Cornm. #12-85-5 Universal Properties Sketch Plan l.J l.J ,.-\ I "'-J CITY of ANDOVER REGULAR PLANNING AND ZONING COMMISSION MEETING JANUARY 14, 1986 - MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman Jacobson at 7:30 P.M., Tuesday, January 14, 1986 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, MN. Commissioners Present: Commissioners Absent: Rogers, Jovanovich, Apel Bosell Approval of Minutes December 10, 1985 MOTION by Apel, seconded by Jovanovich to approve the minutes of December 10, 1985 as written. Motion carried on a 3 yes, 1 present (Rogers) vote. Ordinance 8, Section 7.03 Amendment Public Hearing ,- , , I \.J Chairman Jacobson opened the public hearing. He noted that this amend- ment came about because the Anoka County Attorney said that the State Law only requires a Special Use Permit for a day care center when there are more than 12 children in the home. Our ordinance states that a day care center requires a Special Use Permit no matter how many children there are. MOTION by Rogers, seconded by Jovanovich to close the public hearing. Motion carried unanimously. ~OTION by Apel, seconded by Commission recommend to the require Special Use Permits Rogers that the Andover Planning and Zoning City Council adoption of Ordinance 8CC to if day nurseries have 13 or more children. Motion carried unanimously. This will go to the City Council on 2-4-86. Ordinance 8 Amendment/Public Hearing Chairman Jacobson opened the public hearing. MOTION by Apel, seconded by Rogers to close the public hearing. Motion carried unanimously. Chairman Jacobson noted that every time the Council wants to change a fee for a rezoning, special use permit or variance, they have to have an ordinance amendment. This amendment will set the fees by Council resolution. 1'- -'\ \...,) MOTION by Rogers, seconded by Jovanovich that the Andover Planning and Zoning Commission recommend to the City Council adoption of Ordinance No. 8DD regarding the fees set in Ordinance 8, Sections 5.02 and 5.03. Motion carried unanimously. MOTION by Rogers, seconded by Jovanovich to close the public hearing. Motion carried unanimously. MOTION by Rogers, seconded by Apel that the Andover Planning and Zoning Commission recommend to the City Council adoption of Ordinance No. 10J, Sections 7 and 11. Motion carried unanimously. This will go to the City Council on 2-4-86. Various Ordinance Amendments Chairman Jacobson noted that these are amendments which will eliminate the dollar amounts for fees, setting them by Council resolution and also some of the ordinances have a penalty in them and this will be taken out with the following statement being inserted: 'upon conviction, be punished according to prevailing State law.' MOTION by Apel, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council adoption of amendments to ordinances that will be known as Ordinances 4A, 22E, 28B, 32F, 35A, 40D, 45A, 51A, 55F and 56A. Motion carried unanimously. This will go to the City Council on February 4, 1986. MOTION by Apel, seconded by Rogers to adjourn. Motion carried. Meeting adjourned at 7:45 P.M.
