchcock, 9516 Tyler Street N.E., Blaine, representing D.A. Smith Builders - stated that the property they are requesting the variance for has 120 feet of frontage on Cross- town Boulevard rather than the required 300 feet. Where they plan to build the house, the land is 280 feet wide. Chairman Bosell asked if all of the surrounding properties are built on as indicated on the materials received from City Hall. Mr. Hitchcock stated they are. He also noted that he checked with the County Highway Department regarding the need for a culvert. The driveway will be Class 5. Chairman Bosell noted that the tax statement indicates the property is 6-1/3 acres; however the section map shows it being 10.26 acres. She asked which is correct. Mr. Hitchcock noted that the property is 6-1/3 acres. He 988 square feet, with 3 bedrooms and a tuckunder garage. prior to the end of March if the variance is approved. MOTION by Apel, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council approval of a variance requested by D.A. Smith Builders for the property described as Plat 65913, Parcel 6230, to allow them to build a single family residence. The lot does not have the 300 feet of frontage as required in Ordinance 8C, Section 6.02. Reasons for approval are: 1) There was no vocal opposition; 2) Basically it follows the intent of our Comprehensive Plan in that it would not cause any problems regarding the health or welfare of the locality; 3) It is in keeping with the type of residences in that area; 4) It is in conformance with Ordinance 8, Section 5.04 in that the problem is not generated by the land itself, but the way the land is set out. stated that the house will be They plan to start construction ~ Motion carried unanimously. This will go to the City Council on March 15, 1983. , V The regular meeting recessed at 7:50 P.M. so that the Commissioners could view some slide presentations dealing with Planning Commissions and their responsibilities. The meeting reconvened at 8:45 P.M. o u Planning and Zoning Commission Meeting February 22, 1983 - Minutes Page 2 " , }The Commissioners then decided that Wednesday, March 2, 1983 would be the next work session with Barton-Aschman regarding the Ordinance 8 update. The secretary was also asked to check with Bill Short to see if March 15th would be suitable as an alternative if he could not make it on the 2nd. Ordinance 8 Update Chairman Bosell explained to the new commissioners what has transpired since we began the updating of this ordinance. Chairman Bosell then explained that as a result of a meeting with the City Council, the Planning Commission will hold a public hearing to amend Ordinance 8 to allow for 11,400 square foot minimum lot sizes for single family homes in the urban area with a minimum width of 80 feet and a minimum depth of 130 feet. Also, corner lots would not need to be 15 feet wider than interior lots and two-family homes will be allowed in new plats. The Commission needs to decide whether we should have two residential districts, rural and urban. Commissioner Apel felt that having two residential districts each with one lot size would be easy. City Engineer Schrantz asked if the front yard setback in the rural area (2! acre lots) is going to be 30 feet. Commissioner Perry noted that Bill Short suggested that figure but some of the Planning Commissioners felt it should be 40 feet. Chairman Bosell stated that if we only have the two districts, we have to look at the density allowed and also the permitted and conditional uses. It was decided that Urban Agricultural Uses will be eliminated from the urban district. City Engineer Schrantz suggested having three zoning districts, R-l, R-2 and R-3 in order to have criteria for building in the areas now zoned R-3, such as Auditor's Subdivision 82 and Green Acres. Discussion then centered on the Conditional Uses in the urban area. Because of the high amount of traffic generated by clinics, churches and day nurseries it was the concensus of the Commission that they not be allowed on residential size lots in the urban area. It was felt that Neighborhood Business districts would be more suitable for these uses. Philanthropic and charitable institutions were also discussed with the suggestion that they only be allowed in Neighborhood Business districts and higher. Chairman Bosell noted that at previous meetings, Neighborhood Business districts were discussed and it was suggested that that name be changed to something more suitable. Commissioner Perry felt that with the definition of NB in the Ordinance update, it should be left as is. Commissioner Perry asked if there are any areas in urban Andover where there is no sanitary sewer. Chairman Bosell noted that there are. Commissioner Perry then asked if someone could plat land in the Urban Service Area without sanitary sewer. Chairman Bosell explained they can if they comply with Ordinance 10C, each lot having 39,000 square feet of buildable land and 165 feet of frontage at the building setback line. They also have to provide a resubdivision plan showing the lots as they would be when sanitary sewer becomes available. \ ',j Commissioner Perry questioned the wording of Section (J) in the draft ordinance (No construction shall be permitted in this district without sanitary sewer and water). The secretary noted that at a previous meeting it was decided to change this to read: No construction shall be permitted in this district without sanitary sewer. U CommisslOn Minutes Meeting , \ U Commissioner Rogers asked if we wanted to have cemeteries on 11,400 square foot lots. Chairman Bosell noted that they would be allowed on non-residential lots, which would be bigger than 11,400 square feet. The Conditional Uses listed in the draft ordinance were discussed with the following being noted: Nursing Homes are allowed in M-l and M-2 as Conditional Uses; Philanthropic and charitable institutions are allowed in M-l and M-2 as Conditional Uses; Churches are allowed in M-l as Conditional Uses and M-2 as Permitted Uses; Schools are allowed in M-l and M-2 as Conditional Uses. Golf Courses are allowed in M-l as Conditional Uses and in M-2 as permitted uses. Recess 10:35 - Reconvene 10:50 P.M. City Engineer Schrantz asked how we are going to regulate existing plats if we go to two residential districts and take the old R-l, R-2, R-3 and R-4 out of the ordinance. Chairman Bosell suggested that we could leave the old districts, R-l, R-2, R-3 and R-4, in the ordinance and create two new districts. We are going to have the rules for the old districts in the ordinance. The secretary was asked to retype pages 6-8 through 6-10 of the ordinance draft for the public hearing.
