MINUTES
A special Andover Planning and Zoning Commission meeting was called to order by
Chairperson d'Arcy Bosell at 7:34 P.M., Tuesday, January 18, 1983 at the Andover
City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota.

Chairperson Bosell noted that the purpose of the meeting is to review the draft
of Ordinance 8, The Zoning Ordinance, as prepared by Bill Short and Susan Blachman
of Barton-Aschman Associates.
Bill Short - stated that there will be a series of three workshops with the Planning
Commission to review the draft ordinance. They are proposing major revisions to
Section 6 of the ordinance and would also like to reference the Agricultural Preserve
Ordinance in Ordinance 8.
Commissioner Perry noted that Agricultural Preserve can be a use in the Urban Service
Area if the City Council determines that land to be unbuildable.

Dave Almgren suggested that in Section 3, Mobile Home be changed to Manufactured Homes.
He also questioned the 135 degree angle noted in the definition for Corner Lot.
Mr. Short stated that the 135 degree angle is something out of the original ordinance.
Chairperson Bosell suggested that Through Lot be changed also because you cannot front
a house on a MSA street. She also felt that Commercial Recreation should have more
uses listed such as gyms, health spas, tennis clubs, etc.
Commissioner Perry stated that under Home Occupation the last part of the paragraph
which reads, 'and entrance to the home occupation is gained from within the structure'
should be eliminated as this conflicts with the State requirements for beauty shops
and barber shops. She also noted that under Medical Uses, there is no place where
a group home would be allowed. This should also be listed under Nursing Home.
Dave Almgren stated that under (NNNN) Story, the last statement which says 'A
basement shall be counted as a story', should be taken out. Also, under Section 4.07,
Farming Operations, the second sentence of the first paragraph should be amended to
read: 'All dwelling units, private garages and structures for processing of farm goods
shall require a building permit and conform to all requirements of the building code.'
In the next paragraph, 'agri-business permit' should be changed to'agri-building permit.'
Mr. Almgren also felt that the section dealing with ice fishing houses should be
eliminated. He stated that we have not had a problem with ice houses and didn't
anticipate any future problems.
Going to Section 6, District Provisions, Mr. Short noted that they are recommending
some changes such as dropping General Recreational, dropping two residential districts
and adding one new one.

Chairperson Bosell noted that the Planning Commission had previously discussed
the term Neighborhood Business, noting that people ususally thought of it as a ma
and pa operation. That really is not what Neighborhood Business is today.
Commissioner Perry felt that with the definition of NB in the draft ordinance, it
should be left in.

Mr. Short noted that in R-l, Single Family Rural District, the minimum lot size will
remain at 2! acres. He noted that there were not too many areas zoned as R-2 and
R-3 in the city; didn't feel there is a need for an R-2 district. The new R-2 district
will be single family suburban with 13,000 square foot minimum lot sizes.
The new district bej,ng proposed is R-3, which has a minimum lot size of 10,000 square
feet for single family homes and 16,000 square feet for two family homes.
Dave Almgren noted that under R-l, the front yard setback has been changed to 30 feet.
He would like to see it left at 40 feet in the event that a person has their septic
system in the front yard and it failed, they would need the room to put in a new system.
Under Floor Area Per Dwelling Unit, a two story house should be referenced or we will
end up with a house that has 480 square feet on each floor.
It was decided that under Permitted Uses, Urban agriculture, gardening and sod farming
would be changed to Urban Agricultural Uses; rural agriculture with five non-domestic
animals or less will be changed to rural agricultural uses; and commercial greenhouses
and nurseries will be taken out and put under Conditional Uses.
Under Conditional Uses, Stock raising of more than five non-domestic farm animals will be
eliminated. A definition for wild game farms is also needed.
Commissioner Perry reminded Mr. Short that under permitted uses in R-l, everything
permitted in Agricultural Preserve should be listed.
Chairperson Bosell noted that there is no lot depth listed in any of the districts.
Mr. Short didn't feel it was necessary unless someone was platting short lots. It
was the concensus that lot depth be added to each district.
Under R-2, Single Family Suburban District under Purpose - the last sentence in this
paragraph should have added to it ., sewer and water, where available." Floor Area Per
Dwelling Unit should reference the requirements for a two story house. Under Permitted
Uses, Urban agriculture will be changed to Urban Agricultural Uses. Section (H),
Sanitary Sewer, will have added to it the following sentence. 'Public water will be
required where it is available.'

Bill Short noted that the new district, R-3, Single Family Urban District has a mlnlmum
lot size of 10,000 square feet. If you have a lot this size, you will have an area of
55' x 73' on which to build a house. The minimum lot size would be 75' x 133'.

Commissioner Apel felt this would be a good addition to the ordinance because of the
current economic situation.
Chairperson Bosell asked where in the city an R-3 district would fit in. Mr. Short
noted it would have to be served by sanitary sewer. Ms. Bosell then showed on the map
the areas that would be suitable for R-3, indicating the Good Value property south of

Bunker Lake Boulevard and west of Crooked Lake Boulevard; George Adolfson's property
north of Bunker Lake Boulevard east of Round Lake Boulevard; Good Value's property on
the west side of Round Lake Boulevard.
Commissioner Rogers noted that he is not in favor of having a lot size smaller than
13,000 square feet.
It was noted that the garage requirement is not listed in any of the residential districts
and Mr. Short was requested to put it in under R-l, R-2 and R-3.

The side yard setback (accessory building at interior lot): 5 feet was questioned.
Chairperson Bosell felt that this should be 10 feet for permanent accessory buildings.
Bill Short stated that it could be 5 feet on the garage side and 10 feet on the non-
garage side.
Changes to be made under the R-3 Single Family Urban District include: Purpose-
the last sentence should be changed to read "Two-family dwellings may be allowed in some
areas if consistent in character and density with the rest of the district. Under (J)
Sanitary Se~ler, the sentence should read "No construction shall be permitted in this
district without public sanitary sewer. Public water will be required where it is
available."
Chairperson Bosell asked if the words structure and building are one in the same. Mr.
Short noted that you can have a structure without it being a building, such as a sign.
It was suggested that this discussion continue at the February 8th regular Planning
Commission meeting if the agenda is not very long. If it is rather lengthly, this
discussion will be continued on February 9th. The Commissioners should review the
remainder of the draft noting their major items of concern, which will then be brought
to the attention of Mr. Short.
