Comm. #1-83-2 Carl Christensen Variance ,-) '...... o 0 ~ 0& AN DOVER o REGULAR PLANNING AND ZONING COMMISSION MEETING JANUARY 25, 1983 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Acting Chairman Maynard Apel at 7:32 P.M., Tuesday, January 25, 1983 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota. Commissioners Present: Perry; Rogers Commissioners Absent: Bosell; Spotts Also Present: Tom Christensen; Carl Christensen Good Value Homes/T. Christensen Variance (Comm. #1-83-1) Tom Christensen, 3469 - 138th Court N.W. - stated that he is just basically changing the lot lines on the east side of his lot and the west side of Lot 30. The reason for this change is to not create a hardship for whoever buys the vacant lot next to him. The lot lines will be straight instead of the way they are now. He noted that Lot 30 would go from 7,127 square feet to 7,032 square feet, which is still within our ordinance for a twin home. Discussion centered on the question of whether there would still be the proper frontage for each lot with the Commissioners agreeing that there would be. MOTION by Perry, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council approval of a variance requested by Tom Christensen, 3469 - 138th Court N.W., for the purpose of redrawing the east lot line of Lot 31, Block 6, Northglen. The replatting of a portion of Lot 31 is requested to make the lot more symmetrical. This re- platting would not adversely affect the existing or potential use of the adjacent land; it would be in conformance with the Comprehensive Plan; it would be pursuant to Ordinance 10, Section 8.02(e) and 17.01. Motion carried unanimously. This will go to the City Council on February 15, 1983. Carl Christensen Variance (Comm. #1-83-2) Carl Christensen, 9950 Cottonwood Street N.W. - stated that in reading the topography on this lot (Lot 6, Block 1, Rum River Forest), you can see it slopes heavily down to the river. Everything on the lot is greater than a 12 percent slope except for the one flat area, which is the only buildable site on the lot. The Department of Natural Resources went out to the lot last week. Mr. Christensen noted that he is asking for a~riance to build a house on the flat area which would still stay in conformance with the requirement of being 30 feet from the bluffline. Commissioner Perry asked what the encroachment would be. Mr. Christensen noted that it will be 105 feet back when it should be 150 feet. To build a house where it should go, according to the ordinance, he would have to put in quite a lot of fill. He also noted that he spoke to the DNR regarding the erosion problem and he agreed to correct that problem. dommissioner Perry asked where the ordinanary high water mark is. hat it is the mark on the drawing where the survey was started. Mr. Christensen noted Commissioner Apel asked when this property was platted. Mr. Christensen thought it was around 1980 because the Scenic River Ordinance was not in effect at that time. MOTION by Perry, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council approval of the variance requested by Carl E. Christensen, 9950 Cottonwood Street N.E., for the property at Lot 6, Block 1, Rum River Forest. Mr. Christensen desires to build a two story home and because of the unusual topography of the property, the building site would be within 105 feet of the high water mark rather than the 150 feet required by the ordinance, Ordinance 52, Section 5.02.01, Subsection (4). The Department of Natural Resources accompanied Mr. Christensen to the property and submitted a letter to the City of Andover in which they expressed concern about sewage treatment system, screening, tree management and the erosion problem. However, the Department of Natural Resources indicated that they do not have a problem with the variance. Mr. Christensen indicated in his testimony that he is interested in the tree management program and correcting the problem of the river bank erosion. Motion carried unanimously.
